Abstract

Kurator (perorangan/tim) sebagai profesi bertanggung jawab kepada para kreditor untuk melakukan pengurusan dan pemberesan harta pailit secara adil. Penelitian ini untuk mengetahui pertanggungjawaban Kurator apabila terjadi kesalahan (melanggar hukum) baik berdasarkan kesalahan maupun kelalaian dan atau tidak sesuai dengan ketentuan hukum yang berlaku dalam melakukan pengurusan, pemberesan dan pemberesan harta pailit dan termasuk untuk mengetahui cara penyelesaian terhadap kreditor yang dirugikan. Batasan masalah dari latar belakang tersebut, bagaimanakah pertanggungjawaban kurator baik pertanggungjawaban secara profesional maupun pidana terhadap masyarakat dan kreditor yang dirugikan dalam pengurusan dan pemberesan harta pailit. Penelitian kualitatif dalam tulisan ini menggunakan metode penelitian hukum normatif, dengan studi kasus yang relevan mengenai Perbuatan Melawan Hukum dan pertanggungjawaban Kurator dengan menggunakan analisis deskriptif kualitatif dari sudut pandang doktrin, peraturan ketentuan hukum atau undang-undang yang berlaku dan isu-isu yang terkait. Hasil penelitian ini menunjukkan pertanggungjawaban kurator berdasarkan ketentuan Perbuatan Melawan Hukum, menyangkut tanggung jawab dalam kemampuan profesional sebagai kurator yang berkaitan langsung dengan kinerja dalam pemberesan harta pailit secara profesional. Oleh karena itu, pertanggungjawaban kurator secara perbuatan melawan hukum didasarkan pada kesalahan dan/atau kelalaiannya, lebih lanjut pertanggungjawaban kurator secara pribadi adalah mengganti kerugian dalam rangka melaksanakan Putusan Pengadilan Niaga dalam membereskan harta pailit.

Abstract

This research addresses the role of Intellectual Property (IP) Lawyers in patent registration and prosecution, particularly in the Patent Cooperation Treaty (PCT) context. In a complex research and development environment, an understanding of the risk of patent imitation is essential. This study aims to analyze the strategy of international patent registration through the PCT system and evaluate its effectiveness compared to national patent registration in Indonesia. This research uses a normative legal approach by analyzing the literature and practical aspects relating to international patent registration through the PCT system. The research findings show that Intellectual Property Lawyers need to have in-depth knowledge of the national and international patent registration systems. The research also highlights the challenges for inventors with limited budgets in choosing between national Patent and PCT registration, as well as the importance of strategic planning in registration to protect innovation. This research underscores the important role of IP Attorneys in assisting inventors through the patent registration process, both nationally and internationally, and emphasizes that the PCT system is a viable option to effectively protect innovation while managing costs.

Abstract

This study examines the application of criminal sanctions in an environmental pollution case from the perspective of justice, focusing on Decision No. 321/Pid.Sus/LH/2025/PN Bdg involving PT Mitra Light Block. The issue is significant because environmental criminal law is expected not only to enforce statutory compliance but also to ensure that punishment is imposed in a fair, proportionate, and legally reasoned manner. This article aims to analyze the correlation between environmental law enforcement and the principle of justice in the imposition of criminal sanctions. The study employs normative legal research using statute, conceptual, and case approaches. The analysis is based on primary legal materials, including statutory regulations and the court decision, as well as secondary legal materials in the form of legal doctrines and scholarly literature. The findings indicate that the application of criminal sanctions in environmental cases cannot be assessed solely on the basis of formal statutory violation. It must also consider culpability, proportionality, environmental risk, judicial reasoning, and the broader public interest protected by environmental law. The case demonstrates that although the prohibited act was legally established, the question of justice remains closely tied to the relationship between the unlawful conduct, the degree of harm, and the reasoning underlying the sanction. This study concludes that a justice-based approach to environmental criminal law requires punishment to reflect not only legal certainty but also substantive fairness in responding to environmental violations.

Abstract

This study examines legal issues in Indonesian property transactions arising from the absence of clear regulatory time limits for title transfer (balik nama) from developers to buyers. This legal gap creates a transitional period in which buyers have fulfilled their financial obligations but have not yet obtained legally registered property rights, resulting in legal uncertainty. The study aims to analyze the juridical implications of delayed title transfer on the validity of mortgage rights and the legal position of the parties involved, particularly in the event of developer bankruptcy. This research employs a normative juridical method using statutory and case approaches, focusing on relevant legislation and the Supreme Court Decision No. 2768 K/Pdt/2011. The findings reveal that delays in title transfer directly affect the registration of mortgage rights, which is constitutive in nature. Failure to comply with procedural requirements, particularly the statutory time limit for registration, may render the Mortgage Certificate legally defective and eliminate the creditor’s preferential rights. Consequently, creditors may be downgraded to concurrent status, while buyers face the risk of losing legal protection over the property, especially in bankruptcy proceedings. The study concludes that the absence of clear regulatory timelines creates systemic legal uncertainty affecting both consumers and financial institutions. Therefore, it is recommended that the government establish strict and enforceable deadlines for title transfer processes, accompanied by administrative sanctions for non-compliance, in order to ensure legal certainty, enhance consumer protection, and strengthen the integrity of the property and banking sectors.
