Abstract

Tujuan pembangunan nasional berdasarkan Pancasila dan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 adalah terciptanya masyarakat adil dan makmur, berdasarkan demokrasi ekonomi dengan mengembangkan sistem ekonomi yang bertumpu pada mekanisme pasar yang berkeadilan. Untuk mencapai tujuan pembangunan nasional, sistem ekonomi syariah menjadi salah satu alternatif pilihan sistem perekonomian Indonesia setelah terbukti mampu bertahan pada saat krisis perekonomian yang menghantam Indonesia pada tahun 1998. Setelah dikeluarkannya payung hukum yang mengatur mengenai perbankan syariah di Indonesia, perbankan syariah di Indonesia berkembang dengan cukup pesat walaupun masih tertinggal jauh dari perbankan konvensional. Agar perkembangan perbankan syariah dapat lebih maksimal, Otoritas Jasa Keuangan (OJK) Republik Indonesia membuat Grand Strategy Perkembangan Pasar Perbankan Syariah di Indonesia. Salah satu dari grand strategy tersebut merupakan sarana untuk dapat mewujudkan ciri mendasar perbankan syariah yaitu agar perbankan syariah dapat memberikan kemanfaatan bagi masyarakat. Harapan agar masyarakat dapat meninggalkan praktik riba dalam perbankan harus didukung dengan peranan bank syariah untuk aktif melakukan sosialisasi dan edukasi kepada masyarakat agar terbangun pemahaman mengenai kemanfaatan produk dan jasa perbankan syariah. Abstract

AbstractThe Covid-19 pandemic outbreak in 2020 also affected the implementation of the trial in Indonesia. As an effort to prevent the spread of Covid-19, the trial was conducted electronically, without presenting the litigants. This needs to be done to ensure health, safety, and guarantee legal certainty for justice seekers. This study uses a normative juridical research method. The normative juridical research method is carried out through a literature study that examines secondary data in the form of laws and regulations, court decisions, agreements, contracts, or other legal documents, as well as research results, study results, and other references. The results of this study are gems, electronic hearings in criminal cases during the Covid-19 pandemic at the Purwokerto District Court continue to be carried out by taking into account the standard protocols for preventing and handling Covid-19. Second, there are several obstacles faced by the electronic trial in criminal cases during the Covid-19 pandemic at the Purwokerto District Court. The implementation of electronic hearings in criminal cases during the Covid-19 pandemic is the right solution, innovation, and breakthrough in efforts to prevent the transmission of Covid-19 as regulated in Supreme Court Regulation (Peraturan Mahkamah Agung, PERMA) Number 4 of 2020 concerning Administration and Trial of Criminal Cases in Electronic Court.Keywords: Electronic Court, Covid-19 Pandemic, Legal Certainty

Abstract

The classification of the population in Indonesia has occurred since the days of the Dutch East Indies, which is regulated in Article 163 IS. The regulation of population classification is still applied in the making of the Inheritance Certificate for Indonesian citizens, which is now regulated in the Regulation of the State Minister for Agrarian Affairs / Head of the National Land Agency No. 3 of 1997 concerning the Implementation of Government Regulation no. 24 of 1997 concerning Land Registration. The existence of these regulations creates acts of discrimination that are against Pancasila, legal principles, and laws. This research uses a normative juridical approach, namely by reviewing or analyzing secondary data in the form of literature, journals, and laws and regulations. Based on the results of research in the making of an inheritance certificate, there is still discrimination because it is based on the division of 3 (three) population groups, namely the European group, the Bumiputera group, and the Foreign Eastern group, thus this is not in line with the provisions of Law Number 40 of 2008 concerning the Elimination of Racial Discrimination and ethnicity because Indonesian citizens are entitled to equal positions before the law.Keywords: Classification, Inheritance Certificate, Discrimination

Abstract

Bank Syariah lahir melengkapi kebutuhan perbankan bagi masyarakat Indonesia yang mayoritas beragama Islam. Salah satu produk dari bank Syariah yaitu murabahah atau jual beli yang dilakukan antara nasabah dengan pihak bank. Tujuan penelitian ini adalah untuk mengetahui bagaimana analisis hukum dan kebijakan dalam penyelesaian keterlambatan pembayaran pembiayaan akad murabahah pada Bank Syariah Indonesia area Purwokerto. Metode dalam penelitian ini adalah menggunakan metode yuridis normatif. Metode yuridis normatif dilakukan melalui studi pustaka yang menelaah terutama data sekunder yang berupa Peraturan Perundang-undangan, putusan pengadilan, perjanjian, kontrak, atau dokumen hukum lainnya, serta hasil penelitian, hasil pengkajian, dan referensi lainnya. Metode yuridis normatif dapat dilengkapi dengan identifikasi dan klarifikasi fakta hukum, Penelitian ini bersifat deskriptif yaitu memberikan gambaran terkait penyelesaian keterlambatan pembayaran pada Bank Syariah Indonesia area Purwokerto menurut hukum yang berlaku di Indonesia. Dalam menjalankan kegiatan pembiayaan kepada masyarakat, Bank Syariah Indonesia sudah mengikuti atau selalu mengacu pada fatwa MUI yang sudah di keluarkan untuk mengatur jalannya kegiatan perbankan Syariah. Bank Syariah Indonesia telah melakukan penyelesaian keterlambatan pembayaran akad murabahah sesuai dengan hukum yang berlaku. Abstract

