Abstract

Co-operative as company structure (bangun perusahaan) is a concept developed by the Founding Fathers, enshrined in Article 33.1 of the 1945 Constitution. This concept is further developed by renowned economists and lawyers as well. This Article explores the thoughts of Mohammad Hatta, Soepomo, economists and lawyers who have contributed to the development of the concept of co-operatives as company structure. Subsequently, it will offer a framework in which the constitutional stipulation of "a common endeavor based on familial principles" serves as the philosophical basis for the concept. Using Sri-Edi Swasono’s Idea of "Triple-Co" as yardstick, the concept of co-operatives as company structure ought to be the spirit of any legal regulation concerning business organization. Finally, this article recommends a legal political option that might be pursued by the Government to realize the ideals of our Founding Fathers concerning business organization as stipulated in Article 33.1 of the 1945 Constitution.

Abstract

Pancasila as the basis of the state is the main guideline for Indonesian political and social life. In the field of law, Pancasila has been determined as the main source national legislation process. However, the competing interests in formulation of legal policies sometimes put Pancasila values at difficult position to be implemented. Indonesian lawmakers should end the unfavorable situation by utilizing geopolitical knowledge. Moreover, currently there is important change in the global geopolitical map which provides opportunity for Indonesia to make legal policies which are in accordance with its national interests. This research was conducted based on the inter-disciplinary legal research methodology by using a socio-legal approach for the data collection process. This research analyzes the natural resource sector which is very important for Indonesia, but vulnerable to foreign intervention. The result of the study finds the values of Pancasila in the midst of changes in the global geopolitical map can actually be implemented if the legal policy is mainly based on Indonesia's national interests.

Abstract

The purpose of this paper is to evaluate the division of inheritance in situations where marriage and child recognition take place after the testator dies. This research uses the doctrinal method, taking a statutory approach and a conceptual approach. The results show that a marriage that occurs after one of the spouses dies can still be recognized if it follows the procedure of registering the marriage at the civil registry office after obtaining a determination from the court, so that the marriage is considered valid. This is in accordance with Article 825A which states that the spouse left behind becomes the first class of heirs. Regarding the recognition of a child after the death of the father, Constitutional Court Decision No. 46/PUU-VIII/2010 allows for the legal recognition of the child, provided that it can be proven through science and technology, or other evidence that is valid according to law. Thus, the child is considered a legitimate child and becomes part of the first class of heirs together with the mother.

Abstract

Deed of Recognition of Debt is a deed that is generally made by the notary public, followed by binding guarantees that are attached (accessoir) the main agreement. In practice, the Deed of Recognition of Debt can be transferred to another party who is willing to buy it, so that The Sale and Purchase Agreement of Rights to Cessie and Agreements of Transfer of Rights to Cessie is notarized made. The last party who has the cessie rights sometimes does not get his rights because the debtor is no longer known to exist. That is why the party who has the cessie rights claims it to District Court so that it can be determined as the owner of the object of collateral. This case happened at the North Jakarta District Court No. 123/Pdt.G/2018/PN. JKT.UTR where the Panel of Judges decided that the Court's Decision could be a substitute of the land deed sell and purchase based on the sale and purchase agreement of rights to cessie and agreements of transfer of rights to cessie. This court decision is certainly a new legal breakthrough, especially in the notarial and land affairs fields. This type of research is normative with qualitative data analysis, and concluding deductive means. Based on the author's analysis, The Sale and Purchase Agreement of Rights to Cessie and Agreements of Transfer of Rights to Cessie is valid is authentic deeds that are valid and in accordance with applicable law. The public notaries also run their authority properly, so that the deeds have fulfilled the external, formal, and material aspects. Land deed officer who will make the deed on Land Certificate Number. 5217/Bojongnangka has been protected by law because the Land deed officer is obliged to obey the Decision of the Panel of Judges as the competent general authority, and the land deed officer only run his authority after the Land Office of Tangerang Regency has processed the owner's name change of initials TN to SS.

Abstract

Penelitian ini dilatarbelakangi dari adanya sengketa tumpang tindih klaim kepemilikan antara masyarakat hukum adat Kaum selaku penguasa tanah harato pusako tinggi dengan pemerintah Kota Pariaman selaku penguasa tanah timbul (pasie maelo) dalam permohonan pendaftaran hak atas tanah, yang terjadi di wilayah pesisir Kota Pariaman. Penelitian ini dilakukan untuk mengidentifikasi penguasaan pasie maelo atau tanah timbul karena pergeseran garis pantai berdasarkan hukum pertanahan serta menganalisis kedudukan tanah harato pusako tinggi sebagai tanah hak ulayat masyarakat hukum adat yang berbatasan dengan tanah timbul dalam Putusan Nomor 55/Pdt.G/2022/Pn.Pmn. Metode Penelitian yang digunakan adalah penelitian doktrinal berdasarkan data sekunder, dengan penelitian yang bersifat eksplanatoris dan kemudian dianalisis secara kualitatif. Hasil penelitian menunjukan bahwa penguasaan tanah timbul dilakukan menyesuaikan pada keadaan dari tanah timbul, sehingga dapat dikuasai secara langsung oleh negara, maupun dilakukan berdasarkan hak terdahulu dan asas kepentingan umum. Penguasaan dan pelepasan tanah timbul harus dilaksanakan dengan memperhatikan asas Contradictoire Delimitatie, yaitu asas dalam hukum pertanahan yang mendahulukan kesepakatan batas tanah. Dalam penelitian juga diperoleh temuan bahwa tanah harato pusako tinggi adalah tanah ulayat yang diakui dalam hukum positif dan dalam Putusan Nomor 55/Pdt.G/2022/Pn.Pmn, Kaum Para Penggugat diakui dan dilindungi eksistensinya sebagai masyarakat hukum adat. Dengan demikian, kedudukan tanah harato pusako tinggi diakui dalam ius constitutum dan tidak boleh diklaim tanpa persetujuan masyarakat hukum adat yang menguasainya.

Abstract

Certificate of land ownership regulated in the Undang-Undang Pokok Agraria (“UUPA”) is an ownership proof of the land right where it becomes powerful evidence. The increasement of necessity of a land is not followed by the increasement of the availability of land that can be utilized by the society, which causes many disputes related to the ownership or land right. One of many problems that arises is double certificate on a land. Double certificate on a land causing risks on the owner of land right where such phenomena caused by the maladministration to criminal action. Badan Pertanahan Nasional (“BPN”) as an institution established by the Government that holds the sole authority in national land should be responsible in the matters related to the land dispute, especially double certificate. Beside that, there is a necessity on the legal protection to be provided by the State for the owner of land right to protect the rights of the land owner. The research performed using juridical normative with legislation approach and conseptual approach. Research result will be written in the form of explanatory-analysis where the writer explains the case in the case of lawsuit and the theories related with the problem, then analyzes the consistency between the problem and the applicable laws and regulations or theories.
