Abstract

Abstract:  Islam as a religion that comes from Allah does not only talk about the problems of ubudiyah and the hereafter, but also talks about various aspects of life, including governance. However, it is recognized that it is strictly and clearly not found the concept of government or caliphate in Islam, let alone the concept of the state in the sense of nation-state. Understanding the concept of the state will feel more complicated when we include various points of view and perspectives. Because the order to establish a state will not be found in the literature of the Holy Qur'an and the Hadith of the Prophet. However, when we want to know the organs of this country, we find many in the Al-Quran and Hadith. Islam is a cooperative religion, discussing all issues, both ukhrawi and worldly problems. From this worldly discussion, it will definitely discuss constitutional issues including discussing the issue of the concept of the state according to Islam. The purpose of this research is to add and enrich the knowledge about the state as a positive side.Keywords: Concept, State, Islamic Scholar

Abstract

One of the proposed local government regulations (Perda) proposed by the members of district parliament  (DPRD) of the city of Serang is Perda number 1 year 2011 about the annual parking system in the side of  public road which received records from the Ministry of Home Affairs and Ministry of Finance so that it could not be implemented in Serang City.  The focus of this research is the implications of the unenactment of Perda number 1 year 2011 against the implementation of the local government of Serang. The research method used was qualitative with normative and juridical approach empirically. The results showed that Perda of Serang City initiative could not be enforced because it is contrary to the higher Perda.  Its implications for the regional government of Serang City is the parliament of Serang was not working well in impelementing their legislation function.

Abstract

This study examines the implementation of Perda No. 4 of 2008 in the process of infrastructure development in Nagari Koto Baru, Sungai Tarab District by looking at the Siyasah Dusturiyyah perspective. This research was conducted using field research methods. From the results of the study it can be concluded that the implementation of Tanah Datar Regional Regulation Number 4 of 2008 in the process of infrastructure development in Nagari Koto Baru, Sungai Tarab District is appropriate and well implemented in accordance with the provisions contained in Article 106 of Tanah Datar District Regulation Number 4 of 2008 concerning Nagari . Meanwhile, Siyasah Dusturiyah's review regarding the implementation of Tanah Datar Regional Regulation Number 4 of 2008 in the process of infrastructure development in Nagari Koto Baru, Sungai Tarab District is appropriate and in line with the principles of deliberation. Whereas the executor of the Law, namely the executive, is also referred to in the siyasah dusturiyah as sulthah tanfidziyah which discusses the issue of Imamat or leadership in the Nagari Koto Baru Government who has run the government in accordance with the principles of fath adz-dzari'ah and the sixth rule of branch fiqh rules according to the majority of scholars who become a reference for leaders and government in making policies related to the people.

Abstract

This article aims at discussing the struggle of one of the Umayyads’ descendants who was able to escape from the Abbasid army from the city of Damascus (Syria) to Andalusia (Al-Andalus). He managed to re-establish the power of the Umayyads in Andalusia after the collapse of their power in Damascus, due to the Abbasid army attack. A qualitative method with library research-based was used in conducting this study, the data were analyzed by using qualitative descriptive approach, technical descriptive analysis, and content analysis. The results showed that ‘Abdurrahman Ad-Dakhil had great talent and strong influence with the result that Islamic Spain could be united under his rule. He was very instrumental in building a government in Andalusia in such a way that the Andalusian State could compete with the influence of the Abbasid Daulahh’s power in Baghdad. Thus, he is one of the most important figures in Islamic history. He became an inspirational figure because of having persistency, intelligence, thorough struggle, and upholding Islamic law.

