Abstract

Based on the UUD 1945, delegated legislation in Indonesia is Government Regulations made by the President. The making of delegated legislation from 1999 to 2012 has shown some development in how delegated legislation is made. Therefore, this article shows three traditional models of delegated legislation in Indonesia between 1999 to 2012 that are different from the stipulations provided within the UUD 1945. Practice shows that there are 3 traditions of delegation legislation making models in Indonesia. Such tradition is not in accordance with the provisions in the Indonesian constitution. Therefore, it is necessary to control the delegation of Laws in Indonesia by selecting government regulations as delegated legislation.

Abstract

Since Indonesia entered a period of health emergencies caused by the outbreak ofthe Covid-19, the Indonesian government has attempted to develop various legal instruments to regulatethe behavior of the Indonesian people. One of the instruments used is a circular letter. This paper tries to examine the normative juridical use of circular letters as an instrument of state administration during this pandemic. In legislation science and administrative law theory,a circular letter is a piece of legislationthat should be used as an official note to warn and remind, notto regulate.In practice, there are several problematic Circular Letters which are used to regulate the public.

Abstract

In recent years, Indonesia and the world have faced an unprecedented non-natural disaster, namely the Covid-19 Virus, which has severely impacted the economies of almost all countries. In response, Indonesia has implemented various legal instruments, including legislation and policy regulations, to address the crisis. One of the controversial legal instruments in Indonesia is the Minister of Home Affairs' Instruction Number 15 of 2021, which pertains to the enforcement of restrictions on community activities in Java and Bali due to the Covid-19 pandemic. This paper examines the implementation of this instruction by the regions of Java and Bali, focusing on the policy regulations issued in response. The research methodology employed in this study is normative juridical research (Legal Research). The findings reveal that policy regulations are distinct from legislation and that the regions, including DKI Jakarta Province, Banten Province, Central Java Province, West Java Province, East Java Province, and Bali Province, have issued various legal instruments to comply with the Minister of Home Affairs' instruction. However, both the central and regional governments must ensure that these legal instruments meet the requirements stipulated in the applicable laws and regulations. As Indonesia is a legal state, it is crucial for government officials to base their actions on the principles of the law.

Abstract

Dalam perkembangan praktik perundang-undangan di Indonesia, dewasa ini sering dikenal adanya mekanisme konsultasi dengan Dewan Perwakilan Rakyat (DPR) dalam pembentukan peraturan delegasi undang-undang. Mekanisme konsultasi menimbulkan banyak pertanyaan yang berkaitan dengan otoritas pembentuk peraturan delegasi undang-undang, mengingat kewenangan pembentukan peraturan delegasi undang-undang merupakan kewenangan absolut dari instansi pembentuk peraturan tersebut. Acapkali dairtikan hasil dari mekanisme konsultasi ke DPR sebagai keputusan yang wajib untuk dilaksanakan oleh oleh pembentuk peraturan delegasi dan dapat mempengaruhi materi muatan peraturan delegasi undang-undang. Dalam perjalanannya terdapat Putusan Mahkamah Konstitusi Nomor 92/PUU-XIV/2016 yang telah menilai makna hasil dari mekanisme konsultasi peraturan delegasi ke DPR sebagai hal yang tidak mengikat. Sehingga dalam penelitian ini akan menguraikan eksistensi penerapan mekanisme konsultasi dengan DPR pada pembentukan peraturan delegasi undang-undang. Penelitian ini merupakan penelitian hukum dengan menggunakan pendekatan perundang-undangan dan pendekatan konsep. Kata Kunci: Konsultasi, Peraturan Delegasi, Undang-Undang

Abstract

Pembentukan undang-undang selama ini bersifat periodik, tidak mencerminkan perencanaan yang berkelanjutan, dan tidak efektif. Hal ini tergambar dengan berakhirnya periode masa keanggotaan DPR RI saat ini maka berakhir pula pembentukan undang-undang, sehingga pembentukan undang-undang periode selanjutnya dimulai dari awal. Carry over dalam pembentukan undang-undang berdasarkan Undang-Undang Nomor 15 Tahun 2019 hadir sebagai solusinya. Penelitian ini menganalisis mengenai konsep carry over dalam pembentukan undang-undang di Indonesia berdasarkan Undang-Undang Nomor 15 Tahun 2019, serta politik hukum konsep carry over dalam pembentukan undang-undang yang baik. Konsep carry over dalam pembentukan undang-undang di Indonesia berdasarkan Undang-Undang Nomor 15 Tahun 2019 adalah berlaku dalam hal suatu RUU telah memasuki pembahasan Daftar Inventarisasi Masalah pada periode masa keanggotaan DPR saat itu, hasil pembahasan RUU tersebut disampaikan kepada DPR periode berikutnya dan berdasarkan kesepakatan DPR, Presiden, dan/atau DPD, RUU tersebut dapat dimasukkan kembali ke dalam daftar Prolegnas jangka menengah dan/atau Prolegnas prioritas tahunan. Politik hukum konsep carry over dalam pembentukan undang-undang yang baik adalah politik hukum dalam pembentukan undang-undang dengan konsep carry over yang memperhatikan nilai-nilai yang terkandung dalam Pancasila, yang diawali dari tahap perencanaan melalui penyusunan Prolegnas hingga tahap pengundangan dalam proses pembentukan undang-undang.

