Abstract

Islam exists in order to uphold justice. Likewise with families, where there are often unfair relationships between husband and wife, there are so many obstacles which can threaten the harmony of marriage. So far the issue of nusyūz is often connected to the wife and the Compilation of Islamic Law (KHI) confirms this. How Islamic law regulates nusyūz and how the perspective of qira'ah mubādalah about this nusyūz is are the main questions of this study. This study uses normative legal research method with descriptive technique. Data collection was carried out by literary study and then they were analyzed qualitatively by the deductive method. The results of this study are as follow: Nusyūz according to Islamic law (KHI) is conceptualized as a wife's disobedience to her husband, such as reluctance to have intercourse, surly in front of her husband, leaving the house without the husband's permission and others which make the husband dislike. If nusyūz occurs then it is resolved by: giving advice, separating beds, and hitting. Mubādalah as a method of interpretation of texts which is reciprocal, in terms of family relations between husband and wife, defines nusyūz as disobedience to household commitments so it applies to husband and wife. Nusyūz settlement by beating is considered as an act of violence so it should not be done. Inviting reconciliation to return to commitment is the best way according to QS. An Nisa': 128.

Abstract

Tujuan penulisan artikel untuk mengulas pendapat Nahdlatul Ulama (NU) tentang pidana mati bagi pelaku korupsi. Pada Musyawarah Nasional (Mubes) dan Konferensi Besar (Konbes) tahun 2012, para ahli hukum NU mencapai kesepakatan tentang kebolehan pelaku korupsi dijatuhi hukuman mati. Perbuatan korupsi tidak dikategorisasi sebagai hudud maupun kisas, melainkan takzir. Pendapat hukum tentang pidana mati diperbolehkan jika itu hukuman terakhir dan sesuai prinsip-prinsip kemaslahatan. Artikel ditulis dengan pendekatan deskriptif kualitatif. Data utama adalah dokumen fatwa hasil sidang Mubes dan Konbes NU tahun 2012. Data dilakukan pengolahan, kompilasi dengan data pendukung lain, serta dilakukan analisis. Hasil penelitian menunjukkan bahwa argumen-argumen ideologis tentang kebolehan pidana mati bagi pelaku korupsi melalui jalan takzir. Pidana mati yang dijatuhkan kepada pelaku korupsi diilhaqkan dengan hukum hirabah. NU berpendapat bahwa pidana mati diharapkan menjadi efek jera bagi siapa saja yang melakukan praktik korupsi. Fatwa ini setidaknya menunjukkan bahwa NU berani mengambil resiko dengan mencari dasar-dasar argumentasi hukum agama terkait hukuman maksimal, serta mendorong aparat pemerintah berani menjatuhkan hukuman yang berat bagi pelaku korupsi. Abstract The purpose of writing an article is to review the opinion of the Nahdlatul Ulama (NU) regarding the death penalty for corruption perpetrators. At the 2012 National Deliberation (Mubes) and Grand Conference (Konbes), NU legal experts reached an agreement on allowing corruption offenders to be sentenced to death. Corruption is not categorized as hudud or kisas, but takzir. The legal opinion regarding the death penalty is permissible if it is the final sentence and is in accordance with the principles of maslahat. Articles written with a qualitative descriptive approach. The main data is the fatwa document from the 2012 meeting of the Mubes and Konbes NU. The data is processed, compiled with other supporting data, and analysis is carried out. The result of the research shows that ideological arguments about the permissibility of capital punishment for corruptors take the takzir way. The death penalty imposed on the perpetrators corruption is related to the law of hirabah. NU is of the opinion that the death penalty is expected to be a deterrent effect for anyone who practices corruption. This fatwa at least shows that NU is brave enough to take risks by looking for the basis of religious law arguments regarding the maximum punishment, and encourages government officials to have the courage to impose harsh penalties for corruption perpetrators. Abstract

ABSTRACT The pesantren’s potential includes economic assets, religious teachings and ties between Kiai, santri, santri families, alumni, and the surrounding community to be important social capital in economic activities. This economic potential was realized by the Maslakul Huda Kajen Pati Islamic Boarding School, giving birth to several business units under the auspices of Islamic Boarding Schools. Then the pesantren business unit management is deemed necessary to be applied in order to create a pesantren sustainability. The study uses qualitative research method (qualitative research). The object of this study is BUMP Maslakul Huda with several business units, those are: BPRS Artha Mas Abadi, BPR Artha Huda Abadi, CV Mabadi Sejahtera and Agribusiness. The implementation of management functions at BUMP Maslakul Huda is planning, organizing, actuating and controlling, have gone well. With the implementation of management in BUMP and business units, what is produced is: the mechanism of the organization is running well, identifying problems and finding solutions and strategies to minimize failure and maximize the success of the program. Thus, the steps taken by BUMP and business units will encourage the economic independence of pesantren.

