Abstract

Islamic sharia comes not only to realize the humankind benefits in the world and the hereafter but also to realize the profit (maslahah) and to prevent the damage. Islamic sharia is essentially a virtue. Islam sharia is very concerned about social problems. In practice, it protects 5 things including religion, soul, intellect, descent, and property. Islamic Sharia also gives priority to women with great attention in which Islam frees women from the shackles of ignorance (jahiliyah) and saves them from the tyranny that occurred at that time mainly related to marriage and divorce and their impacts. One of the rules is the law of marriage for the woman whose husband passed away known as the law of ihdad or haddad. In this law, a woman must have a period of mourning after the death of her husband followed the iddah period. The mufassir (al Quran interpreter) and Fuqoha (Islamic jurist) agree that the period of iddah for women is to preserve the glory of women, guard their souls and their rights. Maintaining the rights of morality and humanity is aimed to realize the profit (maslahat) of religion and the world for women. A woman during iddah period in her husband's house is a tribute to her former husband and shows a sense of grief and respect for the family's feelings because of the sanctity of family relationships. Therefore women should spend their iddah at home except in an emergency situation.جاءت الشريعة الإسلامية لتحقيق مصالح العباد في الدنيا والآخرة كما جاءت لجلب المصالح ودرء المفاسد . فالشريعة الإسلامية في جلها خير.وقد اهتمت الشريعة بكل قضايا المجتمع وعلى رأسها الإنسان وقضت بالمحافظة على الكليات والضروريات الخمس الدين والنفس والعقل والنسل والمال.وأولت الشريعة الإسلامية المرأة اهتماماً عظيماً فحررتها من قيود الجاهلية وأنقذتها من الظلم الواقع عليها في مجالات الحياة ومن ضمن هذه الأشياء ما يتعلق بزواجها وطلاقها وما يترتب على ذلك من آثار ، ومن الآثار التي عالجتها الشريعة الإسلامية في زواج المرأة هي حالة وفاة زوجها وما ينتج عنه من أحكام مثل الإحداد أو الحداد يعني التزام المرأة المتوفى عنها زوجها مظاهر الحزن والأسى على زوجها طيلة مدة العدة.        اتفقت كلمة  المفسرين و الفقهاء أن عدة المرأة المتوفى عنها زوجها إنما هي حفظ لكرامتها وصون لنفسها وحفظ لحقوقها ورعاية لقيم أخلاقية وإنسانية تهدف في جملتها إلى تحقيق مصالح دينية ودنيوية للمرأة.اعتداد المرأة في بيت الزوجية فيه تعظيم لحق الزوج وإظهار الحزن عليه ومواساة لأهله وبيان لقدسية العلاقة الزوجية فلا تعتد في غير بيت الزوجية إلا للضرورة.Kata-Kata Kunci: Ihdād, Berkabung, Mufassir, Fuqaha

Abstract

It is undeniable that the dynamics of social and Islamic law are intertwined in forming a change. On the one hand, the dynamics and social change occur because of the influence of Islamic law, and in one side the social change affects the development and change of Islamic law. The inscription shows that the Islamic law brought by the prophet Muhammad SAW. has clearly changed the social community order at the time. Social conditions based on poor customs and habits have turned into a society based on Islamic law. Therefore, it can not be denied the change of law because of social change as affirmed in the rule of fiqh. This also demonstrates the nature of Islamic law that always matches the development of the times.

