Abstract

Ashabul furudh is a group of heirs who have a certain part in Islamic inheritance. In the process of determining the inheritance share, the ashabul furudh group takes precedence over other inheritance groups. The practice of this determination will determine the share of each heir and describe the heirs who do not inherit. This study will describe the process of determining the part of ashabul furudh through the concept of syajarotul mirats. The method used in this research is a qualitative method with the type of library research. So that in collecting data, a many of books and journals were searched that were relevant to the research theme. Furthermore, the data were analyzed by content analysis. The results of the study concluded that the order of kinship in the concept of syajarotul mirats greatly influences the process of determining the share of heirs. Furthermore, the concept also describes that each heir has a relationship with other heirs. So that each heir will affect the other heirs. Therefore, the results of this study are expected to provide scientific treasures in the practice of dividing Islamic inheritance.

Abstract

AbstractJurisprudence is always present and able to balance every state of society with all forms of problems that occur in every situation and time. The flexible fiqh is a strong proof of the perfection of this religion. This study discusses the legal issue of the use of contraceptives in the four schools of jurisprudence. This research is a library research with a qualitative approach. The results of this study can be concluded that contraceptives have existed since ancient times and the scholars of the four schools of thought view that the law is permissible on the condition that it does not violate the provisions of the Shari'ah. If the goal is to terminate pregnancy permanently without a reason accepted by the Shari'ah or because of fear of being poor and unable to provide for it, all madhhab scholars agree on the prohibition.Keywords: Contraceptive Devices;Jurisprudence; Ulama of the Four Schools.AbstrakFikih selalu hadir dan mampu mengimbangi setiap keadaan masyarakat dengan segala bentuk permasalahan yang terjadi dalam setiap keadaan dan waktu. Fikih yang bersifat fleksibel sebagai bukti kuat akan kesempurnaan agama ini. Penelitian ini membahas masalah hukum penggunaan alat kontrasepsi dalam fikih empat mazhab. Penelitian ini merupakan library research dengan pendekatan kualitatif. Hasil dari penelitian ini dapat disimpulkan bahwa alat kontrasepsi sudah ada sejak zaman dahulu dan ulama empat mazhab memandang hukumnya boleh dengan syarat tidak melanggar ketentuan syari’at. Apabila tujuannya untuk memutus kehamilan secara permanen tanpa sebab yang diterima oleh syari’at atau karena alasan takut miskin dan merasa khawatir tidak mampu menafkahi anak keturunan, maka para ulama dari kalangan empat mazhab bersepakat akan keharaman penggunaan alat kontrasepsi.Kata Kunci: Alat Kontrasepsi; Fikih; Ulama Empat Mazhab.

