Abstract

This study discusses the participation (deelneming) which includes all forms of participation/involvement of people both psychologically and physically by doing each act so as to give birth to a crime. Participation is regulated in Article 55 and Article 56 of the Criminal Code which means that there are two or more people who commit a crime or say that there are two or more people taking part in realizing a crime can be mentioned that a person participates in relation to the person other. This research is a type of normative research using secondary legal material sources and using qualitative descriptive analysis. The results of this study indicate that the forms of participation can be divided into two, namely first, the maker which consists of: Actors (pleger), the enforcer (doenpleger), who participates (madepleger) and penganjur (uitlokker). Second, the Assistant consists of: Helper at the time the crime was committed and the Helper before the crime was committed. While the criminal system for the inclusion of criminal acts is as follows. The first system originated in roman and second, a system originating from Italian parajurists in medieval times.Keywords: crime; criminal code; inclusion.Penelitian ini membahas tentang penyertaan (Deelneming) yang meliputi semua bentuk turut serta/terlibatnya orang-orang baik secara psikis maupun fisik dengan melakukan masing-masing perbuatan sehingga melahirkan suatu tindak pidana. Penyertaan di atur dalam Pasal 55 dan Pasal 56 KUHP yang berarti bahwa ada dua orang atau lebih yang melakukan suatu tindak pidana atau dengan perkataan ada dua orang atau lebih mengambil bagian untuk mewujudkan suatu tindak pidana dapat di sebutkan bahwa seseorang tersebut turut serta dalam hubungannya dengan orang lain. Penelitian ini merupakan jenis penelitian normatif dengan menggunakan sumber bahan hukum sekunder serta menggunakan analisis deskriptif kualitatif. Hasil penelitian ini menunjukkan bahwa bentuk-bentuk penyertaan dapat dibagi menjadi dua yaitu pertama, Pembuat yang terdiri dari: Pelaku (pleger), yang menyuruhlakukan (doenpleger), yang turut serta (madepleger) dan penganjur (uitlokker); kedua, Pembantu yang terdiri dari: Pembantu pada saat kejahatan dilakukan dan Pembantu sebelum kejahatan dilakukan. Sedangkan sistem pemidanaan terhadap penyertaan tindak pidana adalah sebagai berikut, Pertama Sistem yang berasal dari romawi dan kedua, Sistem yang berasal dariparajurist italia dalam abad pertengahan.Kata kunci: KUHP; penyertaan; tindak pidana.

Abstract

The development of law in Indonesia is determined by the political configuration between the legislature and the executive. Nearly 85 percent of the People's Representative Council tends to close or qualify with the executive. When the executive submits draft legislation, it is immediately approved by the Indonesian Parliament. The urgency of the research is to determine the influence of politics on the formation of law in Indonesia. What is the political configuration and character of Indonesian legal products and their re-actualization and formulation? The research method used is normative research through library research and a statutory approach. The research shows that currently, in Indonesia, the political dominance of the law is getting stronger. A political party that should be the incarnation of the people's will only appear to be a vehicle to gain or maintain power. This results in legal products produced only by political interests and certain groups, without paying attention to their suitability with the objectives of the State. The historical movement of the transition of Islamic law in Indonesia is full of various historical, philosophical, political, sociological, and juridical dimensions. In fact, Islamic law in Indonesia has fluctuated in line with the politics of law practiced by state authorities. This is based on the socio-cultural strength of the majority of the Muslim community in Indonesia. There is interaction in terms of political decisions, thus giving rise to various political decisions to benefit the Islamic community itself. In Indonesia, there is a determinant politics of law. This means that law is a variable that is influenced by politics. The situation and the political policies that took place greatly influenced the Islamic community's attitudes.Keywords: Politics; Law; Indonesia. ABSTRAKPerkembangan hukum di Indonesia ditentukan oleh konfigurasi politik yang terjadi antara legislatif dan eksekutif. Kecenderungan Dewan Perwakilan Rakyat hampir 85 persen merapat atau berkualisi dengan eksekutif, sehingga ketika eksekutif mengajukan draf perundang-undangan langsung di setujui DPR RI. Urgensi penelitian untuk mengetahui pengaruh politik terhadap pembentukan hukum di Indonesia. Bagaimana konfigurasi politik dan karakter produk hukum Indonesia, dan reaktualisasi dan formulasinya. Metode penelitian yang digunakan adalah penelitian normatif, melalui penelitian kepustakaan dan pendekatan perundang-undangan. Hasil penelitian, bahwa saat ini di Indonesia, dominasi politik terhadap hukum semakin menguat. Partai politik yang seharusnya menjadi penjelmaan kehendak rakyat, hanya terkesan menjadi kendaraan untuk memperoleh maupun mempertahankan kekuasaan. Hal ini berakibat pada produk hukum yang dihasilkan hanya sesuai dengan kepentingan-kepentingan politik dan golongan tertentu, tanpa memperhatikan kesesuaiannya dengan tujuan Negara. Pergerakan sejarah peralihan hukum Islam di Indonesia, penuh dengan berbagai macam dimensi historis, filosofis, politik, sosiologis dan yuridis. Faktanya, hukum Islam di Indonesia telah naik turun sejalan dengan politik hukum yang di praktekan oleh penguasa negara. Hal tersebut besumber pada kekuatan sosial budaya mayoritas masyarakat Islam di Indonesia. Adanya Interaksi dalam hal putusan politik, sehingga memunculkan berbagai keputusan politik bagi kepentingan masyarakat Islam itu sendiri. Di Indonesia terjadi politik determinan atas hukum. Artinya bahwa hukum adalah variabel yang terpengaruhi oleh politik. Situasi dan kebijakan politik yang berlangsung sangat mempengaruhi sikap yang harus di ambil oleh masyarakat Islam.

