Impoverishment corruptors will have positive impact on the image of Indonesia as a state of law and prevention of corruption. For corruption, this can cause a deterrent effect, which then can prevent anyone who wants to involved in corruption. However, the verdict of impoverishing for corruptors is determined by the judges consistency in implementing the code of conduct of his profession

Abstract

The objective of the empirical study is to examine liquidity (CR), profitability (ROA), reputation of accountant public firms (KAP), public ownership and audit opinion towards the timeliness of delivering financial statement. This research is using 63 manufacturing companies which listed in Indonesian Stock Exchange from period 2008 – 2010. In this data analysis the technique used is logistic regression to test: an overall model fit by using the -2Log Likelihood, assess the feasibility of a regression model using the Hosmer and Lemeshow's Goodness of fit, Cox and Snell's R Square and Nagelkerke's R Square and parameter estimation and interpretation using the classification table. The results from this study are (1) liquidity had no significant influence to the timeliness of delivering financial statements (2) profitability had no significant influence to the timeliness of delivering financial statements (3) reputation of accountant public firms (KAP) had no significant influence to the timeliness of delivering financial statements (4) public ownership had no significant influence to the timeliness of delivering financial statement (5) audit opinion had no significant influence to the timeliness of delivering financial statement (6) liquidity (CR), profitability (ROA), reputation of accountant public firms (KAP), public ownership and audit opinion had significant influence to the timeliness of delivering financial statement. Abstract

ABSTRACTTerrorism is one of extraordinary crimes. The extraordinary of this crime is not only because it can cause serious impacts on the community life in general, but it also because of its ability to establish regeneration. This terrorist organization is quite successful in recruiting new members. This effectively encourages the willingness and the commitment of their members in conducting serious crimes in relation to terrorists conducts. In this circumstance, it is quite reasonable that all parties are encouraged to respond critically by deconstructing those terrorists’ regenerations.  Keywords: Terrorism, Regeneration, Deconstruction, Society, Nation  ABSTRAKTeroris merupakan salah satu jenis kejahatan isimewa (extraordinary crime). Keistimewaan kejahatan ini bukan semata disebabkan dampaknya yang serius terhadap kehidupan bermasyarakat dan berbangsa, tetapi juga dari sepek kemampuannya dalam membangun regenerasi. Organisasi teroris ini tergolong sukses dalam melakukan pembimbitan kader, sehingga untuk menjalankan modus operandi yang tergolong mengerikan, ada saja kader yang mau melaksanakannya. Berdasarkan kondisi ini, logis jika semua pihak dituntut melakukan dekonstruksi terhadap kaderisasi teroris.Kata Kunci: Terorisme, Kaderisasi,  Dekonstruksi, Masyarakat, Negara.

Abstract

Negara ini (Indonesia) terus berupaya membangun dirinya supaya menjadi negara hukum yang kuat. Ada banyak dan beragam hambatan yang ditemui oleh setiap aparat penegak hukum dalam upaya membangun negara ini. Tidak sedikit aparat penegak hukum yang gagal menunjukkan dirinya sebagai aparat yang punya komitmen dalam salah satu cita dari “Nawa Cita” Presiden Joko Widodo itu. Penyelenggaraan sistem peradilan pidana merupakan bagian dari sistem hukum Indonesia  yang seringkali diposisikan belum berhasil mewujudkan cita-cita itu akibat  para penyelenggaranya yang belum menjalankan prinsip konstitusionalitas dalam kinerjanya.Kata Kunci: negara hukum, penyelenggaraan, sistem peradilan pidana, konstitusi

Abstract

The crime of money laundering can tarnish the life of the nation and state because this crime can endanger the stability and security of the community. This study aims to examine strategies for eradicating the crime of money laundering. Because the crime of money laundering is an act that is continued or continued from the predicate crime where the person perpetrators process large sums of illegal money proceeds of crime into apparently clean or lawful funds, using sophisticated, creative and complex methods. From the results of the study there are two main things that can be concluded. First, the criminal law policy in criminal law reform in the field of money laundering crime which focuses on policies for formulating criminal acts, criminal liability, and criminal sanctions. formulated in a statutory regulation. Second, criminal law policies in the framework of overcoming the crime of money laundering can be formulated as an effort to make and shape criminal law regulations in the future effectively and efficiently.

