Abstract

"At the beginning of the independence era, Kahrudin Yunus proposed a natural law-based economic law model, but it declined in recent years or discussion in scholarly communities. This article examines the trend toward relations between state, government, and the rule of economic law based on bersamaism. Interpretive analytic is the method employed. Bersamaism’s basic assumptions are based on the universality of Quran truth, and the state must be positioned as an intermediary in legal and economic activities. Bersamaism is similar to the natural law school in terms of thought, but it also provides an understanding empirical considerations, actually has provided a prototype for the development of an economic system for Indonesia."Keywords: Economic justice; natural law; prophetic lawMenilik Kahrudin Yunus Mengenai Bersamaisme: Desain Hukum Alam Untuk Indonesia Hari IniAbstrakPada awal era kemerdekaan, Kahrudin Yunus mengajukan model hukum ekonomi berbasis hukum alam, namun beberapa tahun belakangan ini ditolak dalam diskusi di kalangan cendikiawan. Artikel ini mengkaji kecenderungan hubungan antara negara, pemerintah, dan supremasi hukum ekonomi berbasis Bersamaisme. Analitik interpretatif adalah metode yang digunakan. Asumsi dasar Bersamaisme didasarkan pada universalitas kebenaran Alquran, dan negara harus diposisikan sebagai perantara dalam kegiatan hukum dan ekonomi. Bersamaisme mirip dengan mazhab hukum alam dalam hal pemikiran, tetapi juga memberikan pemahaman pertimbangan empiris, sebenarnya telah memberikan prototipe bagi pengembangan sistem ekonomi bagi Indonesia.Kata kunci: Keadilan ekonomi; hukum alam; hukum profetik

Abstract

One of the important aspects to understand about the issue of polygamy is the motives of the perpetrators, as polygamy has psychological impacts on the wives and children involved. This study aims to explore the motives of polygamists and the effects on their wives and children. A qualitative method with a phenomenological approach was employed, and data were collected through in-depth individual interviews with five informants selected using purposive sampling. The six informants in this study are individuals who have two wives. All data were analyzed thematically using the Miles and Huberman analysis technique. The findings revealed six key motives of polygamists: i) the ability to be fair, ii) having sufficient economic resources, iii) the first wife suffering from a chronic illness, iv) hypersexual behavior, v) incompatibility between the first wife and the family, and vi) raising the dignity of the second wife due to economic hardship. These six motives challenge the negative perceptions of polygamists often held by society, which tend to view their actions as inherently wrong. In reality, these motives are driven by good intentions and align with the values of being a good Muslim.

Abstract

This study examines the tension between the religious legitimacy of Islamic sharia and contemporary social norms in the practice of polygamy in Indonesia. While polygamy is permitted in Islam under the fundamental condition of justice among wives, its practice frequently encounters social resistance rooted in values of gender equality and family integrity. Employing a descriptive qualitative approach, this research combines field studies and literature review methods. Data were collected through semi-structured interviews involving women in polygamous marriages, religious leaders, women’s rights activists, and members of the general public. The findings indicate that polygamy is predominantly perceived negatively by Indonesian society, largely due to prevailing social constructions, collective experiences associated with marital conflict, and biased representations in mass media. Women who become second wives often experience social stigma in the form of negative labeling and social exclusion, which adversely affects their psychological well-being and social standing. Moreover, mass media tends to reinforce narratives of injustice and conflict within polygamous households, producing a monolithic image that fails to capture the diversity of lived experiences. This study concludes that polygamy constitutes a complex and multidimensional social phenomenon that cannot be assessed solely on the basis of religious permissibility. Accordingly, a more equitable, contextual, and gender-sensitive approach is necessary for understanding and evaluating the practice of polygamy within Indonesian society.