Abstract

This study discusses the forms of crime in the context of criminal acts or the comparison of criminal acts (same loop) that occur in society. This happens where one person commits a crime, but it is not uncommon for one person to commit several functional crimes at the same time in the same place. On the other hand, there is also one person who determines the number of crimes at different times in different locations which in criminal law is known as the term of criminal acts or sharing criminal acts (same loop) or in Dutch is same loop van Strafbare Feiten. This study uses a normative method using qualitative descriptive analysis. The results of this study indicate that there are three forms of criminal acts namely Concursus Idialis, continuing actions and realist Concursus while the penal system in the proportion of criminal acts can be applied to three methods, namely Stelsel absorption, cumulative Stelsel, and limited cumulative Stelsel.Keywords: criminal code; criminal system; joint crime. AbstrakPenelitian ini membahas tentang bentuk-bentuk kejahatan perbarengan perbuatan pidana atau perbarengan tindak pidana (samenloop) yang terjadi di dalam masyarakat. Hal tersebut bisa terjadi dimana satu orang melakukan satu kejahatan tapi tidak jarang terjadi satu orang melakukan beberapa kejahatan baik dalam waktu yang sama di tempat yang sama. Disisi lain, ada juga satu orang yang melakukan beberapa kejahatan pada waktu yang berbeda di tempat yang berbeda pula yang dalam hukum pidana dikenal dengan istilah perbarengan perbuatan pidana atau perbarengan tindak pidana (samenloop) atau dalam bahasa belanda ialah sameloop van strafbare feiten. Penelitian ini menggunakan metode normatif, dengan menggunakan analisis deskriptif kualitatif. Adapun hasil penelitian ini menunjukkan bahwa ada tiga bentuk perbarengan tindak pidana yaitu concursus idialis, perbuatan berlanjut dan concursus realis sedangkan sistem pemidanaan dalam perbarengan tindak pidana dapat diterapkan tiga stelsel yaitu stelsel absorpsi, stelsel kumulasi dan stelsel kumulasi terbatas.Kata kunci: KUHP; sistem pemidanaan; perbarengan tindak pidana.

Abstract

This study aims to find answers to the problems formulated, namely to find out the implementation of the rights and obligations of fathers towards biological children after a divorce case study at the Agam Selong Court. This research uses a type of normative legal research using the statute approach, case approach and conceptual approach. The conclusions from this study indicate that divorce will not eliminate or abort the obligations of parents towards their children, that the obligations of parents are still the same, whether there is a divorce or not.

Abstract

Regarding the polemic regarding the determination of suspects by KPK investigators against active TNI soldiers. The central point is the issue of authority. The authority in question is related to whether or not KPK investigators may carry out investigations and determine suspects against active TNI soldiers. So the researchers proposed a problem formulation; Does the Corruption Eradication Committee have the authority to investigate criminal acts of corruption committed by active TNI while holding civilian positions? The aim to be achieved with this legal issue is to find out and provide scientific information to interested parties. This research is a type of Normative legal research. "According to Peter Mahmud Marzuki, normative legal research is a process of finding legal rules, legal principles and legal doctrines to answer the legal issues faced." The approach is Legislation (Statuta Approach). The analysis is by means of legal interpretation and analytical descriptive. The result is that in a normal view, if the TNI commits corruption while serving as TNI, then it is purely subject to the military justice law. However, if a member of the TNI commits corruption while holding a civil position, then the Corruption Eradication Commission (KPK) investigators have the authority to conduct an investigation based on the provisions of article 42, Law Number 30 of 2002 concerning the Corruption Eradication Commission, Jo, law Number 19 of 2019 concerning the second amendment to Law Number 30 of 2002 concerning the Corruption Eradication Commission, article 1 number (4), and article 6. Because it is a connectivity court, investigative authority remains with the Corruption Eradication Commission. The Corruption Eradication Commission (KPK) has the authority to coordinate and control the investigation, investigation and prosecution of criminal acts of corruption carried out jointly by persons subject to military justice and general justice.
