Abstract

ABSTRACT   Legal substances establishment of houses of worship in the city of Medan is divided in three components namely the structural components of the law in this cases in the conceptual framework of the applicable rule and regulations regarding the licensing houses of worship, namely construction of 1945; Law No. 28 of 2002 on building regulations, along religious affairs minister and minister of interior number 9 and 8 of 2006 on the establishment houses of worship; towns and local regulations number 5 2012 concerning the levy of building permits. Component substance of the law, namely the legal entities related of governance of licensing house of worship in the city of Medan that the city administration of Medan, the ministry of religion and forum religious harmony city of Medan, department of spatial and urban planning, as well as the official licensing of integrated city of Medan, further substance component of the legal culture in this case is the implementations of such rules in a society that must be adapted to the system of values, norm and habits in urban terrain to run properly and effectively. Abstract

Anak adalah bagian dari generasi muda sebagai salah satu sumber daya manusia yang merupakan potensi dan penerus cita-cita perjuangan bangsa, yang memiliki peranan strategis dan mempunyai ciri dan sifat khusus, memerlukan pembinaan dan perlindungan dalam rangka menjamin pertumbuhan dan perkembangan fisik, mental dan sosial. Untuk melaksanakan pembinaan dan memberikan perlindungan terhadap anak diperlukan dukungan baik yang menyangkut kelembagaan maupun perangkat hukum yang lebih mantap dan memadai oleh karena itu terhadap anak yang melakukan tindak pidana diperlukan pengadilan anak secara khusus. Indonesia, sudah memiliki sejumlah aturan untuk melindungi, mensejahterakan dan memenuhi hak-hak anak. Indonesia, dalam upay perlindungan terhadap anak telah memiliki  Undang-undang No. 4 Tahun 1979 Tentang Kesejahteraan Anak, Seharusnya sudah dapat menjadi rujukan dalam pengambilan kebijakan terhadap perlindungan anak. Indonesia mengesahkan undang-undang Nomor 3 Tahun 1997 tentang Peradilan Anak dan Undang-undang Nomor 23 Tahun 2002 tentang Perlindungan Anak. Akan tetapi dalam prakteknya instrument hukum dalam bidang perlindungan anak ini masih belum sepenuhnya dapat berjalan.

Abstract

The enactment of Law No. 6 Year 2024 on Villages in Indonesia has made the Village Head Election System in Indonesia better and more organized. Village Head Election is a form of democratic party at the village level that is conducted simultaneously in all districts/cities. The policy for the implementation of simultaneous Village Head Elections as intended is determined by the regency / city government by regency / city regulation. The method used is a qualitative method, research that produces descriptive data analysis, namely analysis that describes the state or status of the phenomenon with words or sentences, then separated according to its category to obtain conclusions from all the problems studied by collecting data, qualifying then connecting theories related to the problem and drawing conclusions to determine the results Data obtained from field research and literature studies are collected and then analyzed. The postponement of the 2023 Simultaneous Village Head Election in Labuhanbatu Selatan Regency occurred due to several factors including the Budget Factor from the Regional Budget and the Politicization Factor of a Regent so that legal uncertainty was the impact of the postponement of this village head election. Abstract

The Unitary State of the Republic of Indonesia is a constitutional state that places the highest sovereignty in the hands of the people, as referred to in Article 1 paragraph (2) of the 1945 Constitution of the Republic of Indonesia, which reads: "Sovereignty is in the hands of the people and is implemented according to the Constitution". Based on the statement above, making Indonesia a democratic country, so that not only leaders but also all Indonesian people have full rights to determine the principles of good governance. Basically, a democratic system is a form of government where all citizens have the same rights in determining decisions that can change their lives. The democratic system allows citizens to participate, both directly and through representatives in the formulation, development and creation of laws. The research was conducted in Binjai City, precisely at the Binjai City Bawaslu Gakkumdu Center. This research uses an empirical legal approach method, data obtained in the field are presented descriptively using an empirical normative approach method. This study aims to determine the form of criminal acts in the 2020 regional head election (pilkada) in Binjai City, Law enforcement of criminal acts in the 2020 regional head election (pilkada) in Binjai City, and the role of the Integrated Law Enforcement Center (Sentra Gakkumdu) in handling criminal acts in the 2020 regional head election (pilkada) in Binjai City. Based on the results of the research that the author obtained, in the data on handling violations of the 2020 Regional Head Election in Binjai City, there were 5 (five) handling of alleged election crime violations, consisting of 2 (two) Findings based on the results of supervision by the Binjai City General Election Supervisory Agency and 3 (three) Reports from the public, In enforcing the law on election crimes, especially in Binjai City in the 2020 Binjai Mayor and Deputy Mayor Election, the principle of fast law enforcement is used, meaning that in terms of law enforcement on election crimes, it is carried out quickly and there is a time limit that is relatively faster than handling crimes in general, where the General Election Supervisory Agency together with police investigators and prosecutors will conduct the first discussion within a maximum of 1 x 24 hours from the date the findings or reports are received and registered by the General Election Supervisory Agency, That the Integrated Law Enforcement Center (Sentra Gakkumdu) has the main function and role in conducting case titles to identify elements of election crimes and evidence that must be collected, then the work procedures in handling election crimes which include receiving reports, first discussion, second discussion, investigation, third discussion, and prosecution with the aim of achieving a common understanding in handling election crime cases.

Abstract

This study stems from the urgency of maintaining the stability of the presidential system through the effective implementation of the principle of checks and balances. The research focuses on a comparison of the implementation of this principle in three countries with presidential systems, namely Indonesia, the Philippines and South Korea. The main problem is how the checks and balances mechanism is designed and implemented in the constitutional structure of each country, and how effective the mechanism is in preventing the domination of power by one state institution. The method used is normative juridical research with a comparative legal approach, through analysis of legislation, judicial decisions, and relevant academic documents. The results show that the effectiveness of checks and balances is highly dependent on constitutional design, political culture, and the strength of countervailing institutions. The Philippines demonstrates an active oversight system, mainly by the legislature and the Supreme Court. South Korea has effective oversight through audit institutions and impeachment procedures. Indonesia still faces challenges in strengthening oversight due to overly harmonious executive-legislative political relations. This research suggests the importance of strengthening the state's institutional structure and acculturating the principle of mutual supervision between branches of power as the main prerequisites for the creation of a healthy, balanced presidential system, and able to prevent the domination of power by one state institution.
