Abstract

Problem of label foods product very important because a part consumer is in muslim circle whereas in statistics more than 80% Indonesian occupation is Islam religion Consume activity certain of material foods for muslim it just not only for fulfill hungry but more than worship to God. For ensure the permitted of product then by producer, that product must imploring certification of permitted before marketing for muslim consumer. For every produser going to having include label product in their product it must following process or stage to get permitted instruction consist of pre registration and registration up to publication of permitted certificate graduated by MUI after permanently of permitted status by instruction commision of MUI. Consequences law for producer carry out inclusion of permitted label of product illegal from clause of UU Consumer Protection although UU No. 7 years 1996 about Label and Foods and PP No 69 years 1999 about Label and Foods Advertising there are three categories, producer can be allowed acted crime, civil although administratif. Besides that consequences law for producer that include permitted label of foods roduct, illegal actually really adverse the muslim consumer is like responsibility from producer to consumer, in other wise responsibility of producer like product responsibility it means responsibility product for that product bring along in currency that have made or included loss because flawed at that product.

Abstract

Economy and moral rights are the part of basic human rights entitled to the proprietor of theintellectual property that must be full filed by the state, to meet the requirements of Constitution.Similar treatment must be provided by the state to economic and moral rights of indigenouspeoples on their own Intellectual Property, in the form of Traditional Knowledge and TraditionalCultural expressions as described in Article 18 b of the Constitution of 1945 “The state recognizesand respects the customary law community units including their traditional rights as long as itexists and in accordance to society development and principles of Unitary State of The Republicof Indonesia, as stated by the Law.”. Fulfilment of these rights through modern TRIPs-WTOIPRs regime brings about legal problems, considering their different character, where individualand commercial character of modern IPRs contradicts the communal and non-commercialcharacter of Traditional Knowledge and Traditional Cultural Expression. On the other hand,to get modern IPRs protection, Traditional Knowledge and Traditional Cultural Expressionmust meet particular conditions such as originality/ novelty, inventive step and applicable toindustry which indeed unable to fill due to its anonymous inventor, developed and bequeathedfrom generation to generation and is not intended specifically for industrial/commercial purpose.Keywords: Rights, Indigenous Peoples

Abstract

Tujuan Penelitian Ini adalah untuk menganalisi mengenai peran, tugas, dan wewenang serta tanggung jawab kurator dalam menyelesaiakan sengketa kepailitan. Jnis penelitian yang digunakan dalam penelitian ini adalah penelitian normatif dengan metode pendekatan konseptual dan Perundang-Undangan. Adapun hasil penelitian adalah sebagai berikut: Mengingat begitu sentral kedudukan hukum kepailitann dalam tatanan hukum bisnis, dan banyaknya permohonan pailit yang diajukan oleh debitur ke Pengadilan Niaga Dewasa ini, dan kemudian telah diputus, maka tanggung jawab kurator dalam menyelesaikan utang debitur pailit menjadi sangat penting.Kurator setelah ditunjuk oleh pengadilan memiliki peran yang sangat strategis dalam proses penyelesaian utang pailit. Kurator mengurus dan membereskan proses sampai akhir atau final. Kurator hanya ada dalam proses kepailitan sadangkan dalam hal Penundaan kewajiban pembayaran utang, peran kurator dilaksanakan oleh pihak yang disebut dengan pengurus. Pekerjaan lain yang dilakukan pasca berlakunya UU No. 37 Tahun 2004 Tentang Kepailitan dan Penundaan Pembayaran Utang adalah mengelola harta pailit. Kurator diberi keleluasaan menjual harta debitur pailit. Juga meminjamkan dari pihak lain dengan agunan harta yang pada saat pernyataan pailit belum dibebani agunan. Untuk menjalankan itu perlu izin dari Hakim Pengawas. Selain hal tersebut di atas, dalam rangka mengoptimalisasi harta debitur pailit, sejak pernyataan pailit ditetapkan walaupun belum keputusan mempunyai kekuatan hukum tetap, meskipun diajukan upaya hukum, kurator dapat menjual harta debitur pailit dan mengambil tindakan untuk mengoptimalisasikan harta debitur pailit.Tanggung jawab yang besar yang diberikan oleh oleh Undang-undang kepada curator untuk menentukan penyelesaian harta debitur pailit sungguhmenjadi bebab bagi curator jika tidak didukung oleh kemampuan intelektual secara individual dalam menjalankan kewenangannya. Mengingat tanggung jawab yang sangat berat dewasa ini berkaitan dengan penyelesaian utang debitur pailit, maka Menteri Kehakiman dan HAN memulai Keputusan No. M.09-HT.05.10 Tahun 1998 Tanggal 12 Desember 1998 Tentang Pedoman bsarnya Imbalan Jasa Bagi Kurator dan Pengurus dalam rangka pengurusan dan atau pemberesan harta debitur pailit dan kepada pengurus dalam rangka pengurusan harta debitur.