Abstract

Abstract Batak Angkola is one of Batak ethnic who lived at south of Tapanuli in North Sumatera. The societies usually called as Angkola’s people. Up to now, they still hold the local principle tradition. Start from marriage, inheritance moreover about death. All of them have the local tradition to present by society. Then, this research describes about the inheritance system of Muslim Batak Angkola’s society. This research uses the qualitative descriptive method by approaching normative juridical, all of the data which found in the field, describes naturally, and expresses, then considers with surah an-nisa ayat 11, 12 and 176, as four the finding in this research shows that the Batak’s Muslim society follow the patrilineal relationship system, it is the generation line is taken from man. Then, in dividing inheritance, men have dominated from women. So, the men expert of inheritance authorizes most of the inheritance than women. While the women only get the gift from the men. Furthermore, the men expert of inheritance often postponed to divide the inheritance if one of their parents was still alive. While, Alqur’an as the first escort of Islamic inheritance presents in giving the portion of each expert of inheritance. The inhetances is appropriate with Allah’s firmness; it is the determinate is not based on the age, young or old. Furthermore, by explicit law of inheritance settles that in every death must do dividing of the inheritance for the expert of inheritance. Keywords : Tradition Inheritance System, Batak Angkola’s Muslim Abstrak Batak Angkola adalah salah satu sub suku Batak yang mendiami daerah Tapanuli bagian selatan Sumatera Utara. Masyarakatnya disebut dengan istilah orang Angkola. Mereka sampai saat ini masih selalu memegang prinsip adat setempat, mulai dari masalah pernikahan, kewarisan bahkan terkait kematianpun ada aturan adat yang diselenggarakan oleh masyarakat. Jadi, penelitian ini mendeskripsikan tentang sistem waris masyarakat muslim Batak Angkola. Penelitian ini menggunakan metode kualitatif deskriptif dengan pendekatan yuridis normatif, semua data-data yang ditemukan dilapangan diuraikan secara alami dan diungkapkan apa adanya kemudian dikomparasikan dengan surah an-nisa ayat 11, 12 dan 176. Adapun temuan dalam penelitian ini menunjukkan bahwa masyarakat muslim Batak Angkola menganut sistem kekerabatan patrilineal, yaitu garis keturunan diambil dari pihak laki-laki. Kemudian pada tataran pembagian harta warisan, pihak laki-laki mempunyai peranan yang lebih dominan ketimbang pihak perempuan. Jadi, ahli waris laki-laki menguasai hampir seluruh harta warisan, sementara ahli waris perempuan hanya mendapatkan bagian berupa pemberian dari kelompok ahli waris laki-laki. Selanjutnya, para ahli waris sering menunda untuk melakukan pembagian warisan jika salah satu dari kedua orang tua masih hidup. Sementara itu Alqur’an sebagai panduan utama hukum waris islam hadir dengan memberikan porsi bagian kepada masing-masing ahli waris sesuai dengan ketetapan dari Allah Swt, yaitu dengan ketentuan ukuran bagian yang tidak berdasarkan kecil dan besarnya usia. Kemudian secara tegas hukum waris islam menetapkan bahwa setiap ada kematian maka harus dilakukan penentuan bagian masing-masing ahli waris. Kata Kunci: Sistem Waris Adat, Batak Angkola Muslim

Abstract

AbstractMaqasid al-Sharia is one of the discourses in the study of fiqh thought, both traditional and contemporary. However, in its development experienced various challenges and problems that surround it. Some of the problems that arise are that ushul fiqh is considered too textual and ignores the purpose of the text. Thus, it makes the purpose of making sharia laws or decisions not in accordance with the context. In this case, Jasser Auda tries to make an effort to criticize this issue. On the other hand, there are some weaknesses in the maqasid theory which does not provide details on certain chapters or problems. So that these conditions are considered unable to provide detailed answers to certain problems. Therefore, in this study, attempts to re-construct and make improvements with various approaches and methodologies initiated by Jasser Auda. Qualitative research methods are used in this study to examine various literatures related to the data that support this research, especially related to the renewal methodology carried out by Jasser Auda in analyzing maqasid al-shariah. This study found that in fact the perspective of the old maqasid concept to the new maqasid, that is, if you look at the classical paradigm, it lies in efforts to protect and guard or preserve. Meanwhile, if you look at the contemporary paradigm, it focuses more on the development and right side.Keywords: Islamic Law; Jasser Auda; Methodology; Maqasid al-Shariah.

Abstract

Economic philosophy is the basic orientation of economics, which can differ from one religion to another, or from one school to another because of a different frame of reference. These philosophical values ​​then become the frame of reference for Islamic economic principles. The principles of Islamic economics then become the basis for thinking and behaving in all economic activities in society, including dharibah (tax) activities. The purpose of this research is to see further how dharibah is in Islamic economic philosophy. The research method used is qualitative research with library research, namely examining written sources from various literature references, which is carried out by collecting data, then reviewing and analyzing data obtained from various written sources. The results of the study indicate that dharibah (tax) in Islam is one source of state revenue based on ijtihadulilamri approved by the House of Representatives (ahlilhalliwalaqdi) and the approval of scholars used to finance development and the benefit of the people. Some jurists are of the opinion that there is no other obligation on property other than zakat. Meanwhile, some other jurists are of the opinion that there are other obligations on assets other than zakat. These jurists do not object that the obligation on assets that is obligatory is zakat, but if conditions arise that require additional needs (darurah), then there will be additional obligations in the form of dharibah (taxes).

