Abstract

There are still cases of hospital accreditation manipulation, highlighting the importance of the existence of independent institutions as assessors of government hospital accreditation. Therefore, two research questions arise: the regulation of independent institutions as assessors of government hospital accreditation and the administrative legal accountability of independent institutions as assessors of government hospital accreditation. This study is a normative legal research employing several approaches, including legislative approach, conceptual approach, and comparative approach. The results show that the authorization given to independent institutions in accrediting hospitals is regulated by Law Number 17 of 2023 concerning Health, aiming to create consistency, harmony, systematicity, and synchronicity in efforts to improve the quality of health services. These provisions are reinforced by regulations such as the Hospital Law, Minister of Health Regulation Number 12 of 2020, and Minister of Health Decree Number HK.01.07/MENKES/406/2020 jo. Minister of Health Decree Number HK.01.07/MENKES/6604/2021, and Minister of Health Decree Number HK.01.07/MENKES/1128/2022, demonstrating the accountability, consistency, and systematic nature of the legal basis needed. The administrative legal accountability of independent institutions as assessors of government hospital accreditation has administrative legal consequences, namely the revocation of the Minister of Health's decree that approves their status as hospital accreditation providers.

Abstract

The legal protection for victims of sexual violence has been addressed in statutory regulations, but its implementation remains inadequate. This is evident in the lack of competence and training among law enforcers in handling victims of sexual violence, as well as the absence of psychologists/psychiatrists who can provide assistance in explaining mental conditions. The objective of this study is to examine the legal safeguards available to victims of sexual assault crimes and evaluate the compensation options provided to these victims. This study was conducted utilizing a normative juridical research methodology, which specifically involves analyzing the implementation of legal laws or norms. This research employs both a statutory approach and a conceptual approach. The government has not adequately fulfilled its responsibilities in providing the necessary facilities and equipment to handle, protect, and support victims of sexual abuse. Statutory regulations have established compensation in the form of restitution, but the victim must still take initiative by submitting a request to secure the right to reparation. Restitution should be mandatory for the perpetrator/defendant to compensate the victim, irrespective of whether the victim initiates a request or not.

Abstract

Citizens' rights to Social Security are realized by the Government through the National Health Insurance Program (JKN Program) with the principles of Social Insurance. The JKN Program is an initiation to achieve Universal Health Coverage (UHC), which is one of the objectives of the Sustainable Development Goals (SDGs). The government has the authority and responsibility for administering the JKN Program, particularly in terms of participation and financing. This research aims to analyze the Government's authority and responsibility within the JKN Program to achieve UHC. The research is Normative Juridical, using a Juridical approach based on statutory regulations. It concludes that the Government's authority in the JKN Program is legally attributed to the National Social Security Council and the Social Security Administering Body. Concerning the Government's responsibility in the JKN to achieve UHC, the Government must prioritize participation and financing to ensure effective implementation as a part of its obligation to its citizens. BPJS, as a Legal Entity organizing the JKN Program, has Sole Authority and must involve Independent Government Institutions for aspects like service, promotion, and supervision.

Abstract

The right to live with an adequate standard for the health and well-being of oneself and one's family is a human right recognized by all countries worldwide. Therefore, the state has a responsibility to provide proper healthcare to improve public health and the well-being of its citizens, where the implementation of social security is a prerequisite for a welfare state. Based on these circumstances, the following issues are formulated: 1) The regulation of the national health insurance system in Indonesia and the Republic of China; 2) The responsibilities of both countries in providing health protection through national health insurance. Objective to analyze the regulation of each national health insurance system in the Republic of China and Indonesia and analyze the legal efforts made by each country to protect its citizens to obtain welfare in terms of health insurance. This study is normative juridical research with a legislative approach, a conceptual approach, and a comparative approach. We employ a documentary study as a data collection method, involving primary, secondary, and tertiary sources related to the topic. Legal material analysis is conducted using a qualitative approach to address the research problems. This method produces descriptive-analytical data in the form of written, verbal, or actual behavior. The secondary data obtained through the documentary study will be analyzed concerning the applicable laws in both countries and compared accordingly. The findings of this thesis indicate that there are similarities and differences in the regulation of national health insurance in the two countries, particularly in terms of history, insurance providers, participation, covered services, and financing. Indonesia has fulfilled its constitutional obligation as stipulated in the 1945 Constitution and Law No. 40 of 2004 on the National Social Security System, which mandates the implementation of the Indonesian National Health Insurance to provide healthcare services for every citizen. Meanwhile, in the Republic of China (Taiwan), the National Health Insurance fulfills the constitutional obligations set forth in the Constitution of the Republic of China. The national health insurance systems in Taiwan and Indonesia have different approaches. Taiwan implements a centralized National Health Insurance, managed by the NHIA, with funding from individual contributions, employers, and government subsidies. In Indonesia, the National Health Insurance is managed by the Health Social Security Agency (Badan Penyelenggara Jaminan Sosial Kesehatan) under the Social Security Agency Act, despite facing accessibility and efficiency challenges. Both countries protect the health rights of their citizens through their respective legal bases. Taiwan relies on the Constitution of the Republic of China and National Health Insurance regulations, while Indonesia uses the 1945 Constitution and related regulations. To improve transparency, funding, and service quality, Indonesia can study Taiwan's National Health Insurance system and strengthen policy evaluation and public education.

