Abstract

Permasalahan yang diteliti dalam artikel ini adalah bagaimanakah mekanisme pembiayaan ijarahmuntahiya bittamlik dengan janji (Wa’d) hibah dalam kaitannya dengan prinsip syariah? serta bagaimanakah perlindungan hukum bagi nasabah dalam pembiayaan ijarah muntahiya bittamlik dengan janji (Wa’d) hibah apabila janji hibah diputuskan sepihak dalam kaitannya dengan ketentuan Undang-Undang Hukum Perbankan Syariah? Metode yang digunakan adalah deskriptif analisis dengan pendekatan yuridis normative. Penerapan prinsip syariah pada pembiayaan ijarah dengan janji (Wa’d) hibah dalam kaitannya dengan prinsip syariah dilaksanakan dengan menggunakan dua akad yang terpisah antara akad pembiayaan ijarah dan akad hibah, serta perhitungan harga sewa ditentukan tanpa memperhitungkan nilai residu barang. Perlindungan hukum bagi nasabah dalam pembiayaan ijarah muntahiya bittamlik dengan janji (Wa’d) hibah apabila janji hibah diputuskan sepihak dalam kaitannya dengan ketentuan Undang-Undang Hukum Perbankan Syariah dilakukan melalui pengaduan nasabah dan forum penyelesaian sengketa baik melalui Lembaga Alternatif Penyelesaian Sengketa maupun jalur litigasi. Kata Kunci: Pembiayaan Ijarah Muntahiya Bittamlik, Hibah, Hukum pada Perbankan Syariah

Abstract

This research aims to look at the Financial Services Authority (OJK) establishing an Investor Protection Fund (DPP) to protect investors in the capital market. This study discusses the scope of DPP protection and the effectiveness of DPP implementation in the capital market. The problem is focused on the DPP having a fairly narrow scope of protection, namely protection only for the loss of investor assets caused by the custodian, and only for SIPF members. The effectiveness of DPP implementation can be seen from two sides, namely as a compensation fund and as an investment fund. To approach the problem, references from the Law of the Agreement are used. The data were collected through literature and field studies, document study data collection tools, and interviews and were analyzed descriptively and qualitatively.This study concludes that the implementation of DPP can be divided into two types, namely DPP with its function as a compensation fund and DPP with its function as an investment fund, the implementation of DPP as an investment fund has been effective, as can be seen from its rapid development

Abstract

Otoritas Jasa Keuangan (OJK) melalui Peraturan Otoritas Jasa Keuangan 22/2021 memperbolehkan perusahaan tertentu untuk menerapkan Multi Voting Shares (MVS). Diterapkannya MVS mengakibatkan rasio antara hak suara dan kepemilikan saham yang tidak seimbang. Adapun tujuan yang hendak dicapai dalam penelitian ini adalah untuk menganalisis akibat hukum dari pemberlakuan Multi Voting Shares dihubungkan dengan penerapan Good Corporate Governance sebagaimana diamanatkan pada Undang-Undang No. 40 Tahun 2007 tentang Perseroan Terbatas. Penelitian ini menggunakan metode deskriptif analitis dan metode pendekatan yuridis normatif dengan mengkaji bahan hukum primer, sekunder, dan tersier. Berdasarkan penelitian ini diketahui bahwa MVS dapat meningkatkan potensi dilanggarnya berbagai prinsip GCG, yaitu prinsip Independensi, prinsip akuntabilitas, prinsip transparansi, dan prinsip kesetaraan dan kewajaran. Tidak hanya itu, MVS juga berpotensi meningkatkan terjadinya transaksi self-dealing yang dapat mengakibatkan ketidakpastian hukum bagi para pemegang saham minoritas.

Abstract

The community's need for economic activities based on sharia principles has been accomodated by the implementation of a dual economic system in Indonesi. This also has an impact on the banking system which carried out with a dual banking system, namely the conventional banking system and Sharia banking, and both are run side by side. Public understanding of Sharia Banking is very important considering that the majority of the Indonesian population is Muslim who has the obligation to carry out religion orders thoroughly .(kaffah) including in the economic activities. In addition, universal Sharia economics can be carried out by anyone and everywhere, which lead to the need to understand sharia banking business activities to be important. The method used is the public education method which is carried out with interactive lectures and discussion which are carried out offline at the office of the All-Indonesian Workers Union Executive in Karawang Regency which was attended by the head of the labour association. Sharia banking business activities, both in the process of collecting and distributing funds, can support the economic activities of workers, especially in the needs of economic activities based on Sharia Principles. The subject in this socialization includes regulations related to Sharia banking in Indonesia including the products offered related to sharia banking business activities

