Abstract

Digital assets in the broadest sense can be interpreted to cover all electronic assets including social media accounts. Nowadays, besides being used to interaction, social media accounts can also be utilized to gain income or material benefits. In addition, social media accounts are generally handled by influencers with abundant followers. One of the social media used by influencers on the internet is YouTube. The social media actors on YouTube are referred to as YouTubers or content creators. This research is a normative juridical legal research with the descriptive method of analysis. The result of the study shows that YouTube accounts as digital assets in practice can be used as assets in business activities. This is proven by the existence of a YouTuber or content creator who sells his account for charity or commercial purposes. In the future, YouTube accounts can potentially be a digital asset that can be used as a collateral object due to its economic value. Nevertheless, based on the property of law in Indonesia, YouTube social media accounts as a digital asset cannot be qualified as an asset yet, therefore a redefinition, a reconceptualization and a reform of the property of law are considered necessary.

Abstract

Koperasi merupakan salah satu bentuk yang paling konkrit dari usaha bersama berdasar asas kekeluargaan.Dewasa ini, koperasi mengalami beberapa permasalahan, salah satunya terkait modal koperasi yang terbatas dalam mengembangkan usahanya. Guna mengatasi masalah tersebut, koperasi melakukan kerja samasalah satunya dengan perbankan dalam bentuk kredit.Pemberian pinjaman kredit dari perbankantersebut dalam pelaksanaannya dapat mengalami kedit macet, sehingga koperasi harus bertanggungjawab dan apabila harta koperasi tidak mencukupi maka pemilik koperasi juga dapat dimintai pertanggungjawaban.Penelitian ini bersifat deskriptif analitis dengan menggunakan pendekatan yuridis empiris.Hasil penelitian menunjukan bahwa tanggung jawab pemilik koperasi dalam hal terjadi kredit macet dapat sampai harta pribadinya, apabila harta koperasi sudah tidak mencukupi untuk membayar kredit. Namun terdapat ketidakjelasan siapa pemilik koperasi,anggota koperasi yang disebut sebagai pemilik dalam Undang-Undang Nomor 25 Tahun 1992 tentang Perkoperasian tidak dapat dimintai pertanggungjawaban sebagai pemilik. Syarat kepemilikan ditinjau dari teori kepastian hukum terbagi ke dalam tiga bentuk yaitukewajiban atau tanggung jawab pemilik, hak-hak pemilik, dan bukti kepemilikan.

Abstract

Cash waqf is an innovative instrument of waqf aiming to create social welfare. It is expected that cash waqf enables extensive public participation to support social welfare. However, in reality, cash waqf management in Indonesia has not yet resulted optimal benefit. Based on the Law Number 41 of 2004 on Waqf, three institutions carry out cash waqf management. They are the Indonesian Waqf Board as the collector and the developer, Nazhir as the manager, and the Islamic Financial Institution as the collector. The three institutions make the cash waqf management and development ineffective and not optimal. Based on the data from the Indonesian Waqf Board, of the total potential cash waqf IDR180 Trillion, only IDR400 billion was realized. This study is a normative juridical legal study employing descriptive method. The results reveal that the role of the Islamic Financial Institution, Islamic bank, as collector can actually be expanded. Thus, it covers the management and distribution roles like a Waqf Bank in Bangladesh, the Social Islami Bank Ltd. (formerly known as Social Investment Bank Ltd). Islamic bank has capability and professionalism of management and distribution of funds generated from the cash waqf.Studi Yuridis tentang Optimalisasi Manajemen Wakaf Uang oleh Bank Syariah di Indonesia AbstrakWakaf uang merupakan salah satu instrumen inovatif dari wakaf dalam menciptakan kesejahteraan sosial di masyarakat. Dengan wakaf uang, partisipasi masyarakat umum akan terbuka lebih lebar dalam menunjang pemerataan kesejahteraan sosial. Akan tetapi, dalam kenyataannya pengelolaan wakaf uang di Indonesia masih belum dirasakan manfaatnya secara optimal. Berdasarkan Undang-Undang Nomor 41 Tahun 2004 tentang Wakaf, pengelolaan wakaf uang dilakukan oleh tiga lembaga yakni Badan Wakaf Indonesia (BWI) sebagai penghimpun dan pengembang, Nazhir sebagai pengelola, dan Lembaga Keuangan Syariah (LKS) sebagai penghimpun. Pengelolaan Wakaf Uang oleh tiga lembaga tersebut menjadikan pengelolaan dan pengembangan Wakaf Uang tidak efektif dan optimal. Hal ini terbukti dari data BWI, bahwa di tahun 2017 dengan total potensi Wakaf Uang keseluruhan yang mencapai Rp180 Trilyun, hanya terealisasikan sebesar Rp400 Milyar. Penelitian ini bersifat deskriptif analitis dengan menggunakan pendekatan yuridis normatif. Hasil penelitian menunjukan bahwa fungsi LKS dalam hal ini perbankan syariah sebagai penghimpun wakaf uang, sesungguhnya dapat diperluas sehingga mencakup fungsi pengelolaan dan penyaluran seperti Bank Wakaf yang ada di Bangladesh yakni Social Islami Bank Limited (sebelumnya dikenal sebagai Social Investment Bank Ltd). Perbankan syariah memiliki kompetensi dan profesionalisme dalam pengelolaan dan penyaluran dana yang berasal dari wakaf uang tersebut.Kata kunci: Optimalisasi, Perbankan Syariah, Wakaf UangDOI: https://doi.org/10.22304/pjih.v6n3.a1

