Abstract

ABSTRACT Diversion is the duty of law enforcer handling the case of criminal offenses committed by children to take action to continue or discontinue court cases. Diversion in an effort to urge people to obey and uphold the laws of the country, its implementation still consider fairness as the top priority in addition to providing the opportunity for offenders to take the path of non-criminal as compensation, social work or supervision of their parents. Investigation authority possessed by police is the initial process in a juvenile justice process. This is due, whether or not children in conflict with the law are processed in juvenile justice is highly dependent on the results of investigations conducted by the Police by first asking for consideration or advice from community mentors. In the case of children in conflict with the law, the police in the execution of discretion can upgrade the case so that the child does not have to deal with a formal court settlement. The formulation of the research problem in this study is the first, the effect of the diversion of children in conflict with the law. Second, synchronization regulations on diversion of children in conflict with the law in Indonesia at the level of investigation. Third, the implementation of the diversion of children in conflict with the law in Medan Police. Diversion done to prevent children perpetrators of the negative impact of the implementation of the juvenile justice practice. Diversion is an idea if the appropriate consideration to avoid the stigma in children. Diversion has a positive and negative influence for children and the other parties involved. There are differences between the Secret Telegram with legislation that is in the application of the diversion of children in terms of the threat of punishment, child investigators, diversion agreement and coordination with the prosecution (the prosecutor) and the determination made by the local District Court. On the implementation of diversion in Medan Police, guidelines used namely Act No. 11 of 2012, the Criminal Police Secret Telegram TR / 1124 / XI / 2006 and TR / 395 / DIT, VI / 2008 but has not made the PP 65 Year 2015 as the Guidelines for the implementation of diversion. There are some reasons why the diversion implementation by the police does not comply with the rules in the Act No. 11 Year 2012. There should be rules governing the supervision of the implementation of diversion. Abstract

Hak Asasi Manusia adalah suatu hak fundemental yang dimiliki manusia yang merekat pada seseorang dari lahir, HAM tersebut juga tidak dapat dirampas dan dicabut keberadaannya selain itu untuk kehormatan, HAM juga harus dihargai, dipelihara, dan dijaga oleh negara, hukum, pemerintah dan semua orang. Dalam  konstitusi    ditegaskan  bahwa  negara  Indonesia adalah  negara  hukum (Rechtsstaat), bukan  negara  kekuasaan (Machtsstaat).   Di   dalamnya   terkandung   pengertian   adanya pengakuan  terhadap  prinsip  supremasi  hukum  dan  konstitusi, dianutnya prinsip pemisahan dan pembatasan kekuasaan menurut sistem  konstitusional  yang  diatur  dalam  Undang-Undang  Dasar, adanya  prinsip  peradilan  yang  bebasdan  tidak  memihak  yang menjamin  persamaan  setiap  warga  negara  dalam  hukum,  serta menjamin    keadilan    bagi    setiap    orang    termasuk    terhadap penyalahgunaan  wewenang  oleh  pihak  yang  berkuasa, Negara yang berdemokrasi, implementasi Hak Asasi Manusia merupakan suatu keharusan. Tingkatan implementasi demokrasi dan hak asasi manusia juga dipengaruhi oleh peran Negara. Implementasi demokrasi dan Hak asasi manusia yang berkedaulatan rakyat merupakan cita-cita yang hendak dicapai.

Abstract

Abstract: Human Rights are a set of rights that are inherent in the nature and existence of humans as creatures of God Almighty and are His gift which must be respected, upheld and protected by the legal state, the Government, and every person for the sake of honor and protection of human dignity. The right to a sense of security is regulated in Law Number 39 of 1999 concerning Human Rights from Articles 28-35. The research method used in this article is normative, namely legal research carried out by examining library materials, with a focus on the legislative approach, namely by examining all statutory regulations. This article is descriptive with the main data source being secondary data. The data obtained is sorted into one pattern, category and basic description. So conclusions can be drawn using qualitative analysis. A series of laws that regulate many things regarding the importance of security which emphasizes that guaranteed protection from the threat of fear of doing or not doing something which is a human right, guaranteed protection from torture or treatment that degrades human dignity, and guaranteed safety to be free from treatment discriminatory on any basis. Keywords: Human Rights, Right to Feeling Safe Abstrak: Hak Asasi Manusia adalah seperangkat hak yang melekat pada hakikat dan keberadaan manusia sebagai mahluk Tuhan Yang Maha Esa dan merupakan anugrah-Nya yang wajib dihormati, dijunjung tinggi dan dilindungi oleh negara hukum, Pemerintahan, dan setiap orang demi kehormatan serta perlindungan harkat dan martabat manusia. Hak atas rasa aman diatur dalam Undang-Undang Nomor 39 Tahun 1999 Tentang Hak Asasi manusia dari Pasal 28-35. Metode penelitian dalam artikel ini yang digunakan adalah normatif yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan kepustakaan, dengan fokus pada pendekatan perundang-undangan yaitu dilakukan dengan menelaah semua peraturan perundang-undangan. Artikel ini adalah deskriptip dengan sumber data utama berupa data sekunder. Data yang diperoleh diurutkan dalam satu pola, kategori dan uraian dasar. Sehingga dapat diambil kesimpulannya dengan menggunakan analisis kualitatif. Serangkaian Undang-Undang yang mengatur banyak hal akan pentingnnya sebuah keamanan yang menegaskan bahwa terjaminnya perlindungan dari ancaman ketakutan untuk berbuat atau tidak berbuat sesuatu yang merupakan hak asasi, terjaminnya perlindungan dari penyiksaan atau perlakuan yang merendahkan derajat martabat manusia, serta terjaminnya keselamatan untuk bebas dari perlakuan diskriminatif atas dasar apapun. Kata kunci: Hak Asasi Manusia, Hak Rasa Aman

