Abstract

This research focuses on the Proportionality test model of Competing Rights in practice in civil law countries (Germany and South Korea) and the Common Law System (United States and Canada). The research method used is a normative legal research method with statutory, comparative, and case approaches. The results show that the proportionality test is the "ultimate rule of law," a fundamental benchmark in judicial review, and has become a global constitutionalism recognised and applied internationally. Its application is structured and systematic with four test stages, such as German, Canadian, and South Korean models. Meanwhile, it is unstructured in the United States, and there is only one analytical tool (balancing test). In the case of decision, the four stages are only sometimes applied, but according to the needs of the analysis. If, at the third stage (necessity/minimal impairment), it is found that the object being tested is contrary to the Constitution, then the argumentation focuses on that analysis of it. The fourth stage is used if the case is more complicated and requires analysing the balance of norms and legal values. Meanwhile, in the Indonesian Constitutional Court practice, there is a proportional analysis, but it is partial, unstructured, and unsystematic. Therefore, in the future, it is essential to develop an Indonesian model of the principle of proportionality under the values of Pancasila and the 1945 Constitution.

Abstract

Early childhood language development is language development that children must have as one of the basic abilities, according to their age stages and developmental characteristics. This research generally aims to improve oral language, specifically finding out how much oral language ability is through the application/use of storytelling methods. This research was carried out in class B of harapan islamiah.. The research subjects were 22 students consisting of 6 boys and 16 girls. The data for this research are data on students' oral language skills, data collection instruments using observation sheets and data collection techniques through observation. The data analysis technique uses a comparative descriptive method, namely comparing cycle I and cycle II each in two meetings. Based on the analysis of the data obtained, learning activities used II cycles, totaling 4 meetings. In cycle I, the number of presentations was 36.4%, followed by meeting II at 54.5%. Meanwhile, in cycle II, meeting I, it was 68%, followed by meeting II to 86.4%. This increase has exceeded learning completion. The results of the research show that the storytelling method which is done repeatedly can train children's concentration in improving language skills through listening and expressing language in group B of harapan islamiah

Abstract

Artikel ini membahas pentingnya kesantunan berbahasa dalam pembelajaran dasar rias di Universitas Negeri Medan. Kesantunan berbahasa merupakan aspek krusial dalam komunikasi yang mempengaruhi interaksi antara dosen dan mahasiswa. Penelitian ini bertujuan untuk mengeksplorasi bagaimana penerapan prinsip-prinsip kesantunan berbahasa dapat meningkatkan kualitas pembelajaran dan menciptakan suasana belajar yang positif. Melalui metode kualitatif, data dikumpulkan dari observasi kelas, wawancara dengan dosen dan mahasiswa, serta analisis dokumen terkait. Hasil penelitian menunjukkan bahwa penggunaan bahasa yang santun tidak hanya memperkuat hubungan interpersonal, tetapi juga meningkatkan motivasi belajar mahasiswa. Artikel ini menyimpulkan bahwa integrasi kesantunan berbahasa dalam kurikulum pembelajaran rias dapat memberikan dampak positif bagi perkembangan keterampilan sosial dan profesional mahasiswa.

Abstract

The use of slang among Indonesian teenagers has become increasingly popular, especially on social media and in daily life. While slang serves as a symbol of social identity, its excessive use can affect the ability to use correct and proper Indonesian, particularly in academic settings. This article examines the influence of slang on teenagers' Indonesian language skills, particularly in writing and speaking in formal school contexts. Through a literature review, it is found that while slang strengthens social bonds, uncontrolled usage can disrupt the ability to use standard Indonesian in formal situations. Therefore, it is important to find a balance between language creativity and the use of standard Indonesian in educational environments.

Abstract

Penelitian ini tentang pengenyampingan keadilan substantif dalam penerapan ambang batas sengketa hasil pilkada di Mahkamah Konstitusi, yang dilatarbelakangi oleh persoalan penerapan ambang batas sebagai syarat formil permohonan penyelesaian sengketa hasil pilkada. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif/ doktrinal dengan pendekatan perundang-undangan (statute approach), pendekatan analitis (analytical approach), pendekatan kasus (case approach). Teknik pengumpulan data dilakukan dengan cara penelitian kepustakaan (library research) dan analisis data menggunakan deskriptif kualitatif.Hasil penelitian membuktikan bahwa penerapan ambang batas permohonan sengketa hasil (0,5-2%) pada pilkada tahun 2015, 2017, dan 2018 yang seluruhnya diterapkan dengan kaku dengan mengutamakan Pasal 158 Undang-undang Pilkada yang berkepastian hukum. Penerapan ini telah menciderai ketentuan Pasal 24 ayat (1), Pasal 18 ayat (4), dan Pasal 28D ayat (1) Undang-undang Dasar 1945 yang menegaskan peradilan MK tidaklah sekedar menerapkan kepastian hukum (undang-undang pilkada), peradilan MK sesungguhnya adalah menerapkan konstitusi, bukan undang-undang. Artinya jika ada undang-undang melanggar/ menghalangi ketentuan ruh peradilan konstitusi, maka harus dibatalkan/ dikesampingkan dalam penerapannya (kasuistis). Marwah peradilan konstitusi harus ditegakkan dengan mengutamakan keadilan substantif agar mampu membuktikan penerapan nilai-nilai demokrasi yang jujur dan adil, sekaligus membuktikan tidak adanya pelanggaran yang terstruktur, sistematis, dan masif.