Abstract

Indonesia menjalankan kegiatan perekonomiannya berdasarkan dual economic system, dimana dijalankan dua sistem perekonomian secara berdampingan yaitu sistem perekonomian konvensional dan sistem perekonomian syariah. Perkembangan sistem perekonomian syariah yang cukup tinggi di Indonesia harus diimbangi dengan literasi keuangan syariah terutama terkait perbankan syariah yang merupakan lembaga keuangan syariah yang permodalannya terbesar di Indonesia. Tujuan pengabdian kepada Masyarakat ini adalah untuk meningkatkan literasi masyarakat akan kegiatan usaha perbankan syariah sehingga diharapkan dapat memudahkan masyarakat dalam mengakses dan menggunakan layanan perbankan syariah. Metode yang digunakan dalam pengabdian kepada masyarakat ini adalah diskusi terarah yang diikuti oleh semua unsur masyarakat desa cileunyi wetan Kabupaten Bandung. Kegiatan usaha perbankan syariah yang utama terdiri dari proses penghimpunan dan penyaluran dana melalui mekanisme pembiayaan yang didasarkan pada akad yang berbeda-beda sesuai dengan tujuannya berdasarkan Prinsip Syariah. Mayoritas masyarakat peserta pengabdian pada masyarakat ini sudah mengetahui keberadaan perbankan syariah dan setelah penyuluhan ini lebih memahami terkait kegiatan usaha perbankan syariah termasuk jenis-jenis akad yang digunakan.

Abstract

Banks, as financial institutions, have an essential role in the economy, including in terms of providing credit. In the process of granting credit, collateral is one of the main elements that guarantee the debtor's ability to fulfil his obligations. One form of collateral that is often accepted is land rights, which are bound through mortgage rights based on Law Number 4 of 1996 concerning Mortgage Rights. This research aims to analyze the legal certainty related to the use of the power of sale by banks in relation to AYDA (repossessed collateral), as well as examine the legal aspects that need to be considered in its implementation. The research method used is a normative juridical approach, focusing on the analysis of relevant laws and regulations and related legal principles. The result of this research is that the position of a power of attorney to sell has a vital role in resolving bad debts, primarily related to the sale of collateral objects used as collateral in credit agreements. This power of attorney must meet the legal requirements of the contract stipulated in Article 1320 of the Civil Code and can take the form of a deed under the hand or an authentic deed. Legal certainty is critical in resolving bad debts through AYDA. The power of attorney to sell benefits the Bank by facilitating the execution of collateral, but it must also be balanced with strict supervision to avoid abuse of authority. This legal certainty also protects the rights of debtors, ensuring a transparent and fair process in the sale of assets. This increases public confidence in the banking system and provides protection for both parties. This research is expected to give a clearer understanding of the legality and legal implications of the use of a power of attorney to sell in the settlement of bad debts through AYDA.

Abstract

Standard clauses in consumer protection are terms or conditions unilaterally determined by business actors. Standard clauses are regulated in Article 18 of the Consumer Protection Act. Understanding standard clauses is essential for consumers and business actors, so legal counseling is needed to increase awareness and understanding for consumers and business actors. The Consumer Protection Act does not prohibit the inclusion of standard clauses in agreement documents between consumers and business actors. The Consumer Protection Act only prohibits the inclusion of standard clauses contrary to Article 18, paragraphs (1) (2) of the Consumer Protection Act. Article 18 paragraph (3) of the Consumer Protection Act determines that the standard clause that contradicts Article 18 paragraph (1), (2) of the Consumer Protection Act is declared null and void. In addition, the legal consequences for business actors for the inclusion of standard clauses that are contrary to Article 18 paragraph (1), (2) of the Consumer Protection Act based on Article 62 paragraph (1) of the Consumer Protection Act are threatened with imprisonment for a maximum of five years or a maximum fine of two billion. In including standard clauses in documents or agreements with consumers, business actors must pay attention to the provisions of Article 18 of the Consumer Protection Act. This legal counseling activity increases the awareness and understanding of consumers and business actors regarding standard clauses based on consumer protection laws, which can ultimately realize consumer protection.

Abstract

Nazhir dalam mengelola wakaf dapat bekerja sama dengan pihak ketiga. Dalam mengelola wakaf saham, Dompet Dhuafa bekerja sama dengan Philip Sekuritas. Kerja sama antara Dompet Dhuafa dengan Philip Sekuritas tersebut adalah bahasan yang menarik untuk dibahas. Penelitian ini bersifat deskriptif analitis dengan menggunakan pendekatan yuridis normatif. Hasil penelitian ini menemukan bahwa kerja sama yang terjalin dilakukan dengan Syirkah Mudharabah. Dalam Syirkah Mudharabah Dompet Dhuafa bertindak sebagai pemilik modal dan Philip Sekuritas bertindak sebagai pengelola. Seharusnya Philip Sekuritas bisa mendapatkan haknya atas pengelolaan harta tersebut. Namun Philip Sekuritas tidak menerimanya dan menjadikan itu sebagai CSR perusahaannya. Sinergitas CSR dengan wakaf sangat bagus untuk dilakukan karena dengan wakaf, pelaksanaan CSR dapat dilaksanakan lebih lama.