Abstract

Abstract: In the command of the Prelude of the 1945 Constitution, the Public authority has a commitment to propel the overall government assistance, teach the country's life. For this situation, the arrangement of wellbeing administrations is one type of government assistance that can be delighted in by the local area. Besides the fact that it spins around the commitments of the public authority, the arrangement of wellbeing administrations is one type of the idea of Common freedoms, all the more unequivocally the Second Era Basic liberties that arose in the nineteenth century which around then neediness and double-dealing were limitless, as an agreement the right to wellbeing was remembered for one of the Basic freedoms that should be safeguarded. Providing health services is a form of facilitating human rights in a country. Providing health services for the community is an obligation for a country which is a mandate from the opening of the 1945 Constitution and the national goals of the Indonesian state. keywords: health services, social security, HAM. Abstrak: Dalam amanat Pendahuluan UUD 1945, Kekuasaan Umum mempunyai komitmen untuk menggerakkan bantuan pemerintah secara menyeluruh, mencerdaskan kehidupan negara. Untuk itu, penyediaan layanan kesejahteraan merupakan salah satu bentuk bantuan pemerintah yang dapat dinikmati oleh daerah setempat. Selain berputar di sekitar komitmen otoritas publik, pengaturan administrasi kesejahteraan adalah salah satu jenis gagasan Kebebasan Umum, terlebih lagi Kebebasan Dasar Era Kedua yang muncul pada abad ke-19 yang pada saat itu merupakan kebutuhan dan kemelaratan ganda, transaksi tidak terbatas, karena perjanjian hak atas kesejahteraan dikenang sebagai salah satu kebebasan Dasar yang harus dijaga. penyediaan pelayanan kesehatan merupakan bentuk terwujudnya fasilitasi dalam hal Hak Asasi Manusia dalam suatu negara. penyediaan layanan kesehatan untuk masyarakat merupakan kewajiban bagi suatu negara yang merupakan amanat dari pembukaan UUD 1945 serta tujuan nasional negara Indonesia. Kata kunci: pelayanan kesehatan, jaminan sosial, HAM

Abstract

Konstitusi lahir dari adanya kontrak sosial atau general egreement antara segenap rakyat Indonesia yang memiliki kedaulatan dan pemerintah selaku pelaksana konstitusi, terkait mekanisme yang diidealkan oleh sebuah negara. Konstitusi tersebut digunakan warga negara untuk mengatur segala kepentingan mereka bersama agar dapat dilindungi. Adapun kepentingan yang paling fundamental dari setiap warga negara yaitu perlindungan terhadap Hak Asasi Manusia (HAM) yang menjadi salah satu bagian sentral di dalam konstitusi. HAM secara singkat dapat dibagi menjadi tiga kategori, diantaranya: pertama, generasi pertama HAM yang menyangkut masalah hak-hak sipil dan politik, kedua mengenai hak-hak ekonomi, sosial dan budaya, dan ketiga mewakili hak persamaan. Dalam hal ini, konstitusi tidak hanya sebatas memberikan jaminan dan perlindungan di atas kertas saja, melainkan wajib memberikan kepastian berbagai nilai dan norma yang dijadikan landasan oleh lembaga peradilan dan pemerintah untuk memberika keadilan seadil adilnya sesuai dengan prikemausian dan priketuhanan.

Abstract

This research aims to discuss the importance of upholding human rights principles (HRP) in teacher profession policies, particularly regarding the appointment of Functional Teacher positions as PPPK civil servants. This study employs a juridical-normative method with a human rights-based approach to evaluate related policy regulations. The research findings indicate that the designation of the Functional Teacher Position as a PPPK civil servant violates HRP principles such as equality, interconnectedness, and non-discrimination. Therefore, a re-evaluation of this policy is necessary, considering HRP principles, and reinstating the status of the Functional Teacher Position as PNS civil servants in the SSCASN process. This research is descriptive, utilizing data from legislation, books, and scholarly articles related to HRP. Thus, understanding and respecting HRP principles are crucial in establishing teacher profession-related policies.