Abstract

Along with technological advances, there are many media that can be used to support school children's learning, one of which is digital education media that can provide various learning methods so that students do not feel bored during the learning process. However, currently there are still many schools that have not used technology in the field of education that requires different methods, such as introduction to computer hardware in ICT subjects for junior high school students. Existing facilities in some schools are very limited and teachers still use conventional methods, namely using tools such as books or 2-dimensional pictures that are only shown to students but do not practice so that students do not have a broad understanding of information and uses regarding computer hardware. If Augmented Reality technology is applied in schools, students will be more interested in learning about this material because computer hardware objects can be displayed in 3D form. This study uses the Multimedia Development Life Cycle (MDLC) method, the Marker based tracking method which is used as a benchmark for displaying 3D objects and can be run on smartphones with the Android operating system. This application is made with several supporting applications such as Unity 3D, Vuforia, Adobe Photoshop, Blender 3D, Visual studio and the C# (C Sharp) programming language. The purpose of building this augmented reality application is to increase students' interest and enthusiasm for learning about computer hardware introduction material at the school level.

Abstract

Artikel ini membahas pentingnya kesantunan berbahasa dalam pembelajaran dasar rias di Universitas Negeri Medan. Kesantunan berbahasa merupakan aspek krusial dalam komunikasi yang mempengaruhi interaksi antara dosen dan mahasiswa. Hasil penelitian menunjukkan bahwa penggunaan bahasa yang santun tidak hanya memperkuat hubungan interpersonal, tetapi juga meningkatkan motivasi belajar mahasiswa. Artikel ini menyimpulkan bahwa integrasi kesantunan berbahasa dalam kurikulum pembelajaran rias dapat memberikan dampak positif bagi perkembangan keterampilan sosial dan profesional mahasiswa.

Abstract

Tujuan penelitian ini adalah untuk mengetahui gambaran  belajar, hasil belajar fisika dan untuk mengetahui hubungan antara  belajar dengan hasil belajar fisika Siswa kelas X SMA Negeri 3 Pinrang. Teknik dalam pengambilan sampel yaitu menggunakan teknik propossional randem Sampling dan penentuan jumlah sampel menggunakan rumus Yamanen dari populasi yang ada, sehingga sampel penelitian ini ditentukan sebanyak 65 siswa dari 265 siswa sebagai populasi. Metode yang digunakan dalam penelitian ini adalah metode asosiatif korelasional dengan pendekatan expost facto dan survey. Analisis yang digunakan adalah analisi deskriptif dan analisi korelasi sederhana untuk mengetahui hubungan antara dua variabel dan mengetahui arah hubungan yang terjadi. Hasil variabel  pada 40 Item soal angket berkategori valid, nilai cronbach’s Alpha X sebesar 0,895 yang berarti bahwa pada instrumen adalah reliabel. Deskripsi analisis deskriptif secara numerik pada nilai Mean sebesar 61,38, Median sebesar 62,50, Mode sebesar 65, Std. Deviation sebesar 8,46 Variance 71,5, Range sebesar 33, Minimum sebesar 41, dan nilai Maximum sebesar 74. Tingkat keeratan hubungan  terhadap hasil belajar sebesar 0,990 maka dapat dikatakan motivasi belajar memiliki tingkat hubungan berada pada kategori berkorelasi sempurna terhadap hasil belajar siswa kelas X SMA Negeri 3 Pinrang.

Abstract

As a member of the international community, Indonesia has a responsibility to participate in the execution of global policy. Recently, a global policy was implemented to address the sharing of financial information between countries. Financial information transparency between countries requires the sharing of bank customers' financial information via both manual and automatic transmission. This policy aims to prevent economic crimes, including tax evasion. This study combines normative legal research and in-depth interviews aimed at determining how to determine how legal justice can be achieved in the context of the exchange of financial data for taxes purposes in Indonesia. The principle of bank secrecy functions as a safeguard to protect bank clients' right to privacy, which is a human right that must be preserved. On the one hand, citizens have a civic duty to voluntarily fulfill their tax obligations. On the other hand, as bank clients, citizens also have the right to be protected from violations of privacy. Assuming the perspective of legal justice, this paper seeks to describe the balance between these two needs. Finally, the study's results support the argument for abolishing the principle of bank secrecy, especially in the realm of taxation.
