Abstract

The Indonesian government has an obligation to protect every citizen in any situation and condition. Protection from the government must be given to the community if there is an impact, not only to the community but also to an impact that occurs in the economy and politics on the government. Since March 2020 until now, Indonesia is facing a coronavirus pandemic. Due to the virus, the government issued Government Regulation Number 21 of 2020 concerning Government Regulation (PP) concerning Large-Scale Social Restrictions in the Context of Accelerating Handling of CoronaVirus Disease 2019 (COVID-19). One of the policies is the rapid antigen test to prevent the spread of the virus and as a condition for traveling outside the city. In addition to being regulated by the Minister of Health, consumers are given protection according to Law Number 8 of 1999 concerning Consumer Protection. Consumers are given rights that are guaranteed and protected by the government in Article 4 of the consumer protection law. Despite having two regulations, it turns out that in the field there are still cases of misuse of medical devices by the perpetrators. One of the business actors who abused the rapid test medical device at Kualanamu Airport, North Sumatra. The formulation of the problem in this study is how the legal protection of consumer rights related to the misuse of used antigen rapid test medical devices is based on Law Number 8 of 1999 concerning Consumer Protection. The method used; normative juridical, with the types and sources of secondary, primary, tertiary data. The results of the research are that consumer protection in medical devices for rapid tests is still lacking in supervision and guidance, resulting in violations of the law in the health sector and harming many consumers.

Abstract

The United States and Indonesia each have recognized the so-called marketplace platform. Marketplace platform is a place where sellers and buyers as consumers for platform providers or PPMSE can make buying and selling transactions online. The marketplace platform is also easily accessible anywhere by the public, therefore many counterfeit goods are sold on the marketplace platform, so that supervision is needed from PPMSE or platform providers as people or business entities that provide and facilitate electronic buying and selling transactions. To answer these problems, the author uses normative legal research methods. Based on the research results, if there are counterfeit goods on the marketplace platform, PPMSE in Indonesia and the United States are not responsible if there are counterfeit goods on the marketplace platform if the platform provider or PPMSE is not the party selling the counterfeit goods and PPMSE or the platform provider has taken the appropriate steps established legal rules. Then the equation of the legal rules regarding platform providers in Indonesia and the United States is that the platform providers both do not monitor and are not responsible for the list of goods sold on the marketplace platform on a regular basis. The difference is that in the Indonesian law regarding PMSE, the cooperative attitude of PPMSE is not regulated if there is a complaint or lawsuit from the owner of the rights, whereas in the United States law, it regulates how PPMSE should behave when the owner of the right to file a subpoena from the court against the platform provider regarding the sale of goods fake on the marketplace platform.

Abstract

Often there are applicants who have bad intentions in registering their trademarks, especially those that have substantially or in full similarity with well-known marks. This can be detrimental to the party being imitated because it will affect the decline in profits and loss of brand reputation. If there is a party who feels that it has been harmed by the registration, they may file a lawsuit for the cancellation of the mark. The method used in this paper is a normative legal research method. The results showed that the application of the equation assessment criteria in essence can be proven in the Judgment on Cassation level No. 92K / Pdt.Sus-HKI / 2017 between the famous Hugo Boss brand and the disputed “Hugo” brands. The application of the law by the Panel of Judges was correct because it had been proven that the “Hugo” brands owned by Teddy Tan had bad faith in registering their trademarks which were basically similar to the well-known brand, namely Hugo Boss. Moreover, Hugo Boss has already been registered and the famous brand should have received legal protection that has been guaranteed by the state as a consequence of the exclusive rights attached to the brand. Registration with an element of bad faith with equality assessment indicators will basically be rejected by the Directorate General of IPR based on Article 21 paragraph (1) and paragraph (3) of Law No.20 of 2016 concerning Trademarks and Geographical Indications because it can be misleading and cause confusion in Public.

Abstract

Mark registration is very important, considering that the right to a mark as an exclusive right for the owner of a mark arises from the existence of registration. In practice, it turns out that a trademark that has been registered can be re-registered. The problems faced in writing this thesis are what is the method of trademark registration in Indonesia and the legal consequences if there is a double registration based on law number 20 of 2016 concerning Geografis Marks and Indications, how is the application of article 21 paragraph (1) letter (a) of Law no. 20 of 2016 related to the cancellation of the mark in the case NO. 13 / PDT, SUS-Mark / 2019 / PN. NIAGA. JKT, PST in the Decision of the Central Jakarta Commercial Court Number 13 / Pdt.Sus-Mark / 2019 / PN. Niaga. Jkt. PST. The research method used in writing this thesis is normative legal research. The results showed that the trademark registration method in Indonesia is constitutive, which means that trademark registration is an obligation to obtain the right to a trademark, because the right to a mark is given to the person or legal entity who registers the mark for the first time and obtains legal protection. On the other hand, the legal consequences can be punished with imprisonment of up to 5 (five) years and / or a maximum fine of Rp. 2,000,000,000.00 (two billion rupiah).

