Abstract

Undang-undang dasar RI mengamanatkan adanya hak atas lingkungan hidup yang baik dan sehat. Namun dalam praktiknya, dengan masih banyaknya kasus lingkungan yang terjadi dewasa ini, tentunya dapat menjadi kritik bagi Pemerintah sebagai organ yang bertanggung jawab penuh terhadap pemenuhan hak tersebut. Berbagai masalah lingkungan yang terjadi, baik kerusakan maupun pencemaran tidak berbanding lurus dengan mekanisme penegakan hukum yang diterapkan oleh Pemerintah. Lahirnya UU No. 32/2009 (UU PPLH) rupanya juga belum mampu menjawab segala problematika penegakan hukum lingkungan di Indonesia. Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup (UUPPLH) telah memasukkan ketentuan pidana dalam Bab XV, yang terdiri dari 23 pasal. Ketentuan pemidanaan ini jauh lebih lengkap dan rinci bila dibandingkan dengan Undang-Undang Nomor 23 Tahun 1997 tentang Lingkungan Hidup yang lama, namun masih banyak hal-hal yang perlu dibenahi dalam UUPPLH tersebut, oleh karenanya dalam tulisan ini akan diuraikan mengenai mekanisme penegakan hukum lingkungan yang berlaku di Indonesia.

Abstract

ABSTRACT This research discusses the juridical study of land acquisition for the public interest in DKI Jakarta Province. This research uses a normative juridical method with an approach to reviewing laws and regulations and the President's Rule with the aim of exploring the rules governing the implementation of land acquisition for development in the public interest, which can be seen from legal sources, legal subjects, legal objects, characteristics and forms. sanctions, as well as the formulation of the criminal and criminal sanctions itself. The results of this study are in the Province of DKI Jakarta, Indonesia. Keywords: Juridical Review, Public Interest, Presidential Regulation No.71 of 2012 ABSTRAK Penelitian ini membahas tentang kajian Yuridis pengadaan Lahan untuk kepentingan umum di Propinsi DKI Jakarta. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan kajian peraturan perundang-undangan dan Peratutan Presiden dengan Tujuuan untuk mendalami tentang aturan yang mengatur tentang Penyelenggaraan Pengadaan tanah bagi pembangunan untuk kepentingan umum, yang dapat dilihat dari sumber hukum, subjek hukum, objek hukum, sifat dan bentuk sanski, serta rumusan pidana dan sanksi pidana itu sendiri. Abstract

Ruas jalan merupakan salah satu hal yang selalu beriringan dengan tuntutan kebutuhan manusia, tuntutan perkembangan jaman dan kemajuan teknologi serta berkembangnya pemikiran manusia sebagai pengguna jalan itu sendiri. Jalan adalah prasarana transportasi darat yang meliputi segala bagian jalan, termasuk bangunan pelengkap dan perlengkapannya yang diperuntukkan bagi lalu lintas, yang berada pada permukaan tanah, di atas permukaan tanah, di bawah permukaan tanah dan/atau air, serta di atas permukaan air, kecuali jalan kereta api, jalan lori, dan jalan kabel. Terjadinya penambahan volume lalu lintas jalan telah mengakibatkan kemacetan lalu lintas pada ruas jalan sekitar Gedung Islamic Centre Madiun (ICM). Kemacetan lalu lintas terjadi karena pergerakan kendaraan keluar masuk gedung ini, perilaku ketidakdisiplinan para penyeberang jalan, dan adanya angkutan umum yang berhenti menunggu penumpang. Tujuan dari penelitian ini untuk mengetahui dampak lalu lintas, volume kendaraan, derajat kejenuhan dan Tingkat pelayanan Level of Service (LOS). Hasil Analisa pada penelitian didapatkan volume puncak kendaraan pada Jalan Sumatera 398 Skr/jam, pada Jalan Dr. Soetomo 1.486,2 Skr/jam, kemudian volume pada kendaraan pada Jalan Sumatera Q = 105.552 skr/jam, Pada Jalan Dr. Soetomo Q = 1955.601 skr/jam. Dan kapasitas ruas Jalan Sumatera C = 6118,78 skr/jam, pada Jalan Dr. Soetomo C = 4960,824 skr/jam, dan derajat kejenuhan pada Jalan Sumatera , pada Jalan Dr. Soetomo DJ = , kemudian Tingkat pelayanan Level of Service (LOS) pada Jalan Sumatra VCR = 0,01 skr/jam (temasuk kategori tingkat pelayanan A) hal 42, Pada Jalan Dr. Soetomo VCR = 0,39 skr/jam (termasuk kategori tingkat pelayanan B) hal 42.

