Abstract

This research aims to analyze the application of the "in dubio pro natura" principle in Indonesia. This principle translates as "in doubt, for nature" and emphasizes the importance of protecting nature and the environment in making legal decisions. This scientific research uses one of the parts of the grand method, namely Library Research which is based on literature or literature. The author uses several references as legal materials to analyze the object of writing. The results show that the application of the principle of "in dubio pro natura" is the foundation of the application of the concept of the precautionary principle that has entered the Indonesian legal order since the enactment of Law Number 32 of 2009, this principle is in line with the principles of environmental equity, bio diversity and polluter pays principle. In addition, this principle in Indonesia still faces challenges in its application. Several factors affecting the application of this principle in Indonesia include inconsistent government policies in environmental protection, lack of public understanding and awareness of the importance of nature conservation, and shortage of human and technical resources in environmental law enforcement.

Abstract

The implementation of the Bilateral Investment Treaty in Indonesia with foreign investors must still pay attention to the existence of Indonesian state sovereignty. State sovereignty must be maintained by the host state to maintain the existence of the country in the international world. BIT has the main function as an international legal instrument that is useful in foreign investment activities with reciprocal relations in obtaining benefits between the guarantee of legal protection of the home state of foreign investors and the economic growth of the host state. BIT signatories are theoretically balanced and reciprocal, but they are often detrimental to host states, most of which come from developing countries. This research aims to find out the extent of Indonesia's implementation of BIT and still protect the existence of state sovereignty. The method used in this research uses normative and comparative juridical and this research has an analytical descriptive nature. Normative legal research is obtained by studying the Churchill Mining case approach and collecting data from articles, web, books, and websites and then comparing the implementation of BITs in Indonesia as a developing country and the United States as a developed country and comparing the implementation of BITs in fellow developing countries between Indonesia and Brazil. The first victory achieved by Indonesia against Churchill Mining in the resolution of the international investment dispute at the ICSID forum proved the BIT reform in Indonesia that continues to develop. This study showed that: first, The Bilateral Investment Agreement provides legal protection guarantees for foreign investors and settlement of settlement disputes through ICSID, an international investment settlement arbitration agency between the two countries that signed the BIT so that the BIT is a protection guarantee for investors. Second, Indonesia's victory against Churchill Mining proves that it has reformed the BIT that applies to Indonesia in a balanced manner to provide legal protection (host state) and the existence of state sovereignty (home state).

Abstract

Jumlah UMKM di Kabupaten Temanggung yaitu sebanyak 24.000. Batursari saat ini memiliki jumlah UMKM yang tergolong cukup banyak. Bidang usaha yang ditekuni kebanyakan masyarakat yaitu pedagang sembako dan makanan. Keberadaan para pelaku UMKM selain membuat lingkungan sekitarnya terlihat ramai, juga mampu meningkatkan perekonomian dan kondisi finansial desa. Permasalahan masih banyak para pelaku UMKM di wilayah Batursari, Kabupaten Temanggung yang belum mengetahui dan memahami tentang pentingnya penghapusan jaminan fidusia ketika utang telah lunas. Kegiatan ini bertujuan meningkatkan pemahaman penghapusan jaminan fidusia kepada para pelaku usaha UMKM dalam rangka memberikan kepastian hukum. Metode pengabdian yang digunakan adalah edukasi, workshop dan pendampingan. Edukasi mencakupi tata cara poses penghapusana jaminan fidusia secara online serta memberikan gambaran biaya yang perlu dikeluarkan dalam pengurusannya. Workshop digunakan untuk melakukan analisis permasalahan riil dan menyusun langkah-langkah penyelesaiannya. Pendampingan dilakukan untuk memastikan langkah-langkah penyelesaian berjalan sesuai rencana.