Abstract

Problems for infertile couples are currently being answered with the advancement of Assisted Reproductive Technology (ART) which is experiencing a leap of innovation in medical science for handling infertility problems and reproductive challenges. assisted reproduction in Indonesia. This research is normative legal research with statutory, conceptual and comparative approaches. This research also highlights the role of health institutions, practitioners and policy makers in ensuring equitable provision of ART services while respecting cultural and religious values. The research results show that although Indonesia has basic regulations, further improvements are needed to adapt to advances in ART technology and community needs. The lack of harmonization of regulations between countries has led to legal uncertainty regarding the status of children resulting from assisted reproduction, especially in cross-country cases.

Abstract

This research discusses the current determination of Archipelagic Sea Lanes determined by the Indonesian government which is able to provide legal certainty for foreign-flagged ships crossing Indonesian waters. The problem that arises with the determination is whether they do not create vulnerabilities that have the potential to harm the national interests of the Indonesian people. This research is normative legal research with a conceptual and statutory approach. The research results show that the Indonesian government has established archipelagic sea lanes so that it can provide legal certainty for foreign ships crossing Indonesian waters. This determination is a mandate from the ratification of the 1982 international maritime law convention. However, this determination still creates vulnerabilities that have the potential to harm the national interests of the Indonesian people. The cause of this vulnerability is because the norms contained in the regulations regarding archipelagic sea lanes does not contain sanctions norms so that legal violations often occur in the archipelagic sea lanes area. The need for more significant sanctions is due to the fact that archipelagic sea lanes have specificities compared to other maritime zones.

Abstract

This research discusses the issue of forming a Joint Decree of the Minister of Defense, Attorney General and Commander of the Indonesian National Army, whether it is in accordance with the provisions of the laws in force in Indonesia. This research falls into the category of normative legal research with a statutory and conceptual approach. The results of the research found that the Minister of Defense, the Attorney General and the Commander-in-Chief have the authority to form a Permanent Team for Investigating Criminal Crimes, but its formation does not involve elements of the Indonesian National Police as investigators of general crimes and certain Civil Servant Investigators as investigators of certain crimes (including Commission investigators). Eradication of Corruption) does not comply with the mechanisms regulated in the Criminal Procedure Code and the Military Justice Law. Conditions like this have the implication of not being able to carry out investigations into general crimes and specific crimes related to connection cases, except for corruption crimes. The issuance of the Joint Ministerial Decree has the implication of creating a statutory law in the process of investigating general crimes in connection cases. In order to fill this statutory law, law enforcers carry out legal smuggling by carrying out a separation process, resulting in the potential for inequality before the law.

