Abstract

Abstract: Neglected land is land that has received rights from the state in the form of property rights, land use rights, building rights, usage rights and administrative rights or the basis for the control of land that is not cultivated, not used or not used according to the circumstances or nature and nature the purpose of granting rights or the basis of their control. Determination of the abandoned country in accordance with Article 19 paragraph 1, the percentage of the abandoned land area is divided into the following groups: (a) 100 percent distributed, (b) more than 25 percent to less than 100 percent displaced,, and (d) distributed less than or equal to 25 percent. Sanctions pursuant to Article 23 paragraph 1 must be cleared of land that has been designated as abandoned land within a period of 1 (one) month after the decision on the determination of the abandoned land has been made by the former rights holder of the items located thereon. (2) If the former right holder does not fulfill the obligations mentioned in paragraph 1, the objects on it no longer belong to him and are controlled directly by the state.Keywords: Neglected land; Rights holders; penalty

Abstract

Abstract: The increasing demand for land also increases land issues that need to be addressed immediately. Land dispute is a land dispute between individuals, legal entities or institutions that does not have far-reaching implications. Typology of land disputes handled by the Department of ATR / BPN are grouped into: (1) land ownership and property; (2) establishment of land rights and registration; (3) boundary / location of parcels; (4) land acquisition; (5) subject of land reform; (6) Claims for damages for private property; (7) Ulayat Land; (8) Implementation of court decisions. Dispute resolution through consultation and consensus that ends in peace is always better than through court or arbitration. The problem under investigation is the role of the Bengkulu Land Office as a mediator in settling land disputes in Bengkulu City. What are the obstacles in the settlement of land disputes in the city carried out by the Bengkulu City Land Bureau. Abstract

 Abstract: The most disadvantaged child is a child chosen 5-18 years due to a certain cause (due to several groups: poverty, one of the parents / guardian who is sick, one / both parents / guardian), the family is not harmonious, there is no caregiver) so it cannot fulfill basic needs physically, spiritually, or socially. In the city of Bengkulu at the present time every meeting involving children is scheduled between 5-18 years and the children are busking and asking for mercy by two-wheeled or four-wheeled motorists. Pay attention to the attention of the Bengkulu city government in handling and providing assistance to the outermost child so that in this case the bBengkulu provincial government has overcome the 1945 Constitution. Hoping the government has responsibility for the care and guidance of abandoned children. How is the concept of al-maul shelter in providing assistance to neglected children in the city of Bengkulu. to find out the role of open houses in providing assistance for abandoned children in the city of Bengkulu. Empirical Law Research is a legal research method that uses empirical facts derived from human behavior, both verbal policies obtained from interviews and research conducted through direct search. Primary data is data obtained directly from the field based on respondents and informants. Secondary data is obtained from literature books, regulations, internet browsing, and other documents. Abstract

KKN merupakan wujud dari praktik kegiatan pembelajaran dalam rangka penerapan ilmu pengetahuan yang bersifat interdisipliner yang dilaksanakan oleh mahasiswa secara langsung di tengah lingkungan masyarakat. Pelaksanaan KKN diharapkan dapat meningkatkan empati mahasiswa serta dapat memberikan sumbangan penyelesaian persoalan yang ada di masyarakat, terutama di tengah masa pandemi Covid-19 seperti saat ini. Mengkonsumsi minuman herbal merupakan salah satu yang dapat menjaga imunitas tubuh seseorang. Oleh karena itu dengan adanya kegiatan KKN Mandiri dengan program kerja yang akan dilakukan oleh mahasiswa diharapkan dapat ikut membantu warga Desa Air Sebakul dalam menangani serta mencegah penyebaran virus covid 19 ini dengan melakukan pengolahan minuman herbal dari jahe merah untuk menjaga dan miningkatkan imun tubuh. jahe dibedakan menjadi tiga golongan. Yaitu jahe putih besar yang disebut juga jahe badak, jahe putih kecil,  jahemerah. . Jahe merah, juga dikenal sebagai jahe pahit, memiliki rimpang merah atau keabu-abuan. Umumnya jahe merah berukuran kecil dan digunakan dalam berbagai macam obat. Di Jawa, jahe merah digunakan sebagai penawar racun ular.   Kata Kunci: jahe merah, minuman, herbal

Abstract

Indonesia as an archipelagic country, the existence of fish resources contained in Indonesian waters is quite large, both in terms of quality and various types that can be managed and utilized for the benefit of the nation and state, especially society as a whole. Based on Law Number 16 of 1964 concerning the System for Production Sharing Patterns, cultivator fishermen in marine fisheries will get a share of 75% of the net output if a sailboat is used and 40% if a motor boat is used. This study aims to determine the form of fishery production sharing agreements between owner fishermen and working fishermen in the Malabero fishing community in Bengkulu City, to find out how the profit sharing system is implemented by the Malabero fishing community in Bengkulu City, and to find out how legal protection is for owner fishermen and fishermen. cultivators in a fishery production sharing system. The research method used is empirical and normative. The empirical approach is research conducted by analyzing problems by combining legal materials which are a group of secondary data and combined with primary data obtained in the field. The practice of profit sharing that occurs in the fishing community of Malabero village, Bengkulu City has occurred based on local customs or has been passed down from generation to generation and is a local wisdom carried out by pledging a profit sharing agreement in the form of speech / oral without any written evidence and only attended by a few witnesses Usually, the fishery product sharing carried out by the fishing community of Malabero village, Bengkulu City, the owner fisherman will get a share of 50% of the net result and the cultivator fishermen will get a share of 10% of the net result after the ship departure costs are issued. This explanation is based on fishing gear in the form of net, while fishing gear in the form of owner's trawl will get 50% share and cultivator fishermen will get a share of 25% of the net proceeds after the ship departure costs are incurred. Therefore, it is necessary to have a form of fishery production sharing agreement between owner fishermen and cultivator fishermen which is more legally proven, and there is a need for regulations that can protect fishermen in terms of fishery production sharing patterns, especially for small (traditional) fishermen.

