Abstract

This article is the result of research with the aim of analyzing and examining the principles in the implementation of the National Social Security System by BPJS Kesehatan in Jambi City. Then it aims to study and analyze the problems and efforts to overcome the problems. The research carried out is a type of empirical research, which concentrates on the main data from the field. The sampling method is through the 'accidental sampling' technique. The result of the research states that the humanitarian principle and the principle of benefit have mostly been implemented in BPJS services at the Hospital in Jambi City. Only the principle of social justice for all Indonesian people is still obscured and its implementation has not yet been seen in the implementation of health services by BPJS at Jambi City Hospital. Furthermore, there are still problems in the implementation of the BPJS in Jambi City, namely some of the losses in the implementation of the National Health Insurance, the unfairness of claims by participants in certain groups, unequal facilities and health workers in Hospitals.

Abstract

Land is a vital component of human life and has economic worth. According to a Javanese adage, "sedhunuk bathuk senyarii bumi" signifies that one inch of land will be preserved even at the cost of one's life. The lack of legal protection for indigenous people's land has resulted in a plethora of land conflicts with parties with legal standing. Indigenous people have had a difficult time protecting their land against parties with legal protection due to the lack of formal and legitimate land ownership proof. Formal and authentic evidence of property ownership is critical in preventing land dispute. Indigenous peoples must register their lands in order to obtain authentic and formal evidence of their ownership. The purpose of this research is to determine the urgency of registering customary lands, as well as the primary cause for registering the communal lands. Additionally, this study will investigate the procedure of registering customary lands. This research included empirical methodologies, which included data collection, data processing, and data analysis. The outcome will be presented in a systematic and objective manner to assist in the resolution of a problem or the testing of a hypothesis. Land tenure, land registration, and land rights are all terms that refer to customary land.

Abstract

This study aims: 1) To find out and analyze the implementation of the responsibility of the Perumda Air Minum Tirta Muaro Jambi towards the fulfillment of consumer rights in drinking water services, 2) To find out and analyze the dispute resolution efforts carried out by Perumda Air Minum Tirta Muaro Jambi on the losses suffered by consumers. The method used in this research is the empirical juridical method. This research is descriptive, the sampling procedure is purposive sampling. The research results obtained are 1). The responsibility of the Tirta Muaro Jambi Drinking Water Perumda is an absolute responsibility (strict product liability) but in its implementation Perumda Air Minum Tirta Muaro Jambi not yet absolutely responsible for fulfilling consumer rights in drinking water services. There are still 115 complaints that have not been responded to or 46% of the 246 Perumda Air Minum Tirta Muaro Jambi customers who reported the complaint. 2) Perumda Air Minum Tirta Muaro Jambi has attempted to settle consumer demands for negligence by Perumda Air Minum Tirta Muaro Jambi but not optimal. Efforts made by Perumda Air Minum Tirta Muaro Jambi: a. Conduct site inspections in case of pipe leaks; b. Find out the cause of expensive payments; c. Replace the customer's water meter if there is damage due to negligence of the Perumda Air Minum Tirta Muaro Jambi. As well as efforts to resolve disputes that have existed at Perumda Air Minum Tirta Muaro Jambi are by way of peace or negotiation.Keywords: responsibility; consumer; drinking water.

Abstract

This study aims to examine and analyze the urgency of respecting and protecting the right to manage natural resources for the Talang Mamak customary law community in Tebo District; and Researching and analyzing the conception of the relationship between the Talang Mamak people over natural resources in Tebo District. This research is an empirical research. The results of the study show that respect and protection of the right to manage the natural resources of the Talang Mamak customary law community in Tebo Regency have been carried out, although only in a number of sectors, namely recognition of existence in the government administration sector and residential areas. In the sector of recognition of the existence of customary law on natural resources by the Regional Government has not been carried out. Furthermore, the concept of the relationship between the Talang Mamak people over natural resources in Tebo Regency is a relationship concept based on political power and ideological power. Abstrak Penelitian ini bertujuan untuk Meneliti dan menganalisis urgensi penghormatan dan perlindungan hak mengelola sumber daya alam masyarakat hukum adat Suku Talang Mamak di Kabupaten Tebo; dan Meneliti dan menghanalisis konsepsi hubungan antara masyarakat suku Talang Mamak atas sumber daya alam di Kabupaten Tebo. Penelitian ini merupakan penelitian empiris. Hasil Penelitian menunjukkan bahwa penghormatan dan perlindungan hak mengelola sumber daya alam masyarakat hukum adat suku talang mamak di Kabupaten Tebo telah di lakukan walaupun hanya di sebagian sektot, yaitu pengakuan eksistensi di sektor adminitrasi pemerintahan, dan wilayah pemukiman. Disektor pengakuan terhadap eksistensi hukum adat terhadap sumber daya alam oleh Pemerintah Daerah belum di lakukan. Selanjutnya, Konsep hubungan antara masyarakat suku Talang Mamak atas sumber daya alam di Kabupaten Tebo adalah konsep hubungan berdasarkan kekuasaan politk dan kekuasaan ideologi.

