Abstract

Penelitian ini membahas jual beli kuini dengan sistem tebasan di DesaIparbondar dan pandangan hukum Islam terhadap jual beli kuini secara tebasa.Jenis penelitian ini merupakan penelitian lapangan (field research metode penelitian kualitatif. Adapun hasil penelitian ini menyimpulkan bahwa system jual beli tebasan di Desa Iparbondar terjadi setelah adanya kesepakatan antara penjual dan pembeli. Dalam akad jual beli ini, kedua belah pihak yang terlibat dalam transaksi jual beli tidak menuangkan kesepakatan yang tercapai pada sebuah perjanjian yang tertulis, artinya kesepakatan antara kedua belah pihak hanya secara lisan yang dijadikan dasar transaksi jual beli dari awal sampai akhir. Dalam hal ini, pemilik pohon kuini memberikan kepercayaan atau amanah sepenuhnya kepada pembeli untuk memetik kuini yang sudah tua atau layak untuk dipetik, dari sejumlah pohon kuini yang sudah ditentukan oleh penjual atau pemilik pohon.Praktek jual beli menurut hukum Islam adalah sah, karena telah memenuhi semua rukun dan syaratnya. Jual beli tebasan ini merupakan bentuk yang sederhana dan praktis dengan tujuan untuk memperlancar pelaksanaan penyelenggaraan jual beli kuini. Jual beli kuini secara tebasan ini didalamnya mengandung manfaat atau kemaslahatan yang dicapai dengan madharat yang ditimbulkan tetapi akan lebih baik apabila memelihara kemaslahatan atau manfaat tersebut dengan mengesampingkan madharat yang ditimbulkan selama tidak melenceng dari tujuan syara’.

Abstract

Marriage is a bond between a man and a woman whom he is lawful to marry. This relationship will certainly be valid if the terms and conditions have been fulfilled. The wedding sequence is often mixed with certain regional traditions. For the Aek Marian people, marriage customs are something that must be followed. So, this article aims to describe a number of customs in marriage in the Mandailing community in Aek Marian village and their relevance in Islamic law. The research is a qualitative form of field research. Primary data was produced through observation and interviews. Meanwhile, secondary data was generated through literature study. All findings data were analyzed descriptively. The results of the research explain that the series of customs in marriage in the Mandailing community in Aek Marian village do not substantially conflict with Islamic law. Apart from that, the practices carried out by the community are dynamic and adapt to Islamic law. Perkawinan merupakan sebuah ikatan antara seorang laki-laki dengan perempuan yang halal dinikahinya. Hubungan ini tentu menjadi sah apabila telah terpenuhi rukun dan syarat-syaratnya. Rangkaian dalam perkawinan sering dicampur dengan tardisi adat daerah tertentu. Bagi masyarakat Aek Marian, adat dalam perkawinan merupakan hal yang mesti dilakukan. Jadi, artikel ini bertujuan untuk mendeskripsikan terkait sejumlah rangkaian adat dalam perkawinan pada masyarakat Mandailing di desa Aek Marian serta relevansinya dalam hukum Islam. Penelitian merupakan bentuk kualitatif dengan jenis penelitian lapangan. Data-data primer dihasilkan melalui observasi dan wawancara. Sedangkan untuk data skunder dihasilkan melalui studi pustaka. Semua data-data temuan dianalisis secara deskriptif. Hasil penelitian menjelaskan bahwa rangkaian adat dalam perkawinan pada masyarakat Mandailing di desa Aek Marian secara substansial tidak bertentangan dengan Hukum Islam. Selain itu, praktik yang dilakukan oleh masyarakat bersifat dinamis dan menyesuaikan dengan hukum Islam.

Abstract

Fazlur Rahman, a leading Islamic thinker of the 20th century, proposed the concept of double movement as an important structure for analyzing the relationship between tradition and modernity in Islamic thought. The term “double movement” reflects Rahman's theory that the evolution of Islamic society included two fundamental movements. This type of research is qualitative research, using library research methods or also called literature review research with a character study approach. Fazlur Rahman's concept of double movement encapsulates the belief that the understanding and interpretation of Islamic teachings must occur in two areas: The First implies a commitment to the written sources and essential doctrines of Islam, while the Second movement represents the rapid adaptation of these teachings into everyday life. day. This theoretical picture stems from a critique of static interpretations of religious texts, which are believed to fall into dogmatism and ignore the experiences of individuals and society. The dual movement theory tries to align Islamic teachings with the needs of contemporary life. The double movement, as articulated by Fazlur Rahman, serves as an important structure for understanding the relationship between traditional texts and contemporary social challenges.

Abstract

Poverty remains a major development challenge in Indonesia despite various government programs. In this context, zakat as an Islamic economic instrument holds significant potential to address economic inequality and improve community welfare. However, the optimal utilization of zakat to support economic empowerment and development has yet to be fully realized. This study aims to analyze the role of zakat in alleviating poverty and promoting economic growth in Indonesia, as well as to identify obstacles and strategies for optimizing its management. This research employs a descriptive qualitative approach, utilizing literature review and secondary data analysis from zakat institutions’ reports, academic publications, and national statistics. Additionally, case studies were conducted on economic empowerment programs based on zakat implemented by several prominent zakat institutions in Indonesia. The findings indicate that zakat plays a significant role in increasing the income of zakat recipients (mustahik), expanding access to micro business capital, and encouraging economic self reliance. Productive zakat programs are proven to be more effective in the long term compared to consumptive zakat distribution. Nevertheless, challenges such as low zakat literacy, unequal distribution, and the lack of integration between zakat institutions and government programs remain key barriers. The study recommends enhancing collaboration among institutions, utilizing digital technology for zakat collection and distribution, and strengthening regulations and public education as strategies to maximize zakat's potential in national economic development. Abstract

This study explores the dynamic relationship between indigenous customs and Islamic principles in promoting sustainable natural resource management. Grounded in a socio legal and normative approach, the research examines how local wisdom embedded in customary practices can be harmonized with Islamic ethical and legal frameworks to address contemporary environmental challenges. Indigenous communities have long upheld ecological balance through traditions that regulate resource use, conservation, and communal responsibility. Similarly, Islamic teachings emphasize stewardship (khilāfah), balance (mīzān), and the prohibition of environmental destruction (fasād), offering a moral and theological foundation for sustainability. Through qualitative analysis of relevant literature and selected case studies, this research identifies areas of convergence between customary norms and Islamic values, particularly in forest management, water conservation, and land use. The findings reveal that the integration of these two systems not only strengthens environmental governance at the local level but also enhances community participation and compliance. Moreover, the synergy between adat and Sharia based principles provides a culturally resonant and spiritually grounded model for sustainable development. The study concludes that bridging indigenous traditions with Islamic principles offers a holistic and context sensitive framework for natural resource management. This approach is especially relevant in plural legal systems such as Indonesia, where the recognition of customary law alongside religious and national legal systems can contribute to more inclusive and sustainable environmental policies.
