Abstract

The study focuses on the roles of International Law in responding to the technological advances, particularly examining the International Law as a regulator on emerging technology. The technological advances, especially in the means and method of war and environmental issues, have been contributing to the development of International Law. It is a normative legal research using the secondary data including primary and secondary legal materials. While the primary legal materials consist of all the international agreement related to the development of technology both directly and indirectly, secondary ones included the references having correlation and support to the issues. The technique of analysis data used legal interpretation. The study concludes that as a regulator of technological advances, International Law has a role to play in regulating its development. Many facts showed that International Law has capability to respond to the challenges.  However, the scope and application of International Law is subject to a number of limitations inherent the nature of International Law itself.

Abstract

The emergence of disruptive technologies has transformed how the conflict is resolved. If Alternative Dispute Resolution (ADR) has been understood as a more efficient method of resolving dispute than through the court, then in line with the development of technologies, Online Dispute Resolution (ODR) considered as the most efficient mechanism in ADR. Through ODR, access barriers are reduced, effectiveness increases, software becomes smarter and some ADR elements are challenged. This article focuses on the shifting of dispute resolution from the traditional approach to the new generation one which called digital justice.

Abstract

AbstractThis paper describes and examines the issues of how to protect against shipping companies contained in sea transport agreement agreements. The purpose of this paper is to know the legal protection of shipping companies contained in sea transport agreements. Data collection technique is literature study with statute approach method, the instrument of this research is the Book of Trade Law Act, Law Number 17 Year 2008 concerning Shipping and related legislation, as well as sea transport documents. The result of the research shows that every sea freight shipping company (EMKL) has procedures and requirements in transporting goods by sea, legal protection against shipping companies contained in sea transport agreement there are 2 (two) properties that is preventive and repressive. As a preventive measure, Legal Protection of the Expeditor from the delivery of Agricultural Products and Products is seen from what the understanding, duties, and rights and obligations of the expeditor Then as a repressive step that is behind the bill of lading it is mentioned that there are procedures to claim damage, loss and delay of delivery of goods , and thereafter shall be liable to sanctions in the form of damages for loss, loss, and delay in the delivery of goods in respect of quantities and other calculations agreed upon by both parties.Keywords: Legal Protection; Expedition; Transportation of Agricultural Products; Sea Freight LawAbstrakPenulisan ini mendeskripsikan dan mengkaji permasalahan mengenai bagaimana perlindungan terhadap perusahaan ekspeditur yang dimuat dalam perjanjian perjanjian pengangkutan laut. Tujuan penulisan ini adalah untuk mengetahui perlindungan hukum terhadap perusahaan ekspeditur yang dimuat dalam perjanjian  pengangkutan  laut. Teknik  pengumpulan  data  adalah  studi  kepustakaan  dengan  metode pendekatan  statute  approach,  instrumen  penelitian  ini  yaitu  Kitab  Undang-undang  Hukum  Dagang, Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran dan peraturan perundanng-undangan terkait, serta dokumen-dokumen pengangkutan laut. Hasil penelitian menunjukan bahwa setiap perusahaan ekspedisi muatan kapal laut (EMKL) memiliki prosedur dan persyaratan dalam mengangkut barang melalui laut, perlindungan hukum terhadap perusahaan ekspeditur yang dimuat dalam perjanjian pengangkutan laut terdapat 2(dua) sifat yaitu preventif dan represif. Sebagai langkah preventif, perlindungan hukum ekspeditur dari  pengiriman barang hasil  dan produk pertanian dilihat dari apa pengertian, tugas, serta hak dan kewajiban ekspeditur kemudian sebagai langkah represif yaitu dibalik bill of lading tersebut disebutkan bahwa terdapat prosedur megenai klaim kerusakan, kehilangan, dan keterlambatan pengiriman  barang, dan untuk selanjutnya akan diberikan sanksi berupa ganti kerugian atas kerusakan, kehilangan, dan keterlambatan pengiriman barang yang mengenai jumlah dan perhitungan lainnya telah disepakati oleh kedua belah pihak.Kata Kunci: Perlidungan Hukum; Ekspeditur; Pengangkutan Produk Pertanian; Hukum Pengangkutan Laut

Abstract

Solving the problem of traditional knowledge biopiracy faced by Indonesia is the background of this article. Thereby the problem of this papers is to seek the best way to settle the dispute occurred in biopiracy case. Due to the economic value of traditional knowledge this national resources need to be protected. Due to this economic value, a lot of traditional knowledge stolen and patented by someone else, this biopiracy cases had been long faces by the developing countries i.e Indonesia with shisheido case and avian influenza (H5NI) case, India with turmeric case and basmati rice case. Judicial settlement of dispute, alternative dispute resolution, quasi-judicial is a way to solve the cases which can be chosen.Keywords: biopiracy, traditional knowledge, dispute

Abstract

The aim of this paper is to examine an applying the precautionary principle in fisheries management. Precautionary principle is a principle where the possibility exist of serious or irreversible harm, lack of scientific certainty should not preclude cautions action by decision-makers to prevent or mitigate such harm. This principle has been accepting in widely international environmental law so that with applying this principle in fisheries management, it could be expected to provide an opportunity to progress towards sustainable fisheries development.

