Abstract

 Tujuan yang ingin dicapai dalam penelitian ini adalah Untuk Mengkaji, mengetahui dan menganalisa rasio logis dari Pasal 21 ayat (1) Undang-Undang No. 30 Tahun 2014 tentang Administrasi Pemerintahan, yang memberi wewenang kepada peradilan Tata Usaha Negara untuk menguji unsur penyalahgunaan wewenang dan implikasi wewenang PTUN dalam menguji penyalahgunaan wewenang terhadap penegakan tindak pidana korupsi. Metode yang digunakan dalam penelitian ini adalah penelitian hukum Normatif dengan Teknik penelusuran bahan hukum dilakukan dengan studi Pustaka. Hasil penelitian dengan metode diatas menunjukan bahwa Rasio logis dari Pasal 21 Undang-Undang Nomor 30 tahun 2014 Tentang Administrasi Pemerintahan adalah Pengawasan oleh Peradilan Tata Usaha Negara sebagai sarana pencegahan penyalahgunaan wewenang dalam keputusan dan/atau tindakan (diskresi) oleh pejabat administrasi pemerintahan menjalankan tugas pelayanan dan implikasi hukum yang bisa timbul dari wewenang Peradilan Tata Usaha Negara menguji ada tidaknya penyalahgunaan wewenang yang berkaitan dengan Tindak Pidana Korupsi adalah bahwa Wewenang PTUN membawa implikasi dalam proses penegakan hukum tindak pidana korupsi.  Kata-Kunci: kewenangan, Peradilan Tata Usaha negara, Korupsi The objective to be achieved in this study is to Review, know and analyze the logical ratio of Article 21 paragraph (1) of Law No. 30 of 2014 on Government Administration, which authorizes the State Administrative judiciary to test the elements of abuse of authority and implications of ptun authority in testing abuse of authority against the enforcement of corruption crimes. The method used in this study is Normative legal research with legal material tracing techniques conducted with Pustaka studies. The results of the research with the above method show that the logical ratio of Article 21 of Law No. 30 of 2014 on Government Administration is Supervision by the State Administrative Court as a means of preventing abuse of authority in decisions and /or actions (discretion) by government administration officials carrying out service duties and legal implications that can arise from the authority of the State Administrative Court to test whether or not abuse of authority related to corruption crimes is that the Authority of state administrative judiciary carries implications in the enforcement process of corruption crimes.Keywords: authority, state administrative judiciary, corruption

Abstract

The prohibition or recommendation for the detention of workers 'original documents is not clearly stipulated in the labor law so that some employers detain or retain workers' original documents to be made to bind workers. This is permissible if it becomes an agreement between workers and employers, but of course there will be some risks borne by workers if the original documents are guaranteed. In this case a clear and definite rule is needed regarding the prohibition of hold or save of original documents of workers by employers as an effort to protect workers. The government has the authority to make regulations that can protect workers from arbitrary rules made by employers

Abstract

State as the main subject of international law has the sovereignty to determine to stay or withdraw from membership of an international organization. ASEAN as an international organization has a constituent instrument. ASEAN member states are bound to comply the obligations specified in the ASEAN Charter. However, the ASEAN Charter as the constituent instrument does not set the withdrawal clause. Thus, the possibility of withdrawal of ASEAN members become blurred and indistinct.Keyword : ASEAN Charter, Withdrawal, Vienna Convention 1969

Abstract

Advocate is a free and independent profession. According to the Constitutional Court Decision number 112/PUU–XII/2014 & 36/PUU–XIII/2015. It is interesting that the decision has decided the issue of oath in Article 4 Paragraph (1) Advocate Law, but affects Article 28 Paragraph (1) concerning Advocates Organization. This research is a normative research that uses conceptual approach and legislative approach, which hopefully can dig up and find out the position of Advo- cates Organizations after the Constitutional Court Decision number 112/PUU–XII/2014 & 36/PUU– XIII/2015. It is known from the research that the Constitutional Court is unauthorized to decide which organization is legitimate, although Advocates Organization can also be named as state institution.

Abstract

AbstractProblems arises in the implementation of elections between the election of the President / Vice President who are no longer held separately such as previous Elections. The technical implications are related to the ability of the Constitutional Court to adjudicate disputes over the legislative and presidential elections which are certainly unbalanced with the number of justices and the limited time. This study aims to map the problems experienced by the Constitutional Court in adjudicating disputes over simultaneous election results. The research method used is normative legal research using conceptual, legislation, history and case approach. The results shows that a separation of authority is needed between the disputes over the results of the presidential / vice presidential election with disputes over the results of the DPR, DPD and DPRD elections. The separation is needed to ensure that the election dispute resolution process does not accumulate in one judicial institution and results in a decision which passes the time limit given. With the separation of authority in adjudicating disputes over the results of the presidential election and legislative elections, the Constitutional Court will only focus on adjudicating cases of outcome disputes and other institutions will also focus on prosecuting thousands of legislative electoral disputes. AbstrakTerdapat permasalahan dalam penyelenggaraan pemilihan antara pemilihan Presiden/wakil Presiden yang tidak lagi digelar terpisah. Implikasi teknis berkaitan dengan kemampuan MK dalam mengadili perselisihan pemilu legislatif dan Pilpres yang tentu tidak berimbang dengan jumlah hakim konstitusi dan limitasi waktu yang dimiliki. Penelitian ini bertujuan untuk memetakan problematika yang dialami oleh MK dalam mengadili perselisihan hasil pemilu serentak. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan konsep, peraturan perundang-undangan, sejarah dan kasus. Hasilnya, diperlukan pemisahan kewenangan mengadili antara perselisihan hasil pemilihan umum Presiden/wakil Presiden dengan perselisihan hasil pemilihan umum DPR, DPD, dan DPRD demi menjamin proses penyelesaian perselisihan hasil pemilihan yang tidak menumpuk disatu lembaga peradilan dan berakibat pada putusan yang melewati batas waktu yang diberikan. Pemisahan ini akan membuat Mahkamah Konstitusi hanya fokus mengadili perkara perselisihan hasil saja dan lembaga lain juga fokus mengadili perselisihan Pileg yang jumlahnya ribuan.

Abstract

This study aims to analyze the validity of the designation of acting regional heads as an implication of the postponement of the 2022 and 2023 regional elections. This research is normative, with a statutory and analytical approach. The primary legal material is Law Number 10 of 2016 concerning  Regional Head Elections. Secondary legal materials are articles, books, and research findings gathered through normative research and analyzed using a research methodology. The results showed that the implication of postponing the 2022 and 2023 regional elections caused a vacancy in the position of the regional head, which had implications for the appointment of the TNI/Polri as acting regional head, which deviated from the state rule of law. Based on the decision of the Constitutional Court, the TNI/ Polri can occupy civilian positions if they retire or resign from active service and have gone through the process openly and competitively. Meanwhile, the mechanism for appointing acting regional heads from the TNI/ Polri who are still active has been contrary to the principle of the procedure for the validity of the actions of government officials. So that the government needs to immediately issue a government regulation related to the mechanism for appointing acting regional heads due to the postponement of technical regional elections so that the appointment can have a basis in the selection mechanism and qualification of acting regional heads democraticallyThis study aims to analyze the validity of the designation of acting regional heads as an implication of the postponement of the 2022 and 2023 regional elections.