Abstract

Hotmix performance is very dependent on volumetric characteristics and Marshall characteristics, one of the parameters of which is density. Unmet density will affect other Marshall parameters which can also result in early damage to road pavement. This thesis is the result of research in the field and in the laboratory which aims to analyze the effect of temperature at the stage of exposure, and the stage of compaction as well as the number of compaction paths on the density of pavement AC-WC type IVB Asphalt Institute. Research in the field is divided into two categories that are distinguished at the temperature of the exposure to meet the specification requirements and do not meet. The results showed that there was a tendency that the temperature of the dispersion in the range of requirements had a stronger correlation to get the value of the hotmix density according to the requirements compared to the overlay temperature not in the range of requirements. The regression equation model relates the laying temperature (X1), the initial compaction temperature (X2), and the number of compaction paths (X3) to the hotmix density (Y) obtained are: Y = 82,7 + 0,021X1 + 0,033X2 + 0,409X3.

Abstract

The government has made many efforts to improve the quality of human resources, one of which is by procuring government goods and services by government agencies. The State of Indonesia is a legal country that is developing (developing country), which is currently actively carrying out development in all fields. Development is an effort to create prosperity and welfare of the people. Procurement that uses providers of goods and services, both as business entities and individuals, is basically carried out through the selection of providers of goods and services. Procurement of government goods and services by direct procurement is carried out by procurement officials by buying goods or paying for services directly to providers of goods and services, without going through a tender or selection process. In essence, direct procurement is normal, where between providers who have procurement goods and services that require goods and services there is an agreement to conduct a tender for goods and services at a certain price.

