Abstract

In accordance with the characteristics of empirical legal research using secondary data and the approach to this research is taken from legislation and revelation. Then the instrument used in this study is the cluster technique or called area sampling and interviews. The results showed; First, that there are too many statutory arrangements relating to bribery from time to time, there is no significant change from the description of the articles, it's just that the threat of punishment is getting heavier, and even overlaps with each other. Second, that the Medan District Court basically in adjudicating and deciding cases of bribery in corruption cases have used the prevailing laws and regulations, namely Law no. 31 of 1999 concerning the Eradication of Corruption Crime as amended by Law no. 20 of 2001 concerning Amendments to Law no. 31 of 1999 concerning the Eradication of Corruption Crime, however in applying the articles against the defendant still using a subjective interpretation. Third, that the responsibility for a criminal act only refers to prohibition and threatening of an act with a crime, whether the person who commits the act is then sentenced to punishment, this depends on whether in doing this act he has an error ( Geen straf zonder schuld; Actus non facit reum nisi mens sist rea ). This principle is not stated in written law but in unwritten law which also applies in Indonesia. The fiscal criminal law does not use mistakes. In fiscal punishment, if a person has violated the provisions, then he will be given a fine and confiscation. Corruption Crime Court. Whereas criminal responsibility for corruption perpetrators in the perspective of Islamic law is a lot of expert opinions, some are proposing cutting off hands, ta'zir , imprisonment and even the death penalty due to criminal acts of corruption which relies on syariqoh, ghulul , risywah and so on.

Abstract

Penelitian ini bertujuan untuk menganalisis hukum meninggalkan sholat jumat sebanyak 3 kali selama Covid-19 berdasarkan syariat Islam. Sebagaimana kita ketahui bersama pada awal wabah Covid-19 ditengah gegap gempitanya masyarakat Indonesia akan hal tersebut sehingga pemerintah memberlakukan berbagai regulasi untuk mencegah wabah tersebut mulai dari peniadaan sholat jumat, pembelajaran berbasis daring dan lain sebagainya. Penelitian ini menggunakan pendekatan kualitatif dengan jenis studi pustaka. Karena penelitian ini akan menganalisis secara kritis hukum meninggalkan sholat jumat. Hasil penelitian menunjukan bahwa meninggalkan sholat jumat selama pandemi Covid-19 terdapat 2 versi yaitu ada yang membolehkan karena kondisi darurat akan tetapi disisi lain ada yang mengatakan haram meninggalkan sholat jumat.

Abstract

Al-Qur'an is the highest source of law in the rules of Islamic law, while the 1945 Constitution is also the basis as well as norms in positive legal rules. In the legal system in Indonesia, the Qur'an can be used as a source of law in positive law as well as customary law and western law which have contributed to the national legal system, as well as the Qur'an, which is a source of Islamic law, has also contributed to the religious justice system in Indonesia. Thus, there is no longer any view that the application of laws originating from Islamic law is said to be radical and so on. Islamic law as a living law will still exist as a complement to national law. The application and enforcement of Islamic law in Indonesia can be incorporated into national law, either through positive Islamic law or through Islamic legal values that apply to all citizens. Both are influenced by political will which will shape the politics of legislation