Abstract

 ABSTRAKPeraturan Menteri LHK Nomor 9 Tahun 2021 Tentang Perhutanan Sosial, menyebutkan pada Pasal 1 Angka 2 bahwa hutan desa dikelola oleh desa dan dimanfaatkan untuk kesejahteraan masyarakat. Bertolak pada Pasal 1 angka 2 tersebut ternyata secara empiris salah satu Hutan Desa Rimbo Pusako Batang Terab Desa Jelutih Kecamatan Bathin XXIV sejak ditetapkan tahun 2011 sampai tahun 2021 belum dikelola dan dimanfaatkan sehingga belum dapat mewujudkan tujuan dari adanya hutan desa tersebut. Penelitian ini membahas tentang permasalahan hukum sebagai faktor yang menjadi kendala dalam pengelolaan dan pemanfaatan hutan desa Rimbo Pusako Batang Terab di Desa Jelutih, dan penguatan pengaturan yang perlu dilakukan dalam pengelolaan dan pemanfaatan Hutan Desa Rimbo Pusako Batang Terap di Desa Jelutih. Metode penelitian menggunakan yuridis empiris terhadap praktek yuridis terkait pengelolaan dan pemanfaatan  Hutan Desa Rimbo Pusako Batang Terab. Hasil penelitian menegaskan bahwa terdapat permasalahan hukum sebagai faktor kendala  dalam pengelolaan dan pemanfaatan hutan desa yakni peraturan desa, peraturan daerah dan peraturan bupati serta peraturan Menteri Desa Transmigrasi dan daerah tertinggal. Penguatan pengaturan hutan desa ke dalam peraturan menteri desa mengenai dana desa, peraturan daerah kabupaten dan peraturan bupati mengenai RPJMD,RKPD dan APBD serta peraturan desa sebagai solusi dalam mewujudkan kesejahteraan masyarakat sebagai tujuan adanya hutan desa. Kata kunci: permasalahan hukum, hutan desa.ABSTRACT Forest Village of Rimbo Pusako Batang Terab Originates from a production forest area located Minister of Environment and Forestry Regulation Number 9 of 2021 concerning Social Forestry, states in Article 1 Number 2 that village forests are managed by villages and utilized for the welfare of the community. Based on Article 1 point 2, it turns out that empirically one of the Rimbo Pusako Village Forests, Batang Terab, Jelutih Village, Bathin XXIV District, since it was established in 2011 to 2021, has not been managed and utilized so it has not been able to realize the objectives of the village forest. This study discusses legal issues as a factor constraining the management and utilization of the Rimbo Pusako Batang Terab village forest in Jelutih Village, and strengthening the arrangements that need to be made in the management and utilization of the Rimbo Pusako Batang Terap Village Forest in Jelutih Village. The research method uses empirical juridical practices regarding the management and utilization of the Rimbo Pusako Batang Terab Village Forest. The results of the study confirmed that there were legal issues as a constraining factor in the management and utilization of village forests, namely village regulations, regional regulations and regent regulations as well as regulations from the Minister of Transmigration Villages and underdeveloped areas. Strengthening village forest arrangements into village ministerial regulations regarding village funds, district regional regulations and district heads regulations regarding RPJMD, RKPD and APBD as well as village regulations as a solution in realizing community welfare as the goal of village forests.Keywords: legal issues, village forest.