Abstract

Islamic banking, rooted in the foundational principles of shiddiq (honesty), tabligh, amanah (fulfillment of beliefs), and fatanah (intelligence) derived from the teachings of Prophet Muhammad, stands in stark contrast to conventional banking, which is driven by Western-derived concepts encapsulated in Good Corporate Governance (GCG). The latter is characterized by principles such as transparency, accountability, responsibility, independency, and fairness (TARIF). This research investigates the possibilities and implications of applying GCG principles in Islamic banking, examining their impact on Islamic economic law. Utilizing a normative legal study, the research delves into primary and secondary legal materials, employing a deductive analysis with both statutory and conceptual approaches. The integration of GCG principles in Islamic banking signifies a convergence of values that fosters justice, tawazun (balance), mas’uliyah (accountability), akhlaq (morality), shiddiq (honesty), amanah (fulfillment of beliefs), fatanah (intelligence), and economic equilibrium within the framework of Islamic economic law.

Abstract

This research investigates the Plant Varieties Regime's role in safeguarding farmers’ rights in plant development and cultivation in Indonesia. Specifically, it scrutinizes criminal provisions concerning farmers accused of producing seeds without the right holder's consent, as evident in multiple court decisions. These verdicts have ignited legal debates that conflict with the principles of food sovereignty. Given that nearly 90% of corn plants are cultivated through traditional farmer knowledge, the increasing dependence on the seed industry disrupts agricultural practices passed down through generations. The Plant Variety Protection Act (PVP Act) inadvertently encourages seed industry monopolization. This paper advocates a coherent approach in compliance with Article 27(2) of the 1945 Constitution to address these legal issues and establish a just legal framework. The primary legal discourse centers on equitable protection, necessitating a re-evaluation of the PVP Law, which is perceived as restricting plant development opportunities and discriminating against farmers. Farmers, as stewards of seed development and livelihood, should not face criminal charges encroaching upon their rights. Employing a normative methodology involving statutory, conceptual, and case analyses, this study examines the criminal aspects and legal protection of farmers' rights in corn seed cultivation. Ultimately, the paper recommends revising the PVP Law, emphasizing the importance of coherent legal thinking when shaping criminal policies. On a practical level, it calls for collaborative efforts among stakeholders to bolster agricultural sovereignty, particularly in the corn sector, by prioritizing farmers' rights. In summary, this research aims to provide recommendations for enhancing farmers' protection against the criminal provisions outlined in the PVP Act, which holds a pivotal role in shielding farmers engaged in corn seed cultivation.

Abstract

Child marriage in Indonesia is a multifaceted issue, encompassing religious interpretations, cultural values, and even the influence of technological advancement. A significant factor is the amendment of Indonesian marriage law, which include Article 7, empowering judges to grant marriage dispensation. While this is viewed by some as a solution and a means of child protection through religious and cultural lenses, others see it as a perpetuation of child marriage, contradicting both child protection and marriage laws. This research aims to examine the impact of marriage law in Indonesia, specifically regarding age restrictions and its close association with marriage dispensations in religious courts. Critics argue that this provision has led to an increase in child marriages, with a multitude of biological, physiological, and sociological implications. This study employs normative legal research, incorporating legal, conceptual, and comparative approaches through case analysis and juridical methods. The findings indicate that Marriage Law No. 1 of 1974, along with its amendment—Law No. 16 of 2019, are legally inconsistent with Law No. 23 Year 2002 on child protection. Therefore, legal reform is recommended to raise the marriage age to 21, aligning with biological, psychological, and sociological definitions of adulthood.

