Abstract

The purpose of this article is to determine and analyze the meaning of the Nyepeg Sampi tradition from a cultural perspective. As well as to examine the elements of acts against the law in the context of implementing the nyepeg sampi tradition. This article is classified as a type of normative legal research that uses an invited approach and a conceptual approach which also contains supporting data to assess legal materials which are the basis for analyzing legal issues being discussed. Based on the results of the analysis, it is known that the meaning of the nyepeg sampi tradition for peoples live in Asak-Karangasem Village is a ritual that aims to maintain the balance of nature. Given the meaning of the tradition of nyepeg sampi, therefore the nyepeg sampi tradition cannot be classified as a form of crime against animals as referred to in the provisions of Article 302 of the Criminal Code. Abstract

Penulisan artikel ini bertujuan untuk mengetahui legalitas yang dimiliki desa adat untuk bertindak sebagai pelaku usaha pertambangan galian C serta kedudukan Hukum Desa adat yang melakukan usaha pertambangan diatas tanah Druwe Desa, sebagaimana dijelaskan desa adat merupakan merupakan kesatuan masyarakat yang memiliki kedudukan yang dapat menjalankan dan melaksanakan kebijakan lingkungan wilayahnya, sehingga dapat melaksanakan melaksanakan urusan dan kepentingan masyarakat setempat dalam kegiatan usaha pertambangan galian C di Desa Adat Badeg. Meninjau permasalahan di atas maka metode yang digunakan ialah penelitian socio-legal merupakan sebuah studi penelitian yang melihat hukum melalui penggabungan antara analisa normatif dan pendekatan ilmu non-hukum, bertujuan untuk mengidentifikasi hukum sebagai institusi sosial yang riil dan fungsional dalam sistem kehidupan danmemperoleh pengetahuan hukum secara empiris dengan terjun langsung ke obyek penelitian yaitu mengetahui bagaimana keadaan lapangan menegenai usaha pertambangan galian C pada Desa Adat Badeg, dengan analisa normatif yang meneliti melalui bahan berupa buku, jurnal dan peraturan perundang-undangan, sedangkan dengan analisa empiris yakni data yang diperoleh langsung dari masyarakat berupa wawancara. Pengelolahan tanah padruwen desa yang dijadikan pertambangan galian C merupakan tanah diperoleh berdasarkan metinin yang dilakukan oleh Desa Adat kepada masyarakat adat, tanah tersebut dapat dipergunakan untuk menunjang sektor perekonomian, sebagaimana pekerjaan masyarakat adat adalah menggarap tanah metinin menjadi pertambangan galian C sesuai dengan UU MINERBA dan menggunakan bahan galian yang ditegaskan dalam PP Nomor 26 Tahun 2012. The writing of this article to find out and analyze the legality of the Traditional Village to act as a mining business actor for mining materials C on the Druwe Village land, and to know and analyze the legal position of the Badeg Traditional Village in you by mining C minerals on druwe land. The village, as explained by the customary village, is a community unit that has a position that can carry out and implement the environmental policy of its territory, so that it can carry out the affairs and interests of the local community in the C excavation mining business activities in the Badeg Traditional Village. Reviewing the above problems, the method used is socio-legal research, which is a research study that looks at law through a combination of normative analysis and non-legal scientific approaches, aims to identify law as a real and functional social institution in a living system and obtain empirical legal knowledge. by going directly to the object of research, namely knowing how the state of the field regarding the C mining business in Badeg Traditional Village, with normative analysis that examines through materials in the form of books, journals and statutory regulations, while with empirical analysis, namely data obtained directly from the community in the form of Interview. The management of the village padruwen land which is used as an excavation C mining is land obtained based on metinine carried out by the Traditional Village to the customary community, the land can be used to support the economic sector, as the work of the customary community is to cultivate metinine land into quarry mining C in accordance with the MINERBA Law and use minerals that are confirmed in Government Regulation Number 26 of 2012.