Abstract

Penelitian ini didasari oleh pemikiran bahwa pembentukan Badan Permusyawaratan Desa (BPD) adalah untuk mendukung pemerintahan Desa agar mampu meningkatkan kesejahteraan dan kesejahteraan di desa. BPD merupakan lembaga yang melaksanakan fungsi pemerintahan yang anggotanya merupakan wakil dari penduduk Desa berdasarkan keterwakilan wilayah dan ditetapkan secara demokratis. Pembentukan BPD dimaksudkan untuk mendampingi dan membantu Kepala Desa dalam menyelenggarakan Pemerintahan Desa. Dasar hukum pembentukan BPD adalah amanah dari Undang-Undang Nomor 6 Tahun 2014 tentang Desa. Dalam Pasal 55 UU Desa diatur tentang fungsi BPD yaitu: (a)membahas dan menyepakati rencana Peraturan Desa bersama Kepala Desa; (b) menggali, menampung, dan menyalurkan aspirasi masyarakat; (c) pengawasan terhadap kinerja Kepala Desa. Dalam kaitannya dengan fungsi pertama BPD yaitu membahas dan menyepakati rancangan Peraturan Desa bersama Kepala Desa, timbul pertanyaan apakah fungsi ini sudah terlaksana atau belum. Atas dasar permasalahan tersebut, permasalahan penelitian ini adalah: (1) bagaimana pelaksanaan fungsi Badan Permusyawaratan Desa (BPD) dalam pembentukan peraturan desa, dan (2) bagaimana optimalisasi keahlian anggota Badan Permusyawaratan Desa (BPD) dalam pembentukan peraturan desa yang partisipatif. Metode yang digunakan dalam penelitian ini bersifat deskriptif, dengan pendekatan yuridis sosiologis. Pengumpulan data primer dilakukan melalui wawancara danFocus Group Discussion (FGD) dengan perwakilan anggota BPD (7 desa) se-Kecamatan Tarumajaya, pejabat Kecamatan, dan tokoh masyarakat desa di Kecamatan Tarumajaya. Data primer di atas dilengkapi dengan data sekunder yang dikumpulkan melalui studi dokumen peraturan desa dan sumber-sumber kepustakaan lainnya. Hasil penelitian menggambarkan: (1) pelaksanaan fungsi Badan Permusyawaratan Desa (BPD) di Kecamatan Tarumajaya dalam pembentukan peraturan desa relative telah dijalankan. Pada setiap desa telah diterbitkan peraturan desa baik hasil inisiatif anggota BPD maupun kepala desa yang perancangannya dibahas bersama; (2) Namun keahlian anggota Badan Permusyawaratan Desa (BPD) dalam pembentukan peraturan desa yang partisipatif belum optimal sehingga perlu ditingkatkan. Optimalisasi keahlian perlu dilakukan pada semua tahapan penyusunan peraturan desa, mulai dari perencanaan, perancangan, pembahasan, sampai ke pengundangan. Adapun bentuk optimalisasi keahlian yang perlu dilakukan adalah melalui pemberian bimbingan teknis ketrampilan perancangan (legal drafting)dan program pendampingan penyusunan peraturan desa yang partisipatif sesuai kebutuhan masyarakat.

Abstract

Sharia Bank is an Islamic bank that is starting to be in great demand by Indonesians, especially Muslims. Financing. In the running of the IMBT contract, bad credit problems often occur by the customer to the bank with guarantees of security rights to pay off their obligations. Usually the bank will ask the Head of the Religious Court to carry out the execution. When there is no good faith from the customer to the bank, the bank asks the Head of the Religious Court to submit a written auction request to (KPKNL) to sell auction of goods that have been executed. In this paper, the author focuses on the formulation of the problem, namely: 1. How is the IMBT model of shari'ah financing mechanism with guarantees of mortgage rights? auction implementation of the mortgage rights of Ijarah Muntahiya Bittamlik syari'ah financing with guarantees of coverage rights at BUPLN ? Bank Syariah merupakan bank Islam yang mulai banyak diminati oleh masyarakat Indonesia khususnya kaum muslim. Dalam berjalannya akad IMBT sering terjadi kendala kredit macet yang dilakukan oleh nasabah kepada bank dengan jaminan hak tanggungan untuk melunasi kewajibannya. Biasanya bank akan meminta kepada Ketua Pengadilan Agama untuk dilakanakannya eksekusi. Ketika tidak ada itikad baik dari nasabah kepada bank, bank memohon Ketua Pengadilan Agama untuk mengajukan permohonan lelang secara tertulis kepada (KPKNL) untuk mejual lelang barang-barang yang telah di sita eksekusi. Dalam penulisan ini, penulis menitikberatkan kepada rumusan masalah yaitu: 1. Bagaimana mekanisme pembiayaan syari’ah model IMBT dengan jaminan hak tanggungan?, 2. Bagaimana penyelesaian kredit macet pembiayaan syari’ah IMBT di pengadilan agama dengan jaminan hak tanggungan?, 3. Bagaimana implemestasi pelelangan terhadap hak tanggungan dari pembiayaan syari’ah Ijarah Muntahiya Bittamlik dengan jaminan hak tangungan di BUPLN?

