Abstract

Penelitian ini bertujuan untuk menganalisis tentang jenazah pasien Suspek/Probable Covid-19 dalam Protokol Covid-19 dan tanggungjawab pelaku pengambilan paksa jenazah pasien Suspek/Probable dalam hukum pidana. Penelitian ini merupakan tipe penelitian yuridis normatif, yaitu penelitian yang difokuskan untuk mengkaji penerapan norma-norma dalam hukum positif dengan cara memadukan bahan-bahan hukum yang merupakan bahan hukum sekunder dengan primer. Pendekatan yang dilakukan adalah pendekatan perundang-undangan (statue approach), pendekatan konseptual (conseptual approach). Berdasarkan hasil penelitian ini dapat disimpulkan bahwa jenazah pasien tersebut merupakan jenazah suspek/probable Covid-19, harus diperlakukan seperti Jenazah Covid-19 sampai ada hasil dari tes swab untuk memenuhi hak-hak jenazah, Tanggungjawab pelaku pengambilan paksa jenazah pasien suspek/probable dalam hukum pidana dapat dijatuhi hukuman pidana sesuai dengan Undang-Undang Nomor 4 Tahun 1984 tentang Wabah Penyakit Menular.

Abstract

The implementation of law enforcement in the Indonesian National Army (TNI) is still chaotic due to the sectoral ego of each law enforcement officer so that it is necessary to discuss the concept of law enforcement against soldiers who commit violations using a progressive legal approach conceptual. This research is a normative (doctrinal) legal research with a statutory and conceptual approach. Law enforcement in the Indonesian National Army environment requires the development of the approach that used, one of which uses a progressive legal approach. In progressive legal thinking, the law should be able to give happiness to the people and the nation so that the development of soldier morality is needed. Thinking progressively in law means having the courage to get out of the mainstream of legal absolutism thinking, then placing the law in a relative position. Progressivism does not want to make law a technology that has no conscience, but rather a moral institution, in this case human morality. Good physical development but bad mentality makes the direction of the law go astray.

Abstract

The purpose of this study is to examine the actions of forensic doctors that tend to cause medical negligence. This research is a prescriptive research. The results of this study regarding forensic doctors can be qualified as crimes due to negligence, if they provide inappropriate health services to patients. This can be seen through the Standard Operating Procedures or what are called SPOs that doctors use to work. In addition, forensic doctors can be burdened with legal responsibilities, i. e. administrative, civil and criminal from medical law with license revocation, compensation for patient losses due to liability due to default or unlawful acts. And criminal dispute resolution in the local district court with criminal sanctions.

Abstract

Untuk menganalisis layanan vaksinasi COVID-19 bagi masyarakat Indonesia dalam perspektif hak asasi manusia atas kesehatan dan tanggung jawab negara untuk memenuhi hak asasi manusia atas kesehatan dalam pelaksanaan vaksinasi, dilakukan penelitian terhadap kedua hal tersebut. Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Beberapa hal yang ditemukan dalam penelitian ini, antara lain mengenai kebijakan pemerintah dalam pemberian vaksin Covid-19 yang menuai berbagai sudut pandang, termasuk sudut pandang hak asasi manusia. Dalam hal ini dinamika yang terjadi terhadap layanan yang diberikan cukup membuat pemerintah berhasil dan bertahan dalam melaksanakan kebijakan tersebut. Hal ini kemudian menjadikannya sebagai bentuk tanggung jawab negara dalam penanganan Covid-19 di Indonesia. Tanggung jawab yang diberikan tidak hanya sekedar memberikan vaksin, tetapi juga terdapat perlindungan hukum bagi masyarakat Indonesia yang telah divaksinasi. Hal ini juga karena melihat beberapa negara menerapkan hal ini yang didukung oleh instrumen hukum internasional dalam penanganan Covid-19 di Indonesia.

Abstract

One important component in disclosing the cases of criminal acts of sexual violence case is Visum et Repertum (VeR). Based on article 133 of the Criminal Procedure Code. VeR clarifies cases, especially in the context of proving someone's guilt relating to the body or parts of the human body. The purpose of this research is to analyze the medicolegal aspect in handling TPKS victims, especially victims of rape or sexual intercourse. By using normative research methods and using statutory and conceptual approaches. TPKS arrangements are regulated in Law Number 12 of 2022 concerning Crimes of Sexual Violence. Handling of TPKS victims is regulated through Minister of Health Decree number 1226/Menkes/SK/XII/2009 concerning Guidelines for the Management of Integrated Services for Victims of Violence Against Women and Children in Hospitals. Indonesian medical council regulation number 66 of 2021 concerning forensic and medicolegal medical education standards regulates clinical authority in handling TPKS victims. There are two regulations related to medical services for legal purposes, Minister of Health Regulation Number 38 of 2022 concerning Medical Services for Legal Purposes and Minister of Health Regulation Number 77 of 2015 concerning Guidelines for Mental Health Examination for the Interests of Law Enforcement.