Abstract

The resolution of corruption offenses related to connectivity, following the issuance of Constitutional Court Decision Number: 88/PUU-XXI/2023, requires careful scrutiny due to significant changes in case management mechanisms. Previously, the Corruption Eradication Commission (KPK) lacked jurisdiction over connectivity-related corruption cases; however, this ruling has granted it the authority to handle such matters. This research adopts a normative legal approach, utilizing both legislative and conceptual frameworks to examine the issue. Despite the ruling, the handling of connectivity-related offenses—including investigation, prosecution, and adjudication—remains misaligned with existing Indonesian legal frameworks. Currently, case management in this domain involves the Ministry of Defense, the Attorney General's Office, and the Headquarters of the Indonesian National Armed Forces through a permanent connectivity team. This team was established under the Joint Decision of the Minister of Defense Number: 2196/M/XII/2021, the Attorney General Number: 270 of 2021, and the Indonesian National Armed Forces Commander Number: Kep/1135/XII/2021, dated December 7, 2021. However, this decision does not yet integrate the Corruption Eradication Commission (KPK) or the National Police (Indonesian Police). As a result, if the KPK or the Police handle connectivity-related corruption cases, they must be processed separately (splitting), potentially leading to inconsistencies, inefficiencies, and accountability gaps in law enforcement. Such fragmentation could damage public trust in the justice system and negatively impact the reputation of the Indonesian National Armed Forces. If left unaddressed, these inefficiencies may lead to substantial financial losses for the state. The ruling introduces a shift in operational frameworks, emphasizing a collaborative decision-making process involving all relevant institutions, with careful consideration of military concerns.

Abstract

Dalam praktiknya, proses pemasangan implan gigi merupakan bagian yang tidak terpisahkan dari praktik profesional dokter gigi. Namun demikian, dokter gigi juga perlu memperhatikan pedoman yang digunakan dalam pemasangan implan gigi. Selain pedoman yang bersumber dari aspek medis, perhatian terhadap pedoman dari aspek hukum juga sangat diperlukan agar dokter gigi dapat terhindar dari sanksi yang berpotensi menjeratnya dalam tindakan pemasangan implan gigi. Penelitian ini mengkaji secara yuridis normatif mengenai pemasangan implan gigi di Indonesia, dengan harapan dapat memberikan pemahaman yang lebih komprehensif kepada dokter gigi mengenai pengaturan regulasi yang berlaku, sehingga dokter gigi memperoleh perlindungan hukum. Hasil penelitian menunjukkan bahwa terdapat dua norma yang mengatur pemasangan implan gigi, baik bagi dokter gigi nonspesialis maupun dokter gigi spesialis. Pengaturan tersebut tercantum dalam Peraturan Konsil Kedokteran Indonesia Nomor 48/KKI/PER/XII/2010 tentang Kewenangan Tambahan Dokter dan Dokter Gigi, serta Keputusan yang dikeluarkan oleh Organisasi Profesi Persatuan Dokter Gigi Indonesia (PDGI) mengenai Kegiatan Ilmiah Terstruktur (KIT). Selain itu, dalam praktik pemasangan implan gigi, dokter gigi berpotensi menghadapi sengketa medis yang dapat berujung pada proses litigasi, baik pidana maupun perdata, serta dapat pula diselesaikan melalui mekanisme penyelesaian sengketa nonlitigasi.

Abstract

Penelitian ini membahas tentang regulasi penggunaan drone bawah laut di wilayah Indonesia, apakah sesuai dengan hukum maritim internasional dan tidak merugikan kepentingan dan kedaulatan nasional, serta bagaimana hukum Indonesia ditegakkan. Jenis penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan legislatif dan konseptual. Penelitian ini menemukan bahwa Hukum Laut Internasional (UNCLOS) 1982 telah diratifikasi oleh Pemerintah Indonesia melalui Undang-Undang Nomor 17 Tahun 1985 yang telah diintegrasikan ke dalam hukum nasional. Pemerintah Indonesia telah menetapkan laut teritorial, Kawasan Ekonomi Eksklusif, dan hak negara untuk mengeksplorasi dan mengeksploitasi sumber daya alam, kewajiban negara dalam mengatur kegiatan maritim, dan hak lintasan yang dapat dilalui oleh kapal asing, tetapi belum secara eksplisit mengatur penggunaan Unmanned Underwater Vehicles (UUV). Hal ini menciptakan celah hukum bagi teknologi maritim yang semakin canggih untuk memasuki yurisdiksi Indonesia tanpa diperiksa oleh negara asing, yang menyebabkan beberapa UUV ditemukan di perairan Indonesia. UUV beroperasi secara diam-diam di bawah air dan tidak mengidentifikasi negara bendera, menghadirkan tantangan bagi pemerintah dalam menjatuhkan sanksi terhadap negara bendera. Oleh karena itu, kebijakan mengenai penggunaan UUV harus didasarkan pada hukum internasional yang mengikat dan hukum internasional adat.