Abstract

One of the organs of a Limited Liability Company that often becomes a guarantor of a company’s debt is the Board of Directors. In practice, when a company can no longer carry out its obligations to pay debts, the guarantor is often bankrupted together with the debtor. Article 2 paragraph (1) jo. Article 8 paragraph (4) of the Bankruptcy and PKPU Law states that if the Debtor has two or more Creditors and has debts that are due and collectible, then the request for a bankruptcy statement must be granted if there are facts or circumstances that are proven simply. This research was conducted to examine the legal considerations of judges regarding the application of simple proof in Decision Number 20/Pdt.Sus-Bankruptcy/2022/PN.Niaga.Smg and what the implications are for the Directors of the company who act as a personal guarantee for their company’s debt. The results showed that the legal consideration of the majority of the Panel of Judges examining the case are not entirely in accordance with the Bankruptcy and PKPU Law, as the panel of judges only focused on fulfilling formal requirements without considering the principles of bankruptcy, which will have a broad impact on the parties involved. In addition, the juridical implications arising from the decision are that the Directors of the company as a personal guarantee remains personally responsible for the company’s debt, thus causing bankruptcy for him and the company.

Abstract

Differences in legal systems between Australia and Indonesia have the potential to impact the fulfillment of the legal requirements of an agreement, including in the context of rental contracts. Australia is a leading destination for higher education for Indonesian students, and in 2021, the number of Indonesian students in Australia was recorded as the highest among study destination countries. This situation makes a comparative study of the contract law of the two countries relevant, particularly to understand potential differences in the formation, implementation, and resolution of contractual disputes. This analysis is essential so that parties, especially Indonesian students in Australia, can anticipate the legal consequences of their legal actions in rental practices. The research method used in this study is normative juridical with analytical descriptive research specifications. The results show that the differences in the legal requirements of agreements between Indonesia and Australia are based, in part, on the existence of the Tellinty Form, which emphasizes the need for written contracts. The practice of renting residential properties in Australia uses a special form, as regulated by the Tendential Renancies Act, for its completeness and content. If the landlord does not execute a written contract, there will be special consequences. Meanwhile, in Indonesia, contract-making practices are still based on verbal agreements. Likewise, even when written, many do not comply with the standard rental contract format stipulated in Government Regulations. This research contributes to the analysis of student housing rental agreements as a basis for reforming rental law in Indonesia. Perbedaan sistem hukum antara Australia dan Indonesia berpotensi mempengaruhi pemenuhan syarat sah suatu perjanjian, termasuk dalam konteks kontrak sewa-menyewa. Australia merupakan salah satu tujuan utama pendidikan tinggi bagi mahasiswa Indonesia, dan pada tahun 2021 jumlah mahasiswa Indonesia di Australia tercatat sebagai yang tertinggi di antara negara tujuan studi. Kondisi ini menjadikan kajian komparatif mengenai hukum kontrak kedua negara relevan, terutama untuk memahami potensi perbedaan dalam pembentukan, pelaksanaan, dan penyelesaian sengketa kontraktual. Analisis ini penting agar para pihak khususnya mahasiswa Indonesia di Australia dapat mengantisipasi akibat hukum dari tindakan hukum yang mereka lakukan dalam praktik sewa-menyewa. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Hasil menunjukan bahwa perbedaan syarat sah perjanjian antara negara Indonesia dengan Australia salah satunya didasari oleh adanya Ceritainty Form yang menekankan perlunya hukum kontrak yang harus dilakukan secara tertulis. Praktik sewa menyewa tempat tinggal di Australia menggunakan form khusus sebagaimana yang telah diatur kelengkapan dan isiannya antara penyewa dan pemilik tempat tinggal sebagaimana dalam Tendencial Renancies Act. Apabila pemilik tempat tinggal tidak melaksanakan kontrak secara tertulis, maka akan ada konsekuensi-konsekuensi khusus yang akan didapat. Sedangkan di Indonesia, praktik pembuatan kontrak masih didasarkan pada perjanjian secara lisan. Begitupun jika dilakukan secara tertulis, masih banyak yang tidak sesuai dengan standar format pengisian kontrak sewa sebagaimana yang telah diatur dalam Peraturan Pemerintah. Penelitian ini berkontribusi dengan menganalisis perjanjian sewa tempat tinggal mahasiswa sebagai landasan untuk mereformasi hukum sewa menyewa di Indonesia.
