Abstract

Dalam istilah yuridis formal, definisi tindak pidana korupsi tertuang dalam Bab II tentang tindak pidana korupsi dalam Pasal 2 dengan Pasal 20 Undang-Undang Nomor 31 Tahun 1999, tentang unsur-unsur perbuatan melawan hukum sebagaimana dimaksud dengan "melawan hukum" dalam pasal ini termasuk perbuatan melawan hukum secara formal serta dalam arti materiil. Berdasarkan laporan hasil audit BPKP Provinsi Riau atas dugaan penyimpangan pengelolaan anggaran pembuatan tanggul mekanik di dinas perkebunan Indragiri Hilir tahun anggaran 2011, pekerjaan tersebut mengakibatkan kerugian keuangan negara/daerah. Dalam hal ini, akan dibahas bagaimana proses pembuktian tindak pidana korupsi pengadaan barang dan jasa di Dinas Perkebunan Indragiri Hilir dan kendala yang terjadi akan dibahas.

Abstract

According to the findings, inhabitants of the Indragiri Hilir region have a strong understanding of the procedures involved in applying for loans online if their income is at least comparable to the average pay. This is the case regardless of whether or not they live in the region. People who earn less than their drinking wages have a low level of understanding, but those who earn more than their drinking wages have a very high level of knowledge. Those people who make more than their drinking wages are able to understand more. According to these findings, respondents who identify as either single or married have a grasp of online loans that is, on average, superior to that of other respondents. This holds true for both of the categories that were previously discussed. The respondents' decision to utilise this online loan application was most influenced by the fact that it was convenient to borrow money without having to offer a guarantee; however, providing financial support to members of the borrower's family was only a secondary factor in the decision to utilise this online loan application.

Abstract

State financial losses can take many forms, including the expenditure of state assets that exceed what should be issued by the state, loss of state assets that exceed what should be received, and reduced revenue from sources of state wealth that should obtain. From the criminal law perspective, corruption is hazardous for society, the nation, and the state. Losses to state finances and the country's economy are real consequences that form the basis for justifying the criminalization of forms of corruption in criminal law policies. This research is normative legal research based on secondary data obtained from legal hierarchies, laws, regulations, and developments in legal issues in Indonesia. The data and information obtained by the authors were analyzed by comparing normative provisions (das sollen) with reality (das sein) that occurs in society. This descriptive and analytical writing provides an overview accompanied by systematic, factual, and accurate explanations. Return of stolen state assets (stolen asset recovery) is critical for developing countries' development because it not only restores state assets but also aims to uphold the rule of law in a society where no one is above the law
