Abstract

Dalam masyarakat agama akan selalu terjadi perdebatan antara kelompok yang bertahan dengan teks sebagaimana adanya dengan pihak-pihak yang mencoba membaca teks dalam konteks dan membuatnya selaras dengan perkembangan paradigma baru dalam kehidupan kekinian. Salah satu topik yang merefleksikan fenomena di atas adalah ketika wacana gender yang adalah problematika kehidupan cosmopolitan modern dihadapkan dengan teks-teks suci yang telah berusia berabad-abad yang lalu. Tidaklah mengherankan bila kemudian terjadi perdebatan yang serius tentang kemampuan masyarakat agama di dalam merespon issu gender ini. Artikel ini berusaha untuk mengungkapkan pengkajian Islam modern dengan mempelajari suatu pendekatan baru yang popular dengan istilah pendekatan gender di dalam melakukan analisa terhadap ayat-ayat maupun hadis nabi dan istinbat hukum terutama di dalam menggambarkan posisi dan peranan kaum wanita serta hubungan mereka dengan kaum laki-laki. Dalam artikel ini akan ditemukan secara jelas bahwa Konsep relasi gender di dalam Alquran merefleksikan dua kesan yang berbeda secara theologies dan sosiologis. In religious societies there will always be debates between groups that persist with the text as it is with parties who try to read the text in context and make it in harmony with the development of new paradigms in contemporary life. One topic that reflects the above phenomenon is when gender discourse is a problem of modern cosmopolitan life confronted with sacred texts that have been centuries old. It is not surprising then that serious debate ensues about the ability of religious communities to respond to this gender issue. This article seeks to express the study of modern Islam by studying a new app roach that is popular with the term gender approach in analyzing the verses and traditions of the prophet and legal istinbat especially in describing the position and role of women and their relationship with men . In this article it will be clearly found that the concept of gender relations in the Koran reflects two different theological and sociological impressions.

Abstract

Di antara berbgai jenis hukuman yang diperkenalkan oleh hukum Islam baik dalam bentuk qishash,hudud dan ta’zir, denda meru[pakan hukuman yang sangat jarang dibahas dan dipopulerkan sebagi jenis hukuman yang dibenarkan oleh Islam. Kebanyakan peminat hukum Islam lebih sering menyebut qishash dan hudud sebagai trademark hukum Islam, padahal denda juga layak diterapkan sebagai jenis hukuman yang lebih moderat dan manusiawi.

Abstract

This research is aims to find out how much the influence of Zakah on Civil Servant Profession and Development conducted by Baitul Mal on Economic Empowerment Society in East Aceh. The research sample is taken from 3 (three) sub-districts, namely Simpang Jernih, Peureulak Barat and Peudawa Sub-districts for 3 (three) months from 7 May to 7 July 2016. The research design used is quantitative research design using linear regression analysis multiple and supported by model test and statistical test using the help of program Eviews 8 and SPSS 16.0. The results showed that the zakah received and variable construction can explain mustahik income of about 33.38%, while 66.62% is explained by other factors. Simultaneously variables that receive alms from the treasury construction affects income mustahik using alpha 5%. Zakah received a positive and significant impact on revenue mustahik. Zakah profession salary civil servants in baitul mal East Aceh in accordance with the purpose and objectives of Islamic economics.

Abstract

A dowry is a gift that a husband must give to a wife as a gift that can be in the form of money, jewelry or services such as teaching the Qur'an as long as it does not conflict with Islamic law. Although this dowry is required to be paid by the bridegroom-to-be, this dowry is not a pillar that exists in the marriage law. Because this dowry is not a pillar, the dowry is sometimes not seen as important for the future husband. The purpose of this study is to explain how important the dowry is for the bride-to-be which has been regulated in articles 30 to 38 of the KHI on dowry. This type of research is library research, namely all efforts made by the author to obtain or collect all information relevant to the problem under study. The data found are then discussed and analyzed inductively to produce conclusions. The next step is for researchers to explain the articles contained in the KHI related to dowry. The result and discussion that the dowry is an obligation that must indeed be given by the prospective bridegroom either directly or suspended.