Abstract

Abstract : Sharia mutual fund can be used as an investment alternative for investors, especially for small investors or retailers. The excess of sharia mutual funds that can be reached by all groups shall be a means to promote financial inclusion in Indonesia. Based on data released by the Bank of Indonesia (BI), in 2018, financial inclusion or access to financial institutions of the Indonesian citizens is only 49% (forty-nine percent). Therefore, we need a concrete strategy to promote financial inclusion in Indonesia in which one of the strategies that can be applied is by optimizing sharia mutual funds as an investment means. This study aims to find out the regulation and legal protection of investors in implementing sharia mutual fund investments in the marketplace. The method used was a normative juridical emphasizing on legal research literatures or secondary data. The results showed that sharia mutual funds can be one of the means in promoting financial inclusion program as it can be reached by all groups, especially small investors or retailers. The optimization of sharia mutual funds can be done by utilizing advanced technology in which one of them is the implementation of sharia mutual fund investments through the marketplace. Sharia mutual fund investment in the marketplace has the potential to develop as it can be done easily, quickly, and cheaply. However, the implementation of sharia mutual fund investments in the marketplace still requires strengthening regulations to provide legal certainty and legal protection for its users.Keywords: Investment, Optimization, Sharia Mutual Funds. Optimalisasi Reksadana Syariah sebagai Sarana Investasi dalam Rangka Memajukan Keuangan Inklusif di IndonesiaAbstrak : Reksadana syariah dapat dijadikan salah satu alternatif investasi bagi investor, khususnya investor kecil atau ritel. Kelebihan reksadana syariah yang dapat dijangkau oleh semua kalangan dapat menjadi sarana dalam rangka memajukan keuangan inklusif di Indonesia. Berdasarkan data Bank Indonesia (BI) pada tahun 2018 inklusi keuangan atau akses terhadap lembaga keuangan masyarakat Indonesia hanya sebesar 49% (empat puluh sembilan persen). Oleh karenanya diperlukan strategi dan langkah-langkah konkrit guna memajukan inklusif keuangan di Indonesia yang salah satunya dapat melalui pengoptimalan reksadana syariah sebagai sarana investasi. Tujuan penelitian ini adalah untuk mengetahui bagaimana pengaturan dan perlindungan hukum investor dalam pelaksanaan investasi reksadana syariah di marketplace. Metode penelitian yang digunakan adalah yuridis normatif dengan menitik beratkan kepada penelitian hukum kepustakaan atau data sekunder. Hasil penelitian menunjukan bahwa reksadana syariah dapat menjadi salah satu sarana dalam mendukung program keuangan inklusif dikarenakan dapat dijangkau oleh semua kalangan terutama investor kecil atau ritel. Optimalisasi reksadana syariah dapat dilakukan dengan cara memanfaatkan penggunaan teknologi secara muktahir, salah satunya yaitu pelaksanaan investasi reksadana syariah melalui marketplace. Investasi reksadana syariah di marketplace sangat berpotensi berkembang dikarenakan investasi reksadananya dapat dilakukan dengan mudah, cepat, dan murah. Namun pelaksanaan investasi reksadana syariah di marketplace tersebut masih memerlukan penguatan regulasi guna memberikan kepastian dan perlindungan hukum yang kuat bagi para penggunanya.Kata kunci: Investasi, Optimalisasi, Reksadana Syariah

