Abstract

Cases of crimes involving children as perpetrators of crimes bring their own phenomena. Considering that children are individuals who are still emotionally unstable have become legal subjects, the handling of crime cases with child perpetrators needs special attention, starting from the Criminal Procedure Law applicable to children. The Code of Criminal Procedure of the child regulates in particular the obligations and rights acquired by the child. The handling of children as perpetrators of criminal acts from year to year has always drawn criticism from academics, practitioners and the public. This is more due to the culture that is maintained from generation to generation in the mindset of law enforcement in dealing with criminal offenders. Regarding the systematics or legal order that in fact discusses about children, the existence of child criminal law if a child is committing a criminal act while he is still relatively underage or not legally competent. Children commit immoral acts that are currently happening in Gorontalo. This case really happened and the way the punishment turned out to be very different from adults in general. Abstract

Penelitian ini bertujuan untuk menganalisis efektivitas penerapan sistem whistleblower dalam mengungkap pelanggaran dan penyalahgunaan wewenang di Pemerintah Kabupaten Bone Bolango serta mengkaji bentuk perlindungan hukum yang diberikan kepada pelapor. Pendekatan penelitian yang digunakan adalah metode yuridis normatif dengan analisis terhadap peraturan perundang-undangan yang mengatur mekanisme whistleblower di Indonesia serta penerapannya di tingkat daerah. Hasil penelitian menunjukkan bahwa meskipun sistem whistleblowing telah diimplementasikan sebagai bagian dari reformasi birokrasi, efektivitasnya masih rendah akibat lemahnya infrastruktur teknis, terbatasnya sumber daya manusia, dan belum adanya perangkat hukum daerah yang secara spesifik melindungi pelapor. Perlindungan terhadap whistleblower merupakan faktor penentu dalam keberhasilan sistem ini, karena tanpa jaminan keamanan dan perlindungan hukum, pelapor cenderung enggan untuk mengungkapkan pelanggaran. Diperlukan penguatan regulasi melalui peraturan daerah, peningkatan kapasitas kelembagaan, serta pembentukan budaya birokrasi yang mendukung transparansi agar sistem whistleblower dapat berjalan secara efektif. Kesimpulan penelitian ini menekankan bahwa keberhasilan sistem whistleblower harus ditopang oleh integrasi antara regulasi, komitmen politik, dan kesadaran hukum masyarakat dalam mewujudkan pemerintahan daerah yang bersih, transparan, dan akuntabel.

Abstract

This study interrogates the legal and normative compatibility of applying restorative justice to repeat offenders within Indonesia’s criminal justice framework. Using a normative juridical and qualitative approach, it analyzes statutory provisions, institutional regulations, and a case study of an assault resolved through a restorative mechanism by the Tapa Sector Police in Bone Bolango. The findings reveal a persistent tension between the positivist pursuit of legal certainty and the restorative emphasis on moral rehabilitation and social harmony. Although Police Regulation No. 8 of 2021 explicitly prohibits restorative settlements for recidivists, empirical practice shows that reconciliation can, in certain contexts, produce more equitable and enduring outcomes than punitive sanctions. The study argues that a strict legal exclusion of repeat offenders undermines the humanistic and moral essence of Indonesian law, which aspires to uphold both justice and compassion. It concludes by advocating for the institutionalization of structured discretion, procedural transparency, and inter-agency coordination to harmonize legality with restorative values. Such integration would transform restorative justice from a procedural deviation into a substantive component of Indonesia’s evolving pursuit of humane and balanced justice.
