Abstract

Tujuan dari penulisan penelitian ini untuk mengetahui dan mengkaji peran original intent yang penting dalam mengembalikan maksud dari materi yang termuat dalam suatu peraturan untuk kembali pada para pembuat konstitusi. Studi ini menggunakan metode penelitian hukum normatif yang ketika proses penyelesaiannya data yang diperoleh berasal dari bahan kepustakaan atau disebut dengan data sekunder dengan pendekatan perundang-undangan dan pendekatan konsep. Hasil studi menunjukan bahwa pendekatan original intent mempermudah mengetahui tujuan awal dan niat awal dibentuknya fungsi dari KY sendiri. Sebagai lembaga negara yang cukup muda, Komisi Yudisial diberikan weweang oleh konstitusi untuk menjalankan fungsi pengawasan terhadap para hakim dalam kekuasaan yudikatif. Inilah yang menjadi permasalah muatan materi Undang-undang terhadap UUD yang diajukan oleh para hakim agung dalam lingkup Mahkamah Agung. Sebagai lembaga negara yang menyelesaikan pada tingkat akhir sengketa perundang-undagan terhadap konstitusi, Mahkamah Konstitusi memutuskan makna hakim yang menjadi objek pengawasan terhadap hakim yang merupakan wewenang KY. Dalam ingkrah dari putusan tersebut dapat diketahui ruang lingkup arti dari diksi atau kata hakim yang menjadi wewenag KY. Kata Kunci: Original Intent, Komisi Yudisial, Hakim, Pengawasan. ABSTRACT The purpose of writing this research is to find out and examine the role of original intent which is important in returning the intent of the material contained in a regulation to return to the constitution-makers. This study uses a normative legal research method in which the data obtained comes from literature or what is called secondary data with a statutory approach and a conceptual approach. The results of the study show that the original intent approach makes it easier to know the original purpose and initial intention of establishing the function of KY itself. As a fairly young state institution, the Judicial Commission is empowered by the constitution to carry out the oversight function of judges in judicial powers. This is the problem with the content of the Law on the Constitution submitted by the Supreme Court justices within the scope of the Supreme Court. As a state institution that resolves at the final stage of statutory disputes against the constitution, the Constitutional Court decides the meaning of the judge who is the object of supervision of the judge which is the authority of the KY. In moving away from the decision, the scope of meaning of the diction or the word of the judge who becomes the authority of the Judicial Commission can be identified. Abstract

This article is an interpretation of Article 18B paragraph (2) of the Indonesian constitution: four requirements for recognition of traditional societies. Using sustainable tourism development as a case study, explores the important contribution of genealogical territorial participation and the limits of recognition of the role of the State in providing legal protection and traditional societies as the main coders of legal pluralism. This exploration reveals four different conditions: conditions for survival, dynamic conditions, conditions in accordance with the principle of integration, and regulated by law. The fact that these conditions are so intricately interwoven poses unique challenges for academics and legal practitioners, but also provides a potential blueprint for constitutions and state revenues.

Abstract

The management of the diversity of traditions and culture in each region in the archipelago was born by the plurality of society with the characteristics of the various customary law systems as different from national law which can actually enrich the repertoire of Indonesian national law. The urgency of this article study is that there is a need for an integration of policies for the formation of regulations and management in the field of local wisdom such as customs and traditions found in each region in Indonesia. The problems studied are: first, to examine the policy of developing customs and traditions in the context of legal pluralism and second, to analyze the concept of law as an integrator in the policy of customs and traditions in the context of Indonesian legal pluralism. The results show that first, the development of customs and traditions in the context of legal pluralism so far, state law has been in an ordinate position and local wisdom has been in a subordinate position, while there has been marginalization of customary law community groups in the policy of developing customs and traditions; and second, the concept of law can function as an integrator between the interests of  the sub-system in the policy of developing customs and traditions in the context of legal pluralism in Indonesia.

Abstract

Life imprisonment that was stipulated in article 12 of the penal code gave no clear explanaition about what is meant by life imprisonment and how long it would be. The absence of the clear explanation showed there is happened vagueness norm. so, how about the developing of the regulation of the life imprisonment in Indonesia today, and how it is seen form the correctional system based on act number 12 year 1995regarding with penal law. Article 10 of criminal code that is regulating varius types of criminal is one of which, is about life imprisonment, but there is no explanation, so it causes various interpretation really the purpose of punishment in the penal law is not revenge, but to emphasized to coaching and teaching so that a punishment should have a humanity in it humanity for justice and educational.