Abstract

ABSTRACTEase of Doing Business (EoDB) is a business ease indicator which issued by the World Bank. There are eleven indicators that become a benchmark in measuring the ease of doing business in a country. One of the indicators is related to the settlement of investment dispute or in this case is the enforcing contracts and resolving insolvency. Based on the Doing Business of 2019 report, currently the rating of ease of business in Indonesia occupies the position of 73 (seventy three). Indonesia’s EoDB rating is still far from the target, which is ranked 40 (forty) in the world. This is due to dispute settlement in Indonesia still has a number of issues, both in terms of basic regulations, court proceedings and execution. Whereas in the business world (based on the EoDB indicator) a inexpensive, fast, and simple legal dispute settlement tool is needed. This research is a normative juridical legal research with the descriptive method of analysis, with results show that there are still no applying regulations of Law Number 25 of 2007 concerning on Investment which focused on discussing investment disputes, so that there is not clear legal certainty regarding to investment in Indonesia. In addition, there are also a number of issues related to bankruptcy cases, both of which are Law No. 37 of 2004 concerning Bankruptcy and Suspension of Obligation for Payment of Debts, some of which can lead to certain interests, length of bankruptcy court proceedings, and legal certainty after bankruptcy decisions. A breakthrough or update is needed that can support EoDB, one of which can be done in the field of investment dispute settlement especially related to the enforcing contracts and resolving insolvency by making applying regulations and revising related regulations.ABSTRAKEase of Doing Business (EoDB) merupakan indikator yang berkaitan dengan kemudahan berbisnis yang dibuat oleh Bank Dunia. Terdapat sebelas indikator yang menjadi patokan dalam mengukur kemudahan berbisnis di suatu negara. Salah satu yang menjadi indikator yaitu terkait dengan penyelesaian sengketa investasi atau dalam hal ini penegakan kontrak dan penyelesaian perkara kepailitan. Berdasarkan laporan Doing Business 2019, peringkat kemudahan berbisnis di Indonesia berada pada posisi ke 73 (tujuh puluh tiga). Peringkat EoDB Indonesia tersebut masih jauh dari target yaitu masuk peringkat 40 (empat puluh) besar dunia. Hal ini disebabkan antara lain karena penyelesaian sengketa di Indonesia masih memiliki beberapa permasalahan baik itu dari segi dasar peraturan, proses persidangan dan pelaksanaan putusan. Sedangkan dalam dunia bisnis (berdasarkan indikator EoDB) dibutuhkan sarana penyelesaian sengketa yang murah, cepat, dan sederhana. Penelitian ini bersifat deskriptif analitis dengan menggunakan pendekatan yuridis normatif, dengan hasil menunjukan bahwa belum terdapat peraturan pelaksana dari Undang-undang Nomor 25 Tahun 2007 tentang Penanaman Modal yang fokus membahas sengketa investasi sehingga belum terciptanya kepastian hukum yang kuat dalam berivestasi di Indonesia. Selain itu, terdapat beberapa masalah terkait dengan penyelesaian perkara kepailitan, antara lain bersumber dari peraturannya yaitu Undang-undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang yang beberapa Pasalnya dapat mengarahkan kepada kepentingan tertentu, lamanya proses pengadilan kepailitan, dan kepastian hukum pasca putusan kepailitan. Diperlukan suatu terobosan atau pembaruan yang dapat mendukung EoDB yaitu salah satunya dapat dilakukan pada bidang penyelesaian sengketa investasi khususnya terkait penegakan kontrak dan penyelesaian perkara kepailitan dengan cara membuat peraturan pelaksana dan merevisi peraturan terkait.

Abstract

Micro, Small and Medium Enterprises (MSMEs) in Indonesia has a significant role in national economic development. In addition to supporting the economic growth and providing job opportunities, MSMEs also takes a role in distributing development results.  Based on Statistics Indonesia (BPS) in 2016, from a total of 59,693,791 business units in Indonesia, 99.89 percent is MSMEs and its contribution to Indonesia’s Gross Domestic Product (GDP) reached 62.5 percent, workforce absorption up to 95 percent and its contribution to exports non-oil and gas up to 16.45 percent. However nowadays, MSMEs has to face some problems. One of which is related to capital and business development. The capital and business development issues can be solved through Corporate Social Responsibility (CSR) program. Yet, CSR requires a suitable strategy for a successfull and effective implementation. This research is analytical descriptive using normative juridical approach. The results showed that the implementation of CSR could not be felt optimally in order to develop MSMEs. The concept of CSR implementation by the collaboration of stakeholders is expected to provide a solution so that CSR can be implemented appropriately and effectively. One of the stakeholders in CSR is the academics, where CSR in a broad sense can also be a Community Service Program in Universities.