Abstract

Redistribusi tanah bekas HGU merupakan bagian dari reforma agraria untuk menciptakan keadilan dalam penguasaan dan pemilikan tanah. Penelitian ini memiliki tujuan guna menganalisis implementasi redistribusi tanah eks-HGU dalam kerangka reforma agraria di Jawa Tengah serta mengevaluasi bentuk perlindungan hukum yang diberikan kepada petani sebagai penerima tanah. Fokus utama diarahkan pada dua wilayah studi, yakni eks-HGU PT Sinar Kartasura di Kabupaten Semarang dan eks-HGU PT Perkebunan Tratak di Kabupaten Batang. Penelitian ini menganalisis implementasi redistribusi tanah eks-HGU di Jawa Tengah serta mengevaluasi perlindungan hukum bagi petani penerima, dengan studi kasus. Menggunakan pendekatan yuridis empiris, data dikumpulkan melalui studi kepustakaan, analisis dokumen hukum, dan wawancara. Hasil menunjukkan kemajuan administratif seperti distribusi sertifikat dan penetapan subjek penerima, namun masih terdapat kendala berupa lemahnya koordinasi, validasi data yang belum optimal, ketiadaan pengawasan pascaredistribusi, dan belum adanya mekanisme penyelesaian sengketa yang efektif. Perlindungan hukum terhadap petani belum optimal, sehingga diperlukan penguatan regulasi, pengawasan, dan harmonisasi kelembagaan guna mencapai keadilan agraria yang berkelanjutan.

Abstract

Prinsip kepastian hukum menjadi fondasi dalam UUPA, yang menekankan bahwa pendaftaran tanah merupakan mekanisme formal untuk memberikan perlindungan dan kepastian hukum kepada pemilik tanah yang sah. Namun, implementasi prinsip ini masih menghadapi tantangan signifikan, terutama terkait dengan dokumen lama seperti Letter C yang masih banyak digunakan sebagai bukti kepemilikan tanah oleh masyarakat. Penelitian ini bertujuan untuk menganalisis kepastian hukum bagi pemegang Letter C sebagai alat bukti kepemilikan tanah dalam perspektif Peraturan Pemerintah Nomor 18 Tahun 2021 dan untuk mengidentifikasi kendala yang dihadapi masyarakat dalam proses pendaftaran tanah. Metode penelitian menggunakan pendekatan yuridis normatif melalui studi dokumen serta yuridis empiris dengan wawancara mendalam terhadap pemangku kepentingan di Kelurahan Demaan, Kabupaten Jepara. Hasil penelitian menunjukkan bahwa Letter C masih menjadi alat bukti dominan di masyarakat, namun tidak memberikan kepastian hukum yang memadai karena rentan terhadap sengketa, penyerobotan, dan manipulasi oleh mafia tanah. Implementasi Pasal 96 PP Nomor 18 Tahun 2021, yang mewajibkan pendaftaran tanah dalam jangka waktu lima tahun, menghadapi berbagai kendala dalam faktor administratif, faktor finansial serta faktor sosial dan budaya. Penelitian ini menyimpulkan bahwa Letter C tidak lagi relevan sebagai satu- satunya bukti kepemilikan tanah dalam hukum agraria modern. Oleh karena itu, diperlukan langkah konkret dari pemerintah untuk memfasilitasi pendaftaran tanah guna memberikan kepastian hukum dan perlindungan bagi masyarakat, termasuk penyederhanaan prosedur, bantuan biaya bagi masyarakat miskin, serta sosialisasi yang lebih masif tentang pentingnya sertipikasi tanah.

Abstract

Micro, Small, and Medium Enterprises are business activities that can expand employment and provide extensive economic services to the community. They can also play a role in equalizing and increasing public income, promoting economic growth, and contributing to national stability. In addition, Micro, Small, and Medium Enterprises are one of the main pillars of the national economy that must get the most opportunities, support, protection, and development as a form of firm partiality to the people's economic business groups, without neglecting the role of Large Enterprises and State-Owned Enterprises. In Law No. 11 of 2020 concerning Job Creation, simplification of Business Permissions through Integrated Online Licensing (Online Single Submission). Mergosari Village became the first to produce batik with a typical Wonosobo motif through the Batik Mergosari community named Batik Carica Lestari. The problems partners face include the lack of knowledge and understanding of small- and medium-sized business actors in Mergosari Village regarding the legal aspects of business actors, which still need to be improved. The solution to this problem is to provide education using lectures and seminars with village officials and small and medium enterprises of Mergosari Village, and small and medium enterprises should have a Business Master Number (NIB). The method of service is to provide education through socialization and mentoring practices.