Abstract

Penelitian ini bertujuan untuk mengkaji tentang penyelesaian perselisihan investasi antara pemerintah dengan investor asing melalui lembaga ICSID dan pelaksanaan keputusan lembaga ICSID di Indonesia. Adapun metode penelitian yang digunakan adalah penelitian hukum normatif dengan menggunakan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Berdasarkan hasil penelitian bahwa penyelesaian perselisihan investasi antara pemerintah dengan investor asing melalui lembaga ICSID didasarkan pada perjanjian yang menetapkan sistem otonom dan mandiri untuk lembaga tersebut. Kinerja ICSID tidak mendamaikan atau menengahi perselisihan, ICSID memberikan kerangka kelembagaan dan prosedural untuk komisi konsiliasi independen dan pengadilan arbitrase yang dibentuk dalam setiap kasus untuk menyelesaikan sengketa. Dalam hal ini ICSID hanya menyediakan fasilitas penyelesaian sengketa yang mengacu pada dua set prosedural yaitu Konvensi, Regulasi, aturan ICSID, dan aturan Fasilitas Tambahan ICSID.Selanjutnya dalam pelaksanaan keputusan lembaga internasional ICSID di Indonesia mekanismenya mendasarkan pada Undang-undang No 30 Tahun 1999 dimana ditentukan bahwa yang berwenang menangani masalah pengakuan dan pelaksanaan Putusan Arbitrase Internasional adalah Pengadilan Negeri Jakarta Pusat dengan mekanisme harus didahului adanya permohonan dari pihak pemohon.

Abstract

In the modern context, the Traditional Medicine Knowledge (TMK) of Sasak community is a valuable economic asset considering its usage as a basic knowledge (milestone) in the modern medicine discovery. As a form of human intellectual ability, TMK is regulated under the IPRs-TRIPs regime, whereas TMK have prominent opposite characters with IPRs. This fact raises particular issues in terms of: the form of Sasak community’s TMK, regulation of its protection under the IPRs regime and the ideal legal institution to realize the protection. The majority of Sasak’s TMK are transmitted verbally, a fraction of it was written in babon (book of) tetamba/oat and lontar Usada. The IPRs-TRIPs regime only provides indirect regulation toward TMK, as contained in Patent and Plant Variety Protection Law. Ideally, there should be a local Law that particularly regulates protection on Sasak’s TMK in order to prevent misappropriation. Thus, there is a void of Law since there is no Sui Generis Law on the protection of TMK.Keywords: legal protection, traditional medicine knowledge, legal void

Abstract

Traditional Chinese law is strongly influenced by two schools of thought, namely Confucianism which emphasizes “rule by li” and Legalism which emphasizes “rule of fa”. Both schools of thought have different accentuations, specifically, “li” emphasizes trust, while “fa” prioritizes certainty. In light of this ambivalence, this research seeks to address the following problem formulation: (i) how do the principles of "li" and "fa" inform the foundation of legal agreements? (ii) how has the evolution of these principles been shaped by Mainland Chinese and Peranakan Chinese communities? To address these inquiries, this study delves into the influence of "li" and "fa" within contract law, specifically within the context of Contract Law among Mainland Chinese and Peranakan Chinese in Indonesia. The researcher conducts an exploration of the Analects of Confucius to elucidate the essence of "li" and delves into the texts of Shang Yang and Han Fei Zi to discern the essence of "fa." The findings of this research are subsequently employed as a foundation for analyzing the impact of "li" and "fa" on legal practices in Mainland Chinese and Peranakan Chinese societies, viewed through the lens of legal philosophy.