Abstract

ABSTRACTThe Government's program to accelerate the development of the real sector and the empowerment of Micro, Small and Medium Enterprises (MSMEs), one of which is set forth in the policy package for the distribution of People's Business Credit (KUR). However, in its implementation, the KUR program experienced several problems and could not be carried out only by relying on funds from the Government or banks for the development of MSMEs. This is due to the fact that banks in conducting their business must always pay attention to the principle of banking prudence, while the KUR program requires banks to relax the conditions of their debtors who want to obtain credit or financing. This research uses the normative juridical approach method by emphasizing the study of literature and supported by data from field research. The results showed that the KUR program in its implementation could be synergized with the Corporate Social Responsibility (CSR) program. The CSR program can be a solution to the problems faced by the KUR program where later the CSR program can be used as a trigger for banking business reengineering in implementing the KUR program that can provide benefits for stakeholders. Abstract

Corporate Social Responsibility (CSR) merupakan sebuah komitmen dari perusahaan untuk berkontribusi dalam pengembangan ekonomi yang berkelanjutan. Implementasi CSR salah satunya dapat menjadi sarana dalam rangka memajukan Usaha Mikro Kecil dan Menengah (UMKM). Dewasa ini, pelaksanaan CSR dalam rangka memajukan UMKM dilaksanakan secara masing-masing oleh perusahaan, Pemerintah, perguruan tinggi, dan masyarakat sehingga tidak efektif dan efisien. Guna mewujudkan pelaksanaan CSR yang efektif dan efisien sehingga manfaatnya dapat dirasakan secara optimal, diperlukan sebuah konsep baru yang dapat mengintegrasikan pelaksanaan CSR tersebut. Metode penelitian yang digunakan dalam penelitian ini yaitu yuridis normatif dengan teknik pengumpulan bahan hukum melalui studi kepustakaan terhadap hukum positif yang mengatur tentang CSR dan UMKM serta ditunjang dengan data lapangan. Hasil penelitian menunjukan bahwa pelaksanaan CSR dapat menggunakan konsep QuadrupleHelix, yaitu kolaborasi secara terpadu dan sistematis antara academica, goverment, business, dan civil society. Konsep QuadrupleHelix, dapat mengatasi kelemahan masing-masing pihak pelaksana CSR dengan keunggulan yang dimiliki oleh pihak lainnya, serta pelaksanaanya lebih terfokus kepada tujuan tertentu. Diperlukan payung hukum berupa peraturan perundang-undangan atau perjanjian kolaborasi di antara pelaku CSR dalam pelaksanaan CSR yang menggungkan konsep QuadrupleHelix.

Abstract

Law No. 4 of 2023 on the Development and Strengthening of the Financial Sector has given a new authority to the Deposit Insurance Corporation (LPS) to place funds in order to handle bank liquidation problems. This authority makes LPS like a neo Lender of Last Resort (LoLR) institution that the central bank generally plays. The placement of funds by LPS can pose a great risk considering that the bank that receives the placement of funds falls into the category of banks under the restructuring of the Financial Services Authority (OJK) and does not meet the requirements of receiving loans or short-term liquidity financing from Bank Indonesia (BI). The research shows that: first, the authority of LPS as a neo LoLR in the form of fund placement can still be debated because it creates a double LoLR that is not in accordance with the principle of division and separation of powers. However, in a historical perspective, the authority to place LPS funds has existed since the mass economic crisis conditions caused by COVID-2019 with the issuance of PP No. 33 of 2020. Second, BI’s short-term liquidity loans or financing have more comprehensive requirements than the requirements for the placement of funds from LPS. These different requirements are very dangerous because they have the potential to ignore the character of predictability and knowledge in monetary constitutionalism. Even if the authority to place LPS funds exists, the implementation must apply the principles of prudence and risk management to anticipate potential unpredictable losses.