Abstract

Tulisan ini berjudul pengaturan minuman beralkohol golongan A bagi pelaku usaha toko modern minimarket. Penghapusan minimarket sebagai pengecer minuman beralkohol menimbulkan ketidakpastian hukum dalam melakukan kegiatan usaha. Tujuan dari penulisan ini, untuk menganalisa adanya konflik norma dalam Peraturan Presiden Nomor 74 Tahun 2013 tentang Pengendalian dan Pengawasan Minuman Beralkohol (Perpres No.74 Th.2013) yang mengijinkan minimarket menjual minuman beralkohol golongan A dengan Peraturan Menteri Perdagangan Nomor 06/M-DAG/PER/1/2015 tentang Perubahan kedua atas Peraturan Menteri Perdagangan Nomor 20/M-DAG/PER/4/2014 tentang Pengendalian dan Pengawasan terhadap Pengadaan, Peredaran, dan Penjualan Minuman Beralkohol (Permendag No.06 Th.2015) yang menghapuskan minimarket sebagai penjual minuman beralkohol golongan A. Metode yang digunakan dalam tulisan ini metode penelitian normatif dengan menganalisa Perpres No.74 Th.2013 dengan Permendag No.06 Th.2015. Sehingga menimbulkan ketidakpastian hukum terhadap penjualan minuman beralkohol golongan A di minimarket. Kesimpulan tulisan ini peraturan menteri tidak boleh bertentangan dengan peraturan presiden, sehingga menimbulkan ketidakpastian hukum terhadap diperbolehkan atau dilarangnya minimarket sebagai penjual minuman beralkohol golongan A.

Abstract

Writing a scientific paper entitled "Execution of Judicial Review In The Credit Agreement With Fiduciary guarantee Not Registered ". The method used in this paper is normative. Issues raised in this paper is the execution of the credit agreement with the fiduciary guarantee in the case of debtor violate agreement and how the legal protection of debitor who the fiduciary object is not registered with fiducial guarantee executed by the creditor. From the research, the creditor can not executes fiduciary object if it has not been registered. Before executing the fiduciary object, the creditor must register a credit agreement with fiduciary insurance or may file a suit to the court that the debtor has violates the agreement.

Abstract

Makalah ini mengangkat judul Eksistensi Komisi Penyiaran Indonesia Sebagai Lembaga Negara Bantu (State Auxiliary Bodies) Dalam Sistem Pemerintahan Indonesia. Dengan permasalahan Bagaimana kemandirian KPI sebagai lembaga negara bantu (state auxiliary bodies) berdasarkan putusan-putusan Mahkamah Konstitusi? Bagaimana peran dan fungsi KPI dalam penegakan hukum berdasarkan UU Penyiaran sebagai lembaga negara bantu (state auxiliary bodies)? Penelitian yang dilakukan kaitannya dengan penulisan skripsi ini termasuk dalam kategori/jenis penelitian normatif, yaitu penelitian hukum kepustakaan atau penelitian hukum yang didasarkan pada data sekunder. Berdasarkan Putusan Mahkamah Konstitusi Nomor 005/PUU-I/2003, tersebut hal dinyatakan oleh MK tidak menyalahi, tidak bertentangan dengan UUD 1945 dan KPI adalah lembaga negara yang bersifat independen.Berkaitan dengan Putusan Mahkamah Konstitusi No. 031/PUU-IV/2006, KPI mempermasalahkan pasal 62 ayat (1) dan ayat (2) UU No. 32 Tahun 2002 ternyata bertentangan dengan pasal 28D ayat (1) UUD 1945. Dalam rangka menjalankan fungsinya KPI memiliki kewenangan menyusun dan mengawasi  berbagai peraturan penyiaran yang menghubungkan antara lembaga penyiaran, pemerintah dan masyarakat.