Abstract

Tujuan studi ini untuk mengetahui dan menganalisis tentang konsep dudukan oleh desa adat di Bali, serta mengetahui dan menganalisis tentang legalitas dudukan oleh desa adat di Bali. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil studi menunjukkan bahwa konsep dudukan menunjuk pada pendapatan lain-lain di desa adat yang bersumber dari swadharma (kewajiban) krama yang ada di lingkungan desa adat dan telah diatur dalam awig dan/atau pararem. Konsep dudukan oleh desa adat tidak boleh dimaknai sebagai pajak atau pungutan sebagaimana dimaksud dalam hukum nasional. Bahwa dudukan oleh desa adat di Bali merupakan tindakan yang legal. Dudukan tidak hanya diatur secara tegas dalam Peraturan Gubernur No. 34 Tahun 2019 tentang Pengelolaan Keuangan Desa Adat, melainkan proses pelaksanaan dan peruntukannya juga turut diatur dalam pararem desa adat. The purpose of this study is to find out and analyze the concept of dudukan by desa adat in Bali, as well as to find out and analyze the legality of dudukan by desa adat in. This study uses a normative legal research method with a statutory and conceptual approach. The results of the study indicate that the concept of dudukan refers to other income in desa adat which sourced from swadharma (obligation) of krama in the desa adat and has been regulated in awig and/or pararem. The concept of dudukan by desa adat should not be interpreted as taxes or levies as referred to in state law. Dudukan by desa adat in Bali is a legal act. Dudukan are not only regulated in Peraturan Gubernur No. 34 Tahun 2019 tentang Pengelolaan Keuangan Desa Adat, but the implementation process and its allocation are also regulated regulated in pararem desa adat.

Abstract

Penulisan ini berjudul Perlindungan Hukum Bagi Konsumen Pengguna Aplikasi Pembayaran Digital (Digital Payment). Penulisan ini bertujuan untuk dapat mengetahui mekanisme pembayaran digital dalam sistem pembayaran di Indonesia, serta mengetahui bagaimana perlindungan hukum bagi konsumen selaku pengguna aplikasi pembayaran digital. Dalam penulisan ini menggunakan metode penelitian hukum normatif dengan menggunakan pendekatan peraturan perundang-undangan. Penelitian menunjukan bahwa perlindungan hukum bagi konsumen pengguna aplikasi pembayaran digital (Digital Payment) secara umum diatur dalam Undang-Undang Nomor.8 Tahun 1999 Tentang Perlindungan Konsumen, dan secara khusus diatur dalam Peraturan Bank Indonesia Nomor. 16/1/PBI/2014 tentang Perlindungan Konsumen Jasa Sistem Pembayaran. Apabila konsumen pengguna aplikasi pembayaran digital mengalami kerugian akibat dari penyelenggara jasa sistem pembayaran, maka Undang-Undang Nomor. 8 Tahun 1999 Tentang Perlindungan Konsumen, dan Peraturan Bank Indonesia No. 16/1/PBI/2014 tentang Perlindungan Konsumen Jasa Sistem Pembayaran dapat dijadikan sebagai acuan untuk mendapatkan perlindungan hukum. Peraturan-peraturan ini memberikan kepastian hukum bagi konsumen pengguna aplikasi pembayaran digital. Kata Kunci : Perlindungan Hukum, Konsumen, Aplikasi Pembayaran Digital

Abstract

The establishment of Government Administration Law brings significant change to the competence of the previously restricted Administrative Court to become expanded. This study aims to find the philosophical considerations from the extension of Administrative Decision meaning on Government Administration Law, to classify the legal implication arising from the regulation of the expansion of administrative decision meaning towards dispute submission process in Administrative Court and to formulate ideal attitude of the State Administrative Judge in resolving State Administrative Disputes. This is a combination of normative and empirical legal research. The study indicated that the legislator main consideration in regulating the expansion of administrative decision meaning on Government Administration Law is to expand the absolute competence of Indonesian Administrative Court which previously felt very narrow. The implication arises after new regulation consists of: the expansion of Administrative Court adjudicate authority for factual actions, subject expansion that have the authority to issue Administrative Decision, the expansion of the Administrative Court adjudicate authority over Administrative Decision which has a legal consequences although still need the approval from above instance, the regulation that Administrative Decision can be sued through the Administrative Court of any potential loss that may arise by the issuance of its Administrative Decision and the expansion towards the parties who have a chance to field a State Administrative accusation. The ideal attitude of State Administrative Judge is the judge should remain based on the strong theoretical concepts of the law so can create understanding and attitude in handling a case in Indonesian Administrative Court.

