Abstract

Sebagai respon terhadap tingginya kasus Korupsi di Indonesia, pemerintah melakukan berbagai upaya, antara lain melalui penerapan sanksi pencabutan hak politik terhadap terpidana kasus Korupsi. Hal ini kemudian menimbulkan permasalahan baru. Pidana pencabutan hak politik mampu memberikan rasa keadilan dan menimbulkan efek jera bagi para koruptor, namun di sisi lain, juga berpotensi melanggar ketentuan hak asasi manusia. Penelitian ini bermaksud untuk mengkaji persoalan legalitas Sanksi pencabutan hak politik dalam perspektif hukum dan hak asasi manusia. Penulis menggunakan metode penelitian normatif dengan pendekatan Konsep dan undang-undang. Berdasarkan hasil kajian, penulis menemukan bahwa sanksi pidana pencabutan hak Politik terhadap Koruptor tidaklah bertentangan dengan konsep dan pengaturan hak asasi manuia bila diterapkan dengan batas-batas tertentu. Based on survey results and a report from Transparency International, Indonesia did not show a significant increase in the corruption perception index. Efforts to eradicate corruption are generally still hampered by high levels of corruption in the law and political sector. In response to this, the government made various efforts, including through applying sanctions to revoke political rights against convicted of Corruption cases. On the one hand, the revocation of political rights is expected to be able to provide a sense of justice and cause a deterrent effect for corruptors. But on the other hand, the revocation of political rights also caused controversy in the field of human rights. This paper intends to examine the legality of sanctions for revoking these political rights in the eyes of the law and human rights. Based on the study, the authors conclude that the revocation of political rights against corruptors does not conflict with the concept of human rights when applied to certain limits.

Abstract

Natural resource management is crucial for sustainable development, especially in regions abundant in biodiversity and natural assets. Nations worldwide face the challenge of managing their resources effectively while promoting economic growth, social justice, and environmental conservation. Customary law plays a significant role in resource governance, particularly in countries like Indonesia and Australia, where indigenous communities have deep-rooted connections to the land and its resources. This comparative study explores the role of customary law in natural resource management in Indonesia and Australia. Both countries possess diverse ecosystems and substantial indigenous populations, offering valuable insights into the interaction between customary and state legal systems in resource governance. In Indonesia, customary law, known as adat, influences resource management practices, albeit with variations in recognition and integration into formal legal frameworks. Conversely, in Australia, the colonization process has disrupted traditional governance structures, leading to ongoing struggles for indigenous rights and recognition. By examining case studies, legal frameworks, and policy initiatives in both countries, this study aims to identify challenges and opportunities for integrating customary law into broader governance frameworks and promoting more equitable and sustainable resource management practices. Additionally, this comparative analysis contributes to scholarly debates on the role of customary law in contemporary legal systems and its implications for environmental governance, indigenous rights, and social justice. Interdisciplinary perspectives from legal studies, anthropology, environmental science, and development studies offer valuable insights for policymakers, practitioners, and indigenous communities striving for more inclusive and effective resource management approaches.

Abstract

Purpose: This study aims to enhance constitutional awareness among the community of Kapita Village, Jeneponto Regency, by strengthening their understanding of constitutional rights as outlined in the 1945 Constitution of the Republic of Indonesia. Citizens' low awareness of their rights and role in overseeing government actions necessitates structured legal counseling. The objective is to provide citizens with fundamental knowledge of the constitution and foster a sense of legal awareness to ensure active participation in governance. Research Design and Methodology: This study employs a qualitative approach through direct legal counseling sessions. The counseling is delivered using an oral presentation method, incorporating simple and accessible language. A question-and-answer format is used to engage participants and encourage active discussion. Additionally, visual materials such as posters featuring statements from prominent figures about the Constitution, accompanied by illustrative images, are utilized to capture public attention and reinforce key messages. Findings and Discussion: Implementing this program resulted in an increased general understanding among participants regarding the function of the constitution and its role in governance. Citizens recognized the constitution as the supreme law of the land and an agreement between the state and its citizens. Moreover, they gained insight into their constitutional rights, particularly those directly impacting their daily lives, such as education, healthcare, and civic participation. Implications: The findings suggest that structured constitutional counseling can effectively promote legal awareness at the village level. Improved constitutional understanding can lead to more informed and active citizens participating in governance and advocating for their rights. The study highlights the importance of continuous legal education and engaging educational media to foster constitutional awareness in rural communities.

