Abstract

Kebijakan Kriminal Dalam Penanggulangan Tindak Pidana Penganiayaan Menggunakan Panah Wayer Oleh Anak Di Kota Gorontalo (Studi Kasus Polres Gorontalo Kota). Penelitian ini berangkat dari situasi keamanan dan ketertiban umum yang kurang kondusif khususnya pada malam hari dalam kurun waktu beberapa tahun terakhir ini. Permasalahan utamanya adalah pelopor dari tidak kondusifnya keamanan dan ketertiban umum ini adalah anak-anak sehingga perlu adanya kebijakan kriminal dalam penanggulangan permasalahan ini.Metode pendekatan yang digunakan dalam mengkaji permasalahan adalah metode pendekatan Yuridis – Empiris. Hasil penelitian, 1) lingkup Kota Gorontalo, faktor yang menyebabkan terjadinya tindak pidana penganiayaan menggunakan panah wayer oleh anak adalah lingkungan pergaulan tidak sehat yang dikombinasikan dengan mengendurnya ikatan sosial dan keluarga, penyalahgunaan alkohol, obat-obat terlarang dan zat adiktif, serta adanya dorongan-dorangan ide dan sikap yang dibentuk oleh media massa. 2) kebijakan kriminal penanggulangan kejahatan dapat diimplementasikan dengan cara : mempengaruhi pandangan masyarakat mengenai kejahatan dan pemidanaan melalui media massa  yang mana hal ini merupakan jalur non penal, kemudian penerapan hukum pidana yang merupakan jalur penal, dan pencegahan tanpa pidana yang juga termasuk dalam jalur non penal. Sehingga jelas bahwasanya dalam upaya penanggulangan kejahatan ada korelasi antara jalur penal dan non penal.

Abstract

This study aims to discuss the legal weak protection of personal data which is motivated by the phenomenon of society today which is like living in a world without borders so that it impacts on easy access to one's personal information, the impact of begins to spread illegal practices by irresponsible parties in the illegal use of personal information. In addition, there are no laws that specifically regulate the protection of personal data/information in the 4.0 Industrial Revolution era. The approach method used is a conceptual and case approach, with the purpose of the research is to analyze the weakness of legal protection for personal data in the 4.0 Industrial Revolution era in Indonesia. The results of the study, the spread of personal data protection arrangements in various laws and regulations indicate the protection of personal data is not yet a national legal priority and results in legal weak protection of the personal data of citizens so as to position Indonesian citizens in a vulnerable position, which is certainly not in line with the legal objectives namely provide legal certainty, justice, and expediency. The various cases that exist and pay attention to the phenomenon of digitalization in the era of the industrial revolution 4.0 illustrate the urgency of the need for the legal protection of personal data a state priority. Legal reform through the legitimacy of protecting personal data as a responsive and progressive legal policy is a must so that legal protection in the form of legal guarantees can be carried out properly in order to create a safe and comfortable digital ecosystem for the community.

Abstract

The Principle of Constante Justitie, or the principle of a simple, fast, and light trial, is intended so that handling cases can be resolved in a short time. It does not need to take a long time. The problem in this paper is: (1). how is the application of the Constante Justitie principle or the simple, fast, and low-cost principle as expected by justitiabellen? (2). How to renew the criminal justice system through the principle of Constante Justitie, which can guarantee justitiabellen satisfaction. This research is normative juridical research, namely legal research that aims to find methods, norms, or das sollen. The results showed that the application of the principles of justice, speed, and light costs that guarantee justitiabellen satisfaction has not been following the mandate of laws and regulations. The renewal of the criminal justice system, especially the Principle of Constante Justitie, which can guarantee justitiabellen satisfaction, has now been pursued by the Supreme Court by issuing various regulations such as the Supreme Court Rules or PERMA or Supreme Court Circulars or SEMA, but it has not been successful.

Abstract

AbstractI-Doser Application in smartphone had caused public anxiety and seized greater attention. The purpose of this research is to analyze whether the I-Doser Application application could be put into new narcotic category, to understand and to analyze the impact of law vacuum in I-Doser Application arrangement if understood from law certainty perspective, and to analyze law reformulation policy against I-Doser Application as digital narcotic through Indonesia’s ius constituendum. This is a normative research using statute, conceptual and comparative approaches. Result of this research indicated that I-Doser Application was viewed as the base concept of narcotic thus considered as new narcotic category. The implication of law vacuum, I-Doser Application had embedded its hegemony deeper that could ruin national well-being in the future unless a concrete law measure was taken, so that the necessary law reformulation policy against I-Doser Application as digital narcotic within Indonesia’s ius constituendum.AbstrakAplikasi I-Doser yang terdapat pada smartphone menimbulkan keresahan dan menyita perhatian publik. Penulisan ini bertujuan untuk menganalisa aplikasi I-Doser apakah dapat dikategorikan sebagai narkotika baru, memahami dan menganalisa dampak dari kekosongan hukum pengaturan tentang I-Doser dalam perspektif kepastian hukum dan menganalisa kebijakan reformulasi hukum terhadap aplikasi I-Doser sebagai narkotika digital dalam ius constituendum di Indonesia. Penulisan menggunakan jenis penelitian hukum normatif dengan pendekatan undang-undang, konseptual dan komparatif. Hasil pembahasan, aplikasi I-Doser merujuk pada konsep dasar narkotika, dapat dikategorisasikan sebagai narkotika baru. Dampak dari kekosongan hukum, aplikasi I-Doser semakin menancapkan hegemoninya untuk merusak generasi bangsa kedepannya tanpa bisa diberikan sebuah langkah hukum yang kongkrit, sehingga diperlukan kebijakan reformulasi aturan hukum terhadap aplikasi i-doser sebagai narkotika digital dalam ius constituendum di indonesia.

