Abstract

Criminal Law to deal with Corona Virus Disease 2019 (Covid-19) is under the spotlight during the handling of the pandemic. Criminal Law is intended to be used when the patient's moral responsibility to declare that he has been abroad having not been fulfilled, and the government's health protocols are ignored. Meanwhile, various laws for Covid-19 pandemic treatment does not provide strict norms; on the contrary, it is sometimes using blanket offence formulation. This study explores the limits of Administrative Criminal Law in the health sector and pandemic management to impose penalties for health protocols violation. Using the normative systematic interpretation method, the study results show no difference formulation of criminal law norms in special laws, which are administrative with criminal law norms in special laws. However, the difference exists within the theoretical realm. Administrative criminal law is not aimed at free individuals and is not socially and psychologically illegal. Still, it is aimed at humans as players of particular roles required to conform with other forms of action according to their role. Unfortunately, administrative criminal law exists outside the Criminal Code, primarily aimed at freeing individuals and socially and psychologically illegal. Law enforcement practices cannot provide a gradation for these two groups of laws—conditions where the fundamental rights of citizens are threatened by the power to impose penalties. This study proposes broadening justification and excuse in the Indonesian Criminal Code, which is appropriate for the character of administrative criminal law.Keywords: Blanket Offence Formulation; Excuse; Justification AbstrakHukum Pidana untuk Penanganan Corona Virus Disease 2019 (Covid-19) menjadi sorotan selama penanganan pandemi. Hukum Pidana dimaksudkan untuk digunakan ketika tanggung jawab moral pasien untuk menyatakan bahwa ia telah di luar negeri belum terpenuhi, dan protokol kesehatan pemerintah diabaikan. Sementara itu, berbagai undang-undang penanganan pandemi Covid-19 tidak memberikan norma yang tegas; sebaliknya, kadang-kadang menggunakan rumusan blanket offence. Kajian ini menelusuri batasan Hukum Pidana Administrasi di bidang kesehatan dan manajemen pandemi untuk menjatuhkan sanksi bagi pelanggaran protokol kesehatan. Dengan menggunakan metode interpretasi sistematis normatif, hasil penelitian menunjukkan tidak ada perbedaan rumusan norma hukum pidana dalam undang-undang khusus yang bersifat administratif dengan norma hukum pidana dalam undang-undang khusus. Namun, perbedaannya ada dalam ranah teoretis. Hukum pidana administrasi tidak ditujukan untuk individu yang bebas dan tidak ilegal secara sosial dan psikologis. Namun, itu ditujukan pada manusia sebagai pemain peran tertentu yang diperlukan untuk menyesuaikan diri dengan bentuk tindakan lain sesuai dengan perannya. Sayangnya, hukum pidana administrasi ada di luar KUHP, terutama ditujukan untuk membebaskan individu dan ilegal secara sosial dan psikologis. Praktik penegakan hukum tidak dapat memberikan gradasi bagi kedua kelompok hukum ini—kondisi di mana hak-hak dasar warga negara terancam oleh kekuasaan untuk menjatuhkan hukuman. Penelitian ini mengusulkan perluasan justifikasi dan dalih dalam KUHP Indonesia, yang sesuai dengan karakter hukum pidana administrasi.Kata Kunci: Formulasi Blanket Offense; Mengizinkan; Pembenaran

Abstract

Dalam Pasal 74 UU PT jo. PP 47 Tahun 2012 diatur mengenai kewajiban menjalankan tanggung jawab sosial CSR bagi perusahaan yang berkaitan dengan sumber daya alam. Kewajiban sosial perusahaan diatur dengan UU ini agar kewajiban perusahaan atas lingkungan sekitarnya tidak hanya sebatas dalam tataran moralitas, tetapi perlu diatur dalam suatu norma hukum agar tercapai suatu kepastian hukumnya.Adanya UU Perseroan Terbatas dan PP yang mengatur tentang tanggung- jawab sosial ini tidak akan berhasil apabila tidak adanya sanksi hukum. Mengingat dalam kedua aturan tersebut tidak diatur mengenai sanksi atas tidak dilaksanakannya CSR tersebut yang akan berimbas pada banyaknya perusahaan yang akan mengabaikan ketentuan CSR ini apabila tidak ada aturan yang memaksanya. Oleh karena itu, ketentuan Pasal 74 ayat (3) UU PT tidak akan mempunyai arti apabila belum adanya peraturan yang mengatur secara tegas ketentuan tersebut, begitu pula ketentuan PP 47 Tahun 2012 yang tidak mengatur secara jelas ketentuan tentang sanksi atas tidak dilaksanakan- nya CSR ini akan menjadi masalah dalam mengimplementasikan ketentuan CSR ini dalam praktek.Kata Kunci; CSR, Pasal 74 UU No 40 Tahun 2007, sanksi

Abstract

The declaration of the development of halal tourism in Pamekasan still leaves problems. The burning case of a newly established tourist spot in Pamekasan indicates this phenomenon. The purpose of this study is to examine regulations regarding halal tourism in Pamekasan, which is known as the city of the Islamic community development movement (Gerbang Salam) and the problems that arise from the implementation of these regulations. This research is a sociolegal research, using primary data and secondary data. The data obtained were analyzed qualitatively. The results of the study show that in Pamekasan there is a Pamekasan Regency Regional Regulation Number 2 of 2019 as a regulation that regulates the implementation of entertainment and recreation so that it is in accordance with the customary, religious and cultural values of the community. The problem that arises is that there are still differences in perceptions between entertainment managers and the local community, supervisory institutions are not firm in taking action against violations of entertainment and recreation businesses that violate local regulations, giving rise to vigilante actions by the surrounding community.