Abstract

Consumer Financing Agreements between finance companies called creditors who are domiciled as fiduciary recipients and debtors as fiduciary givers often default. Creditors' efforts to protect the object of collateral and to minimize non-performing loans from debtors require a Fiduciary Guarantee Institution. Based on the Consumer Financing Agreement that has been mutually agreed upon between the two parties, one of the consequences arising from the default is the withdrawal or execution of the object that is the fiduciary guarantee. PT. Mandiri Tunas Finance is one of the financing companies in Bengkulu, a multi-finance company that runs its business in accordance with applicable laws and regulations. In an effort to ensure the settlement of receivables PT. Mandiri Tunas Finance also registers fiduciary guarantees for objects that are collateral for debts. The focus of the research and the study in this research is how the execution process reaches the auction stage. The method used is empirical juridical also known as juridical sociological research where research can be carried out by observing data sources in the field. Based on the results of this study that the process of executing the object of fiduciary guarantees at PT. Mandiri Tunas Finance Bengkulu Branch was carried out on the basis of the provisions of Law Number 42 of 1999 concerning Fiduciary Guarantees that creditors have parate executie rights. The auction process for fiduciary guarantee objects at PT. Mandiri Tunas Finance Bengkulu Branch is carried out when the debtor does not heed the opportunity given by the creditor to pay off his debt as stated in the Credit Settlement Letter (SPK) given by the creditor after the execution is carried out.

Abstract

Hukum adat yang diberlakukan masyarakat adat serawai khususnya di desa Sendawar memberikan dampak yang cukup besar dalam kehidupan sosial dan budaya. Masyarakat yang melanggar aturan hukum adat akan dikenakan sanksi adat yang sesuai dengan perbuatan yang dilanggar. Tujuan Penelitian adalah, Untuk menjelaskan Bagaimana Pelaksanaan sanksi adat serawai terhadap pelaku penggarap tanah ulayat berdasarkan hukum adat di desa sendawar, dan untuk mengetahui dan menjelaskan hambatan-hambatan dalam pelaksanaan sanksi adat bagi masyarakat adat serawai desa sendawar, kecamatan semidang alas maras, kabupaten seluma. Jenis penelitian ini adalah empiris. Dengan menggunakan metode kualitatif. Pengumpulan data dilakukan dengan wawancara dan observasi dan pegumpulan data sekunder. Hasil penelitian menunjukkan : pertama Pelaksanaan sanksi adat merupakan tindakan yang dilakukan oleh lembaga adat dalam rangka melaksanakan ketentuan hukum adat untuk memberikan hukuman kepada masyarakat yang melanggar ketentuan hukum adat, penyelesaian sanksi adat serawai tentang tanah pelaku pengarap tanah ulayat adalah melalui jalur non litigasi yaitu mediasi, lembaga adat mengumpulkan pihak yang melakukan perbuatan melanggar hukum adat, mengadakan musyawarah, memberikan putusan dan sanksi sesuai hukum adat serawai, kedua Hambatan dalam pelaksanaan sanksi adat yaitu Faktor Tempramen, Tingkat Pendidikan, Kedisplinan, Kurangnya Kesadaran Masyarakat dalam Mentaati peraturan Adat, Faktor Ekonomi dan Ketidaktahuan Masyarakat tentang Tanah Adat/Ulayat.

Abstract

Selain pemakai, remaja dijadikan sebagai perantara untuk mengedarkan narkotika di tingkat sekolah. Beberapa remaja yang ditangkap sebagai pengedar tidak mengetahui mengenai apa yang disangkakan. Kewajiban memberikan bantuan hukum bagi orang atau kelompok miskin oleh advokat sejalan dengan prinsip justice for all dan hak untuk didampingi oleh advokat tanpa kecuali. Dalam sistem hukum pidana yang belum mencapai titik keterpaduan, pembelaan bagi orang atau kelompok miskin tetap diperlukan. Tulisan ini membahas mengenai peran pengacara dalam hal pendampingan hukum bagi korban penyalahgunaan narkoba di Kota Bengkulu. Penelitian ini dilakukan dengan pendekatan hukum empiris dengan mengamati perilaku verbal maupun nyata. Hasil penelitian menunjukkan bahwa, informasi berkaitan pemberian hukum secara gratis belum maksimal. Masih banyak pengguna narkotika yang berhadapan dengan hukum tidak mendapatkan pendampingan/ bantuan hukum yang menimbulkan ketidakberdayaan. Perlu adanya ketentuan untuk memberikan bantuan hukum kepada tersangka dan terdakwa yang disangka dan didakwa melakukan tindak pidana dengan ancaman pidana di bawah lima tahun.
