Abstract

Poligami adalah salah satu bentuk kekerasan terhadap perempuan. Secara yuridis, sudah ada peraturan yang mengatur prosedur poligami, yaitu Undang-undang Nomor 1 Tahun 1974 tentang Perkawinan beserta peraturan pelaksanaannya, yaitu Peraturan Pemerintah Nomor 9 Tahun 1975. Peraturan tersebut berlaku bagi seluruh warga negara Indonesia, termasuk masyarakat adat Bali (etnis Bali-Hindu).  Pada prinsipnya, peraturan-peraturan tersebut membolehkan poligami tetapi dengan prosedur yang ketat sehingga dapat digunakan oleh seorang istri untuk mencegah suaminya berpoligami. Dalam kenyataannya, pelaksanaan dan penegakan peraturan-peraturan tersebut tidak efektif mencegah terjadinya kekerasan terhadap perempuan akibat dipoligami. Tulisan ini bertujuan mengungkapkan problematik-problematik yang terjadi dalam pelaksanaan dan penegakan ketentuan-ketentuan poligami bagi masyarakat adat di Bali. Metode yang digunakan untuk mengkaji permasalahan adalah metode penelitian kepustakaan yang dalam studi hukum disebut metode penelitian hukum normatif, dengan mengandalkan penggunaan data sekunder berupa bahan hukum (primer dan sekunder) dan bahan non-hukum. Hasil penelitian menunjukkan bahwa tidak efektifnya ketentuan-ketentuan poligami dalam Undang-undang Perkawinan dan peraturan pelaksanaannya untuk mencegah terjadinya poligami disebabkan masih adanya problematik pada sistem hukumnya, baik pada komponen substansi hukumnya, struktur hukumnya dan budaya hukumnya.  Kata kunci: penegakan hukum, poligami, kekerasan terhadap perempuan.

Abstract

With the enactment of Law Number 32 of 2004 which repealed the Act Number 22 of 1999 arising “the Vacuum of Law” in the foundation as well as in the implementation of village administration in Bali. On the one hand the Act Number 22 of 1999 was repealed, while the Law Number 32 Year 2004 not yet effective in Bali. In such “Vacuum of Law”, arose the polemic regarding the expected model or ideal format of villages held in Bali, which institutions should contribute to resolve cases that occurred in the village in a state of institutional dualism of village administration which is occurring in society and determined by their customary law, the form of out of court settlement in the customary dispute resolved by consensus agreement of peace through the customary laws. How is the effectiveness of out of court settlement in the village to resolve the customary disputes through the justice of the village peace by deliberation?In writing this article, the method used is the method of empirical research. Empirical legal research conceptualized as an empirical phenomenon that can be observed in real life. Settling disputes out of court by a justice of the peace in the village of indigenous people in Bali can be resolved peace and deliberation. The conclusion of the extrajudicial settlement in the village administration dualism conditions can be settled amicably without having to go through judicial mechanisms.

Abstract

Karya tulis ini membahas kedudukan suami istri terhadap harta benda perkawinan dalam hal putusnya perkawainan karena perceraian ditinjau dari perspektif Undang-undang Perkawinan dan hukum adat Bali. Putusnya perkawinan akibat perceraian menimbulkan konflik antara suami istri dalam pembagian harta benda perkawinan. Dengan demikian timbul pertanyaan, bagaimanakah kedudukan suami istri terhadap harta benda perkawinan tersebut?. Metode yang digunakan adalah metode penelitian hukum normatif, dengan pendekatan perundang-undangan dan konseptual. Harta benda perkawinan meliputi tiga golongan, yaitu harta bersama, harta bawaan masing-masing suami istri, dan harta yang diperoleh masing-masing suami-isteri sebagai hadiah atau warisan. Apabila terjadi perceraian suami-isteri berhak menguasai harta bawaan masing-masing dan harta yang mereka peroleh sebagai hadiah atau warisan. Sedangkan hak suami-isteri dalam pembagian harta bersama akan mendapatkan bagian sama rata.

Abstract

The tribe system in Bali called as Wangsa contains the injustice of gender. Inthe wangsa system, there is a principle forbiding a girl to be married with a boy from lower class status; on the other hand that prohibition does not prevailed for the boy. The prohibition is called as asupundung and alangkahi karang hulu.

Abstract

Penelitian ini dilakukan dengan tujuan: (1) untuk mengetahui bentuk-bentuk perlindungan hukum terhadap hak tenaga kerja kontrak yang sudah diterapkan oleh Hotel The Griya Sanur; dan (2) untuk mengetahui faktor-faktor yang menjadi penghambat dalam memberikan perlindungan hukum, khususnya bagi tenaga kerja kontrak pada Hotel The Griya Sanur. Dalam penulisan ini menggunakan metode penelitian hukum empiris dan melalui pendekatan perundang-undangan serta pendekatan fakta. Hasil studi menyatakan bahwa bentuk-bentuk perlindungan hukum yang telah diberikan oleh Hotel The Griya Sanur kepada setiap tenaga kerja kontrak, sudah sesuai dengan Undang-Undang Republik Indonesia No. 13 Tahun 2003 Tentang Ketenagakerjaan. Namun tidak sepenuhnya perlindungan hukum yang diberikan oleh Hotel The Griya Sanur berjalan dengan baik, hal tersebut dikarenakan adanya faktor-faktor penghambat baik dari perusahaan ataupun dari tenaga kerja yang bersangkutan. Kata Kunci: Perlindungan Hukum, Hak Tenaga Kerja, Tenaga Kerja Kontrak Abstract This research was conducted with the aim of: (1) to find out the forms of legal protection of contract worker rights that have been implemented by The Griya Sanur Hotel, and (2) to find out the factors that become obstacles in providing legal protection, especially for contract workers at The Griya Sanur Hotel. This research using empiricial legal research methods and through statute approach and fact approach. The study results state that the forms of legal protection that have been provided by The Griya Sanur Hotel to every contract worker, are in accordance with Act No. 13 of 2003 on Manpower. But not fully legal protection provided by The Griya Sanur Hotel runs well, it is due to the inhibiting factors both from the company or from the workforce concerned. Abstract