Abstract

Interfaith marriage is a phenomenon that is currently happening. It cannot be denied that the implementation of interfaith marriages always passes legal selection in this country. The Qur'an has provided information about interfaith marriage, namely First, surah Al-Baqarah verse 221, regarding the prohibition of Muslims marrying polytheists. Second, surah Al-Mumtahanah verse 10, regarding the prohibition of Muslims marrying infidels. Third, surah al-Maidah verse 5, regarding the prohibition of Muslim women marrying men who are people of the book and the permissibility of Muslim men marrying women who are people of the book. The main reason for the prohibition of Muslim marriages with polytheists is because of differences in faith. Because differences in faith result in no harmony. The purpose of marriage in the Qur'an, namely first to obtain peace of life, peace of mind, full of love and affection. Second, to continue or breed generations of human beings on earth or change of generations. The third is the fulfillment of sexual desires for husband and wife. The fourth is maintaining honor, namely self-respect, children and family. Fifth is worship. Therefore interfaith marriage will not achieve the goal of the marriage.

Abstract

Marriage will achieve peace, tranquility, happiness and serenity both physically and mentally, known as sakinah, mawaddah warohmah, it needs to be well planned and mature. The thing that must be planned is someone who is chosen to be used as a life partner, that person must meet the criteria set both in Islam and other rules. The purpose of this study is to reveal the concept of sekufu in determining companions according to Islamic teachings. This type of research is library research, namely research that focuses on literature by analyzing the content of some related literature. Results of the discussion Choosing a mate is part of the sunnah recommended by the Prophet Muhammad, he said "Women are married in general on the basis of four factors: wealth, social status (rank), beauty, and strength of religion; choose a woman who is strong in her religion, you must be lucky.” Of the 4 recommendations of the Prophet SAW above, in fact it is part of a person in choosing a mate that must be equal or sekufu'. In choosing a mate, the Prophet Muhammad emphasized to find someone who has good religious practices. Islam emphasizes that in marriage not only see worldly elements, pleasure alone, but there is a way to foster a life that is prosperous, eternal and of course morals to teach offspring to become successors of Islamic teachings.

Abstract

The purpose of this study was to determine the influence of legal philosophy on the dynamics of modern law formation, with a focus on students of the Faculty of Sharia and Law. Philosophy of law as a discipline that studies the foundations and principles of law has an important role in shaping students' understanding and views of the law. This research applies quantitative methods, by distributing questionnaires to 100 students of the Faculty of Sharia and Law, State Islamic University of North Sumatra. The results of this study indicate that the regression coefficient value is 1. 984 with a t value of 3.293 and a significance of 0.001 from the F test, namely the value of F count ˃ F table, namely 11.435 ˃ 3.09 and the Sig value ˂ 0.05, then 0.001˂ 0.05. So that the conclusion is obtained in the F test that Ha is Ha. So it is concluded in the F test that Ha3 is accepted and Ho3 is rejected. the regression coefficient of the legal philosophy variable (X) is 0.518, so that if the learning style variable decreases by 1%, if the variable is considered constant, the Dynamics of Modern Law Formation will increase by 0.521%. This study shows that the Adjusted R Square value is 0.770 or 77%. This means that the influence between the independent variables, namely the philosophy of law, is 77% while 23% is influenced by other factors that are not included in the regression model.

Abstract

Wasiat Wajibah is a form of legally mandated bequest granted to specific heirs who, according to Islamic law, do not receive a share of the inheritance or receive an insufficient portion. This concept originally developed in Islamic jurisprudence as a solution for promoting social justice, particularly for grandchildren whose parent (the decedent’s child) had passed away before the testator. The transformation of this concept into Indonesia’s national legal system represents a response by the legal framework to the demand for substantive justice in the context of family and inheritance matters. This study aims to examine the concept of wasiat wajibah in Islamic law, its application within Indonesia’s positive law—particularly as regulated in the Compilation of Islamic Law (Kompilasi Hukum Islam/KHI)—and its transformation into national law. The research employs a normative juridical method, with analysis based on primary legal sources, namely the Compilation of Islamic Law (KHI), especially Articles 171–214 which regulate Islamic inheritance law, and Article 209 which specifically addresses wasiat wajibah. In addition, Law No. 1 of 1974 concerning Marriage serves as the legal framework for family law within the national legal system. The findings indicate that wasiat wajibah is a legal innovation inspired by the principles of justice and protection for relatives whose inheritance rights are otherwise excluded. Article 209 of the KHI explains that there is no inheritance relationship between adopted children and adoptive parents; however, a legal breakthrough exists in the form of wasiat wajibah, which governs such relationships. The transformation of wasiat wajibah into the national legal system is carried out through legislation, judicial practice, and is supported by a legal culture that is increasingly responsive to social justice and the realities of contemporary Muslim families.