Abstract

ABSTRAK Penulisan ini bertujuan untuk mengetahui bagaimana perlindungan Hak Asasi Manusia terhadap pihak-pihak yang terlibat dalam praktik surogasi (Suami-Istri, Ibu Pengganti, dan anak yang akan dilahirkan), dan mengetahui kedudukan surogasi dalam hukum positif Indonesia sebagai payung hukum dari pelaksanaan praktik ini. Penulis menggunakan metode penelitian normatif, melalui penelitian hukum kepustakaan melakukan analisa dan pengkajian terhadap Peraturan Perundang-Undangan, mengumpulkan berbagai buku serta jurnal-jurnal karya sarjana yang relevan dengan permasalahan yang diangkat lalu ditelaah untuk mendapatkan sebuah jawaban untuk dilakukan penyusunan secara sistematis. Digunakan pendekatan Perundang-Undangan dan pendekatan Konseptual dalam proses penelitian ini. Bahan hukum yang penulis gunakan ialah bahan hukum primer, bahan hukum skunder, dan bahan hukum tersier. Dengan memperoleh hasil penelitian, praktik Ibu Pengganti menyebabkan terjadinya pelanggaran Hak Asasi Manusia bagi para pihak yang terlibat praktik ini dan belum adanya peraturan yang tegas tentang praktik ibu pengganti ini menyebabkan terjadiya kekosongan norma. Kata Kunci: Hak Asasi Manusia, Ibu Pengganti, Peraturan ABSTRACT This writing aims to find out how to protect human rights against parties involved in the practice of surrogacy (husband and wife, surrogate mother, and child to be born), and to know the position of surrogacy in Indonesian positive law as the legal umbrella of the implementation of this practice. The author uses normative research methods, through literature law research conducts analysis and assessment of the Laws and Regulations, collects various books and journals of undergraduate works relevant to the problems raised and then examined to get an answer to be done systematic preparation. Used statutory approach and conceptual approach in this research process. The legal materials that the author uses are primary legal materials, skunder legal materials, and tertiary legal materials By obtaining the results of the study, the practice of Surrogate Mothers causes human rights violations for the parties involved in this practice and the absence of strict regulations on the practice of surrogate mothers causes a void of norms. Abstract

ABSTRAK Penulisan karya ilmiah ini bermaksud untuk mengakaji dan menganalisis pengaturan mengenai Automatic Exchange Of Information di tatanan hukum nasional serta mengetahui akibat hukum pasca penandatanganan Automatic Exchange Of Information terhadap kerahasiaan bank di Indonesia. Karya ilmiah ini memakai metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konsep. Bedasarkan hasil penelitian pemberlakuan Automatic Exchange Of Information diatur dalam Undang-Undang Nomor 9 Tahun 2017 tentang Akses Informasi Keuangan Untuk Kepentingan Perpajakan menjadi undang undangdalam pasal 1 mengenai kewenangan pembukaan kerahasiaan akses keuangan terutama di bidang perbankan dan perpajakan. Tujuan Automatic Exchange Of Information ialah untuk membuka otomatis data nasabah guna mencegah penghindaran pajak. Akibat hukum pembukaan rahasia bank ialah hukum terbaru mengabaikan hukum yang lama dimana Undang-Undang Akses Informasi Keuangan diundangkan pada tahun 2017 sehingga mengabaikan Undang-Undang perbankan yang diundangkan pada tahun 1998. Kata Kunci: Sistem Pertukaran Informasi Otomatis, Rahasia Bank, Informasi Nasabah. ABSTRACT The purpose of writing this scientific paper is to study and analyze the regulation regarding the Automatic Exchange of Information in the national legal system and to find out the legal consequences after the Automatic Exchange of Information on bank secrecy in Indonesia. This scientific work uses a normative legal research method with an invitation application approach and a concept approach. The results of the study show that the application of automatic information exchange is regulated in Law Number 9 of 2017 concerning Access to Financial Information for Tax Purposes which becomes law in article 1 regarding the disclosure of confidentiality of financial access, especially in banking and taxation. The purpose of Automatic Information Exchange is to automatically disclose customer data to prevent tax evasion. The legal consequence of opening bank secrecy is the latest law on the old law where the Law on Access to Financial Information was enacted in 2017 so that the law was enacted in 1998. Abstract

Non refoulement principle is the basis of international protection for the refugees that listed in the Article 33 of the Convention Relating to the Status of Refugees 1951 and therefore binding on all of the states who participating in the convention. This principle prohibits the state to drive the refugees to their homeland where their lives would be endangered. However, it’s often to happen that the state, which is not a party of the 1951 convention, become a destination of the refugees. Therefore, this paper will describe the application of non refoulement principle as the basis of international protection for the refugees and also its implementation on the state that are not the parties in 1951 convention.
