Abstract

Today narcotics in Indonesia has been spread, it can be seen at this time inIndonesia not only as a place of narcotics but it has become a place for manufacture ofnarcotics. To prevent this crime, the government has been released a lot of an Act toregulate narcotics and now has been used that is Act 35 in 2009. In this Act there is apunishment that causes polemic that is Death penalty, this polemics said that the deathpenalty is contrary to the Constitution of 1945 and there are say that the death penaltystill need to be implemented to give a deterrent effect on drug abuser. From the problemhence the authors make minithesis with the title "Dead Penalty For Narcotics Abuser inIndonesia".

Abstract

Drugs abuse which doing by foreigner is increasingly happen in Indonesia andits become a threat for National Security. Firm and consistent rules are needed in copewith of drug abuse by foreigner. Criminal responbility for foreign should do inmaximum way by given criminal sanctions. In other way, firm criminal sanctions fordrug user especially doing by foreigner can give leery effect and uphold nationalsovereignity.

Abstract

In a rent-purchase agreement it is possible that the leaseholder for any reason,is unable to meet its obligations to pay the lease purchase in accordance with theagreed terms of the agreement with the seller, that he/she (the buyer) can becategorized have broken a promise or default. Therefore, this paper will explain howthe right of ownership over goods which become the object of leasing shift from theseller to the buyer. In addition, this paper also explains about the legal consequences ifthe buyer defaults lease action. So in the lease agreement the ownership status of thegoods will move from the seller to the leaseholder after the total price for the good havebeen paid in full and legal consequences for the debtor’s liability for the breach ofcontract will get a penalty or legal sanctions. The method used in this paper is thenormative method refers to the sources of law.

Abstract

The emergence of a variety of environmental cases, likely caused by human activityitself. It is needed the laws govern all things related to the environment, the related ActNumber 32 of 2009, the Protection and Environmental Management. The problems thatarise: first, what kind of law enforcement that regulated under Law no. 32 of 2009 inorder to preserve the environment in Indonesia, second what are the obstacles theenforcement of environmental law in Indonesia. The method of this research is anempirical legal research using engineering studies document the legal materialsrelevant to this issue. Conclusions from the research indicate that Law No. 32 of 2009provides three different aspects of environmental law enforcement which areenforcement administrative, civil and criminal. The constraints and obstacles in theenforcement of environmental law is from legal factors itself, law enforcement factors,facilities, constraints of communities, and natural bamers such as: volcano eruption,floods, and landslide.