Abstract

The purpose of this research is to find out and analyze the mechanism for handling suspected election administrative violations in Bawaslu of Gianyar Regency, as well as knowing and analyzing the inhibiting factors in the implementation of handling the alleged administrative violations of the Election at Bawaslu, Gianyar Regency. This study uses an empirical legal research method, with data and data sources coming from the chief informant and members of the Bawaslu Gianyar Regency. The results of this study explain that mechanism for handling alleged administrative violations of the General Election in Gianyar Regency begins with public reports and then determines the type of violation and is registered by Bawaslu of Gianyar Regency. Furthermore, a preliminary hearing and preliminary decisions are held, then an examination session, and finally a final decision is made by the examining panel. There are 3 (three) obstacles in the handling of alleged election administrative violations, namely bringing in witnesses in trials, the authority to execute decisions, and the lack of institutional personnel to carry out trial duties in conjunction with supervision of the Election stages. Tujuan penelitian ini untuk mengetahui dan menganalisis mekanisme penanganan dugaan pelanggaran administratif Pemilu di Bawaslu Kabupaten Gianyar, serta mengetahui dan menganalisis faktor-faktor penghambat dalam pelaksanaan penanganan dugaan pelanggaran administratif Pemilu di Bawaslu Kabupaten Gianyar. Penelitian ini menggunakan metode penelitian hukum empiris, dengan data dan sumber data yang berasal dari informan ketua dan anggota Bawaslu Kabupaten Gianyar. Teori negara hukum digunakan untuk menjawab pertanyaan pertama, dimana mekanisme penanganan dugaan pelanggaran administratif Pemilu di Kabupaten Gianyar diawali dari laporan masyarakat lalu ditentukan jenis pelanggaran dan dilakukan registrasi oleh Bawaslu Kabupaten Gianyar. Selanjutnya dilaksanakan sidang pendahuluan serta putusan pendahuluan, lalu sidang pemeriksaan, dan terakhir pembuatan Putusan akhir oleh majelis pemeriksa. Permasalahan kedua digunakan teori sistem hukum, dilihat dari struktur hukum, terdapat 3 (tiga) hambatan dalam penanganan dugaan pelanggaran administratif pemilu, yaitu mendatangkan saksi dalam perisdangan, kewenangan eksekusi Putusan, serta kurangnya personil lembaga untuk melaksanakan tugas persidangan yang berasamaan dengan pengawasan tahapan Pemilu.

Abstract

Abstract The purpose of this scientific article is to find out the arrangements related to the reading of authentic notary deeds and to analyze the juridical consequences of authentic deeds read by notary employees to the parties. This article is classified as a type of normative research that uses 2 types of approaches, namely the statutory and conceptual approaches. The arrangement regarding the reading of the Notary's Authentic Deed is contained in Article 16 paragraph (1) and letter m on article 16 which means that a Notary is obliged to read the Deed made in front of the parties - the parties in this case the parties making the Deed who are attended by witnesses. It’s very important that the deed is read in front of the parties - the party facing the parties and is an obligation based on the philosophical elements contained in the process of reading the deed. The juridical consequence of the authentic deed read out by the notary employee to the parties is the reading of the deed which is not carried out by the Notary but is carried out by the staff of the Notary to the parties as regulated in Article 16 paragraph (9) UUJN which in principle has the consequence that the authentic deed will be degraded into a deed. under the hand, which before the deed has perfect proof is no longer perfect. However, this legal consequence is exempted from the will deed as referred to in Article 16 paragraph (10) UUJN. Abstrak Tujuan daripada artikel ilmiah ini yaitu untuk mengetahui pengaturan terkait pembacaan akta autentik Notaris dan menganalisis konsekuensi yuridis dari akta autentik yang dibacakan oleh pegawai notaris kepada para pihak. Artikel ini tergolong jenis penelitian normatif yang menggunakan 2 jenis pendekatan yaitu pendekatan perundang-undangan dan konseptual. Pengaturan Terkait Pembacaan Akta Autentik Notaris termuat dalam Pasal 16 ayat (1) dan huruf m pasal 16 UUJN yang bermakna yaitu seorang Notaris diwajibkan untuk membacakan Akta yang dibuat dihadapan pihak – pihak penghadap yang dalam hal ini para pihak yang membuat Akta tersebut yang dihadiri saksi-saksi. Menjadi teramat penting akta dibacakan dihadapan pihak – pihak penghadap dan merupakan suatu kewajiban yang didasarkan kepada unsur filosofis yang terdapat pada proses pembacaan akta tersebut. Konsekuensi yuridis dari atas akta autentik yang dibacakan oleh pegawai notaris kepada para pihak yaitu pembacaan akta yang tidak dilakukan oleh Notaris namun dilakukan oleh pegawainya Notaris kepada para pihak sebagaimana diatur pada Pasal 16 ayat (9) UUJN yang pada prinsipnya memiliki konsekuensi bahwa akta autentik tersebut akan terdegradasi menjadi akta dibawah tangan, yang sebelum akta tersebut memiliki pembuktian yang sempurna menjadi tidak sempurna lagi. Namun akibat hukum ini dikecualikan untuk akta wasiat sebagaimana Pasal 16 ayat (10) UUJN.