Abstract

Ideally, the validity of Testimonium de Auditu evidence in cases of sexual violence should provide stronger legal protection for victims, given that sexual violence often occurs in closed situations without direct witnesses. However, in reality, Testimonium de Auditu has long been considered to have insufficient evidentiary strength in Indonesian criminal law, leading to its frequent disregard in law enforcement processes. This research focuses on how regulatory changes in Indonesia have accommodated and strengthened the validity of Testimonium de Auditu in the context of sexual violence crimes. This study aims to analyze the renewal of the validity of Testimonium de Auditu evidence in sexual violence crimes based on the perspective of Indonesian legislation. The research is classified as a qualitative literature study, utilizing a normative legal approach. The findings indicate that the reforms outlined in the Indonesian Criminal Code (KUHP), Constitutional Court Decision Number 65/PUU-VIII/2010, and Law Number 12 of 2022 on Sexual Violence Crimes (UU TPKS) have strengthened the position of Testimonium de Auditu as valid evidence in cases of sexual violence. These reforms allow Testimonium de Auditu to be recognized and more adaptive within the criminal justice system, particularly in addressing the challenges of proving sexual violence, which often lacks direct witnesses.

Abstract

Democracy in the government system places emphasis on power in the hands of the people; however, with the approval of election law number 7 of 2017 regarding the regulation of threshold requirements for presidential and vice presidential candidates, it is considered detrimental to the people because the additional conditions related to the administrative requirements for presidential and vice presidential candidates are deemed to be contradictory. With the 1945 Constitution Article 6A paragraph (2) and Article 28 D paragraph (3) on human rights, especially the right to participate in politics, the space for democracy is limited because, basically, Indonesian people have the right to vote and choose. In fact, it has been proven that there are only two candidates for president and vice president in the 2014–2019 and 2019–2024 election periods, forcing the public to choose the candidates that have been provided, even though these candidates are not necessarily the candidates that the public expects, thus giving the impression of forcing personal human rights to participate. in the presidential election. In this research, the author uses a normative legal research method in the form of a library search. The results of the research show that the nomination requirements regulated in the 1945 Constitution, Article 6A paragraph (2), do not regulate thresholds, but there are additional requirements in Article 222 that have become controversial, so that the threshold causes the loss of political rights to be able to suggest presidential and vice presidential candidates. Conflicts can destroy democracy. . Indonesia. People and political parties who want to run for the presidential election cross the threshold so that entering a presidential system gives rise to limited democracy. This is because national hopes still require a judicial review to guarantee the upholding of human rights, which hampers the process of emerging more alternative leadership candidates to realize people's welfare. From a benefit perspective, whatever government policy, must take into account the aspirations of its people, so that government policy must be in line with the public interest.

Abstract

The long-running conflict between Israel and Palestine has yet to find a bright light. The international community became aware of this situation and denounced Israel's actions in Palestine. Various parties believe that Israel has committed grave human rights breaches, while many Israeli supporters argue that the attack is a form of vengeance and protection for Israel against attacks by Palestinian supporters. The purpose of this study is to examine the Israeli-Palestinian conflict from the standpoint of international humanitarian law and human rights. Primary, secondary, and tertiary legal resources are the sources of legal materials employed in the normative juridical research process. This study employs a conceptual and case-based approach, methodologies for collecting legal materials through library studies, and analysis of legal materials through the use of legal materials obtained to address problems. The research findings revealed that Israel has violated humanitarian norms (humanity). There were multiple cases in which the Israeli military breached humanitarian precepts. The use of heavy weaponry with uncertain consequences caused significant damage, and several Palestinians died. The Palestinian people's situation is deteriorating due to a food supply problem. Until recently, the International Court of Justice (ICC) has taken no action to prosecute war crimes committed by Zionist Israel.

Abstract

Krisis politik berujung konflik kudeta militer yang memaksa rakyat Myanmar melakukan aksi unjuk rasa mengakibatkan pelanggaran HAM. Peran ASEAN Intergovermental Comission on Human Rights sebagai organisasi integral ASEAN diharapkan menjadi ujung tombak dalam perlindungan HAM di ASEAN. Penulisan ini menggunakan pendekatan yuridis normatif, bersifat deskriptif, dengan menggunakan pendekatan kualitatif. Penelitian menggunakan bahan hukum primer dan sekunder. Selanjutnya, analisis data dilakukan dengan metode analisis kualitatif dengan penguraian secara deskriptif (pemaparan). Peranan AICHR dalam upaya melindungi HAM di tengah konflik kudeta Myanmar juga dinilai belum efektif, hal tersebut dikarenakan ToR AICHR masih sangat terbatas. Perlunya merevisi ToR AICHR untuk memperbesar ruang lingkup penegakan dan perlindungan HAM di ASEAN, salah satunya dengan cara memasukkan doktrin Responsibility to Protect (R2P) supaya memungkinkan langkah AICHR dalam mengintervensi negara yang melakukan pelanggaran HAM.