Abstract

This study aims to analyze the phenomenon of light sentences imposed on corruption perpetrators in Indonesia from the perspective of the theory of justice. In the context of corruption as an extraordinary crime, this study highlights the imbalance between the principles of retributive, distributive, and restorative justice and their implementation in the justice system. This normative legal research uses a regulatory, comparative, and conceptual approach, and analyzes data descriptively-prescriptively based on legal literature and reports from related international institutions. The results of the study indicate that light against corruption perpetrators is caused by a number of factors, including weak law enforcement, political intervention, lack of supervision of the judicial apparatus, and a culture of tolerance for corruption. These findings confirm that the application of the theory of justice in the Indonesian legal system is still far from ideal, with striking disparities in sentencing, especially for perpetrators from the elite compared to perpetrators from the ordinary community. In addition, light sentences have a significant impact on the low deterrent effect, loss of public trust in the legal system, and the negative perception of the international community towards Indonesia's commitment to eradicating corruption. This study recommends structural and institutional reforms that include harmonization of national regulations with international standards, increasing the capacity of law enforcement officers, and strengthening legal literacy in society to create a more just and effective legal system. With a comprehensive approach, it is hoped that the eradication of corruption in Indonesia can achieve more optimal results.

Abstract

This study conducts a comparative analysis of party financing regulations in Indonesia and Germany to explore how these countries adapt to democratic norms, with an emphasis on the impact of regulatory frameworks on political party financing. By investigating diverse socio-political landscapes and historical contexts, this research aims to identify a convergence towards democratic norms, significantly influenced by the regulations governing political party financing. Employing normative legal research, utilizing legislative, conceptual, case, and comparative approaches, analyzed through qualitative descriptive methods, this study integrates document analysis and case studies to provide a comprehensive understanding of the regulatory frameworks. The findings indicate that although Indonesia and Germany are both committed to enhancing democratic governance through transparent and accountable party financing, the implementation of these regulations faces significant challenges. In Indonesia, these include limited enforcement mechanisms, a lack of comprehensive audits, and difficulties in tracking the sources of political donations. Conversely, Germany’s structured approach to party financing regulation demonstrates a robust enforcement mechanism and a public funding model, yet it also encounters challenges, particularly in the realm of indirect support and the use of third-party entities. This study contributes to the discourse on strengthening democratic institutions and practices by offering a comparative perspective that highlights the importance of strong and adaptable regulatory frameworks to ensure transparency, accountability, and fair competition in political financing.

Abstract

Penelitian ini bertujuan untuk mengkaji dan menjelaskan landasan filosofis, sosiologis, yuridis pembentukan rancangan regulasi di Provinsi Sulawesi Selatan tentang Penyelenggaraan cadangan pangan, dan mengkaji dan menjelaskan urgensi pembentukan Peraturan Daerah Provinsi Sulawesi Selatan tentang Penyelenggaraan cadangan pangan sebagai dasar penyelesaian permasalahan. Metode penelitian yang digunakan adalah yuridis empiris. Hasil dan pembahasan menunjukkan bahwa Berdasarkan penelitian mengenai pembentukan peraturan daerah tentang penyelenggaraan cadangan pangan di Provinsi Sulawesi Selatan, disimpulkan bahwa regulasi tersebut memiliki landasan filosofis, sosiologis, dan yuridis yang kuat. Secara filosofis, pemenuhan pangan sebagai kebutuhan dasar manusia mencerminkan nilai-nilai Pancasila dan tujuan luhur bangsa Indonesia untuk mencapai kedaulatan, kemandirian, dan ketahanan pangan yang berkelanjutan demi kesejahteraan masyarakat. Dari aspek sosiologis, penyusunan peraturan ini mendesak untuk mengatasi berbagai tantangan seperti kerawanan pangan, ketidakstabilan harga, dan tingginya angka stunting di wilayah ini. Hal ini juga bertujuan untuk meningkatkan efektivitas pemanfaatan cadangan pangan yang saat ini belum optimal karena belum adanya landasan hukum yang memadai. Secara yuridis, pembentukan peraturan daerah ini diperlukan untuk menggantikan Peraturan Gubernur Sulawesi Selatan Nomor 48 Tahun 2023 yang bertentangan dengan asas "Lex Superior Derogat Legi Inferiori," sehingga menjamin kepastian hukum dan efektivitas pengelolaan pangan di tingkat provinsi. Oleh karena itu, peraturan daerah ini menjadi instrumen penting untuk mendukung ketahanan pangan yang berkeadilan dan berkelanjutan di Sulawesi Selatan, sejalan dengan kebijakan nasional dan target Sustainable Development Goals (SDGs).
