Abstract

The focus of the research is the authority of Bawaslu in dealing with election violations after the determination of election results nationally according to Law Number 7 of 2017 concerning General Elections and how the fiqh dusturiyah fiqh review of the authority possessed by Bawaslu. This research is normative legal research. Based on the results of the research, it can be explained that Bawaslu in dealing with election violations after the determination of election results nationally in its implementation raises a separate problem because Bawaslu is very likely to issue decisions that can have implications for changes in the results of the votes acquired by election participants if the handling of violations is carried out after the determination of national election results. The practice of implementing Bawaslu's authority in dealing with violations that have an impact on the results of the vote acquisition after the determination of the national election results conflicts with the authority of the Constitutional Court so that it allows for overlapping of the authority of Bawaslu in following up on alleged election violations with the authority held by the Constitutional Court to resolve disputes over General Election Results Disputes (PHPU). The fiqh siyasa dusturiyah review of the authority of Bawaslu is not by the values in the Qur'an and fiqh siyasa dusturiyah related to the study of al-hisbah as an institution authorized to carry out supervision aimed at realizing amar ma'ruf nahi munkar which in principle is to bring benefits and reject mafsadat.

Abstract

Abstract: The main issue discussed in this thesis is the ongoing occurrence of illegal racing in Bukittinggi, which contradicts the Bukittinggi Regional Regulation No. 3 of 2015 on Public Order and Tranquility, specifically Article 10, letter a, which prohibits any individual from engaging in racing, speeding, or standing on the road without permission. The purpose of this research is to examine the form of law enforcement by the Civil Service Police Unit (Satpol PP) in addressing illegal racing in Bukittinggi and to analyze the perspective of *Siyasah Dusturiyah* on the authority of Satpol PP in enforcing Bukittinggi Regional Regulation No. 3 of 2015. This research is field research with a descriptive qualitative approach. Primary data sources include Civil Servant Investigators (PPNS) from the Bukittinggi Satpol PP and individuals involved in illegal racing activities. Secondary data sources include the local community around the illegal racing locations. The findings of this study show that Satpol PP’s efforts to combat illegal racing in Bukittinggi are in two forms. First, the pre-emptive law enforcement focuses on prevention through education and outreach activities conducted directly to the public and through media. Second, preventive law enforcement is aimed at preventing legal violations or criminal acts before they occur, such as conducting routine patrols in areas prone to illegal racing and collaborating with related institutions like the Police and the Department of Transportation. Viewed from the Siyasah Dusturiyah perspective, the authority of Satpol PP is relevant to the concept of Wilayatul Hisbah and Ulil Amri. Wilayatul Hisbah emphasizes the task of supervision and enforcement of goodness (amar ma'ruf) and the prevention of wrongdoing (nahi munkar). The enforcement of illegal racing regulations is a form of nahi munkar carried out by Satpol PP to ensure that public behavior remains within safe and lawful boundaries. This action by Satpol PP is in line with the principle of Ulil Amri, which stresses the importance of legitimate authority in maintaining public welfare and safety.

Abstract

The goal of this paper is to demonstrate how corruption is being prevented, starting with the smallest component, the Pusar village administration. Contributing with a community-based research strategy is one way that empowered people can express their concern about national concerns where crime statistics show that corruption, including grant fraud, has increased from 2004 to 2022 and that a solution to eliminate it is therefore being examined. The community must be involved in the prevention and elimination of corruption offenses; it cannot be left to components of the integrated criminal justice system alone. Therefore, the empower thinks that by engaging in this mentoring activity, the central village government would better comprehend and be able to prevent the crime of satisfaction. Tulisan ini bertujuan untuk menunjukkan bagaimana pencegahan korupsi dimulai dari komponen terkecil yaitu Pemerintah Desa Pusar. Berkontribusi dengan strategi penelitian berbasis komunitas adalah salah satu cara yang dapat dilakukan oleh orang-orang yang diberdayakan untuk mengungkapkan keprihatinan mereka tentang keprihatinan nasional dimana statistik kejahatan menunjukkan bahwa korupsi, termasuk penipuan hibah, telah meningkat dari tahun 2004 hingga 2022 dan oleh karena itu solusi untuk menghilangkannya sedang diperiksa. Masyarakat harus dilibatkan dalam pencegahan dan pemberantasan tindak pidana korupsi; tidak dapat diserahkan kepada komponen sistem peradilan pidana terpadu saja. Oleh karena itu, Pemberdaya berpendapat bahwa dengan mengikuti kegiatan pendampingan ini, pemerintah pusat desa akan lebih memahami dan mampu mencegah terjadinya kejahatan untuk memenuhi kepuasan hati itu.

Abstract

This paper aims to find out the implementation of sharia economic law in a multicultural society in Indonesia with its principles. The writing uses the library research method (literature study). The results obtained are that multiculturalism appreciates cultural, ethnic, and religious diversity as assets that enrich society, but brings challenges such as social tensions, economic integration, and inclusive policies. With intercultural dialog, multicultural education, and fair policies, society can overcome these challenges to create harmony and equality for all. Islamic economic principles prioritize justice in wealth distribution and transparency in trading activities, as exemplified by the Prophet Muhammad. Its modern implementation, such as in sharia-based financial institutions, supports multicultural communities through inclusive financing and is based on the values of honesty and trustworthiness.

Abstract

This article was the result of community service in Nagari Tuo Pariangan, Pariangan District, Tanah DatarRegency related to technical assistance in the drafting of the Nagari regulations. The Nagari Regulations are the statutedrafted by the village level legislature (BPRN/BAMUS) and Wali Nagari. Therefore, Nagari Regulations usually haveto be made in accordance with the provisions of laws and regulations. In order to be able to create good NagariRegulation, those who create nagari regulations must have to a holistic and comprehensive understanding of theprocedures for designing nagari regulations since planning untill clarification. The difference from other articles waswrited of this article endowed with a method of devotion participatory action research (PAR) and a shift in legislativefunction at the Nagari level to go to a traditional village.

Abstract

In order to advance knowledge, higher education has a duty to educate all facets of society, including the local population. Additionally, as advancing general welfare is a duty of higher education, these efforts can be carried out through fulfilling duties related to the tri-dharma of higher education, all of which are interconnected and cannot be separated from one another. One of these dharmas is community service, which is why LP2M UIN Mahmud Yunus followed this approach when performing research-based service. Prior study must be done to ensure that the service is modeled, structured, and evaluated in accordance with the needs of the aided community.

Abstract

The criminal justice system, which was previously focused on the criminal aspect or retributive perspective, is now confronted with the reality that there are only a few legal structures, ranging from judges, prosecutors, and police to a small number of prison institutions that serve as execution venues. The author is concerned with this legal fact, so he uses primary data sources and sociological juridical studies to try and find a remedy. According to the author's findings, to prevent the issues mentioned above, criminal cases in Minangkabau can be resolved through the Nagari Traditional Meeting Institution using the restorative justice idea, which aims to repair the social discord caused by criminal acts. When applying restorative justice, the Nagari Customary Association makes use of the relevant legal source of the Nan Salapan Law, while the formal legal procedures can use the Nan Duo Puluah Law.
