Abstract

This research aims to analyze the decision to sue for divorce because the husband is impotent from the perspective of maslahat theory. The main condition for building a harmonious family is the existence of mutual trust and understanding between husband and wife. However, in living a married life, problems sometimes arise, such as the husband suffering from impotence, which can disrupt the relationship between husband and wife. This type of research is normative legal research, the data source is secondary data in the form of the decision of the Andoolo Religious Court, Southeast Sulawesi, Number 0225/Pdt.G/2019/PA.Adl regarding divorce due to husband suffering from impotence. This research found that the judge's consideration in deciding case Number 0225/Pdt.G/2019/PA.Adl was that the judge granted the divorce suit on the grounds that there had been continuous disputes and quarrels between husband and wife, the factor causing the disputes and quarrels was that the defendant was unable to produce children. The defendant suffered from impotence which the plaintiff only discovered after marrying the defendant. The judge's considerations were in accordance with the provisions of Article 19 letter (f) Government Regulation Number 9 of 1975 concerning the Implementation of Law Number 1 of 1974 concerning Marriage jo. Article 116 letter (f) KHI, so that the Plaintiff's divorce claim is granted. The judge's considerations in granting the divorce suit are also in accordance with the benefit theory, including benefits for the wife, benefits for the husband and benefits for society.

Abstract

This study aims to investigate the transformation of leadership in Islamic universities before and after the implementation of the Regulation of the Minister of Religion Number 68 of 2015. This study uses a qualitative approach with a case study design conducted at the State Islamic University of North Sumatra Medan. Data were collected through participant observation, semi-structured interviews with fourteen informants consisting of four students and ten students selected by purposive sampling technique. Data analysis techniques follow the Miles and Huberman method, including data collection, data reduction, data presentation, and conclusion drawn. Triangulation of sources and techniques is used to ensure the validity of the data. This study aims to describe and analyze the transformation of leadership in Islamic universities before and after the implementation of the Regulation of the Minister of Religion Number 68 of 2015. The results of the study show that there are significant changes in the criteria and leadership selection process after the implementation of the new regulation, which emphasizes the importance of the position of Professor and involves the role of the Selection Commission. This change reduces the participation of the academic community and increases the issue of personal closeness in the appointment of officials, affecting the dynamics of leadership and institutional performance. This study provides insight into the impact of regulations on leadership management in Indonesian Religious Higher Education. In the context of moving towards Word Class University, an inclusive and transparent transformational leadership strategy is key to ensuring effective adaptation to new regulations and improving the overall performance of the institution.

Abstract

The main discussion of this research is identifying operational risks in improving the quality of education at Madrasah Tsanawiyah as well as how to control and evaluate these risks. Madrasah or other educational institutions that have the same eligibility requirements as any organization. Operational risk control is a way of managing risk that goes hand in hand with various aspects of the company, where risks can be managed or reduced until the amount of risk cannot be completely eliminated. This research uses qualitative research methods through a descriptive approach. This research aims to determine and describe operational risks in improving the quality of education at Madrasah Tsanawiyah, as the results of the author's research conclude that there are several operational risks identified and the institution already knows how to control and evaluate to follow up on these matters.

Abstract

This research aims to examine the implementation of Abraham Maslow's humanistic learning theory in the learning process. The method used in this research is the Systematic Literature Review (SLR) method. This research data uses the main source of information by analyzing documents related to Abraham Maslow's Humanistic learning theory in the learning process. The research results show that the implementation of Abraham Maslow's humanistic learning theory is very relevant to the learning process where there are five human needs that can be applied in the learning process, namely: first, physiological needs where parents must pay attention to children starting from nutrition and other needs because this will relate to development a child; second, the need for safety and security where educators such as parents and teachers must provide a sense of security and safety for children; third, the need to be loved and loved, where the need to love and have someone, parents must create good closeness to their children and a teacher must provide motivation; fourth, the need to be respected. In the learning process, every effort made by students should be respected and the attitude must be equal to all children and there should be no favoritism between students because each child has their own strengths; fifth, the need to increase self-actualization where in implementing humanistic learning theory students are given the opportunity to actualize themselves according to their talents and interests.

Abstract

Asbabun nuzul is the process of the revelation of the Quran at certain times, the cause of its revelation was based on an event that occurred, or the revelation was caused by questions from the Arabs to the Prophet. This research discusses the benefits asbabun nuzul, the concept of education, as one of the story teaching methods applied by the Prophet. So the method used in this research uses library research methods which include book sources, journals and historical stories. The results of research studies on the relevance of the causes of the revelation and Islamic law can improve student learning outcomes effectively and build moral character and exemplary attitudes among students, accompanied by an analysis of the asbabun nuzul verses on education in Surah Al-Luqman verses 12-19 which contain them. Islamic faith and sharia education.

