Abstract

Abstract. Penal system for children today still does not provide justice for them. It is grounded on the Penal Code, Law Number 11/2012 on Child Criminal Justice System (hereinforth is referred to as UU SPA), and Law Number 35/2014 on child protection which implementation is not yet maximum to secure children’s rights and future as either the perpetrators or victims.. The policy to children to prevent recidivists is made by 2 (two) ways; namely penal policy and non-penal policy. Penal policy is the policy made based on best legal formulation for children, either from the Law maker, law enforcer, or law abiding society. Non-penal policy that is more preventive to social effects and imprisonment, is the last effort for children as recidivists. The ruling Number 02/PID.Sus.Anak/2014/PN.Skt which punishes the child with the weighting for being a recidivist needs to be reviewed. UU SPA and Law on Child Protection need to revise the punishment for children to be more treating, not torturing. Punishment for children should be made based on double track system stating that imprisonment and treatment sanctions have to be balanced.   Keywords: judge’s ruling, children as recidivists, child protection

Abstract

Abstract. Online-based transportation business has spread to various cities in Indonesia, one of them is in the city of Medan. Various cheating modes are carried out by several driver partners, including fictitious orders, using the Fake GPS application to cheat the system, and using additional applications to not take orders without reducing the performance of receiving orders from partners. Based on the above problems, the problems with this thesis are as follows: What is the regulation regarding the crime of breaking into online transportation system applications in the Information and Electronic Transactions Law? How does the evidentiary system relate to the crime of breaking into online transportation system applications? What is the analysis of the judges' consideration of the Medan District Court's decision regarding the criminal offense of the application of the online transportation system? The research method used is normative legal research. The nature of this research is descriptive-analytic with the Legislative Approach (legal approach), case approach. In normative legal research, the data used are secondary data. Secondary data obtained by conducting research on primary legal materials, secondary legal materials, and tertiary legal materials. The criminal act of breaking into an online transportation system application is regulated in Article 30 paragraph (3) of Law Number 19 the Year 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions (UU ITE). The Negative Proof System is a proof system used under Article 183 of the Criminal Procedure Code which is an attempt to find material truth. The judges decide and convict based on the facts of the trial, the defendant in committing his actions using electronic media as his object, this is in accordance with the elements contained in Article 30 paragraph (3) of the ITE Law, which specifically regulates acts that violate, breakthrough, surpassing, or breaking down the security system, in this case the online transportation system application.   Keywords: criminal acts, inroad to system applications, online transportation

Abstract. The implementation of diversion in Deli Serdang Regency based on Law No. 11 of 2012 concerning the Child Criminal Justice System and Deli Serdang District Decree No. 2283 of 2016 concerning the Implementation Team of the Diversity and Restorative Justice Forum in Handling Children in Conflict with the Law in Deli Serdang Regency is an effort made to achieve the diversion goal optimally in the form of avoiding detention, avoiding labeling as a criminal, proposing interventions needed by victims or the perpetrators without going through a formal process and avoiding children from following the criminal justice process in order to avoid the negative influence and implications of the process. Abstract

Abstract. Criminal act of premeditated murder is an action intentionally done by one or more persons by initially planning to take other person’s life. The premeditation includes the certain time period in which a person thinks peacefully and makes the decision to take another person’s life. An action can be called a premeditated murder under one condition is that the action has firstly been premeditated (taking one person’s life). Nowadays premeditated murders are not done by adults alone, but in same legal cases, they involve minors to help them. Children in conflict with law are called juvenile criminals, although a child has helped a premeditated murder, he cannot absolutely be held responsible for the crime that he did. It firstly has to be proved whether his action meets the elements of a criminal act pursuant to the articles Stipulated in Penal Code. If his action does not meet the required elements, the child cannot be held responsible. He might have forcibly helped committing the premeditated murder or been influenced by force such as inevitable threats from adults. In other words, a child’s involvement is only used as a tool to carry forward adults’ bad intentions.   Keywords : premeditated murder, children, penal sentence.