Abstract

This research aims to analyze the benefits of Medical Record Encryption (MRE) data in legal safeguards for physicians and patients, while also investigating the trajectory of medical dispute resolution through the lens of Restorative Justice, employing the utilization of MRE data. Framed within the contextual backdrop, this study responds to the imperative for further exploration into the pivotal role of MRE data in resolving cases of medical malpractice, with the overarching objective of contributing to the advancement of equitable and forward-looking strategies in medical dispute resolution. Employing a normative juridical research approach, this study discerns the significance of MRE data security and its implications in the legal responsibilities’ incumbent upon MRE custodians. Additionally, this study posits that the Restorative Justice approach, coupled with MRE data, can manifest as an efficacious methodology in comprehending, preempting, and fortifying the dynamics of medical disputes, thereby fostering the rapport between healthcare practitioners and patients. Consequently, the integration of MRE data in medical dispute resolution via the Restorative Justice paradigm has the potential to heighten legal protection, reinforce medical integrity, and enhance the overall efficiency of the healthcare system

Abstract

Port security is a crucial component of maritime security that plays a vital role in facilitating economic activity at sea, particularly in the transit of people, commodities, and services. The terrorist assault on September 11, 2001, commonly referred to as 9/11, resulted in the destruction of the twin towers of the World Trade Centre (WTC) in New York, United States. This event served as the catalyst for the adoption of the International Ships and Port Facility Security Code (ISPS Code) across all port facilities. It is desired that acts of terrorism, narcotics smuggling, illegal drug trafficking, piracy, and theft do not take place. The objective of this study is to examine the execution of security system policies, the compliance of port facility facilities and infrastructure, and the necessary measures to regulate and meet these facilities and infrastructure. The ultimate goal is to reduce and prevent potential security risks to port facilities. Several member countries of the International Maritime Organisation (IMO) are driven to amend the international convention, commonly referred to as the International Ship and Port Facility Security Code (ISPS Code), or the International Code pertaining to the security of ships and port facilities, with the aim of guaranteeing the safety of ships and port facilities.

Abstract

The legal protection for victims of sexual violence has been addressed in statutory regulations, but its implementation remains inadequate. This is evident in the lack of competence and training among law enforcers in handling victims of sexual violence, as well as the absence of psychologists/psychiatrists who can provide assistance in explaining mental conditions. The objective of this study is to examine the legal safeguards available to victims of sexual assault crimes and evaluate the compensation options provided to these victims. This study was conducted utilizing a normative juridical research methodology, which specifically involves analyzing the implementation of legal laws or norms. This research employs both a statutory approach and a conceptual approach. The government has not adequately fulfilled its responsibilities in providing the necessary facilities and equipment to handle, protect, and support victims of sexual abuse. Statutory regulations have established compensation in the form of restitution, but the victim must still take initiative by submitting a request to secure the right to reparation. Restitution should be mandatory for the perpetrator/defendant to compensate the victim, irrespective of whether the victim initiates a request or not.

Abstract

The resolution of corruption offenses related to connectivity, following the issuance of Constitutional Court Decision Number: 88/PUU-XXI/2023, requires careful scrutiny due to significant changes in case management mechanisms. Previously, the Corruption Eradication Commission (KPK) lacked jurisdiction over connectivity-related corruption cases; however, this ruling has granted it the authority to handle such matters. This research adopts a normative legal approach, utilizing both legislative and conceptual frameworks to examine the issue. Despite the ruling, the handling of connectivity-related offenses—including investigation, prosecution, and adjudication—remains misaligned with existing Indonesian legal frameworks. Currently, case management in this domain involves the Ministry of Defense, the Attorney General's Office, and the Headquarters of the Indonesian National Armed Forces through a permanent connectivity team. This team was established under the Joint Decision of the Minister of Defense Number: 2196/M/XII/2021, the Attorney General Number: 270 of 2021, and the Indonesian National Armed Forces Commander Number: Kep/1135/XII/2021, dated December 7, 2021. However, this decision does not yet integrate the Corruption Eradication Commission (KPK) or the National Police (Indonesian Police). As a result, if the KPK or the Police handle connectivity-related corruption cases, they must be processed separately (splitting), potentially leading to inconsistencies, inefficiencies, and accountability gaps in law enforcement. Such fragmentation could damage public trust in the justice system and negatively impact the reputation of the Indonesian National Armed Forces. If left unaddressed, these inefficiencies may lead to substantial financial losses for the state. The ruling introduces a shift in operational frameworks, emphasizing a collaborative decision-making process involving all relevant institutions, with careful consideration of military concerns.