Abstract

Setiap negara memiliki potensi yang berbeda dengan negara lain, misalnya Indonesia sebagai negara yang memiliki kekayaan alam dan nilai kekerabatan yang erat. Di era globalisasi negara maju menerapkan transplantasi hukum merek untuk menstandarkan hukum merek dalam menunjang kepentingan mereka di pasar bebas. Salah satunya, perlindungan indikasi geografis yang telah diadopsi dalam Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis. Bagaimana transplantasi hukum dalam melindungi indikasi geografis kopi Kintamani untuk meningkatkan nilai ekonomi produknya? dan bagaimana upaya berbagai pihak di Kabupaten Bangli Bali dalam melestarikan lingkungan geografis kopi Kintamani? Jenis penelitian ini bersifat normatif dengan pendekatan budaya terhadap masyarakat dan menggunakan data sekunder serta dianalisis secara kualitatif. Transplantasi hukum berjalan seiring dengan budaya hukum masyarakat penghasil kopi. Hal ini, dapat dilihat dari pemahaman masyarakat dalam pengelolaan kopi yang dilindungi indikasi geografis dan upaya melestarikan geografisnya. Upaya masyarakat menjaga lingkungan geografisnya didukung oleh hubungan kekerabatan yang erat. Terpelihara lingkungan geografis merupakan salah satu syarat mempertahankan perlindungan indikasi geografis. Pemerintah Daerah dan berbagai pihak berupaya mempromosikan dan memasarkan produk kopi Kintamani. Namun, untuk meningkatkan nilai ekonomi dan menguasai pangsa pasar, perlu diupayakan untuk pendaftaran merek kolektif bagi produk kopi Kintamani. Abstract

Copyright is an exclusive right owned by an author that can arise automatically based on declarative principlesafter the existence of a work which is then made into a concrete form without any reduction or restriction inaccordance with the provisions of the legislation. Copyright itself, if detailed in more detail, can be said to be aright that can be used in the context of copying a copyrighted work, which then gives the right holder anopportunity to determine restrictions on the act of duplicating his creation without permission and also the rightis limited in terms of meaning has a certain time limit on its validity. Intellectual property is attached to thecreation of the mind, and this is attached to everyone who owns the work of his creation if the work is publishedbut there will be problems if a person or legal entity uses the work of another person. Abstract

Abstract

Human beings are social creatures (cannot live alone), so they must live in society. Humans, who cannot live without their daily needs, engage in buying and selling activities. With the advent of technology, buying and selling is now done electronically. However, recently the situation has changed with the emergence of virtual payments. One type of virtual currency is bitcoin. In this essay, the author investigates the validity of buying and selling transactions using crypto assets as a means of payment in Indonesia? and the responsibility of the Indonesian government towards buying and selling using crypto assets as a means of payment in Indonesia? Answering the issues in this essay, the author uses a normative research method, a descriptive research nature, using primary, secondary, and tertiary data types, using a legal approach, data collected, processed and analyzed qualitatively. The results of this analysis show that the validity of buying and selling transactions using bitcoin as a means of payment in Indonesia is not valid and is only used as an investment suggestion, so the government must clearly provide warnings/sanctions in Article 33 Paragraph (1) of Law Number 7 of 2011 on Currency and be responsible for regulating the supervision of the use of bitcoin, about standards such as Know Your Customer, money laundering, risks faced by the public, and standardization regarding security systems, and the public should be careful and cautious in activities in the digital world and not accept any other payments except for the legitimate currency in Indonesia (rupiah).

Abstract

The existence of regulations regarding Collective Management Institutions (LMK) in Law 28/2014 and the existence of monetization on YouTube should prevent YouTubers from copyright violations, because Article 87 of Law 28/2014 regulates that the use of works and/or is not considered a violation of Law 28/2014. Related Rights products commercially by users as long as the user has carried out and fulfilled the obligations in accordance with the agreement with LMK. However, there is one very interesting case to be studied in Decision 41PK/Pdt.Sus-HKI/2021 where the Defendant is the creator and owner of video content through the account/channel of YouTuber Gen Halilintar which has been monetized and has paid royalties to LMK, namely Wahana Musik Indonesia (WAMI) was sued by PT Nagaswara Publisherindo which is the copyright holder of a song creation (music and lyrics) entitled "Lagi Syantik" "Ciptaan". The purpose of writing this article is to find out and describe YouTubers' legal protection for video publications that have been monetized for distribution of royalties by LMK (Study Decision No. 41PK/Pdt.Sus-HKI/2021). The research method used is normative legal research. The results and conclusions show that legal protection is given to YouTubers who have monetized and paid royalties to their creators through LMK but must still pay attention to moral rights over the creation, namely by not making modifications to the creator's work.

Abstract

The state has the right to govern its territory and citizens, but this cannot be done without the assistance of state institutions. One such institution that helps in the administration of governance is the Indonesian National Police, whose duties are regulated by Undang-Undang Nomor 2 Tahun 2002. In carrying out their duties, the Indonesian National Police have a code of ethics as a guide for their members to reflect the comprehensive character of a police officer. However, as time progresses, changes occur in the ethics and morality of police members, which led to the establishment of Peraturan Kepolisian Negara Republik Indonesia Nomor 7 Tahun 2022 Tentang Kode Etik Profesi dan Komisi Kode Etik Kepolisian Negara Republik Indonesia. Violations of this code, particularly by high-ranking officials, such as the case of Teddy Minahasa, a former high-ranking police officer, hinder the enforcement of law. Therefore, it is crucial for the Indonesian National Police to follow and practice ethics in their duties, such as state ethics, institutional ethics, community ethics, and personal ethics. By adhering to these ethics, it is hoped that police members can carry out their duties with commitment, honesty, and high responsibility, for the safety, welfare, and unity of the nation. However, to address these violations, it is necessary to enforce the law firmly and to continuously prevent and cultivate police members to understand and internalize these ethics in every aspect of their life and duties.