Abstract

This article will examine the Criminal Law loophole which can still be found in the qualification of the crime of, “having intercourse with a woman out of wedlock”. In Verdict Number 30/Pid.B/2017/PN.bdw the perpetrator of crime and the victim who are both adults and without marital ties have intercourse without coercion, threats of violence and/or violence in different private areas. The Bondowoso District Court judge sentenced the perpetrator to three years in prison with a subsidiary indictment of the Public Prosecutor, namely Article 5 paragraph (3) letter b of the Emergency Law Number 1 of 1951 jo. Article 289 of the Criminal Code in Verdict Number 30/Pid.B/2017/PN.Bdw. This article will examine the accuracy of Article in Verdict Number 30/Pid.B/2017/PN.Bdw which uses Article 5 paragraph (3) letter b of the Emergency Law Number 1 of 1951 jo. Article 289 of the Criminal Code regarding the criminal act of obscenity and to examine the application of Article 412 in the new Criminal Code no. 1 of 2023 for perpetrators of criminal acts in Verdict Number 30/Pid.B/PN.Bdw.The research uses normative juridical research with statute approach and a conceptual approach.The temporary conclusion of this article is that the act of two single adults who have intercourse with the promise of marriage is still not punishable by crime. Indonesia's positive law and criminal law reforms still have legal loopholes, so they require government regulations to regulate actions that are considered morally bad. Law enforces need to take a legal sources outside of the appropriate law to convict perpetrator of criminal acts are that unequaled in the Criminal Code to fill the legal vacuum so that it does not become arbitrary space for law enforcers.

Abstract

The existence of political parties plays a strategic role in the development of democracy and the nation is faced with a number of issues that create a negative impression on these organs, some of which include; first, the problem of involvement of political parties in various cases of corruption and money laundering crimes that have an impact on the fall of public image and trust in the organization; second, the problem of pro and contra accountability of political parties involved in cases of corruption and criminal acts of money laundering before the law; and third, the issue of imposing criminal sanctions on political parties as the subject of corporate offenses known in corruption and money laundering. This research belongs to the typology of juridical normative legal research with secondary data types in the form of primary, secondary and tertiary legal materials. The approach taken includes the comparison, conceptual, statutory, and philosophical approaches, and analyzed descriptively qualitatively through literature. The results of the study show that; first, the justification of political parties as corporations in criminal acts of corruption and criminal acts of money laundering can be seen in five basic perspectives, namely philosophical foundation, juridical basis, historical basis, sociological basis, and political foundation of criminal law; second, the ideal concept of political party punishment as a corporation is carried out with a reconceptualization of the subject of corporate delictions in the affirmation of two types of corporations, namely corporations in the form of private and special corporations or in the form of public with different provisions on punishment arrangements. The need for an amendment to some provisions of the Corruption Law and the TPPU Law related to corporations in accommodating the two types of corporations into a forum for the implementation of ideas, of course issuing a law that contains specific provisions regarding special corporate punishment can be the answer to a myriad of issues regarding criminalization

Abstract

The crime of murder is included in the category of crimes against life. The qualifications for the crime of murder consist several forms listed in Articles 338-350 of the KUHP. Broadly speaking, forms of murder are divided into two, the crime of ordinary murder and the crime of premeditated murder. These two forms of criminal acts of murder have differences, namely in the element of planning. The provisions of Article 338 of the Criminal Code explain murder in basic form, namely the intentional killing of another person. Meanwhile, Article 340 of the Criminal Code explains the deliberate taking of another person's life which is preceded by a plan. However, the meaning planning element in the Criminal Code is not explained in detail. This needs to be studied further regarding the differences between ordinary murder and premeditated murder. In analyzing this research, the author uses a normative juridical method with a statutory regulatory approach and a conceptual approach. The results of this research show that when it comes to planning elements, criminal events and the evidentiary process are seen which are linked to the theory of legal science doctrine applied by judges as a guide in making legal considerations in decisions

Abstract

With the enactment of Law Number 1 of 2023 concerning the Criminal Code (New Criminal Code), there will be legal implications for several important aspects, namely the source of criminal law, the criminal justice system, and the practice of criminal law. This article aims to analyze predictions of implementing these 3 (three) aspects related to the provisions of Article 1 paragraph (1) and Article 2 of the New Criminal Code. In principle, Article 1 paragraph (1) of the New Criminal Code regulates the Principle of Legality, and Article 2 of the New Criminal Code regulates the existence and application of laws in society. The legal issue in this article is the potential difficulty of implementing 'living law'. It is necessary to substantially analyze several substantial things about the existence of the criminal law system and the criminal justice system that was formed with the enactment of Article 2 paragraph (1) of the New Criminal Code, as well as the potential juridical obstacles that exist in legal practice, with the existence of the newly formed criminal law system. This article uses legal research methods and doctrinal research types. This research uses a statutory approach and a conceptual approach. Analysis of legal materials uses prescriptive analysis with authentic and systematic interpretation. The analysis is intended to develop legal arguments regarding the juridical obstacles to enforcing 'laws that live in society.
