Abstract

This research has the purpose to find out the legal relations between the parties like guarantor (bank) and insured (customer) through telemarketing offering bank insurance to the customers. This bank insurance is an agreement to give rights and duties to the parties. The type of this research is normative-empirical legal research which uses the statute approach, the conceptual approach, and the sociological approach. Based on the result of this field study, the study showed that there are problems like the bank not clearly explaining the insurance products when they offered to the customers. The legal protection for the bank customers regulated in Act Number 8 of 1999 concerning Consumer Protection and Financial Services Authority Regulation Number 23/POJK.05/2015 concerning Insurance Product and Insurance Product Marketing.

Abstract

Undang Undang Dasar 1945, Pasal 27 ayat (2) menetapkan bahwa, “tiap-tiap warganegara berhak atas pekerjaan dan penghidupan yang layak bagi kemanusiaan”. Guna mewujudkan ketentuan pasal tersebut maka Pemerintah mengeluarkan UU. Undang-Undang Nomor 18 Tahun 2017 tentang Pelindungan Pekerja Migran Indonesia (PPMI). Undang-Undang Nomor 18 Tahun 2017 tentang Pelindungan Pekerja Migran Indonesia (PPMI), pada intinya mengatur tentang bagaimana cara bekerja di Luar Negeri yang baik atau sesuai dengan ketentuan peraturan perundang-undangan. Dalam rangka memasyarakatkan tentang bagaimana prosedur bekerja yang baik di luar Negeri sebagaimana diatur dalam Undang-Undang Nomor 18 Tahun 2017 tentang Pelindungan Pekerja Migran Indonesia (PPMI) di atas Tim Penyuluh Fakultas Hukum Universitas Mataram dengan Surat Tugas No. 3340/UN18.F3/PP/2021 tanggal 5 Juli 2021 melakukan penyuluhan di Desa Kekeri, Kecamatan Gunungsari, Kabupaten Lombok Barat, tanggal 9 September 2021. Penyuluhan dilakukan dengan tatap muka secara langsung dengan para audience yang terdiri dari para pemuda, tokoh masyarakat dan aparat Kampung dan desa.

Abstract

This study aims to determine the employer's responsibility for the safety of the home wi-fi installation workforce and the factors that affect the safety of the home wi-fi installation workforce. The type of research used is normative-empirical law with the approach method used by legislation (statute approach), conceptual approach (conceptual approach) and Sociological Approach (Social Approach). The results showed The responsibility of the entrepreneur PT. Netzen Media Access, PT. Icomnets Plus, and PT. Media Facilities Data on labor safety, namely, First Aid and BPJS Employment. Factors that affect workers can be internal factors, caused by human error and external factors caused by the work environment and weather.

Abstract

This research aimed to find out the protection effort for Indonesian migrant workers by BP2MI of the West Lombok regency according to Law number 18 of 2017 concerning protection for Indonesian migrant workers. This research can be categorized as normative-empirical legal research. It can be concluded that the government has implemented this law by providing attendance for future migrant workers. It is also known several other implementations have been in accordance with the provisions of Law number 18 of 2018 concerning the protection of Indonesian migrant workers.

Abstract

Penelitian ini bertujuan untuk mengetahui implementasi pencoretan/penghapusan jaminan Hak Tanggungan dengan akta konsen roya di Kantor Badan Pertanahan Nasional Kabupaten Lombok Barat dan mengetahui kedudukan akta konsen roya sebagai pengganti sertifikat Hak Tanggungan. Jenis penelitian ini adalah penelitian hukum empiris dengan menggunakan metode pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan sosiologis. Teknik pengumpulan data menggunakan data kepustakaan dan data lapangan dari hasil wawancara yang dianalisis secara deskriptif-kualitatif. Dari hasil penelitian ini menunjukan bahwa dalam implementasi pencoretan/penghapusan Hak Tanggungan (roya) dengan menggunakan akta konsen roya, semestinya penghapusan dilakukan menggunakan sertifikat Hak Tanggungan. Namun dalam praktik, sertifikat Hak Tanggungan tersebut hilang maka notaris berwenang mengeluarkan suatu akta yang bisa menggantikan fungsi dari sertifikat Hak Tanggungan. Akta konsen roya memenuhi keadaan atau persyaratan untuk menghapuskan Hak Tanggungan.

Abstract

This study aims to look at the contractual relationships surrounding hajj financing at PT. Federal International Finance (FIF Group) Branch Praya, as well as how those agreements are resolved when there is a breach of contract, and what causes consumer breaches of contract. The study uses a normative-empirical legal research methodology and draws on three perspectives: conceptual, legal, and sociological. This study uses qualitative and descriptive analysis to examine legal texts. According to the study's findings, PT. Federal International Finance (FIF Group) Branch Praya’s consumer financing agreement governs the hajj financing, which is a component of a brand-named religious travel program. The study's findings suggest that PT. Federal International Finance (FIF Group) Branch Praya's consumer financing agreement governs the legal relationship for hajj financing, which is a component of a religious travel program offered by PT. Federal International Finance (FIF Group) with the brand name "AMITRA." In hajj financing agreements, the resolution of a breach of contract is accomplished using out-of-court procedures such discussion or mutual consultation between the parties. customers' poor economic conditions, deteriorating payment capacity, their death with recalcitrant heirs, their having several lending facilities, and the failure of consumer-owned firms are among the factors that contribute to contract breaches by customers.

Abstract

This research aims are to analyse and to understand how is the arrangement of Immigration office supervisory on foreign manpower according to Indonesian positive laws. Applied method in this study was normative legal research which primarily conducted through library research and assessing related statutes. Result of this study shows that, regulations on the supervisory office conducted by the immigration office are based on the Law Number 11 of 2011 on Immigration and its implementing regulation, Presidential Regulation Number 34 of 2021 on the Employment of Foreign Manpower and completed with Law Number 13 of 2003 on Manpower. Immigration responsibility in conducting immigration actions is carried out by administrative and criminal actions. In order to guarantee legal certainty and justice for foreigners who are subject to immigration measures, the decision shall be stipulated in written form, which contains the identity of the person affected by the immigration action, the reasons for the action and the type of action, and may submit an objection to the said immigration action. The purpose of this immigration action is to carry out supervisory policies in the field of immigration and assist the implementation of law enforcement in the territory of the Republic of Indonesia, both preventive and repressive in nature.

Abstract

This research aims to understand the essential considerations for adding a pension security program with legal consequences for employers who do not include workers in the pension security program based on Law Number 24 of 2011. This study uses a normative research method using a statutory, conceptual, and case approach. The results are that the addition of a pension security program to Law Number 24 of 2011 is a representation of the international convention , the mandate of Article 28 letter h paragraph (3) of the 1945 Constitution, Articles 22 and 25 of the Universal Declaration of Human Rights. As for the legal consequences are criminal penalties and administrative sanctions.Keywords: Employee Rights, Pension Guarantee, Legal Consequences.

Abstract

This study aims to determine the responsibilities of online transportation service companies to partners exposed to risk in terms of Law Number 13 of 2003 concerning Employment and Law Number 11 of 2020 concerning Job Creation and the factors that affect the responsibility of transportation service companies online to partners. This research uses conceptual, legislation, and sociological approaches to normative-empirical law. In contrast, the data collection techniques used in this study were library materials and interviews. The study results show that the company provides an alternative in the form of insurance to partners as a form of concern for the company. And the factors that affect the responsibility of the company with the driver are the non-fulfilment of the elements of the working relationship because the company's relationship with the driver is only a partnership relationship.
