Abstract

The reform of family law in Muslim countries often encounters tensions between classical Islamic legal norms and the demands of modernity, particularly concerning gender equality in inheritance law. Turkey represents one of the most significant examples of legal reform through the enactment of the Turkish Civil Code in 1926, which replaced the Islamic family law system with a modern civil law framework. Article 495 of the code establishes the principle of equal inheritance rights between men and women without gender discrimination. This study aims to analyze the reform of women’s inheritance rights in Turkey under Article 495 of the Turkish Civil Code from the perspective of maqasid al-shari’ah, while examining the dialectic between normative Islamic legal texts and the socio-historical context underlying the reform. This research employs a qualitative method using a normative-juridical approach combined with historical and conceptual approaches. Data were collected through library research on relevant primary and secondary legal sources. The findings indicate that although Article 495 formally differs from the distributive formula of classical Islamic inheritance law, the reform can be understood as a reinterpretation of distributive justice within the framework of maqasid al-shari’ah, particularly in terms of the protection of property (hifz al-mal) and social justice. The reform reflects an effort to adapt inheritance law to the changing social responsibilities of men and women in modern society. Therefore, the reform of inheritance law in Turkey may be viewed as a form of contextual ijtihad within modern family law policy aimed at achieving public welfare, gender equality, and substantive justice.

Abstract

This study employs a library research method to examine the formulation of Law Number 6 of 2014 concerning Villages through the lens of Maqashid Syariah, the objectives of Islamic law. The law is recognized as reflecting strong Islamic values, consistent with the perspective of Imam Al-Ghazali, who emphasized that Islamic law aims to achieve the well-being and happiness of humanity both in this world and the hereafter. The five key components of Maqashid Syariah protection of religion (hifdz ad-din), life (hifdz an-nafs), intellect (hifdz al-‘aql), lineage (hifdz an-nasb), and property (hifdz al-maal) serve as the evaluative framework in this analysis. The research findings indicate that the establishment of Law Number 6 of 2014 was intended to enhance the effectiveness of village governance, improve public service delivery, strengthen community empowerment, and encourage active citizen participation in national development. The law provides maslahah (public benefit) by addressing the universal needs of society and aligning with the principles of Maqashid Syariah. Additionally, the study affirms that the law not only benefits Muslims but also serves the interests of non-Muslim communities, thereby reinforcing the universal applicability of Islamic legal values. The analysis concludes that the integration of Maqashid Syariah into legislative processes, as demonstrated by this law, supports the development of regulations that are comprehensive, inclusive, and beneficial to society. It also underscores the role of Islamic legal philosophy as a valuable standard for law-making aimed at achieving sustainable and widespread societal welfare.

Abstract

Accreditation is a fundamental mechanism for evaluating the standard of higher education programs. The Constitutional Law Study Program within the Sharia Faculty at UIN Khas Jember has undertaken this process under the framework of BAN-PT, following the nine core criteria specified in BAN-PT Regulation No. 2 of 2019. This study investigates the challenges, hindrances, and potential solutions in implementing BAN-PT regulations to achieve superior accreditation status. Using an empirical legal research approach, the study collected data through interviews, direct observation, and document analysis. The accreditation process includes stages such as planning, submission, evaluation, and post-evaluation follow-up, involving various stakeholders lecturers, students, and administrative staff. Factors contributing to successful accreditation include qualified faculty, curriculum alignment, adequate infrastructure, and external partnerships. However, a significant challenge remains: limited international collaboration, which restricts access to research resources and funding. Achieving top-tier accreditation requires strategic planning, the formation of a competent accreditation drafting team, structured compliance with standards, and consistent application of the PPEPP quality cycle. Ultimately, excellent accreditation enhances institutional credibility and supports the advancement of legal education in Indonesia.