Traditional medicine by the people in several regions in Indonesia is very diverse. Communities in a particular area have different ways and techniques in traditional medicine, this is because culture and understanding and also the biodiversity found in the environment in which they live and the local wisdom they have is the cause of the emergence of various cultural products. Given that Bali has a culture related to the understanding of traditional medicine since ancient times, inherited from generation to generation, it has the potential to carry out complementary traditional medicine that has local wisdom. Usadha was populist in Bali carried out by a balian. There are several types of balian that are contained in the palm bodon ejection in accordance with the field and purpose. Normatively, the government has issued Regulation of the Minister of Health of the Republic of Indonesia Number 15 of 2018 concerning the Implementation of Complementary Traditional Health Services as a basis for implementing complementary traditional medicine. There are provisions that need to be studied and criticized so that they do not have the potential to hinder if Bali carries out complementary traditional medicine services in the future.

Abstract

Tulisan ini bertujuan untuk menjelaskan urgensi dan strategi pemberdayaan peradilan adat dalam sistem hukum di Indonesia. Secara konseptual, peradilan adat yang dimaksud dalam tulisan ini adalah sistem peradilan yang hidup dan dipraktikkan dalam kesatuan-kesatuan masyarakat hukum adat. Secara konstitusional, eksistensi peradilan adat diakui berdasarkan Pasal 18B ayat (2) Undang-undang Dasar Negara Republik Indonesia Tahun 1945, tetapi dalam level peraturan perundang-undnagan di bawah Undang-undang Dasar, eksistensi peradilan adat tidak mendapat pengakuan yang memadai. Kondisi ini menimbulkan dampak melemahnya posisi peradilan adat pada sebagian masyarakat adat ditandai oleh sikap dan perilaku masyarakat yang mulai enggan menyelesaikan perkaranya melalui peradilan adat. Di beberapa tempat, dewasa ini sudah tidak bisa ditemukan lagi adanya peradilan adat. Apabila kondisi ini dibiarkan berlangsung terus maka akan mengancam eksitensi kesatuan masyarakat hukum adat, sebab tanpa adanya pranata peradilan adat yang berfungsi menegakkan norma-norma hukum adat, suatu kesatuan masyarakat hukum adat akan kehilangan eksistensinya sebagai suatu kesatuan masyarakat hukum adat yang hidup. Oleh karena itu, peradilan adat sangat penting dan mendesak direvitalisasi, dalam arti diberdayakan agar dapat berfungsi kembali sebagai alternatif penyelesaian perkara, khususnya di lingkungan kesatuankesatuan masyarakat hukum adat.. Revitalisasi peradilan adat dapat dilakukan melalui strategi pembenahan seluruh komponen sistem hukumnya, baik substansi hukum, struktur hukum, dan buidaya hukumnya. This paper aims to explain the urgency and strategy of empowering customary justice in the legal system in Indonesia. Conceptually, the customary judiciary referred to in this paper is a living justice system that is practiced in customary law communities. Constitutionally, the existence of customary courts is recognized based on Article 18B paragraph (2) of the 1945 Constitution of the Republic of Indonesia, but at the level of statutory regulations under the Constitution, the existence of adat justice does not receive adequate recognition. This condition has the effect of weakening the position of customary justice in some indigenous communities marked by the attitudes and behavior of people who are reluctant to settle their cases through adat justice. In some places, there is no longer any traditional justice. If this condition is allowed to continue, it will threaten the existence of the customary community, because without customary judicial institutions that function to uphold customary law norms, a customary community community will lose its existence as a living customary community. Therefore, customary justice is very important and urgent to be revitalized, in the sense that it is empowered so that it can function again as an alternative case settlement, especially in the environment of customary law community units. Revitalization of customary justice can be done through a strategy of revamping all components of the legal system, both in substance the law, the legal structure and the legal nature.

Abstract

This article is an interpretation of Article 18B paragraph (2) of the Indonesian constitution: four requirements for recognition of traditional societies. Using sustainable tourism development as a case study, explores the important contribution of genealogical territorial participation and the limits of recognition of the role of the State in providing legal protection and traditional societies as the main coders of legal pluralism. This exploration reveals four different conditions: conditions for survival, dynamic conditions, conditions in accordance with the principle of integration, and regulated by law. The fact that these conditions are so intricately interwoven poses unique challenges for academics and legal practitioners, but also provides a potential blueprint for constitutions and state revenues.

Abstract

The management of the diversity of traditions and culture in each region in the archipelago was born by the plurality of society with the characteristics of the various customary law systems as different from national law which can actually enrich the repertoire of Indonesian national law. The urgency of this article study is that there is a need for an integration of policies for the formation of regulations and management in the field of local wisdom such as customs and traditions found in each region in Indonesia. The problems studied are: first, to examine the policy of developing customs and traditions in the context of legal pluralism and second, to analyze the concept of law as an integrator in the policy of customs and traditions in the context of Indonesian legal pluralism. The results show that first, the development of customs and traditions in the context of legal pluralism so far, state law has been in an ordinate position and local wisdom has been in a subordinate position, while there has been marginalization of customary law community groups in the policy of developing customs and traditions; and second, the concept of law can function as an integrator between the interests of  the sub-system in the policy of developing customs and traditions in the context of legal pluralism in Indonesia.