Abstract

Penelitian ini berlatarbelakang tentang suatu fenomena nyata di mana umat Islam berada di dalam posisi yang cukup dilematis, yaitu berpegang teguh terhadap teks agama di tengah terjadinya perkembangan kehidupan, atau mengesampingkan teks yang dianggap sudah tidak relevan dengan konteks. Penelitian ini adalah penelitian pustaka, di mana peneliti akan mengungkapkan sebuah fenomena perubahan sosial dan perubahan hukum sebagaimana dijelaskan dalam banyak teori yang ada di berbagai data pustaka. Penelitian ini bertujuan untuk mengungkap bagaimana hukum yang akan selalu sejalan dengan perubahan sosial. Termasuk menguraikan suatu problem yang terjadi dalam upaya pembaharuan hukum keluarga Islam agar senantiasa mampu memberikan kemaslahatan dan solusi di tengah dahsyatnya perubahan sosial. Sayangnya, upaya pembaharuan hukum tersebut mendapat tantangan besar, salah satunya upaya menjaga otentisitas hukum Islam itu sendiri.

Abstract

Divorce is one of life's events that has significant impacts, not only on the divorcing couple but also on the families involved, especially the children. In this context, women often find themselves in a more vulnerable position as they frequently shoulder dual roles as mothers and workers. After a divorce, women often face substantial economic, social, and psychological pressures. The objective of this research is to describe and analyze the lives of women in Silo Subdistrict, Jember Regency, after divorce. The research approach chosen by the researcher is a legal research approach. This research was conducted in Silo Subdistrict, Jember Regency. The research subjects in this study included several single-parent women, widows, community figures (modin), and officials from Silo Subdistrict, Jember Regency. Data collection methods employed in this research included observation, interviews, and documentation. The researcher used a qualitative descriptive analysis technique in this study. The research findings indicate that the majority of single-parent women in Silo Subdistrict, Jember Regency, strive to meet their living needs by engaging in small-scale businesses such as selling cilok (Indonesian snack made from tapioca) and sausages, operating grocery stores and snack shops, and also selling vegetables. Additionally, some work as domestic assistants, overseas migrant workers (TKW), and engage in other activities, including labor work.

Abstract

Polygamy is a controversy among Muslim scholars. The pros and cons of polygamy in Islam have strengthened since the spread of gender equality issues between men and women. With regard to the problem of polygamy which is still the pros and cons, in Jember which is predominantly Muslim and many Islamic boarding schools have been established in this area. This study aims to determine the views of the asatidz PP. Nurul Islam Jember about polygamy and fiqh review of the views of the asatidz PP. Nurul Islam Jember about polygamy. This research is field research, in which this research focuses more on the results of data collection from informants or respondents who have been determined. Data collection techniques using interview techniques and documentation techniques. The data analysis technique used in this research is descriptive qualitative analysis. This research states that: 1) polygamy according to the view of Asatidz Pondok Pesantren Nurul Islam Jember against polygamy is that polygamy can be practiced with several conditions, such as being financially capable, being able to do justice between wives, children, and their families. The Nurul Islam Islamic Boarding School Asatidz chose not to practice polygamy because of their concerns in the field of livelihoods, their fear of not being able to do justice if they have more than one. Besides all of them have felt quite and happy with one wife, 2) In the fiqh review, the view of Asatidz Pondok Pesantren Nurul Islam Jember on Polygamy is in line with the views of the fiqh scholars. This is reflected in their opinion which states that polygamy can be practiced for anyone who meets the qualifications with the limit of four wives. Poligami merupakan suatu kontroversi dikalangan para cendekiawan Muslim. Pro dan kontra tentang poligami dalam Islam menguat semenjak santernya isu-isu kesetaraan gender antara laki-laki dan perempuan. Berkenaan dengan masalah poligami yang masih menjadi pro dan kontra, di Jember yang mayoritas berpenduduk muslim serta banyak pondok pesantren yang didirikan di daerah ini. Penelitian ini bertujuan untuk mengetahui pandangan para asatidz PP. Nurul Islam Jember tentang poligami dan Tinjauan fiqh terhadap pandangan para asatidz PP. Nurul Islam Jember tentang poligami. Penelitian ini adalah field research (penelitian lapangan), yang mana penelitian ini lebih menitik beratkan kepada hasil pengumpulan data dari informan atau responden yang telah ditentukan. Teknik pengumpulan data menggunakan teknik wawancara dan teknik dokumentasi. teknik analisis data yang digunakan dalam penelitian ini adalah analisis deskriptif kualitatif. Penelitian ini menyatakan bahwa : 1) poligami menurut pandangan Asatidz Pondok Pesantren Nurul Islam Jember Terhadap Poligami adalah bahwa poligami boleh dipraktekan dengan beberapa syarat, seperti mampu secara finansial, mampu berbuat adil di antara isteri-isteri, anak-anak, serta keluarganya. Para Asatidz Pondok Pesantren Nurul Islam memilih untuk tidak melakukan poligami disebabkan kekhawatiran dalam bidang nafkah, kekhawatiran mereka untuk tidak bisa berbuat adil di jika memiliki lebih dari satu. Disamping mereka semua telah merasa cukup dan bahagia dengan satu istri, 2) Dalam tinjauan fiqh, Pandangan Asatidz Pondok Pesantren Nurul Islam Jember Terhadap Poligami sejalan dengan pandangan ulama fiqh. Hal ini tercermin dari pendapat mereka yang mengatakan bahwa poligami boleh dipraktekan bagi siapa saja yang memenuhi kualifikasi dengan batasan empat orang istri.

