Abstract

Abstract Dispute resolution is an important part of maintaining order and justice in the legal system, both through litigation and non-litigation. As the public's need for faster, cheaper, and more peaceful dispute resolution grows, Alternative Dispute Resolution (ADR) methods such as mediation and conciliation are becoming increasingly relevant choices. This article aims to analyze the differences between mediation and conciliation, explain the role of the conciliator in the conciliation process, and examine the legal regulations governing both dispute resolution methods in Indonesia. This study examines the differences between mediation and conciliation in dispute resolution, the role of the conciliator in the conciliation process, and the legal regulations governing mediation and conciliation in Indonesia. This study uses a normative juridical method with a qualitative approach based on laws and legal literature. The results of the discussion show that although mediation and conciliation both involve a neutral third party and aim to reach a peaceful agreement, there are fundamental differences in the process, the role of the third party, and the level of formality. The conciliator plays a more active role than the mediator, with the authority to provide opinions and design settlement proposals, but without making binding decisions. Regulations such as Perma No. 1 of 2016, Law No. 2 of 2004, Law No. 32 of 2009, and Law No. 30 of 1999 are the legal basis that strengthens the position of mediation and conciliation as legitimate instruments in resolving various types of disputes in Indonesia. Abstract

Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana memperkenalkan tindak pidana kohabitasi dalam Pasal 412 yang berlaku bagi setiap orang tanpa membedakan usia pelaku. Ketentuan ini menimbulkan persoalan yuridis ketika diterapkan kepada anak, mengingat anak merupakan subjek hukum khusus yang tunduk pada Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak dan Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak. Rumusan Pasal 412 yang bersifat umum berpotensi menimbulkan kriminalisasi berlebihan terhadap anak serta bertentangan dengan prinsip kepentingan terbaik bagi anak dan asas ultimum remedium. Permasalahan dalam penelitian ini adalah bagaimana bentuk pertanggungjawaban pidana anak dalam tindak pidana kohabitasi menurut Pasal 412 KUHP 2023 serta bagaimana implikasi penerapannya terhadap sistem peradilan pidana anak dan perlindungan hak anak. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual, melalui analisis bahan hukum primer dan sekunder secara kualitatif. Hasil penelitian menunjukkan bahwa meskipun anak secara normatif dapat menjadi subjek Pasal 412 KUHP, penerapannya harus dibatasi dan diselaraskan dengan rezim hukum pidana anak. Kesimpulannya, pertanggungjawaban pidana anak pelaku kohabitasi tidak dapat disamakan dengan orang dewasa dan harus mengutamakan pendekatan pembinaan, diversi, serta keadilan restoratif guna menghindari kriminalisasi yang merugikan tumbuh kembang anak.

Abstract

This article presents how the factors affecting family owned and managed businesses are examined and related to how the business literature develops. In addition, it discusses important patterns in the current literature and new directions regarding family business for future study. This study identifies the main research topics and methodical approaches in a systematic literature review to understand the family business. Insights about behind the historic changes and current directions and trends of family business literature are also identified. The findings of this study argue that the main cause of challenges in running a family business is sourced from managing the relationship between family interests and business interests. The key success factors are strong leadership and building a culture that accepts continuous change.