Abstract

Settlement development in the coastal area of Sendangmulyo Village has significant environmental and socioeconomic impacts. This research analyzes the impact of development as well as constraints in the implementation of the Rembang Regency RTRW Regulation 2023-2043 related to coastal boundary protection. A qualitative approach was used with data collection techniques in the form of interviews, observations and document studies. Data analysis was conducted using content analysis. The results showed that settlement development causes damage to coastal ecosystems, such as loss of natural vegetation and increased risk of abrasion and tidal flooding. Socio-economically, this development triggers conflicts between economic interests and environmental preservation, and shows low public awareness of coastal ecosystem protection. In the implementation of the Rembang Regency RTRW regulation 2023-2043, three main obstacles were found: lack of supervision, lack of public awareness, and weak coordination between related parties. This research found that weak inter-agency coordination is a major factor in the ineffectiveness of the coastal boundary protection policy, an aspect that has not been studied much before. Conflicts of economic and environmental interests in Sendangmulyo Village are also more complex compared to other areas due to the lack of community understanding of the applicable regulations. This research contributes to uncovering the specific impacts of residential development on coastal ecosystems after the implementation of the 2023-2043 Regional Spatial Planning Regulation. Protection of riparian areas requires strengthening regulatory oversight, continuous community education, and increased cross-sectoral coordination to optimize the implementation of the Rembang Regency RTRW 2023-2043.

Abstract

This study aims to analyse the application of the principle of prudence in issuing replacement land certificates from both positive and customary law perspectives. It addresses the increasing land conflicts caused by duplicate certificates and administrative negligence in Indonesia’s land administration system. The research contributes a novel dual-legal approach by integrating statutory procedures and indigenous legal norms into a coherent framework to enhance legal certainty. Employing a normative juridical method, the study uses document analysis, statutory interpretation, and interviews with land officials. The primary data sources include Government Regulation No. 24 of 1997 and Decision No. 59/Pdt.G/2022/PN Unr. Findings reveal systemic weaknesses in verification procedures and a lack of institutional coordination, resulting in the fraudulent reissuance of certificates. Additionally, the neglect of adat-based verification undermines social legitimacy in customary regions. This research concludes that the current formal procedures are insufficient to prevent forgery and land conflicts. It recommends regulatory reform and the incorporation of community-based verification mechanisms as part of a precautionary legal standard. The study provides a critical foundation for integrating legal pluralism into national land governance.

Abstract

The development of business and information technology has a significant impact on economic development on the one hand, but also raises various legal issues on the other. One of the problems that often occur in relation to the business world is trademark disputes. Various cases of trademark disputes occur in various regions in Indonesia, ranging from trademark plagiarism, trademark abuse, to trademark counterfeiting both on a small and large scale. Kenteng Village, as one of the areas in Semarang Regency, has high tourism potential. In addition, Kenteng Village is also known as a village producing various handicrafts and small businesses typical of the region, so many brands in the village have not been registered. Whereas with a registered trademark, it has clear legal legality. This service program aims to provide strengthening of village community empowerment in the mechanism for resolving trademark disputes. This program is a community service program with partners Kenteng Village and Kenteng Village MSME Forum, Bandungan District. The outputs of this program are scientific articles, video highlights and mass media publications. In addition, this program is expected to provide a clear scheme in village institutions related to the settlement of trademark disputes.

Abstract

Cartels, or secret deals among competitors to set prices, limit production, or divide markets, pose a significant challenge to healthy competition and market integrity around the world, including in Indonesia. This study examines the use of indirect evidence, such as economic data and communication patterns, in uncovering such covert operations under the Indonesian Competition Law (Law No. 5 of 1999), using the normative juridical approach. The study uses statutory analysis to understand the legal framework, case analysis to explore the use of indirect evidence in law enforcement, and conceptual analysis to enhance theoretical understanding. This study analyzes the decisions of the KPPU and District Courts, KPPU regulations, and relevant legal frameworks to understand the applicability and challenges of using circumstantial evidence in legal proceedings. The results of the study make it clear that, despite its important role, the study identifies legal uncertainty and the need for corroborating evidence as the main obstacles to the effectiveness of indirect evidence. It reveals a significant gap in the acceptance and interpretation of indirect evidence between the KPPU and the judiciary, highlighting the need for clarity and consistency in the law. This review recommends the revision of Law No. 5 of 1999 and related procedural laws to include provisions for the acceptance and utilization of circumstantial evidence, improving the adjudication process of both the KPPU and the courts. This research contributes to Indonesia's understanding of competition law enforcement and promoting fair business practices.