Abstract

The increases in cross-border trade has resulted in more companies with assets, business, and presence in multiple jurisdiction. When any of these companies face debt restructuring or insolvency, it confronts a myriad of complex issues in coordinating rescue proposals or winding up the businesses across jurisdictions. Prior to the 1997 economic crisis, insolvency laws in most state economies were generally out of date and irrelevant to the modern commercial needs, particulary the cross-border insolvency matters that has not been well regulated. ASEAN has initiated an integrated economy regional by launching an ASEAN Economic Community on late 2015. It aimed to establish a deeply integrated and highly cohesive ASEAN economy that would support sustained high economic growth and resilience in the face of global economic shocks and volatilities within ASEAN members. Unfortunately, ASEAN member has not prepared a regulation regarding cross-border insolvency matters which could restrains its aim to establish a fully integrated economy regional. Each state members has its own national insolvency laws and proceedings, but none have the schemes that could surpassed the national borders and simplified the procedures. The aspects of cross-border insolvency from both the international law and domestic law of Indonesia is already prepared to deal with foreign proceedings. Both could be adjusted to establish a cross-border regulation in ASEAN. Hence, there should be an in-depth harmonization of cross-border insolvency should be another priority upon ASEAN Economic Community to achieve a fully-integrated economy in ASEAN.

Abstract

AbstractThe requirements of intention to create legal relation in an agreement have been a long debate between states both in common law and civil law countries. The absence of legal rules regarding guaranteed stock makes the guaranteed stock agreement a source of legal implementation in the UK. This article purposes to know the importance of the “intention” in guaranteed stock agreement to be applied in Indonesia. This is a normative legal research using comparative approach which compares the concept of intention in a guaranteed stock agreement in the UK with the concept of intention based on Indonesian contract law. Abstract

This article explores the philosophical and constitutional foundations that form the basis for the development of economic law in Indonesia. As is known, Indonesian legal problems such as economic inequality, corruption, legal uncertainty, and complicated bureaucracy make it difficult for the Indonesian economy to develop. Laws that should have been engineered for development capital did not go according to plan. This article uses normative legal methods on legislative systematics. The approach in the paper uses a combination of legislative, philosophical and constitutional approaches. The research results show that the philosophical foundations of economic law in Indonesia are based on Pancasila, which functions to create stability, support development, uphold justice, and increase legal literacy. Economic law plays an important role in national development with the principles of faith, benefits, Pancasila democracy and social justice. The Indonesian Constitution emphasizes the principles of kinship and social justice in economic policy, although it is still challenged by capitalistic and socialistic tendencies. This is why it is important to integrate Pancasila values ​​to achieve sustainable and just development in Indonesia. Artikel ini mengeksplorasi dasar-dasar filosofis dan konstitusional yang menjadi dasar pengembangan hukum ekonomi di Indonesia. Seperti diketahui persoalan hukum Indonesia seperti ketimpangan ekonomi, korupsi, ketidakpastian hukum, hingga birokrasi berbelit membuat ekonomi Indonesia sulit berkembang. Hukum yang semestinya direkayasa untuk modal pembangunan tidak berjalan sesuai rencana. Adapun penelitian ini menggunakan metode hukum normatif pada sistematika perundang-undangan. Pendekatan dalam artikel menggunakan gabungan pendekatan perundang-undangan, filsafat dan konstitusional. Hasil penelitian menunjukkan bahwa dasar-dasar filosofis hukum ekonomi di Indonesia yang berlandaskan Pancasila, yang berfungsi untuk menciptakan stabilitas, mendukung pembangunan, menegakkan keadilan, dan meningkatkan literasi hukum. Hukum ekonomi berperan penting dalam pembangunan nasional dengan prinsip-prinsip keimanan, manfaat, demokrasi Pancasila, dan keadilan sosial. Konstitusi Indonesia menekankan prinsip kekeluargaan dan keadilan sosial dalam kebijakan ekonomi, meskipun masih tantangan dari kecenderungan paham kapitalistik dan sosialistik. Dari sini penting adanya integrasi nilai-nilai Pancasila untuk mencapai pembangunan berkelanjutan dan berkeadilan di Indonesia