Islam berkemajuan adalah slogan yang lekat dengan kalangan Muhammadiyah. Slogan ini bukan merupakan “barang baru”, Islam Berkemajuan sudah dipakai ketika zaman awal Muhammadiyah. Semenjak muktamar ke-47 tersebut, Islam Berkemajuan ala Muhammadiyah menjadi salah satu gagasan popular bersanding dengan gagasan-gagasan Islam lain yang salah satunya adalah Islam Liberal. Tujuan penelitian ini adalah mengetahui dan menganalisis untuk kemudian menjawab perbedaan mendasar kedua gagasan tersebut dengan cara mengkomparasikan karakter-karakter yang dimilikinya. Penelitian ini adalah peneltian kepustakaan penelitian kepustakaan dengan teknik analisis dan perbandingan (studi komparasi). Penelitian ini menunjukkan bahwa antara ideology Islam Berkemajuan ala Muhammadiyah dan Islam Liberal terdapat sebuah perbedaan mendasara yaitu pada objek pembaharuan dalam Agama. Islam Liberal menganut pemahaman bahwa agama harus menyesuaikan zaman dan pembaharuan dapat dilakukan dalam setiap dimensi agama, sedangkan Islam Berkemajuan menitikberatkan tajdid dalam bidang Muamalah.

Abstract

Islamic education has a broad scope that includes intellectual, emotional, and spiritual aspects, with the aim of forming individuals who are faithful, pious, and have noble character. One organization that consistently integrates Islamic values in education is Muhammadiyah. Since its establishment in 1912, Muhammadiyah has developed an education system that combines religious and general knowledge, focusing on character building, morals, and intellectual intelligence. In facing the digital era, Muhammadiyah adopts modern technology through online learning, innovation programs such as Edutabmu, and digital training for teachers. A curriculum that integrates Islamic values with technology-based learning supports the creation of a young generation that is smart, characterized, and responsive to the challenges of the times. The success of Muhammadiyah character education is reflected in the formation of individuals with high integrity, have noble personalities, and are able to contribute positively to society..

Abstract

This article examines Muhammadiyah's challenges and strategies in facing the development of educational science in the digital era. Using a normative research approach, this article explores Muhammadiyah's views regarding the influence of technology in education, as well as its application to Islamic values. Research findings show that the main challenges include the influence of globalization, developments in information technology, and the need for curriculum updates. As a solution, Muhammadiyah adopted an innovation-based strategy, such as developing digital learning models and technology training for educators. This research provides a strategic way for Muhammadiyah to strengthen its role as a main actor in modern Islamic education

Abstract

Abstract. Muhammadiyah's rational approach in establishing just law shows the integration of Islamic values ​​with the modern context. This study aims to explore Muhammadiyah's contribution in the formation of maqashid sharia-based law, emphasizing social justice and the relevance of Islamic law in the era of globalization. The research methods used include literature review and document analysis to identify Muhammadiyah's approach to ijtihad and maqashid sharia. The results of the study show that Muhammadiyah's progressive approach has a significant impact in overcoming contemporary legal challenges, such as gender equality and economic justice. This approach also strengthens the global discourse on just Islamic law, by promoting universal principles derived from Islamic values.

Abstract

Muhammadiyah movement, which is one of the largest Islamic organisations besides Nahdlatul Ulama' in Indonesia, is known for its contribution in modernising the education system. The discussion in this article highlights the role of Muhammadiyah in developing education based on values derived from Islam from primary to tertiary levels. The modernisation includes curriculum, teaching methods, and management of educational institutions that are relevant to the demands of the times. The integration of Islamic values into the education system aims not only to improve academic knowledge but also to build students' character according to Islamic teachings and values. Through the concept of holistic education that includes intellectual, moral, and spiritual aspects, Muhammadiyah seeks to create a generation that is intelligent and has integrity. The article also highlights Haedar Nashir's thoughts on progressive Islamic education, which emphasises the importance of innovation and human resource development as well as technological development for the nation's progress.

Abstract

The famous Muhammadiyah figure, Buya Hamka, emphasized that the integration of religion and science is important to form a good generation. This article discusses Buya Hamka's thoughts on how science relates to religion from an Islamic perspective and how he helped nurture the young generation of Muhammadiyah. This research aims to analyze and deeply analyze Hamka's thoughts related to science and its impact on the formation of a superior Muhammadiyah generation. One of the issues raised by this research is that previous studies have not thoroughly explored Hamka's thoughts and only focused on the historical aspect. Buya Hamka's Personal and Dignity book, along with relevant journals and articles, are used in this research as a qualitative method with a literature study approach. The results show that Hamka saw religion and science as a unity that works together to guide humans towards wisdom and truth. One of Hamka's works, “Falsafah Hidup”, and “Tenggelamnya Kapal Van Der Wijck”, provided inspiration for the Muhammadiyah generation to place science as a pillar of civilization. In short, Buya Hamka's ideas can still be used to address contemporary issues and maintain science-based da'wah.
