Abstract

The existence of human rights in the conception of the rule of law and democracy in Indonesia is the most basic. However, the concept of regulating human rights by the state does not mean that there is a restriction on human rights by the State, but the concept is regulation by the State. Using normative legal research, also called doctrinal law research. In this type of legal research, law is often conceptualized as what is written in laws and regulations (law in books). Analyzed using qualitative descriptive analysis. The results of this study indicate that, in a democratic country, the implementation of human rights is a must. The degree of implementation of democracy and human rights is also influenced by the role of the State. The implementation of democracy and human rights with the people's sovereignty are ideals to be achieved.Keywords: democracy; human rights. AbstrakKeberadaan Hak Asasi Manusia dalam konsepsi Negara hukum dan demokrasi di Indonesia suatu hal yang paling mendasar. Namun konsepsi pengaturan hak asasi manusia oleh negara tersebut bukan berarti terjadinya pengekangan hak asasi manusia oleh Negara, namun konsepsinya adalah pengaturan oleh Negara. Menggunakan penelitian hukum normatif, di sebut juga penelitian hukum doktrinal. Pada penelitian hukum jenis ini, acapkali hukum di konsepkan sebagai apa yang tertulis dalam peraturan perundang undangan (law in books). Dianalisis menggunakan analisis deskriptif kualitatif. Hasil penelitian ini menunjukkan bahwa, pada suatu Negara yang berdemokrasi, implementasi Hak Asasi Manusia merupakan suatu keharusan. Tingkatan implementasi demokrasi dan hak asasi manusia juga dipengaruhi oleh peran Negara. Implementasi demokrasi dan Hak asasi manusia yang berkedaulatan rakyat merupakan cita-cita yang hendak dicapai.Kata Kunci : demokrasi; hak asasi manusia.

Abstract

Peraturan Perundang-undangan adalah keputusan tertulis negara atau pemerintah yang berisi petunjuk atau pola tingkah laku yang bersifat dan mengikat secara umum. Termasuk di dalamnya adalah Peraturan Menteri atas dasar perintah dari undang-undang, meskipun Peraturan Menteri tidak termasuk di dalam hierarki peraturan perundang-undangan berdasarkan Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-Undangan, Tujuan dari penelitian ini adalah untuk menganalis kedudukan Permen dalam hierarki peraturan perundang-undangan. Jenis penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan (statute Approcah) dan pendekatan konsep (Conceptual Approach) serta analasis deskriptif analitik. Hasil penelitian ditemukan bahwa kedudukan Peraturan Menteri tidak termasuk dalam hierarkhi Peraturan Perundang-Undagan, akan tetapi menjadi bagian dari peraturan perundang-undangan.

Abstract

Regarding the polemic regarding the determination of suspects by KPK investigators against active TNI soldiers. The central point is the issue of authority. The authority in question is related to whether or not KPK investigators may carry out investigations and determine suspects against active TNI soldiers. So the researchers proposed a problem formulation; Does the Corruption Eradication Committee have the authority to investigate criminal acts of corruption committed by active TNI while holding civilian positions? The aim to be achieved with this legal issue is to find out and provide scientific information to interested parties. This research is a type of Normative legal research. "According to Peter Mahmud Marzuki, normative legal research is a process of finding legal rules, legal principles and legal doctrines to answer the legal issues faced." The approach is Legislation (Statuta Approach). The analysis is by means of legal interpretation and analytical descriptive. The result is that in a normal view, if the TNI commits corruption while serving as TNI, then it is purely subject to the military justice law. However, if a member of the TNI commits corruption while holding a civil position, then the Corruption Eradication Commission (KPK) investigators have the authority to conduct an investigation based on the provisions of article 42, Law Number 30 of 2002 concerning the Corruption Eradication Commission, Jo, law Number 19 of 2019 concerning the second amendment to Law Number 30 of 2002 concerning the Corruption Eradication Commission, article 1 number (4), and article 6. Because it is a connectivity court, investigative authority remains with the Corruption Eradication Commission. The Corruption Eradication Commission (KPK) has the authority to coordinate and control the investigation, investigation and prosecution of criminal acts of corruption carried out jointly by persons subject to military justice and general justice.