Abstract

General Background: Polygamy remains a controversial issue in Islamic family law and judicial practice in Indonesia, primarily centered on the requirement of justice as mandated in Surah An-Nisa verse 3. Specific Background: In practice, achieving fairness in polygamy often faces challenges, particularly in judicial decisions granting polygamy permits. Quraish Shihab’s interpretation of justice emphasizes balance and contextual fairness, offering a multidimensional perspective for analyzing such rulings. Knowledge Gap: Previous studies have not deeply examined how judges operationalize Quraish Shihab’s concept of justice in actual polygamy permit decisions. Aims: This study aims to analyze the application of justice principles in the Jember Religious Court’s Decision No. 1775/Pdt.G/2023/PA.Jr using Quraish Shihab’s justice framework. Results: The findings reveal that the judges’ considerations emphasize procedural and formal justice—such as equality before the law and compliance with legal requirements—while substantive justice, including psychological and social balance for wives and children, remains limited. Novelty: This study provides an integrative analysis linking Islamic theological concepts of justice with judicial reasoning in polygamy cases. Implications: The research highlights the need for a holistic judicial approach that not only fulfills legal formalities but also ensures equitable family welfare consistent with maqasid al-shariah principles. Abstract

General Background: Islamic inheritance law is fundamentally oriented toward justice and the protection of vulnerable family members, yet its practical application often raises challenges in contemporary contexts. Specific Background: In Indonesia, grandchildren whose parents predeceased the testator are frequently excluded from inheritance despite close kinship ties, prompting the emergence of the substitute heir doctrine in Article 185 of the Compilation of Islamic Law (KHI). Knowledge Gap: Although this doctrine is normatively applied, its Qur’anic foundation—particularly the interpretation of QS. an-Nisā’ (4):33—and its ijtihad construction remain contested, as classical jurists largely rejected the notion of heir substitution. Aims: This study aims to analyze the Qur’anic implementation in the concept of substitute heirs, examine Hazairin’s ijtihad, and assess its legal implications in Indonesian inheritance law. Results: The findings demonstrate that the substitute heir concept represents a synthesis of Qur’anic reinterpretation, customary law, civil law influences, and Hazairin’s bilateral inheritance theory, positioning mawālī as descendants of predeceased heirs. Novelty: The study highlights that this concept constitutes not merely social adaptation but a reconstructive Qur’anic ijtihad strengthening the protection of orphaned grandchildren. Implications: The research underscores the need for firmer and more consistent enforcement of substitute heir provisions to ensure justice and legal certainty in inheritance distribution in Indonesia. Highlights: Emphasizes the role of ijtihad in reconstructing Qur’anic interpretation to address contemporary inheritance issues. Abstract