Abstract

AbstractHuman trafficking is a problem that has not been dealt with explicitly by the Indonesian government or international organizations tasked with handling it. Print and electronic media reports show that law enforcement efforts to eradicate human trafficking are still not optimal. Trafficking in persons is against human dignity and violates their rights, especially when it involves women and children. The research methodology used in this study is a normative legal research method through literature study, which involves gathering information and materials from various sources, including mass press clippings on the issue of human trafficking and legislation related to human trafficking as well as other literature and references. Based on Decision No. 1451/PidSus/2021/PN. The MDN that occurred in Medan concerned the criminal case of human trafficking carried out by parents, namely a mother making her own biological child a commercial sex worker to satisfy a masher. For this criminal act the judge imposed a criminal sanction of imprisonment for 4 (four) years and a fine of Rp. 120,000,000. with the provision that if not paid is replaced with imprisonment of 3 (three) months. Therefore, the defendant remains detained and pays court fees of Rp. 5000, (five thousand rupiah). Human trafficking is caused by various difficulties and problems. Lack of knowledge and poverty force people to seek any type of work when the risks are negligible, as well as cultural factors and weak law enforcement when dealing with the business of trafficking.AbstrakPerdagangan manusia menjadi permasalahan yang belum ditangani secara tegas oleh pemerintah Indonesia atau organisasi internasional yang bertugas menanganinya. Laporan media cetak dan elektronik menunjukkan bahwa upaya penegakan hukum untuk memberantas perdagangan manusia masih belum maksimal. Perdagangan manusia bertentangan dengan martabat manusia dan melanggar hak-hak mereka, terutama ketika melibatkan perempuan dan anak-anak. Metodologi penelitian yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif melalui studi literatur, yang melibatkan pengumpulan informasi dan bahan dari berbagai sumber, termasuk kliping pers massa tentang masalah perdagangan manusia dan perundang-undangan yang berkaitan dengan perdagangan manusia serta literatur dan Referensi lainnya. Berdasarkan Putusan No. 1451/PidSus/2021/PN. MDN yang terjadi di Medan menyangkut tentang perkara pidana Perdagangan Manusia (human Trafficking) yang dilakukan oleh orang tua yaitu seorang ibu menjadikan anak kandungnya sendiri sebagai pekerja seks komersil untuk memuaskan lelaki hidung belang. Atas tindakan pidana tersebut hakim menjatuhkan sanksi pidana penjara pidana penjara 4 (empat) tahun dan denda sejumlah Rp. 120.000.000. dengan ketentuan apabila tidak dibayar diganti dengan pidana kurungan 3 (tiga) bulan. Sehingga demikian, terdakwa tetap ditahan dan membayar biaya perkara Rp. 5000, (lima ribu rupiah). Perdagangan manusia disebabkan oleh berbagai kesulitan dan masalah. Kurangnya pengetahuan dan kemiskinan memaksa orang untuk mencari jenis pekerjaan apa pun ketika risikonya dapat diabaikan, serta faktor budaya dan penegakan hukum yang lemah ketika berurusan dengan bisnis perdagangan manusia.

Abstract

Environmental and forestry crimes are serious violations that not only damage ecosystems but also threaten human sustainability. This study aims to examine the criminal law policy in addressing environmental crimes based on Law Number 32 of 2009 on Environmental Protection and Management, and to evaluate the application of criminal liability through in absentia procedures in illegal logging cases, as exemplified by the District Court Decision No. 954/Pid.Sus/2022/PN Mks. This research adopts a normative juridical approach with a descriptive-qualitative analysis of primary and secondary legal materials. The findings reveal that while the criminal law policy on environmental protection is normatively robust, its implementation faces challenges such as weak supervision and low public legal awareness. Furthermore, the in absentia mechanism has proven effective in ensuring justice when perpetrators evade legal proceedings, though it raises legal debates concerning the defendant’s right to a fair trial. This study underscores the need to strengthen regulations and procedural safeguards to enhance the effectiveness of environmental criminal law enforcement in Indonesia.

Abstract

TikTok Shop is a clear example of the convergence trend between social media and e-commerce into a social commerce phenomenon, where social media platforms integrate e-commerce functions seamlessly, allowing users to interact socially and conduct transactions or conduct Trading Through Electronic Systems (PMSE) in one application. This phenomenon not only changes the way people shop but also poses new challenges in the aspects of regulation and business competition. There is a significant gap between das soll (should) and das sein (reality) in the regulation of e-commerce in Indonesia. Regulation of the Minister of Trade Number 31 of 2023 concerning Business Licensing, Advertising, Guidance, and Supervision of Business Actors in E-Commerce is a reflection of the government's efforts to improve the gap in e-commerce governance. TikTok Shop in Indonesia was officially deactivated on October 04, 2023, but on Harbolnas December 12, 2023, TikTok Shop returned with a merger with Tokopedia as a juridical implication of Trade Number 31 of 2023