Abstract

Tulisan ini membahas tentang Apa saja dampak dari pencemaran lingkungan akibat sampah elektronik dalam prespektif hukum lingkungan dan membahas tentang pengaturan hukum pidana lingkungan terhadap pencemaran dan pengelolaan sampah elektronik (E-Waste) Di Indonesia. Dalam Undang-Undang Nomor 32 Tahun 2009 tentang perlindungan dan pengelolaan lingkungan hidup dan peraturan pemerintah nomor 101 tahun 2014 tentang pengelolaan limbah Bahan Berbaha Dan Beracun mengatur tentang bagaimana melakukan pengelolaan limbah elektronik. Namun sampai dengan saat ini setiap tahun Indonesia mengalami peningkatan terkait dengan sampah elektronik hal ini di sebabkan oleh perkembangan industri teknologi elektronik yang sangat cepat mengeluarkan dan menawarkan alat elektronik yang terbaru dan lebih canggih, hal tersebut menjadi salah satu pendorong meningkatnya jumlah sampah elektronik tiap tahunnya. Penelitian ini menggunakan penelitian Normatif yang menggunakan metode pengumupulan data dengan cara studi literatur mengenai judul penelitian tersebut. Hasil dari penelitian ini yaitu bahwa pengelolaan sampah elektronik Di Indonesia masih jauh dari kata sempurna selain itu juga untuk pengaturan sampah elelktronik sendiri belum diatur secara spesifik dalam satu peraturan

Abstract

This research examines the Implementation of the Law of Evidence: Comparative of the State of Indonesia and the United States of America. This study aims to analyze the application of evidence in Indonesia and the United States. This study uses normative research methods. The results of this study explain that there is a comparison between the application of evidence before and during the process in trials between the two countries, but over time and Indonesian law has implemented several processes in evidence that were previously used by the United States. It is hoped that lawmakers in Indonesia will be able to quickly find a new law that will not hinder the process of proof, and will not complicate the judiciary.

Abstract

Through Article 2 paragraph (1) of Law of the Republic of Indonesia Number 1 of 2023 concerning the Criminal Code (National Criminal Code), customary law opportunities are open to existing through the prerequisites contained in the Explanation to Article 2 paragraph (1). For this reason, this study aims to determine the opportunities for the existence of Gorontalo customary law through the prerequisites contained in the Explanation of Article 2 paragraph (1) of the National Criminal Code. This research uses normative legal research methods with a statutory approach and conceptual approach and uses primary, secondary and tertiary legal materials. The legal material is then analyzed qualitatively using grammatical, systematic, and historical interpretations. The results showed that Gorontalo customary law exists through the presence of several regional regulations, including (1) Gorontalo Provincial Regulation Number 2 of 2016 concerning the Implementation of Customary Institutions; (2) Gorontalo Mayor Regulation Number 10 of 2020 concerning the Implementation of the Dulohupa Customary Institution of Gorontalo City; and (3) Regional Regulation of Bone Bolango Regency Number 8 of 2020 concerning the Implementation of Customary Institutions. Furthermore, through regulations at the regional level, Gorontalo customary law is also present through concrete events such as the management of customary institutions carried out periodically. Based on this, the regulation of concrete norms related to acts prohibited under living law in regional regulations as required by the Explanation to Article 2 paragraph (1) of the National Criminal Code will have a very large opportunity.

Abstract

Abstract: This study aims to analyze law enforcement for people who refuse vaccination from the perspective of human rights, as well as to examine the obstacles faced by law enforcement in enforcing the law for people who refuse vaccination. This type of research is juridical empirical. The approach used in this research is the statute approach and the case approach. The analysis used in this study is descriptive data analysis using a qualitative approach to secondary data and primary data. The results show that the Government and the Covid-19 task force tend to provide education and rewards to people who want to be vaccinated and provide administrative sanctions for those who refuse, especially the space for movement and regulation of vaccine card requirements in receiving public services by the government and the police. The thing that hinders the process of vaccination to the public is the doubts that arise in the community about the safety and halalness of vaccines caused by hoax news from sources that are not credible.

Abstract

This study aims to determinelegal protection for children as victims of the crime of sexual intercourse.The method used in this research is empirical research methodology. This study uses a qualitative approach and sampling using purposive sampling and using descriptive qualitative analysis techniques. The results of this study indicate thatLegal protection for child victims of the crime of sexual intercourse is given with the aim of protecting victims, especially victims of sexual intercourse in order to get their rights as victims by way of children getting health services as an effort to restore the condition of children as victims of sexual intercourse, children also get legal protection in terms of legal aid, rehabilitation, and prevention. The need for a fair criminal law settlement for victims of sexual intercourse, which adds or considers the rights of victims of sexual intercourse and parents should participate in efforts to provide protection for children by fulfilling children's rights, protecting the best interests of children, and increasing supervision over children. environment and children's play area.