Abstract

One of the stressings of President Jokowi's government is governance to accelerate the achievement of bureaucratic reform goals contained in the 2020-2024 bureaucratic reform roadmap, especially related to clean and accountable bureaucracy, and excellent public services, it is necessary to build an Integrity Zone (ZI) in the Religious Courts (PA). The purpose of this study is to analyze the Implementation of the Bureaucratic Reform Policy in the West Sumatra Religious Court with research locations in PA Padang, Pariaman, Payakumbuh, Batusangkar, and Talu. Qualitative descriptive research methods. Data were collected through documentation studies and interviews. Then the data is analyzed through the stages of data collection, data condensation, data display, and finally conclusion. Based on the results and analysis of research, it shows that the implementation of ZI in religious courts in West Sumatra has not been well internalized due to several factors, namely (1) the leverage component consists of two, namely aspects of fulfillment and reform. The five research locus of PA Padang, PA Pariaman, PA Payakumbuh, PA Batusangkar, and PA Talu still focus on fulfilling documents only. So that the reform aspect does not occur significant changes in the dynamic organizational structure and so do human resources that are still lacking in Ber-AKHLAK (service, accountable, competent, harmonious, loyal, adaptive, and collaborative); and (2) the impact of ZI implementation on customer satisfaction by looking at the results of public satisfaction surveys and the corruption perception index is very good.

Abstract

: Pokok permasalahan dalam penelitian ini adalah analisis dampak kebijakan Peraturan Menteri Pehubungan Nomor 118 Tahun 2018 Tentang Angkutan Sewa Khusus terhadap Pasal 27 ayat (2) Undang-Undang Dasar 1945 Perspektif Fiqh Siyasah”Jenis penelitian yang digunakan adalah penelitian kepustakaan (library research) dengan menggunakan metode penelitian normatif. Yaitu menganalisis dampak kebijakan Peraturan Menteri Perhubungangan Nomor 118 Tahun 2018 terhadap Pasal 27 ayat (2) Undang-Undang Dasar 1945. Hasil penelitian menunjukan bahwa pertama: peraturan Menteri Perhubungan Nomor 118 Tahun 2018 Tentang Angkutan Sewa Khusus yang mengatur tentang Transportasi taksi online sudah beberapakali dilakukan  perubahan tapi masih saja merugikan angkutan konvesional (angkutan umum), adanya kelonggaran untuk angkutan transportasi online dari segi Izin operasi, warna plat kendaraan, tempat mengambil penumpang, dan tarif adalah aspek-aspek yang menjadi poin utama konflik yang terjadi di antara transportasi konvensional dan transportasi online, sehingga membuat transportasi online ini dianggap memonopoli tarif transportasi. Dalam Pasal 27 ayat (2) Undang-Undang Dasar 1945 menyatakan bahwa setiap Warga Negara Indonesia berhak atas pekerjaan dan penghidupan yang layak bagi kemanusiaan dimana perkembangan teknologi tidak dapat di batasi karena seiiring pekembangan zaman teknologi juga terus berkembang terutama di bidang transportasi, keberadaan transportasi online menimbulkan dampak positif  bagi pengguna yang sudah terbiasa menggunakan kecanggihan teknologi smart phone, dampak negagatif bagi masyarakat yang ketinggalan teknologi karena tidak dapat menggunakan transportasi online dan menurunya penggunaan angkutan konvesional ( angkutan umum) karena adanya moda transportasi online yang lebih efesien dan efektif. Kedua: menurut fiqh siyasah bahwa kebijakan Peraturan Menteri Perhubungan Nomor 118 tahun 2018 belum memenuhi kriteria dalam pembentukan peraturan perundang-undangan dalam siyasah dusturiyah, karena adanya ketidak kesetaraan yang di timbulkan oleh peraturan terhadap angkutan konvesional (angkutan umum) sehingga memicu persaingan tidak sehat di bidang transportasi. Pemerintah sebagai pembuat kebijakan harus mementingkan kemaslahatan umat, kemaslahatan ini di dapatkan oleh semua kalangan tanpa terkecuali, namun dalam Peraturan Menteri Perhubungan Nomor 118 Tahun 2018 pemerintah lebih pro terhdap akungktan online, dan berdampak kerugian bagi angkutan konvesional (umum) dari segi pekerjaan dan pendapatan yang terus berkurang.