Abstract

The E-Court system in Indonesia is an embodiment of the principles of simple, fast and low-cost justice, as well as technological transformation in the case administration system in court. The E-Court system has been running in all courts in Indonesia since 2018, then in 2019 the Supreme Court implemented the E-Litigation system, namely electronic-based trials and the arrangements continue to be refined, especially with the issuance of Supreme Court Regulation Number 7 of 2022 concerning Amendments to Supreme Court Regulation Number 1 2019 concerning Electronic Administration of Cases and Trials in Court. By implementing E-Litigation, apart from making trials easier and saving time, it will of course also reduce the intensity of meetings with the parties so that bribery and gratification do not occur in the judicial environment. Seeing that the implementation of the electronic trial system in Indonesia is still relatively new, it is necessary to compare with other countries such as Malaysia (2011) and Singapore (2015) which first implemented both E-Court and E-Litigation to see what things need to be optimized in implementation of an electronic trial system so that it can prevent the practice of bribery and gratification. The research methodology used in this research is normative-empirical legal research. The problems to be studied are: 1) What is the trial mechanism through the E-litigation system in Indonesia, Malaysia and Singapore? 2) How to optimize the implementation of e-litigation based trials in reducing bribery and gratification?

Abstract

Anggun Lupita, 2018, Legal Protection against Users of Online Transportation Services, Thesis, Faculty of Law, Islamic University as-Shafi'iyah, Jakarta. This research aims to find out the implementation of legal protections for consumers of online transportation service users who experience losses or accidents and dispute resolution of users of online transportation services. The purpose of this study is to find out how to implement legal protections for consumers of online transportation service users who experience losses or accidents. Formulation of the problem: (1) How to implement legal protections against consumers of online transportation service users. (2) How to resolve disputes with users of online transportation services. Company PT. Go-Jek as an online transportation provider company must provide compensation or insurance to consumers of online transportation service users in the form of Go-Car who have an accident, stipulated in Article 237 of Law No. 22 of 2009 on Traffic and Road Transportation expressly requires public transportation companies to follow the accident insurance program as a form of responsibility for insurance guarantees for accident victims. In the implementation of legal protections for consumers of online transportation service users who have a Go-Car accident, PT. Go-Jek as a transportation provider of Go-Jek only provides compensation or insurance of Rp 10,000,000.00 and hospital costs of Rp 5,000,000.00, as a form of responsibility and compensation to consumers who have experienced accidents. In the settlement of disputes of users of online transportation services that occur in go-car accident cases in Manado that occur by consumers are out of court (non-litigation) or familially in accordance with the results of the agreement of the parties. The conclusion of this study according to the authors of the implementation of compensation in the form of compensation or insurance to consumers of go-car online transportation service users as victims of accidents is unfair and not in accordance with the Regulation of the Minister of Finance No. 16 of 2017 on Large Compensation and Mandatory Contribution of Road Traffic Accident Fund, compensation for victims of road traffic accidents.

Abstract

Lina Marlena, 1220160040, Law Enforcement Against Circulation Of Drugs That Do Not Have ACirculation Permit During The Covid 19 Pandemic. Faculty of Law, Universitas Islam Assyafi’iyah, 2020. The purpose of this study is to determine law enforcement efforts without adistribution permit during the Covid 19 pandemic. This research uses a juridical-empirical researchmethod, a problem approach based on applicable laws and regulations, then touches on legalprinciples and facts of events. that happens on the field. The results of the study can be concludedthat someone can be said to have carried out the act of circulating illegal drugs if they violate articles196-197 of Law No. 36 of 2009 concerning Health. Meanwhile, corporations that carry out illegal drug distribution are charged under Article 201 of the Health Law and also for law enforcement, forperpetrators who have circulated illegal drugs, there are several sanctions, namely for criminal sanctions the perpetrator can be subjected to articles in accordance with the health law. , and forcivil sanctions the perpetrator is responsible for providing compensation for damages or losses to consumers as a result of consuming goods, and finally administrative sanctions in the form of verbal warnings, revocation of business licenses, and imposition of disciplinary penalties based onprevailing laws and regulations.