Abstract

Pembahasan kewarisan antara kakek dengan saudara merupakan masalah khilafiah di kalangan ulama fiqh. Pada fiqh mawaris, kedudukan ayah sangat urgen dan dapat menghalangi hak waris semua jenis saudara. Sehingga ungkapan ayah yang disematkan kepada kakek akan mempengaruhi bagian para saudara. Jenis penelitian ini adalah library research dengan menggunakan metode kualitatif deskriptif. Hasil temuan menjelaskan bahwa kedudukan kakek dan saudara adalah dua hal yang sama kepada pewaris. Karena keduanya terhubung kepada pewaris melalui jalur ayah. Kakek sebagi asal dari ayah dan saudara sebagai furu’nya. Sehingga di antara keduanya harus dilakukan penyelesaian khusus dan perhitungan khusus sesuai dengan porsi masing-masing. Konsep muqosamah, bagian 1/3 dan 1/6 menjadi jawaban atas metode perhitungan bagian antara kakek dengan saudara.

Abstract

Peralihan harta warisan alternatif menjadi isu penting dalam konteks perubahan sosial dan norma-norma hukum. Salah satu alternatif yang menarik perhatian adalah konsep hibah sebagai pengganti dalam praktik pembagian warisan. Penerapan hibah harta dilakukan ketika pewaris masih hidup. Tentu hal ini dilaksanakan untuk meminimalisir konflik internal keluarga. Penelitian ini bertujuan untuk mendeskripsikan dinamika pewarisan alternatif, khususnya melalui analisis konsep hibah sebagai pengganti warisan. Selain itu, penelitian ini juga menggambarkan secara mendalam terhadap aspek hukum, etika, dan dampak sosial dari penerapan konsep hibah. Metode penelitian menggunakan bentuk kualitatif jenis library research dengan pendekatan kerangka hukum normatif. Data penelitian dikumpulkan melalui studi literatur, selanjutnya dianalisis dengan mennggunakan analisis konten. Temuan penelitian menjelaskan bahwa munculnya konsep perubahan paradigma dalam konteks pewarisan, implikasi hukum yang muncul, serta respons sosial terhadap alternatif pewarisan menjadi sebuah kajian menarik. Dengan demikian, penelitian ini memberikan wawasan baru dan pemahaman yang lebih mendalam tentang peran potensial hibah dalam konteks dinamika pewarisan alternatif.The transition of alternative inheritance has become a significant issue in the context of social change and legal norms. One intriguing alternative that has drawn attention is the concept of "hibah" (gift) as a substitute in the practice of inheritance distribution. The implementation of wealth "hibah" occurs while the benefactor is still alive, intending to minimize internal family conflicts. This research aims to describe the dynamics of alternative inheritance, specifically through an analysis of the "hibah" concept as a substitute for inheritance. Furthermore, the study provides an in-depth depiction of the legal, ethical, and social aspects of implementing the "hibah" concept. The research methodology employs qualitative library research with a normative legal framework approach. Data collection involves literature reviews and content analysis. Research findings elucidate the emergence of a paradigm shift in the context of inheritance, the legal implications that arise, and societal responses to alternative inheritance practices. Thus, this study offers new insights and a deeper understanding of the potential role of "hibah" in the dynamics of alternative inheritance.

Abstract

Knowing the status of the heirs is the first step in dividing the inheritance. A person's share will be determined if his position as an heir can be known with certainty. Grandparents are heirs who are very close to the heir. However, not all types of grandparents have the same status and position in obtaining inheritance. This study will describe the inheritance of grandparents through kinship relations to the heirs. Furthermore, this study will also describe in detail the status and share of inheritance of each grandparent. The method used in this research is a qualitative form with the type of library research. The results of the study explain that the inheritance status of grandparents is distinguished based on the line of kinship to the heir. If the line of kinship is through the male line, then the status of grandparents is referred to as grandparents and grandmothers. However, if the kinship route is through women, then the status of grandparents is called fasid grandfather and fasidah grandmother. Then, grandparents whose status is authentic and sohihah grandfather, then those who are domiciled as heirs of ashabul furudh or ashobah. Meanwhile, grandparents whose status is fasid and fasidah, then they are domiciled as heirs of dzawil arham.