Abstract

Based on the previous research, it is known that the micro-enterprises in Bunder, Pademawu, Pamekasan, do not yet have a business license. Moreover, since 2021 there has been a new licensing regulation known as a risk-based permit, so it is necessary to provide literacy on norms, standards, procedures, and criteria in obtaining such permits. In addition, the products of this micro-enterprises do not yet have a trademark. To help overcome these problems, socialization was carried out to micro business actors. The socialization is related to risk-based business licensing and intellectual property rights-based product registration. This activity consists of identifying potentials and problems as well as licensing and trademark socialization activities. This socialization was carried out at the Bunder Village Hall, attended by about 25 micro-enterprises and attended by employees of the Cooperatives and Micro Business Office, Village Heads and Apparatus, as well as BUMDes Management. At the end of the socialization activity, assistance is provided to micro-enterprises so that they can register for a license to obtain a Business Identification Number and micro business actors obtain proof of trademark registration at the Ministry of Law and Human Rights.

Abstract

This research investigates the Plant Varieties Regime's role in safeguarding farmers’ rights in plant development and cultivation in Indonesia. Specifically, it scrutinizes criminal provisions concerning farmers accused of producing seeds without the right holder's consent, as evident in multiple court decisions. These verdicts have ignited legal debates that conflict with the principles of food sovereignty. Given that nearly 90% of corn plants are cultivated through traditional farmer knowledge, the increasing dependence on the seed industry disrupts agricultural practices passed down through generations. The Plant Variety Protection Act (PVP Act) inadvertently encourages seed industry monopolization. This paper advocates a coherent approach in compliance with Article 27(2) of the 1945 Constitution to address these legal issues and establish a just legal framework. The primary legal discourse centers on equitable protection, necessitating a re-evaluation of the PVP Law, which is perceived as restricting plant development opportunities and discriminating against farmers. Farmers, as stewards of seed development and livelihood, should not face criminal charges encroaching upon their rights. Employing a normative methodology involving statutory, conceptual, and case analyses, this study examines the criminal aspects and legal protection of farmers' rights in corn seed cultivation. Ultimately, the paper recommends revising the PVP Law, emphasizing the importance of coherent legal thinking when shaping criminal policies. On a practical level, it calls for collaborative efforts among stakeholders to bolster agricultural sovereignty, particularly in the corn sector, by prioritizing farmers' rights. In summary, this research aims to provide recommendations for enhancing farmers' protection against the criminal provisions outlined in the PVP Act, which holds a pivotal role in shielding farmers engaged in corn seed cultivation.

Abstract

Dalam Putusan Nomor 261/Pid.Sus/2019/PN Gpr, Putusan Nomor 262/Pid.Sus/2019/PN Gpr, dan Putusan Nomor 8/Pid.Sus/2021/PN Gpr, yang mana pelakunya adalah pelaku usaha yang telah melakukan perbuatan pidana karena memperdagangkan barang dan/atau jasa yang ditetapkan sebagai barang dan/atau jasa yang dilarang untuk diperdagangkan dan melanggar Pasal 110 Undang-Undang Nomor 7 Tahun 2014 tentang Perdagangan. Dari ketiga putusan tersebut penjatuhan pidana berbeda terutama ukuran sanksi pidana dan yang menjadi permasalahan adalah apa yang menjadi dasar pemidanaan hakim dalam ketiga putusan tersebut sehingga menghasilkan pidana yang berbeda. Disparitas putusan pidana adalah penerapan pidana yang tidak sama terhadap tindak pidana yang sama (sane offence) atau terhadap tindak pidana yang sifat berbahayanya dapat diperbandingkan (offences of comparable seriousness) tanpa dasar pembenaran yang jelas. Dari ketiga putusan tersebut terjadinya disparitas putusan pidana karena setiap Majelis Hakim memiliki perbedaan dalam membuktikan dan memenuhi setiap unsur dalam pasal tersebut berdasarkan fakta - fakta hukum yang terungkap dalam persidangan. Selain itu Majelis Hakim juga menggunakan barang bukti yang diajukan dalam persidangan terutama jumlah benih jagung bantuan Pemerintah yang diperdagangkan pelaku usaha sebagai dasar pemidanaan. Kemudian Majelis Hakim pada ketiga putusan tersebut juga menggunakan dasar pemidanaan secara non yuridis didasarkan pada tujuan dari pemidanaan dan keadaan yang memberatkan maupun meringankan pelaku usaha. Maka dari hal tersebut menyebabkan perbedaan penjatuhan pidana terhadap pelaku usaha yang memperdagangkan benih jagung bantuan Pemerintah.

Abstract

This research discusses the transformation of understanding and law enforcement of the elements of Article 2 and Article 3 of the Corruption Eradication Law. The element against the law is Article 2 of the Corruption Eradication Law. In contrast, the element of abuse of authority is the core of the offense in Article 3 of the Corruption Eradication Law. Thus, it is inappropriate to indict the perpetrators of mining corruption with an alternative form of indictment between Article 2 and Article 3 of the Corruption Eradication Law. Inconsistencies in formulating the elements of the offense and the parameters of the article have resulted in disparities in punishment, errors in assessing the existence of abuse of authority by using unlawful parameters and mixing the application of the two articles. This can be viewed in several Supreme Court Decisions in mining corruption cases, where the elements and subjects of the offense are interchangeable. This research aims to study the inconsistent formulation of the elements of the offense in Article 2 and Article 3 of the Corruption Eradication Law, which has led to disparities in punishment in mining corruption cases. This study is conducted by analyzing several Supreme Court Jurisprudence. This research employs normative research with a statutory approach, concept approach, and case approach. The results of this study aim to provide a recommendation on the concept of against the law and abuse of authority in the Corruption Eradication Law.