Abstract

Abstract This paper discusses one of the phenomena that erupted Post-Reformation is a desire to make rules in areas removed from the spirit of Islamic law. Appearing later legislation on dressmaking, ask for compensation as well curfew for women. Understanding Islamic Sharia in the context of a plural society like Indonesia is a research question asked in this paper. In conclusion, the substance of the Shari'a must first be made as reference material from the formalist Shari'a. Keywords: Islamic Sharia, Islamization, State Abstrak Tulisan ini membahas salah satu fenomena yang merebak Pasca Reformasi yakni keinginan untuk membuat peraturan di daerah yang disarikan dari semangat hukum Islam. Muncul kemudian legislasi tentang tata busana, kewajiban moral serta pembatasan jam malam bagi perempuan. Memahami Syariat Islam dalam konteks masyarakat yang plural seperti Indonesia adalah pertanyaan penelitian yang hendak dibahas dalam tulisan ini. Abstract

The purpose of this study is to explore the essence, substance and benefits of the DSN-MUI fatwa no.  106 of  2016 concerning waqf insurance benefits and investment benefits in Sharia Life insurance.  This is a library research with primary law, DSN-MUI fatwa no. 106 of  2016. A philosophical approach was chosen in this study to describe the ontology, epistemology and axiology aspects of the fatwa.  The results of this study indicate that the essence of the fatwa is to accommodate legal needs in the synergy of waqf and sharia insurance in order to maximize the benefits of waqf and sharia insurance for the wider community.

Abstract

This paper focuses on the role of Walisongo in addressing religious radicalism in Indonesia. Religious radicalism has emerged due to excessive internet consumption in today’s technologically advanced world. Consequently, it necessitates serious efforts to tackle this issue, including exploring local knowledge to counteract religious radicalism behaviors. This qualitative study adopts a library research approach, incorporating diverse sources to explore theories and knowledge related to these phenomena. This study found the importance of implementing strategies that promote wise behavior and nonviolent approaches in reducing religious radicalism. These efforts primarily involve initiating a change in people’s mindset toward Islam. The success of the strategy to reduce the level of radicalism can be carried out through regional management (geographical considerations), arts management or cultural engagement, health management (medical aspects), fostering noble behavior (akhlāq al-karīmah), marriage alliances, and deepening religious knowledge.

Abstract

This article discusses the issue of disparity in sanctions arising from the issuance of the Regulation of the Minister of Home Affairs of the Republic of Indonesia on Name Registration in Population Documents. A case in Tuban highlights a child who was unable to obtain a birth certificate because the name was too long to be entered into the Population and Civil Registration Office system. The regulation imposes restrictions on naming children, requiring a minimum of two words and no more than sixty characters. Non-compliance with this regulation can result in the non-issuance of a birth certificate, potentially rendering the child stateless. This situation contradicts UDHR Article 15, ICCPR Article 24, CRC Articles 7-8, and the 1945 Constitution Article 26 (1) on citizenship. The purpose of this study is to highlight the imbalance between regulatory rules and sanctions, demonstrating how lower-level regulations can violate higher-level rules. This research employs a qualitative, literature-based, and normative-doctrinal approach. Secondary data sources include Permendagri No. 73/2022, the Population Administration Law, the 1945 Constitution, and international regulations related to population and citizenship. The findings indicate that birth certificates reflect the state's responsibility to provide citizens with rights, including the right to identity. However, the sanction of not issuing a birth certificate due to regulatory non-compliance creates a disproportionate disparity in naming rights. Therefore, policy revision is necessary to optimize legal protection, making the system more equitable and in line with legal norms.

Abstract

This article investigates the evolution of guardianship in Islamic discourse, focusing on the tension between its traditional rigidity and emerging flexibility. Conventional interpretations, often shaped by patriarchal readings of Quranic texts, have historically assigned guardianship exclusively to men. However, contemporary legal and contextual approaches increasingly recognize women’s eligibility as guardians. Using a qualitative method based on a systematic literature review, this study examines primary Quranic sources alongside family law reforms in selected Muslim-majority countries. The findings reveal a paradigmatic shift from male-centered authority to a child-centered model that prioritizes the best interests of the child. The article also clarifies the conceptual distinction between guardianship –pertaining to legal and financial responsibilities- and custody, which addresses emotional and physical support. This shift reflects broader movements to ward egalitarian interpretations and universal child welfare principles within the religious culture frameworks.