Abstract

Penelitian ini membahas jual beli kuini dengan sistem tebasan di DesaIparbondar dan pandangan hukum Islam terhadap jual beli kuini secara tebasa.Jenis penelitian ini merupakan penelitian lapangan (field research metode penelitian kualitatif. Adapun hasil penelitian ini menyimpulkan bahwa system jual beli tebasan di Desa Iparbondar terjadi setelah adanya kesepakatan antara penjual dan pembeli. Dalam akad jual beli ini, kedua belah pihak yang terlibat dalam transaksi jual beli tidak menuangkan kesepakatan yang tercapai pada sebuah perjanjian yang tertulis, artinya kesepakatan antara kedua belah pihak hanya secara lisan yang dijadikan dasar transaksi jual beli dari awal sampai akhir. Dalam hal ini, pemilik pohon kuini memberikan kepercayaan atau amanah sepenuhnya kepada pembeli untuk memetik kuini yang sudah tua atau layak untuk dipetik, dari sejumlah pohon kuini yang sudah ditentukan oleh penjual atau pemilik pohon.Praktek jual beli menurut hukum Islam adalah sah, karena telah memenuhi semua rukun dan syaratnya. Jual beli tebasan ini merupakan bentuk yang sederhana dan praktis dengan tujuan untuk memperlancar pelaksanaan penyelenggaraan jual beli kuini. Jual beli kuini secara tebasan ini didalamnya mengandung manfaat atau kemaslahatan yang dicapai dengan madharat yang ditimbulkan tetapi akan lebih baik apabila memelihara kemaslahatan atau manfaat tersebut dengan mengesampingkan madharat yang ditimbulkan selama tidak melenceng dari tujuan syara’.

Abstract

Marriage is a bond between a man and a woman whom he is lawful to marry. This relationship will certainly be valid if the terms and conditions have been fulfilled. The wedding sequence is often mixed with certain regional traditions. For the Aek Marian people, marriage customs are something that must be followed. So, this article aims to describe a number of customs in marriage in the Mandailing community in Aek Marian village and their relevance in Islamic law. The research is a qualitative form of field research. Primary data was produced through observation and interviews. Meanwhile, secondary data was generated through literature study. All findings data were analyzed descriptively. The results of the research explain that the series of customs in marriage in the Mandailing community in Aek Marian village do not substantially conflict with Islamic law. Apart from that, the practices carried out by the community are dynamic and adapt to Islamic law. Perkawinan merupakan sebuah ikatan antara seorang laki-laki dengan perempuan yang halal dinikahinya. Hubungan ini tentu menjadi sah apabila telah terpenuhi rukun dan syarat-syaratnya. Rangkaian dalam perkawinan sering dicampur dengan tardisi adat daerah tertentu. Bagi masyarakat Aek Marian, adat dalam perkawinan merupakan hal yang mesti dilakukan. Jadi, artikel ini bertujuan untuk mendeskripsikan terkait sejumlah rangkaian adat dalam perkawinan pada masyarakat Mandailing di desa Aek Marian serta relevansinya dalam hukum Islam. Penelitian merupakan bentuk kualitatif dengan jenis penelitian lapangan. Data-data primer dihasilkan melalui observasi dan wawancara. Sedangkan untuk data skunder dihasilkan melalui studi pustaka. Semua data-data temuan dianalisis secara deskriptif. Hasil penelitian menjelaskan bahwa rangkaian adat dalam perkawinan pada masyarakat Mandailing di desa Aek Marian secara substansial tidak bertentangan dengan Hukum Islam. Selain itu, praktik yang dilakukan oleh masyarakat bersifat dinamis dan menyesuaikan dengan hukum Islam.