Abstract

Hancurnya ikatan perkawinan memberi gambaran bahwa kemampuan keluarga dalam ketahanan dirinya belum mampu menopang tujuan dari sebuah pernikahan. Dalam mewujudkan keluarga harmonis dan sejahtera diperlukan konseling pra nikah sebagai bekal pengetahuan kepada pasangan yang akan menikah. Artikel ini akan membahas bagaimana peran konseling pra nikah terhadap ketahanan keluarga di Kabupaten Jember dalam tinjauan Maqasid al-Syari’ah Jamal al-Din Atiyyah. Artikel disusun menggunakan metode deskriptif kualitatif dengan teknik pengumpulan data observasi, interview, dan dokumentasi. Data yang diperoleh dianalisis dengan tahapan reduksi data, penyajian data, dan kesimpulan. Kesimpulan yang diperoleh yaitu konseling pra nikah sangat efektif dalam mempersiapkan calon pengantin dalam menghadapi pernikahan dan membantu individu yang akan berkeluarga memahami tugas dan tanggung jawabnya sebagai anggota keluarga sehingga lebih siap menghadapi kehidupan keluarga dan segala permasalahan di dalamnya dalam upaya menjaga ketahanan keluarga. Konseling pra nikah berfungsi sebagai wadah dalam tercapainya tujuan dari pernikahan sebagaimana dalam Maqashid al-Syari’ah Jamal al-Dn Atiyah dalam ranah keluarga. Dengan demikian pasangan yang akan menikah dengan bekal yang didapat dari konseling pra nikah memiliki ketahanan yang kuat dalam menjalani kehidupan keluarganya. Maka akar timbulnya perceraian akibat kurang kokohnya ketahanan keluarga yang berujung pada perselisihan bahkan perceraian dapat dihindari. Abstract

Child marriage remains a persistent legal and social challenge in Indonesia, despite legal reforms that have raised the minimum age for marriage. The Office of Religious Affairs (KUA) plays a strategic role in preventing child marriage through the provision of pre-marital counselling, particularly through the Marriage Counselling (Bimwin) and School-Age Youth Counselling (BRUS) programmes. This study aims to critically analyse legal protection for children through the model of pre-marital counselling service management in the context of child marriage, as well as the extent to which pre-marital counselling functions as a legal protection tool for children when evaluated through the framework of Islamic family law. The research method employed was descriptive qualitative analysis based on a socio-legal approach, with data selected from the KUA offices in Ajung, Pakusari, and Sumbersari in Jember Regency through observation, in-depth interviews, and documentary analysis. The research findings indicate that the model of pre-marital course practices at the KUA in cases of child marriage is not yet optimal in helping to fulfil children’s rights, as the substance of the material and the service management model remain general in nature and are insufficient in integrating issues of children’s rights and the protection of offspring into programmes for school-age youth guidance and marriage counselling. From the perspective of Islamic family law, this situation indicates that the realisation of the objectives of maqāṣid al-syarī‘ah, particularly ḥifẓ al-nafs and ḥifẓ al-nasl, has not been optimal. This article emphasises the need to reformulate the management of pre-marital courses so that they are preventive, contextual, and in line with the principles of child protection in Islamic family law. Keywords: child marriage, Office of Religious Affairs (KUA), pre-marital counselling, maqāṣid al-Syarī‘ah, islamic family law.   Perkawinan anak tetap menjadi tantangan hukum dan sosial yang persisten di Indonesia, meskipun telah dilakukan reformasi hukum yang menaikkan batas usia minimum untuk menikah. Kantor Urusan Agama (KUA) memiliki peran strategis dalam mencegah perkawinan anak melalui pengelolaan bimbingan pra-nikah, khususnya dalam program Bimbingan Pernikahan (Bimwin) dan Bimbingan Remaja Usia Sekolah (BRUS). Penelitian ini bertujuan untuk menganalisis secara kritis perlindungan hukum bagi anak melalui model pengelolaan layanan bimbingan pra-nikah dalam konteks pernikahan anak, serta sejauh mana bimbingan pra-nikah berfungsi sebagai alat perlindungan hukum bagi anak ketika dievaluasi melalui kerangka hukum keluarga Islam. Metode penelitian yang digunakan adalah analisis kualitatif deskriptif berdasarkan pendekatan sosiologis-hukum, dengan data dipilih dari KUA Ajung, Pakusari, dan Sumbersari di Kabupaten Jember melalui observasi, wawancara mendalam, dan studi dokumentasi. Hasil penelitian menunjukkan bahwa model praktik kursus pra-nikah di KUA dalam kasus pernikahan anak belum optimal dalam membantu memenuhi hak-hak anak karena substansi materi dan model pengelolaan layanan masih bersifat umum dan belum memadai dalam mengintegrasikan isu-isu hak anak dan perlindungan keturunan dalam program bimbingan remaja usia sekolah dan bimbingan pernikahan. Dari perspektif hukum keluarga Islam, kondisi ini menunjukkan bahwa realisasi tujuan maqāṣid al-syarī‘ah, khususnya ḥifẓ al-nafs dan ḥifẓ al-nasl, belum optimal. Artikel ini menekankan perlunya mereformulasi pengelolaan kursus pra-pernikahan agar bersifat preventif, kontekstual, dan sesuai dengan prinsip-prinsip perlindungan anak dalam hukum keluarga Islam. Kata kunci: pernikahan anak, Kantor Urusan Agama (KUA), konseling pranikah, maqāṣid al-syarī‘ah, hukum keluarga islam.