Kewenangan Kejaksaan Agung untuk menyidik tindak pidana tertentu diatur dalam beberapa undang-undang. Salah satu kewenangan tersebut adalah mengejar korporasi sebagai pelaku tindak pidana korupsi.Permasalahan yang dibahas adalah: Bagaimana pengaturan kewenangan Jaksa Penutut Umum dalam upaya mengejar korporasi pelaku tindak pidana korupsi? Bagaimana Perbandingan Penerapan Criminal Based Dan Non Criminal Based Oleh Jaksa Penuntut Umum Dalam Mengejar Korporasi Pelaku Tindak Pidana Korupsi di Indonesia? Apa yang menjadi hambatan Penerapan Criminal Based Dan Non Criminal Based Oleh Jaksa Penuntut Umum Dalam Mengejar Korporasi Pelaku Tindak Pidana Korupsi di Indonesia. Metode penelitian menggunakan metode penelitian hukum yuridis normatif yaitu mengacu pada norma-norma hukum. Penelitian ini bersifat deskriptif analitis. Data yang digunakan adalah data sekunder. terdiri atas bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Teknik pengumpulan data adalah library research (penelitian kepustakaan dan wawancara. Analisis data adalah kualitatif. Hasil penelitian menunjukkan bahwa:Pengaturan kewenangan Jaksa Penutut Umum dalam upaya mengejar korporasi pelaku tindak pidana korupsi oleh lembaga kejaksaan didasarkan pada ketentuan Pasal 30 (1) (d)  UU No. 16/2004 tentang Kejaksaan.. Penerapan Criminal Based lebih berhasil dalam mengejar korporasi sebagai pelaku tindak pidana korupsi dibandingkan dengan non criminal based oleh Jaksa Penuntut Umum. Hambatan Penerapan Criminal Based Dan Non Criminal Based Oleh Jaksa Penuntut Umum Dalam Mengejar Korporasi Pelaku Tindak Pidana Korupsi di Indonesia adalah faktor hukum, penegak hukum, sarana dan prasarana, masyrakat dan kebudayaan

Abstract

Penelitian ini bertujuan untuk mengkaji bagaimana pengaturan hukum terhadap tindak pidana korupsi pengelolaan anggaran desa, menurut Undang-Undang Tindak Pidana Korupsi dan bagaimana pertanggungjawaban pidana terhadap tindak pidana korupsi pengelolaan anggaran Desa yang dilakukan oleh Kepala Desa dalam Putusan Pengadilan Negeri Nomor 26/Pid.SUS-TPK/2021/PN.Kdi. Serta metode yang digunakan adalah yuridis normatif, yaitu penelitian yang dilakukan dengan cara mengkaji peraturan perundang-undangan yang berlaku atau diterapkan terhadap suatu permasalahan hukum dengan mengacu pada norma hukum yang terdapat dalam peraturan perundang-undangan.Korupsi anggaran desa terkait pada kebijakan pengelolaan anggaran desa yang menerapkan asas yang tidak bertentangan dengan undang-undang. Kebijakan hukum tersebut merupakan pernyataan kehendak sepihak dari organ pemerintahan dan membawa akibat. Pelaku tindak pidana korupsi anggaran desa dalam hal terjadinya perbuatan melawan hukum yang menyebabkan kerugian negara tidak dapat dipisahkan pada rumusan ketentuan Undang-Undang Nomor 31 Tahun1999 jo Undang-Undang Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi. Berbicara mengenai pertanggungajwaban pidana pelaku korupsi anggaran desa maka  terkait dengan pertanggungjawaban jabatan sebagai penyelenggara pemerintah desa merujuk pada pasal 1 undang-undang no 31 tahun 1999  sebagaimana telah diubah menjadi undang-undang nomor 20 tahun 2001 tentang pemberantasan tindak pidana korupsi dapat dilihat yang menjadi subjek undang-undang tersebut adalah, korporasi, Pegawai Negeri Sipil dan orang  perseorangan dimana pertanggunggjawaban pribadi melahirkan pertanggunggjawaban pidana

Abstract

One of the factors to maintain and increase the level of public trust in a bank is the bank's compliance with the Bank's Secret obligations, namely protection of depositing customers and their deposits from crimes. The obligation to uphold bank secrecy can be exempted, one of which is the exception, namely to the interests of the judiciary in criminal cases, including online gambling crime with the written statement or approval of the Depository Customer. As stipulated in Article 42 of Law Number 10 Year 1998 concerning Banking, by the request of the police during the investigation stage, prosecutors in the prosecution stage, or judges in the stage of examination before the court, can ask permission from the leadership of Bank Indonesia (now at the Otoritas Jasa Keuangan) to obtain an information about the Suspect's deposit. As a form of applying the principle of trust, an obligation arises for banks to protect customer data and funds, where the concrete form of such protection is Bank Confidentiality
