Abstract

Corona Virus Disease-2019 (Covid-19) is a disease that causes an epidemic with a high number of deaths and morbidity in Indonesia. Covid-19 sufferers often experience respiratory failure, so they need to receive mechanical ventilation assistance. This research aims to find out the rules for legal protection for health workers in the act of installing mechanical ventilation for Covid-19 patients in hospitals and to find out the implementation of legal protection. This type of research is normative juridical based on a legal approach. Data collection is based on literature study, taken from legislation, research results and literature books. The results of the research found that the provision of health services was carried out responsibly, safely, of good quality and evenly and non-discriminatory. The position faced by medical personnel or health workers is sometimes problematic because installing mechanical ventilators for Covid-19 patients from a criminal law perspective is a mistake if it is done outside of their authority, even though the medical personnel or health workers are dealing with the function and task of carrying out actions. for patient safety which is of course tied to the Hippocratic Oath as an ethical and moral basis. The suggestion in this research is that the government must provide legal protection to medical personnel whose rights are not fulfilled by policy organizers, even though their obligations have been fulfilled by health personnel.

Abstract

Latar Belakang: Asuransi jiwa memegang peranan penting dalam menyediakan perlindungan finansial bagi individu dan keluarga di Indonesia, tetapi kompleksitas industri asuransi dan potensi konflik antara pemegang polis dan perusahaan asuransi menuntut kerangka hukum yang kuat. Meskipun telah ada Undang-Undang Nomor 40 Tahun 2014 tentang Perasuransian dan peraturan Otoritas Jasa Keuangan (OJK), masih ada tantangan dalam implementasi dan penegakan hukum, serta ruang untuk perbaikan dalam mekanisme penyelesaian sengketa dan edukasi konsumen. Tujuan : Penelitian ini bertujuan untuk menganalisis perlindungan hukum bagi pemegang polis asuransi jiwa dengan pendekatan yuridis normatif. Metode : Metode penelitian ini menggunakan pendekatan yuridis normatif Hasil: Hasil penelitian menunjukkan bahwa perlindungan hukum bagi pemegang polis diatur oleh Undang-Undang Nomor 40 Tahun 2014 dan peraturan OJK, namun masih ada kelemahan dalam pemahaman masyarakat, pengawasan OJK, mekanisme penyelesaian sengketa, dan penegakan hukum terhadap pelanggaran oleh perusahaan asuransi. Kesimpulan : Perusahaan asuransi perlu meningkatkan transparansi informasi kepada pemegang polis. Ini bertujuan untuk meningkatkan pemahaman pemegang polis, efektivitas mekanisme penyelesaian sengketa, dan pengawasan oleh OJK, dengan tujuan akhir meningkatkan kepercayaan masyarakat terhadap industri asuransi di Indonesia.

Abstract

Penyelenggara Sistem Elektronik (PSE) dalam kasus kebocoran data pribadi berdasarkan perspektif rahasia dagang. Data pribadi yang dikelola oleh PSE sering kali memiliki nilai ekonomi yang signifikan, sehingga kebocoran data tidak hanya merugikan privasi individu tetapi juga dapat mengancam rahasia dagang perusahaan. Melalui pendekatan yuridis normatif, penelitian ini mengkaji bagaimana Undang-Undang Perlindungan Data Pribadi (UU No. 27 Tahun 2022) dan Undang-Undang Rahasia Dagang (UU No. 30 Tahun 2000) mengatur perlindungan serta tanggung jawab PSE dalam melindungi data pribadi dan rahasia dagang. Undang-Undang Perlindungan Data Pribadi menyediakan kerangka hukum yang cukup komprehensif, pelaksanaan dan penegakannya masih menghadapi beberapa tantangan signifikan. Kewajiban untuk memberikan kompensasi kepada pihak yang terdampak juga belum diatur secara jelas, sehingga berpotensi menimbulkan perbedaan standar ganti rugi di berbagai kasus. Perlindungan rahasia dagang yang berkaitan dengan data pelanggan atau informasi bisnis strategis sangat penting untuk mempertahankan keunggulan kompetitif di pasar. Penelitian ini menyarankan adanya peningkatan dalam kerangka regulasi dan kepatuhan untuk membangun lingkungan perlindungan data yang lebih kuat guna menjaga privasi individu sekaligus melindungi kepentingan bisnis.

Abstract

About 50,000 people were displaced by a 7.4 magnitude earthquake, tsunami, and liquefaction 10 km north of Palu City, Central Sulawesi Province, on September 28, 2018. The tragedy damaged many civic, social, and critical infrastructure in Palu City and nearby regions. The national government, Sulawesi provincial administration, and Palu city government are developing a relocation plan for earthquake, tsunami, and liquefaction-affected residents. This strategy will restore and rehabilitate sites like Palu City's Tondo-2 Area. To move affected residents to a safe area quickly after a disaster, land acquisition must be accelerated. This research aims to determine how the earthquake influenced the acquisition of ex-HGB land for Huntap's development in the Tondo-2 Area, Palu, and how such land acquisition was affected by the earthquake. Normative legal research is used. This study used a wide range of relevant books and scholarly papers. The Governor's development block authorized Huntap's construction in Tondo-2, as stated in Governor Decree No. 369/516/DIS-BMPR G.ST/2018, which determines the location (penlok) of land for permanent residential sites for disaster-affected communities in Central Sulawesi Province. The release or transfer of HGB from PT Sinar Putra Murni and PT Sinar Waluyo gave this 65.3-hectare state land its status. The community claims to own the land, and PT Sinar Putra Murni and PT Sinar Waluyo want compensation, which could lead to a lawsuit. Since the two firms no longer own the land, their legal chances are slim. If the firm continues to sue over land acquisition, Huntap can still be built under Law Number 2 of 2012 on Land Acquisition for Development for the Public Interest

Abstract

The development of digital technology innovation in the era of globalization has posed new challenges in the intellectual property rights (IPR) protection system in Indonesia, especially in the field of patent rights. The legal problems that arise are related to the gap between das sollen and das sein, namely between the legal norms that govern patent protection and practices in the field that often face implementation obstacles. The absence of regulations that detail the unique characteristics of digital innovations, such as software-based inventions or algorithms, creates a legal vacuum. This has an impact on the weak legal certainty for inventors who need patent protection as a guarantee of ownership as well as an instrument for commercialization of their intellectual works. This study uses normative juridical research methods with a statutory approach and a conceptual approach. Research data was obtained through a literature review of related laws, court decisions, and academic sources from legal books and journals. The analysis was carried out by examining the synchronization between Law Number 13 of 2016 concerning Patents, Government Regulation Number 46 of 2020, and international legal instruments such as the TRIPS Agreement. The results of the study show that legal protection of digital technology innovations in the framework of patent rights in Indonesia still faces obstacles, both in terms of legal, institutional, and law enforcement substance. Existing regulations have not fully accommodated the need for digital innovation protection which is rapidly changing and borderless. The conclusion of this study emphasizes the need to update patent regulations to be more responsive to digital technology developments, as well as strengthening law enforcement mechanisms to ensure certainty and justice for inventors.