Abstract

Perkembangan hukum di Indonesia telah memperkenalkan konsep dan pelaksanaan partisipasi masyarakat dalam pembentukan undang-undang, meski diperkenalkan dengan berbagai istilah yang berbeda. Sayangnya pada prakteknya tahap partisipasi masyarakat di dalam pembentukan peraturan perundang-undangan masih pada tahap konsultasi. Dengan semangat asas keterbukaan, asas legitimitas, dan asas pemanfaatan teknologi, proses partisipasi masyarakat menjadi vital dalam pembentukan peraturan. Untuk mewujudkan partisipasi masyarakat lebih bermakna dan bermanfaat diperlukan strategi mencapainya. Penggunaan sistem informasi yang menjadi laman yang menerima masukan atau saran dari masyarakat, harus menerapkan SiAKTIF. Selain itu perlu juga memahami keunikan setiap tahap dari pembentukan Undang-Undang untuk menentukan (1) bentuk partisipasi yang sesuai, (2) fasilitas pendukung yang diperlukan dan (3) pencapaian luaran yang dapat menjadi indikator tercapainya partisipasi masyarakat.

Abstract

Mahakamah Konstitusi berdasarkan kewenangan yang diamanatkan konstitusi khususnya dalam memutus sengketa kewenangan lembaga negara, memegang peran dalam penegakan penerapan prinsip checks and balances di Indonesia. Pasca Amandemen Undang-Undang Dasar Negara Republik Indonesia tahun 1945 (UUD NRI 1945), muncul berbagai Komisi Negara Independen yang memiliki peran strategis dalam pembangunan sistem demokrasi di Indonesia. Komisi negara independen ini kerapkali memiliki fungsi ganda (multiple function), dimana satu lembaga independent dapat memegang 3 tiga fungsi sekaligus, yakni fungsi eksekutif, fungsi legislatif, dan fungsi yudikatif. Luasnya fungsi komisi negara independen akan menjadi rentan atas tindakan ultra vires yang kemudian dapat menjadi salah satu penyebab timbulnya sengketa kewenangan yang terjadi antar lembaga negara. Penelitian ini bertujuan untuk mengkaji mengenai eksistensi Komisi Negara Independen di Indonesia serta menelaah kedudukan hukum (legal standing) Komisi Negara Independen dalam penyelesaian sengketa kewenangan lembaga negara oleh Mahkamah Konstitusi. lembaga yang dapat dikategorikan sebagai  komisi negara independen adalah lembaga yang oleh dasar hukum pembentuknya dinyatakan secara tegas sifat independensinya, pemberhentian dan pengangkatanya anggota memiliki mekanisme khusus, kepemimpinan bersifat kolegial, dan pimpinan memiliki masa jabatan definitif. Upaya pemutusan sengketa kewenangan Lembaga negara oleh Mahkamah Konstitusi belum dapat menjadi instrumen penyelesaian sengketa kewenangan antara berbagai Komisi yang bersengketa. Hal ini disebabkan karena adanya batasan kewenangan yang diberikan kepada Mahkamah Konstitusi, yakni hanya dapat memutus sengketa lembaga negara yang kewenanganya diatur dalam UUD NRI 1945.

Abstract

Digital development has had a positive impact on public services; however, it has also introduced various legal challenges. This study aims to examine the direction of policy, legal preparedness in Indonesia, and the participatory role of Indonesian society in the digital sphere, particularly in relation to the development and implementation of Digital Government in Indonesia since the post-1998 reform era. This research employs a normative legal methodology, focusing primarily on secondary legal sources.The analysis reveals that the implementation of Digital Government in Indonesia following the reform period remains hindered by sectoral egos, leading to a lack of integration among state institutions in enhancing public services through the Digital Government framework. The study concludes that there is an urgent need for the establishment of a dedicated law on Digital Government, as well as the creation of a specialized state institution responsible for regulating, implementing, and evaluating Digital Government initiatives in Indonesia. Such measures are essential to ensure that public services are delivered in an efficient, accountable, transparent, fast, accessible, and cost-effective manner.

Abstract

This study examines the regulatory deficiencies in Indonesia’s political finance system, particularly the absence of laws governing party income sources. Although existing rules address campaign spending and financial reporting, they lack limits on donations and fail to restrict high-risk, foreign-linked, or opaque contributions. Using a normative legal method supported by comparative, statutory, and conceptual analysis, the research draws on experiences from Thailand and the Philippines to identify best practices for reform. It argues that source-based regulation is essential to uphold constitutional equality and electoral integrity. The proposed reform agenda rests on three pillars: introducing statutory ceilings on donations, prohibiting high-risk and anonymous contributions, and institutionalising public financing tied to democratic performance. The findings show that Indonesia’s weak regulatory framework fosters elite capture, erodes internal party democracy, and diminishes public trust. By integrating these reforms, Indonesia can close legal gaps, strengthen constitutional democracy, and contribute to global discourse on political finance reform.

Abstract

In an attempt to reform regulation in Indonesia, this study looks at best practice designs that have been adopted in Malaysia and Vietnam in order to determine the optimum government organ in the field of law. Indonesia ought to take a cue from the successful regulatory reform initiatives in Malaysia and Vietnam and establish dedicated agencies that have enhanced the calibre of legislation and regulations. This essay uses a normative legal approach that is descriptive as well as prescriptive. The talk explains how government bodies that deal with a variety of laws are designed to meet the specific demands of the several nations that make up the group. Vietnam adopts the institution's design, which is the assembly in the field of laws and regulations, which holds the position of the highest representative organ, while Malaysia adopts the design of a particular institution with the primary function of guaranteeing the entire process of forming laws and regulations that apply centrally. As per Law Number 15 of 2019 regarding Amendments to Law Number 12 of 2011 regarding the Establishment of Legislation, Indonesia is recommended to establish ministries or institutions whose specific design and existence must be determined as close to the center of government as possible.