Abstract

This research discusses hermeneutics in the study of Alquran interpretation. The aim of this research is to understand the meaning of the text and context in interpreting the Alquran properly and correctly and making the understanding more comprehensive and accurate as well as its application in the current context. This research uses qualitative methods with a thematic analysis approach. By examining books, journals, research reports, magazines, tafsir books and other literature that discusses hermeneutics and interpretation of the Alquran. Then it is analyzed thematically based on the explanations contained in the interpretive books of the mufassir. Furthermore, to strengthen the analysis and discussion, the author also refers to expert opinions and various findings from previous researchers regarding this issue and topic. The result of this research is that we can understand the Alquran both in terms of the text and its context because the text cannot be separated from the context in which the text is expressed. To understand this, several rules are needed for understanding text and context. Among them you need to understand Asbab an-Nuzul, which is the specific background behind the revelation of a verse or chapter is also important to understand the text as a whole. Second, draft munasabah helps find connections and harmony between various verses. Third, draft nasikh mansukh highlighting changes and developments in understanding over time. This discussion is very important to discuss in contemporary times to help provide a deeper understanding of the study of Alquran interpretation and bring it to the present.

Abstract

One of the important aspects to understand about the issue of polygamy is the motives of the perpetrators, as polygamy has psychological impacts on the wives and children involved. This study aims to explore the motives of polygamists and the effects on their wives and children. A qualitative method with a phenomenological approach was employed, and data were collected through in-depth individual interviews with five informants selected using purposive sampling. The six informants in this study are individuals who have two wives. All data were analyzed thematically using the Miles and Huberman analysis technique. The findings revealed six key motives of polygamists: i) the ability to be fair, ii) having sufficient economic resources, iii) the first wife suffering from a chronic illness, iv) hypersexual behavior, v) incompatibility between the first wife and the family, and vi) raising the dignity of the second wife due to economic hardship. These six motives challenge the negative perceptions of polygamists often held by society, which tend to view their actions as inherently wrong. In reality, these motives are driven by good intentions and align with the values of being a good Muslim.

Abstract

Section 171 concerning person who inherits and heir must be a Muslim who has blood relations or marital relations. In case 04/Pdt/2013/ the Bandung Religious Court determined the share of non-Muslim inheritance on the pretext of using a mandatory will. For this reason, research within literature method for case analysis of 04/Pdt/2013/PA Bandung. The results target of this study is determination of Muslim heirs by non-Muslims who are determined by Bandung Religious Court Judge through the determination path number 04/Pdt/2013, if measured through perspective of Islamic Sharia. The judge's determination contradicts the opinion based on the hadith that Muslims do not inherit from infidels and vice versa. Significantly shows the existence of an embargo to become heirs and heirs between people who are Muslims and Non-Muslim. Meanwhile, PA Bandung judges are guided by handful of opinions whose basis is based on general hadith of Prophet and does not discuss inheritance.

Abstract

This research was motivated by discovering waqf land originally built with a prayer room (mushalla). The position of this waqf land is on a hill. However, the prayer room that had been built there was dismantled by the wakif's descendants and moved to another location. The location of the prayer room which was demolished was then used to build a house. This research aims to analyze the transition of the function of waqf land according to Law Number 41 of 2004. This research uses qualitative research methods with a descriptive approach. Data sources include direct interviews, observation, and documentation. The author uses a normative juridical and empirical juridical approach in analyzing the transition of the function of waqf land by Law Number 41 of 2004. Based on the results of this research analysis, the results showed that first, the public's view of the transfer of waqf land shows that some people still do not know the laws governing waqf land. This is proven by the existence of several individuals who have transferred the function of waqf land. Second, the waqf land originally had a prayer room on it and was located on a hill. The prayer room was dismantled by the wakif's grandchildren and reused elsewhere. The location of the prayer room which was demolished was then used by the wakif's grandchildren to build a house. Third, an analysis of Law Number 41 of 2004 concerning the Transfer of Waqf Land shows that the status of waqf land that has been allocated is prohibited from being changed or transferred in any form except for exchange for the public interest by the spatial planning contained in Law Number 41 of 2004 concerning Waqf Articles 1 and 2.
