Abstract

As an Islamic law argument, qiyas is a solution to various legal cases which are not explicitlymentioned in religious texts. Imam Syafii is the initiator of the concept of qiyas. In his view, variouslegal cases found in Muslim society which are not obviously regulated in religious texts can be solvedthrough qiyas, either in the form of strong qiyas or weak qiyas. Anybody who knows Arabic, Islamiclaw contained in the Quran, the prophetic tradition, the opinions of the early generation of the ulama,consensus and controversies among them, having high intellectual capacity and sharp analysis inwhich he or she can identify obscured facts, can become an al-qais. the qiyas should consist of fourelements the al-ashl, the original law derived from the text, the al-far, an the legal al-illah. An qiyasshould not go beyond relegious texts, because it is merely an exension of them

Abstract

The authorities agreed when starting an act of worship was told to read Basmalah, but the deviation that the Basmalah including one verse of Surah al-Fatihah, and there are also differences of Basmalah in the prayer that is read when reading Surah al-Fatihah. Imam Malik, Imam Hana?and Ahmad ibn Hanbal agree that Basmalah does not include the verses from Surah al-Fatihah, but they differ in reading in the prayer if Imam Malik argues that is Makruh, and then Imam Hana?and Imam Ahmad bin Hanbal believes it as Sunnat. While the opinion of Imam Sha?'i Basmalah is one of the verses of Surah al-Fatihah, so, we must read Basmalah in the prayer when reading Surah al-Fatihah. Each of the scholars expresses their opinions with arguments of the Sunnah that supports and reinforces his view.

Abstract

The growth and development of fiqh has a close relationship with ijtihad. Results of ijtihad by mujtahid have contribution in the establishment and development of fiqh. In other words, the growth and development of fiqh is depend on how much mujtahid use the ability and knowledge to make a legal product. Declining in the development of fiqh is caused by weakness of the Ulema to perform ijtihad. After the golden age of Islam, Ulema has no longer perform ijtihad as was done by the his predecessors. Moreover, the Ulema made a statement that ijtihad was closed, so the development of fiqh has decreased. To restore the spirit of ijtihad, the Ulema now have to perform various concepts of ijtihad.

Abstract

The background of this research is that there are differences in retailers' preferences in choosing wholesalers in Paringin, South Kalimantan. This study aims to determine the factors that influence retailers' preferences in choosing wholesalers. This research is a qualitative approach using observation, interviews, and documentation. Then, the data is analyzed by descriptive analysis techniques qualitative. The results of the study found factors that influence the preferences of retailers in choosing wholesalers are: 1) Easily accessible location, 2) complete item, 3) item availability, 4) getting item practically, 5) Long opening time, 6) Price, 7) speed of service, and 8) goods benefits.

Abstract

As the global world develops rapidly and massively, there is a delay in Islamic law in responding to contemporary problems. In relation to Indonesia, many implementations of developments over time have resulted in new jurisprudence and institutions. This research uses normative research methods using libraries (library research) with descriptive qualitative analysis of materials. Reformulation in Islamic law is not westernization which is contrary to Islam (laws that are absolute). Recently, Muslims have shown their de facto lack of ability to meet the demands of the modern world creatively. The main things in contemporary ijtihad are, firstly, methodology, secondly operations. These two ingredients must work in synergy and integrity with each other to produce contextual fiqh. The orientation of contemporary ijtihad is not just contemporary fiqh, but also the development of dawabit al-fiqhiyyah. In the Indonesian context, the implementation of contemporary ijtihad is felt in various fields, especially law in Indonesia.. In conclusion, the implementation of contemporary ijtihad including: 1)Fatwa institutions, 2)Religious Courts, 3)Compilation of Islamic Law, 4)Office of Religious Affairs, 5)Sharia Economics, 6) Zakat Institutions, 7)Halal Labels, 8)Indonesian Fiqh, 9)Medicine, 10)Gender Equality.

Abstract

ABSTRAK Penelitian ini membahas tentang perbandingan antara pendekatan ushul fiqh dan teori maqashid syariah dalam penetapan hukum Islam untuk mengetahui secara jelas hubungan, persamaan, dan perbedaan antara keduanya. Jenis penelitian ini adalah penelitian kepustakaan dengan pendekatan kualitatif. Hasil penelitian ini adalah bahwa pengertian ushul fiqh adalah kumpulan kaidah yang bersifat global (umum) dan pembahasan yang dapat digunakan untuk menetapkan hukum. Pengertian maqashid syariah adalah tujuan dan hikmah yang maksudkan oleh pembuat syariat, yaitu Allah swt. pada setiap hukum yang ditetapkan untuk mewujudkan kemaslahatan bagi hamba-hamba-Nya, yakni dengan memelihara agama, jiwa, akal, keturunan, dan harta mereka. Ushul fiqh telah ada sejak adanya fikih. Selama pada suatu masa terdapat permasalahan fikih, ushul fiqh pasti juga telah ada. Secara esensial, maqashid syariah sudah ada sejak adanya hukum syariat. Artinya, maqashid syariah muncul bersamaan dengan turunnya al-Quran dan hadis Rasulullah saw. Menurut Ibnu ‘Asyur, maqashid syariah dapat dipahami dengan metode istiqra’ terhadap perilaku syariat, menggunakan dalil-dalil dari nash-nash al-Quran yang mempunyai kejelasan makna, dan menggunakan hadis-hadis mutawatir. Terdapat juga metode lain untuk memahami maqashid syariah yang disebutkan oleh ulama, seperti halnya metode al-munasabah (kecocokan). Maqashid syariah merupakan bagian dari ushul fiqh. Hal ini bisa diketahui secara jelas pada banyak pembahasan ushul fiqh. Menurut penulis, maqashid syariah tidak tidak bisa menjadi sumber hukum Islam yang mandiri, sebagaimana al-Quran, hadis, ijma, dan qiyas. Menurut penulis, sumber hukum Islam atau dalil syar’i yang berdekatan dengan maqashid syariah adalah mashlahah syar’iyyah. Jika kita dihadapkan dengan permasalahan fikih baru yang belum pernah dijelaskan hukumnya oleh para ulama terdahulu dan tidak bisa terjawab dengan dalil dari al-Quran, hadis, ijma, dan qiyas, maka maqashid syariah dapat menjadi pijakan pengambilan hukum, akan tetapi tidak secara langsung, melainkan melalui dalil mashlahah.
