Abstract

This paper aims to discover an appropriate port management model so that Indonesian ports can export technology while also supporting managerial and functionally international trade.   The blockchain chain model can help Indonesian ports compete with ports in neighboring countries.   The study also explores whether managing shipping workflows and documents can adopt the Blockchain of existing maritime ports. This study employs qualitative research methods.   The research used secondary data from international regulations and conventions while supporting information with depth interview data; Current studies build a conceptual framework through a systematic project review conducted in conjunction with scientific literature published in journals and conference processes, random sampling, and observation over the past decade. The results showed that the project under review could be compiled into three main conceptual areas: document workflow management, financial processes, and device connectivity. However, having a clear linkage, no project under review considered all three places at once. Concepts related to maritime document workflows receive broad support among the projects under consideration. In addition, the project under review inadvertently followed similar goals set out in the port management scientific project before the introduction of blockchain technology.

Abstract

PT Charoen Pokphand Indonesia Tbk (CPI) merupakan perusahaan integrator besar dalam industri perunggasan nasional yang menguasai rantai pasok dari hulu hingga hilir, mencakup produksi pakan, pembibitan ayam (DOC), hingga distribusi hasil ternak. Penguasaan multi-level ini menempatkan CPI pada posisi dominan yang berpotensi menimbulkan praktik persaingan usaha tidak sehat. Penelitian ini bertujuan: (1) menganalisis penerapan pengaturan integrasi vertikal dalam kegiatan usaha CPI; (2) menilai akibat integrasi vertikal terhadap UMKM peternak mandiri dalam perspektif hukum persaingan usaha; dan (3) merumuskan upaya perlindungan hukum bagi UMKM peternak mandiri dari risiko integrasi vertikal CPI. Metode yang digunakan adalah pendekatan yuridis-normatif dengan spesifikasi deskriptif-analitis, melalui studi dokumen terhadap peraturan perundang-undangan, literatur ilmiah, serta putusan/rujukan KPPU, dan didukung wawancara dengan peternak mandiri serta mitra CPI. Hasil penelitian menunjukkan: (i) praktik CPI dipandang belum memberi perlindungan memadai bagi UMKM peternak mandiri dan bertentangan dengan asas keadilan serta kemandirian usaha; (ii) integrasi vertikal CPI terindikasi menimbulkan foreclosure effect melalui penguasaan pasar input (DOC dan pakan) yang membatasi akses peternak mandiri dan memicu ketidakseimbangan kontraktual yang berpotensi mengarah pada penyalahgunaan posisi dominan; serta (iii) perlindungan hukum perlu diperkuat melalui pengawasan KPPU dan harmonisasi regulasi yang masih inkonsisten agar efisiensi tidak mengorbankan persaingan sehat dan keberlanjutan UMKM.

Abstract

The Merah Putih Cooperative (KMP) program is a government initiative aimed at achieving national economic equality in accordance with the mandate of Article 33 of the 1945 Constitution. However, in its implementation in the field, this program still faces various obstacles, mainly due to the accelerated establishment of institutions and limited human resource capacity. Many cooperative administrators and supervisors do not yet have an adequate understanding of the principles of cooperative law and the responsibilities attached to their positions as stipulated in the law. To overcome this problem, legal counseling activities are carried out using the participatory legal education approach based on the AKOSA (Alami–Kemukakan–Olah–Simpulkan–Aplikasikan) model. Through these five stages, participants were invited to identify actual legal issues in cooperatives, discuss their field experiences, analyze them based on legal provisions, draw conclusions together, and apply them through the practice of drafting Bylaws (ART) and simulating minutes of the Annual Member Meeting (RAT). The results of the activity showed a significant increase in participants' legal knowledge and skills, with the effectiveness of participatory learning reaching a level of practical significance (p < 0.05). A total of 92% of participants stated that this activity was relevant to the needs of cooperatives, and 87% wanted ongoing legal assistance. Qualitatively, this activity also showed a shift in legal culture from compliance-based to participatory-based governance, in which administrators and supervisors not only comply with the rules but also internalize legal values as institutional ethical guidelines.
