Abstract

Kuota ekspor merupakan salah satu mekanisme perlindungan ekosistem laut. Banyaknya perburuan Ikan Hiu Tikus (Alopias Ssp.) di Indonesia saat ini karena permintaan pasar yang tinggi, khususnya dari luar negeri. Tingginya permintaan menyebabkan ikan jenis ini masuk ke dalam daftar Convention on International Trade in Endanger Species of Wild Fauna and Flora (CITES)  Appendiks II pada tahun 2016. Jika Ikan Hiu Tikus yang merupakan predator puncak pada rantai makanan di laut ini sampai terancam punah, maka ekosistem laut akan mengalami kerusakan parah. Hasil penelitian menunjukkan bahwa Indonesia belum memiliki perangkat hukum yang memadai terkait dengan penentuan komponen-komponen kuota ekspor Ikan Hiu, khususnya Ikan Hiu Tikus sebagaimana ketentuan yang diatur di dalam CITES. Keadaan ini menimbulkan dampak terhadap kelestarian Ikan Hiu Tikus itu sendiri, kepentingan masyarakat Indonesia, keberlangsungan lingkungan laut dan generasi yang memanfaatkannya, serta berdampak terhadap perdagangan internasional.The Consequencies of an Inexistence of Alopias Ssp Export Quota Regulation In Indonesia AbstractExport quota is one of mechanical ways to protect marine ecosystem. The huge number of Alopias Ssp. hunts has recently been caused by its international trade worldwide. Highly demands of Alopias Ssp. get this species to be listed on Convention on International Trade in Endanger Species of Wild Fauna and Flora (CITES)  Appendix II in 2016. When Alopias Ssp. as the top predator have been endangered, the marine ecosystem will come to a serious damage. Research shows that Indonesia does not have yet the regulation on components of export quota of Alopias Ssp. as it is regulated on CITES. This condition has affected the preservation of Alopias Ssp. itself, Indonesians’ interest, marine ecosystem sustainability and the generation taking the benefit of it, also international trade as well.DOI: https://doi.org/10.22304/pjih.v4n3.a9

Abstract

Abstrak Penawaran barang dengan media daring dilakukan oleh penjual dengan mengandalkan deskripsi barang dalam bentuk video atau foto sehingga konsumen tidak dapat melakukan pengecekan secara langsung atas barang yang akan dibelinya. Disamping kewajiban konsumen untuk berhati-hati, konsumen juga perlu mendapatkan perlindungan. Artikel ini menganalisis tanggung jawab penjual akibat produk cacat tersembunyi dalam transaksi jual beli secara daring. Penulis berpendapat bahwa produk cacat tersembunyi yang dijual oleh penjual dalam transaksi daring menjadi tanggung jawab mutlak penjual sebagaimana diatur pada Pasal 19 UUPK, serta ketentuan Pasal 1365 dan 1865 KUH Perdata, yaitu penjual bertanggung jawab atas barang yang dijual. Namun tanggung jawab tersebut harus dibuktikan bahwa penjual memang berbuat kesalahan, dan akibat kesalahan tersebut telah merugikan konsumennya.

Abstract

The aim of this paper is to examine an applying the precautionary principle in fisheries management. Precautionary principle is a principle where the possibility exist of serious or irreversible harm, lack of scientific certainty should not preclude cautions action by decision-makers to prevent or mitigate such harm. This principle has been accepting in widely international environmental law so that with applying this principle in fisheries management, it could be expected to provide an opportunity to progress towards sustainable fisheries development.

Abstract

This article aims to analyze and find the answer on how the regulation for transaction activities deals with electronic money by Chinese tourists in Indonesia, especially in Bali, as well as to analyze the effect on using WeChat Pay and Alipay payment in tourism sector. This legal research is using normative research method. It is concluded that Chinese electronic payment platform WeChat Pay and Alipay by Chinese tourists for doing payment transactions in Bali has not been explicitly regulated in Indonesia because those providers have not fulfilled any requirements and standards from Indonesian Central Bank (Bank Indonesia) and have not obtained any Indonesian legal status as a private company. Transactions using Chinese electronic also have impact for the country’s foreign exchange reserves. Foreign exchange reserves is one of the important aspect in deciding the value of state budget (APBN) that is also influenced by foreign exchange reserves from tourism sector.

Abstract

Berbagai kemudahan yang ditawarkan Fintech Peer to Peer Lending, terdapat pula persoalan yang menyertainya yaitu mengenai penetapan bunga yang tinggi dimana berpotensi menyebabkan gagal bayar. Ketika terjadi gagal bayar, pemberi pinjaman (Lender) memiliki risiko kehilangan seluruh pendanaan atas perbuatan wanprestasi penerima pinjaman. Penting dibahas mengenai perlindungan hukum bagi Lender jika terjadi gagal bayar. Tujuan dari penelitian ini untuk mengetahui perlindungan hukum bagi pemberi pinjaman atas risiko gagal bayar. Jenis penelitian yang digunakan adalah penelitian normatif. Pendekatan yang digunakan adalah pendekatan peraturan perundang-undangan (statutory approach). Hasil penelitian menunjukkan bahwa pengaturan mengenai P2P Lending dalam POJK Nomor 77-POJK.01-2016 tidak mengatur adanya jaminan kredit dalam perjanjian pinjam meminjam. Perlindungan preventif yang ada dalam P2P Lending masih menitikberatkan pada pihak penyelenggara, belum menjangkau perlindungan terhadap Lender jika terjadi gagal bayar.

Abstract

With the rapid development of technology and the internet, the marketing world is experiencing a significant transformation. Optimizing and utilizing digital marketing helps in the product marketing activities of a business and the activities of tiny and medium enterprises. Realizing this potential, the UNS 336 KKN Team aims to help market UMKM in Girimulyo Hamlet, Trengguli Village, Jenawi District, Karanganyar, by adopting and optimizing digital marketing techniques to increase the visibility and sales of their products. The activities include socialization and training on marketing digitalization through various platforms such as e-commerce, Google Maps, e-wallet, and social media. The results of this program show a significant increase in the understanding and ability of UMKM players to utilize digital marketing tools. Several UMKM have succeeded in creating online business accounts, increasing visibility on Google Maps, and starting to use social media to promote their products. In conclusion, this marketing digitalization program has the potential to be an essential catalyst in local economic development in Girimulyo Hamlet, with recommendations for continued assistance and further training to ensure the continued adoption of digital technology by local UMKM.

Abstract

The study aims to analyze whether the doctrine of trademark dilution has provided corrective justice or otherwise, so that the balance of rights for trademark owners can be fulfilled.The methods used in this study are normative or doctrinal legal research methods. The research approaches used are legislative, conceptual, case-based, and comparative approaches.The novelty of this research lies in the perspective of corrective justice in analyzing court decisions related to dilution actions. This research is expected to contribute to further research and policy recommendations for the government and judges to produce regulations and decisions that are fair to trademark owners.The results of the comparative law study show that anti-dilution regulations in the United States are comprehensively regulated, but there are shortcomings in the courts. Court decisions regarding well-known trademarks are considered detrimental and do not restore the rights that have been violated. In fact, the main purpose of dilution is to provide legal protection for well-known trademarks. Indonesia itself has not yet fully regulated anti-dilution regulations.The concluded findings of this comparative legal study serve as a lesson for Indonesia so that future regulations can take into account the balance of rights between well-known trademarks and other trademarks in order to avoid market monopoly.