General Background: Early marriage remains a persistent social problem in Indonesia, contributing to educational discontinuity, psychological vulnerability, health risks, and weakened family resilience. Specific Background: In Situbondo Regency, despite stricter legal frameworks and the implementation of multiple preventive programs by the local government, marriage dispensation cases remain relatively high, indicating implementation challenges. Knowledge Gap: Previous studies have largely focused on the causes and impacts of early marriage, while limited attention has been given to in-depth analysis of how local government policies and programs are implemented and what factors shape their effectiveness. Aims: This study aims to analyze the implementation of early marriage prevention policies and programs by the Situbondo Regency Government and to identify supporting and inhibiting factors influencing their outcomes. Results: Using a qualitative empirical approach, the findings show that programs such as PERAK CINTA, BRUS, BINWIN, premarital health checks, psychological counseling, and cross-sector coordination have been implemented with clear objectives and structured mechanisms, yet their effectiveness is constrained by limited resources, uneven communication, strong cultural norms favoring early and unregistered marriages, and low community awareness. Novelty: This study integrates policy implementation analysis with local socio-cultural dynamics using the Van Meter and Van Horn framework in the context of early marriage prevention. Implications: Strengthening budget allocation, community education, and cross-sector synergy is essential to enhance the effectiveness and sustainability of early marriage prevention policies at the local level. Highlights: Policy Execution: Early marriage prevention policies are implemented through structured, cross-sector programs with clear operational mechanisms. Implementation Barriers: Cultural norms, limited resources, and low community awareness significantly constrain policy effectiveness. Abstract

General Background: Women’s participation in public economic activities has increased alongside evolving gender roles in Indonesian society, yet normative legal frameworks emphasize balanced rights and obligations within households. Specific Background: Female agricultural laborers in Ramban Kulon Village simultaneously engage in income-generating activities and domestic responsibilities, reflecting a complex interaction between socio-legal norms and rural realities. Knowledge Gap: Despite formal recognition of gender equality in Islamic family law and national legislation, discrepancies persist in the practical division of household roles, particularly in agrarian communities. Aims: This study aims to analyze the forms of problems experienced by female agricultural laborers and identify the social and economic factors contributing to these challenges. Results: Findings reveal excessive double workloads, limited recovery time, and unequal domestic role distribution, driven by patriarchal norms and unstable household income. Women’s economic participation does not alter domestic responsibilities, resulting in sustained role conflict and structural burden. Novelty: This study highlights the interaction between socio-cultural structures and economic necessity in shaping persistent dual role conditions among rural women within a socio-legal framework. Implications: The findings underscore the need for gender-responsive policies and community-based interventions addressing structural inequality and promoting equitable role distribution in rural households. Highlights: Simultaneous domestic and agricultural responsibilities create continuous physical and emotional strain. Patriarchal cultural norms maintain unequal household task allocation despite income contribution. Abstract

This article aims to provide recommendations for establishing regional regulations related to tourist marriage, the imposition of strict sanctions, and efforts to protect victims. The urgency of this research is because, in several tourist areas, there has been a practice of contract marriage involving women and children with tourists for years. This research uses descriptive-qualitative data analysis with a case study approach. In contrast, data collection techniques are done through interviews and a literature review of online source data. Based on the results of the research, it was found that contract marriage cases in the Puncak Bogor area and the Jember area are one type of sexual trafficking with child victims involving marriage brokers, parents, and tourists. This marriage is motivated by economic factors to save themselves and their families from poverty. Victims are primarily virgin girls aged 14-18 years who are married off on a transactional basis in exchange for half of the promised dowry. In practice, marriages are conducted are not registered. The local government in Jember has passed a local regulation on protecting women and children, while in Cianjur a district head regulation on the prohibition of contract marriages was passed. Socialization from the Religious Affairs Office and local government is still done in tourist areas. However, some contract marriage practices can still be found because women do not feel they are victims of sexual trafficking. This research provides a basis for local government policy towards handling and minimizing the practice of contract marriage.