Abstract

Geguritan Bali as a Traditional Cultural Expression whose copyright is held by the State is a provision of Article 38 paragraph (1) of Law Number 28 Year 2014 concerning Copyright. Countries are required to inventory, preserve and preserve traditional cultural expressions. The problem is that the use of traditional cultural expressions is easily claimed to be the domain of other parties who registered and published it earlier. This study aims to analyze legal protection and legal remedies if the Bali Geguritan is reproduced without permission for commercial needs. This study uses a normative legal research method with a statutory approach. The results of this study indicate that the protection of Geguritan Bali's copyright works in the Copyright Act has not been able to protect the expression of traditional culture as a whole because of the blurring of norms and character differences between Intellectual Property Rights and Traditional Cultural Expressions. The Regional Government has the authority to file a lawsuit related to the multiplication of Geguritan Bali without permission for commercial needs. Based on the theory of the authority of the mandate granted by the state as the copyright holder to the Provincial Culture Office and the City Culture Office as the area carrying the Traditional Cultural Expressions.

Abstract

This research has 2 objectives: (1) to find out and analyze the legality of adopting children of different caste; (2) to find out and analyze the responsibility of the state in the case of the cancellation of adopting children of different castes in the context of fulfill, respect and protect human rights. This research is a sociolegal research that examines the problem of adopting children of different caste from a normative perspective and an empirical perspective. Based on the results of the research, it was concluded that the adoption children of different caste is legal act according to positive law in Indonesia. In fact there are still cases of cancellation of the adoption children of different caste in Bali. The state responsibility in implementing efforts to fulfill, respect and protect human rights, the state then intervenes in cases referred to through mediation efforts and/or appointment of trustees.

Abstract

ABSTRAK Studi ini bertujuan untuk mengkaji tentang Majelis Desa Adat Sebagai Pasikian Desa Adat di Bali. Pengkajian pada Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan sejarah. Hasil studi menjelaskan bahwa Desa Adat di Bali memiliki kewenangan untuk membentuk Pasikian Desa Adat yang telah diakui secara yuridis pada tatanan hukum di Indonesia mulai dari Undang-Undang Dasar Negara Republik Indonesia tahun 1945 hingga pada Peraturan Daerah Provinsi Bali Tentang Desa Adat di Bali. Secara sosiologis telah diakui oleh pemerintah maupun Pemerintah Daerah serta telah disepakati dan diakui oleh Masyarakat (krama) Desa Adat di Bali. Pasca terbentuknya Majelis Desa Adat menimbulkan Konsekuensi yuridis terhadap Desa Adat di Bali, antara lain pada bidang pendampingan serta pembuatan pedoman penyuratan awig-awig dan perarem, pembentukan lembaga adat dan pembentukan pedoman ngadegang Bendesa Adat dan Majelis Desa Adat memiliki wewenang untuk menyelesaikan persoalan-persoalan adat yang tidak bisa diselesaikan oleh Desa Adat dan memberikan keputusan terkait pelanggaran Prajuru Desa Adat. Konsekuensi yuridis tersebut diatur pada Perda tentang Desa Adat, Pergub Bali dan Anggaran Dasar Anggaran Rumah Tangga Majelis Desa Adat Bali. Kata Kunci: Desa Adat, Pasikian, Majelis Desa Adat, Kewenangan, Konsekuensi. ABSTRACT This Study aims to examine the Assembly of Indigenous Villages as Pasikian Indigenous Villages in Bali. The study uses normative legal research methods with statutory approaches, conceptual approaches and historical approaches. The results of the study explain that Indigenous Villages in Bali have the authority to form Pasikian Desa Adat which has been recognized juridically in the legal order in Indonesia starting from the Constitution of the Republic of Indonesia in 1945 to the Regional Regulation of Bali Province on Indigenous Villages in Bali. Sociologically it has been recognized by the government and local government and has been agreed and recognized by the Indigenous Village Community (krama) in Bali. After the formation of the Indigenous Village Assembly gave juridical consequences to indigenous villages in Bali, among others in the field of mentoring and the creation of guidelines awig-awig and perarem, the establishment of customary institutions and the establishment of guidelines ngadegang Bendesa Adat and Indigenous Village Assembly have the authority to resolve customary issues that can not be resolved by the Indigenous Village and give decisions related to violations of The Village Prajuru Adat. The juridical consequences are stipulated in the Regulation on Indigenous Villages, Pergub Bali and the Articles of Association of the Household Budget of the Bali Indigenous Village Assembly.
