Abstract

Transparansi dalam komunikasi antara dokter dan pasien merupakan aspek fundamental dalam pelayanan kesehatan yang berkualitas. Pasien memilik hak atas inforrmasi kesehatan dan dokter berhak atas Informasi yang akurat dari pasien sebab sangat mempengaruhi tindakan medis serta keseluruhan kualitas pelayanan yang diberikan. Penelitian ini menerapkan metode yuridis normatif untuk menganalisis peraturan perundang-undangan serta prinsip hukum yang berkaitan dengan hak atas informasi kesehatan dan perlindungan hukum bagi dokter. Hasil penelitian menunjukkan bahwa pasien memiliki hak untuk mendapatkan informasi yang jelas dari dokter dan keamanan atas kerahasian medis. Sedangkan Dokter berhak menerima informasi yang jujur dan lengkap dari pasien. Hak ini sangat penting untuk mengurangi risiko kesalahan medis serta potensi tuntutan hukum yang dapat terjadi akibat informasi yang tidak akurat. Perlindungan hukum yang efektif untuk dokter menyediakan dasar yang kokoh bagi terciptanya lingkungan praktik medis yang lebih aman, serta membantu memperbaiki hubungan profesional antara dokter dan pasien. Edukasi yang tepat kepada pasien mengenai pentingnya memberikan informasi yang akurat memainkan peran penting dalam proses ini. Hal ini tidak hanya meningkatkan hasil pelayanan kesehatan tetapi juga meminimalisir potensi risiko hukum yang mungkin dihadapi oleh tenaga medis. Penerapan perlindungan hukum yang konsisten dan upaya edukasi yang berkelanjutan sangat penting dalam mendukung pelayanan kesehatan yang efektif dan aman.

Abstract

Batik is a fabric that has enormous differences from other kinds of fabric in design and manufacturing aspects. The Batik design is a masterpiece, created in the form of image design with unique characteristics, which has a copyright that is bounded to be protected by the law. This study focused on the copyright protection of Batik design. The purpose of this study is to learn the implementation of an agreement between Widya Mataram University and Bahana Batik as well as to find out the legal protection of batik design copyright in the cooperation agreement. This research uses the empirical research method with a juridical approach which is conducted by collecting data from interviews and by studying the agreement document which is further analyzed qualitatively. The results showed that the agreement was done under the hands and regulated the rights and obligations in the uniform procurement agreement. However, the agreement only regulates the prohibition for the use of the Widya Mataram Logo and does not include copyright ownership of batik design, thus the copyright of the batik design remains owned by Bahana Batik in accordance with Article 36 of undang-undang No. 28 of 2014 about Copyright. Abstract

This research discusses how the trademark license agreement can protect the licensee and licensor, the rights and obligations of the parties that arise in the trademark license agreement, and the legal consequences in the event of default. This research is normative research, with a statute approach to the problem. The analysis is focused on laws, regulations, documents, and other references related to brands and license contracts. The brand license agreement must comply with the principles of contract law because the principles of contract law are the foundation that must be obeyed by the parties so that it will not harm either party and can be implemented fairly. In addition, there needs to be an agreement that is mutually beneficial and does not burden each other. In a trademark license agreement, reciprocal rights and obligations occur between the licensee and the licensor. Both parties have mutual rights and both also have mutual obligations so a balanced bargaining position between licensee and licensor needs to be balanced so that there is no imbalance in rights and obligations. A brand license agreement will lead to disputes if the parties do not fulfill their rights and obligations as agreed. If one of them defaults, the other party can demand fulfillment of the engagement; fulfillment of the agreement with compensation; compensation; cancellation of the agreement; or cancellation with compensation. The first step that needs to be taken when a dispute occurs is to resolve the dispute by deliberation to reach a consensus. If not reached, dispute resolution can be seen in the trademark license agreement clause. Settlement of this dispute can be done both inside and outside the court. In addition to carrying out civil lawsuits, criminal charges can also be filed by the aggrieved party.

Abstract

Globalization will present opportunities and challenges to watch out for, especially for Indonesia as a country rich in natural resources, human resources, and culture. There are various challenges in the era of globalization, including national defense and security, as well as a weak sense of national identity that makes them vulnerable to division. Currently, the Indonesian people face various challenges in implementing and implementing Pancasila values. At the same time, Pancasila is the fundamental value and ideology in the life of the nation and state for the people of Indonesia. Awareness of national security is a willingness to serve the country and sacrifice to defend the country. National security is closely related to ensuring the existence of the Unitary State of the Republic of Indonesia and realizing the nation's ideals. This study aims to strengthen national resilience by applying Organizational Citizenship Behavior (OCB) in Higher Education. This research is a literature review research using books and articles that focus on national resilience and Organizational Citizenship Behavior (OCB). The results of the study show that education and strengthening of national resilience are carried out both mandatory and voluntary. Volunteering in understanding the OCB concept encourages everyone to produce the best performance without coercion. Improving knowledge and skills voluntarily in teaching and educating students will significantly increase learning motivation. Learning motivation tends to be more easily formed voluntarily if the teachers also have the same attitude. Volunteering included in the teaching and learning process or education in higher education will strengthen the process of disseminating the ideology of national resilience, which will also result in voluntary national resilience behavior.

Abstract

The ability to automate procedures and improve decision-making, artificial intelligence (AI) is quickly transforming a wide range of industries, including human resource management (HRM). The application of AI in different sectors, including HRM, has been predominant and profound. AI has created a disruption by displacing established HRM processes with innovative ones, and its scope includes recruitment and selection, workforce management, and learning and development. AI is enabling machines to make more accurate decisions than humans based on data and behavioral patterns. The integration of AI into HRM is changing how organizations appoint, manage, and engage their workforce, with machines taking over manual tasks and HR professionals taking on more strategic roles. This study aims to ascertain how AI affects human resource management. This research uses theoretical literature review as a research method. 22 publications serve as the research materials for this study, which employs a theoretical literature review methodology. The authors discovered that AI has an impact on HR professionals' abilities, job displacement, and position creation. AI should be used by HR managers to boost productivity.