Abstract

The problem in writing this thesis is to examine the rules regarding procedures or rules for dismissing nagari officials. The purpose of this research is to find out and explain the mechanism for dismissing the nagari apparatus by the Wali Nagari and to find out and analyze the siyasah dusturiyah review of the dismissal of the nagari apparatus. To answer the object of study in this study, the authors use the type of normative legal research or (Library research), namely research that explores law as norms, rules, legal principles, legal principles, legal doctrine, and legal theory. Therefore, this research was conducted by examining library materials to answer legal issues regarding the nagari dismissal system carried out by the Wali Nagari in Nagari Barulak and the perspective of fiqh siyasah dusturiyah through data obtained from the literature. This normative legal research uses a qualitative typology, namely a literature search which is analyzed and described in a comprehensive manner related to the dismissal system of the nagari apparatus carried out by the Wali Nagari in Nagari Barulak. The results of this study: nagari devices that have been determined by the rules. A review of siyasa dusturiyah fiqh in the topic of study Siyasa Qadha'iyah emphasizes that leaders should supervise and guarantee the implementation of statutory values in the community sphere. However, the Wali Nagari Barulak as the leader has made a decision that has violated the law. As well as indirectly his actions have violated the values or mandate of the Al-Quran and the Prophet's Hadith regarding justice and leadership principles.

Abstract

: This study examines the abuse of authority committed by Government Officials, in this case the Head of the Tanah Datar Regency Koperindag Office for the 2019 Period. This research is a Library Research research. The researchers' secondary data sources are taken from Law Number 30 of 2014 concerning Government Administration and books related to research. The results of the research obtained by the author are that the former Head of the Koperindag Office of Tanah Datar Regency for the 2019 period allegedly violated Article 10 Paragraph (1) Letter e of Law Number 30 of 2014 because he had abused his authority in this case based on the source of attribution authority regarding a bribery case with a contractor of the X Koto market construction project, Tanah Datar Regency. According to Siyasah Dusturiyah, Government Officials fall within the scope of Wizarah Tanfidz. Islam forbids any abuse of authority by Government Officials because Allah forbids bribers and bribes in legal matters

Abstract

The results of the author's research in this study that the fulfillment of chidren's rights in positive law is fully regulated by law in which it is regulated explicitly and clearly both the fulfillment of the rights of the child itself and the sanctions for violators. whereas in Islamic constitutional law, the fulfullment of children's rights is explained in the arguments of the Qur'an, hadith, compilations of Islamic law, and also MUI fatwas where are clear. but the similarity is that in positive law and Islamic constitutional law the fulfillment of children's rights is fully guarded and protected so that the child's life is safe and peaceful..

Abstract

This study examines the Review of Article 82 of Law Number 6 of 2014 concerning Check and Balance from the Siyasah Dusturiyah Perspective (Case Study in Nagari Situmbuk, Salimpaung District, Tanah Datar District). The problems are (1) To find out and explain that the Situmbuk Nagari Government has carried out functions and supervision (check and balance) based on Article 82 of Law Number 6 of 2014. (2) To find out and explain Siyasa Dusturiyah's views on the implementation of Article 82 of Law Number 6 of 2014 by the Nagari Situmbuk Government. From these problems the question arises (1) Has the Nagari Situmbuk Government carried out its functions and controls (check and balance) based on Article 82 of Law Number 6 of 2014. (2) What is Siyasah Dusturiyah's view of the implementation of Article 82 of Law Number 6 of 2014 by the Nagari Situmbuk Government. This research is a field research. Data was obtained through interviews with Wali Nagari, Jorong Heads, and community leaders. After the data is collected and processed by collecting data and analyzed by examining the data obtained from related information and literature. Collecting data sources, classifying data and compiling data based on categories in research. Interpretation of the data, namely after the data has been collected and classified, then describes the data in appropriate words. After the data is arranged and classified, then draw conclusions to get conclusions to answer the problems that have been examined. This research found that the results of the Situmbuk Nagari Government had not fully carried out its functions and supervision (check and balance) in accordance with what was mandated in Article 82 of Law Number 6 of 2014, based on the results of interviews and research conducted by the author, there were differences in perception between the Wali Nagari and Community leaders in this case were represented by Ninik Mamak, Cadiak Pandai, Alim Ulama, Bundo Kanduang.
